If the prosecutor is not willing to entertain a favorable <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/plea-bargain.html\">plea bargain<\/a>, then it makes sense to take your chances at trial.<\/p>\n<h2><a id=\"type\"><\/a>What Type of Trial To Expect<\/h2>\n<p>Most DUI cases involve a bench trial, not a jury trial. This is because many DUI cases involve misdemeanor charges, not felony charges.<\/p>\n<p>However, a DUI\/DWI defendant might face felony charges if they have prior convictions for drunk driving. There are also DUI cases where the <a href=\"https:\/\/www.findlaw.com\/dui\/charges\/felony-dui.html\">facts warrant felony charges<\/a>, such as where the defendant caused a fatal accident.<\/p>\n<h3>What Is a Bench Trial?<\/h3>\n<p>With a bench trial, there is no jury. The parties argue their cases directly to the judge, who will determine the defendant\u2019s guilt.<\/p>\n<p>Many defendants choose a bench trial because they want to put the case behind them. Bench trials resolve much more quickly than <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/judge-versus-jury-trials.html\" target=\"_self\">jury trials<\/a>.<\/p>\n<h3>When Is a Jury Trial Better for a DUI?<\/h3>\n<p>While efficiency is a valid reason to accept a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/bench-trial.html\" target=\"_self\" rel=\"noopener\">bench trial<\/a>, there are several reasons why you may opt for a jury trial instead, such as:<\/p>\n<ul>\n<li>The judge will strictly apply the state <a href=\"https:\/\/www.findlaw.com\/dui.html\" target=\"_self\">DUI laws<\/a>, while a jury may vote to acquit based on the defendant\u2019s reasons for driving while under the influence.<\/li>\n<li>Juries are more likely to reach a verdict for emotional reasons rather than legal ones.<\/li>\n<li>Juries are less predictable, so there is a greater likelihood that they will believe a defendant\u2019s story.<\/li>\n<li>Jury members are more likely to relate to a first-time offender.<\/li>\n<\/ul>\n<p>Regardless of the type of trial you choose, the judge is the one who determines your sentence. The jury will have little to no influence on a defendant\u2019s jail sentence, fines, or other <a href=\"https:\/\/www.findlaw.com\/dui\/laws-resources\/state-by-state-dui-penalties.html\" target=\"_self\">DUI penalties<\/a>.<\/p>\n<h3>Can You Request a Jury Trial in Your DUI Case?<\/h3>\n<p>Criminal defendants typically have <a title=\"the right to choose a jury trial\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-right-to-a-jury-trial.html\" target=\"false\">the right to choose a jury trial<\/a> in any case where the potential punishment is at least six months in jail. However, a few states do not allow jury trials in DUI cases.<\/p>\n<p>For example, <a href=\"https:\/\/www.findlaw.com\/state\/new-jersey-law\/new-jersey-dwi-laws.html\" target=\"_self\">New Jersey law<\/a> does not allow DUI defendants to request a jury trial because it is classified as a traffic violation rather than a criminal charge. However, that doesn&#8217;t mean there aren&#8217;t serious penalties at stake. A person can still end up in jail for a DUI in New Jersey.<\/p>\n<p>Other jurisdictions disallow jury trials for DUI cases as well, including Mississippi and North Carolina.<\/p>\n<p>Deciding which type of trial you want is an important decision and can significantly affect the outcome of your case. It\u2019s a good idea to seek legal advice early so you can make an informed decision.<\/p>\n<h2><a id=\"pretrial\"><\/a>Before Trial: Arrest, Arraignment, and Pretrial Motions<\/h2>\n<p>A lot happens before your DUI case goes to trial. The way the police handled your DUI arrest may have a significant impact on the path your criminal case takes.<\/p>\n<p>For example, if the arresting officer fails to read you the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-warnings-and-police-questioning.html\" target=\"_self\"><em>Miranda <\/em>warnings<\/a> before taking you into custody, your DUI attorney can try to have statements you made to police removed from the evidence against you.<\/p>\n<h3>First Court Appearance and Plea<\/h3>\n<p>After your arrest, the court will hold an <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arraignment.html\" target=\"_self\">arraignment<\/a>. At the arraignment, the court will read the criminal charges and ask the defendant how they plead. This is where your criminal defense lawyer informs the court whether you\u2019ll plead guilty or not guilty.<\/p>\n<p>If you plead guilty, there may not be a trial at all. Your defense attorney will meet with the prosecutor and try to negotiate a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/plea-bargain.html\" target=\"_self\">plea bargain<\/a>. Once this happens, your attorney will start to prepare your case and decide if they want to file any pretrial motions.<\/p>\n<h3>Motions Before Your DUI Trial<\/h3>\n<p>A criminal defense attorney can file a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/pre-trial-motions.html\" target=\"_self\">pretrial motion<\/a> for any number of reasons, including:<\/p>\n<ul>\n<li>Ask the judge to exclude evidence<\/li>\n<li>Request a change in venue<\/li>\n<li>Request a reduction in bail (for defendants who are in jail pending trial)<\/li>\n<li>Ask the judge to dismiss the charges due to a lack of evidence<\/li>\n<\/ul>\n<p>The judge will respond to all pretrial motions before the trial starts.<\/p>\n<h2><a id=\"jury\"><\/a>Choosing a Jury To Decide a DUI Case<\/h2>\n<p>One of the first steps in a criminal trial is <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-potential-jurors-selected.html\" target=\"_self\">jury\u00a0selection<\/a>. During jury selection, the judge and the attorneys question a pool of potential jurors\u00a0to see if they should serve on the jury. This process is called \u201cvoir dire.\u201d They may ask questions about the potential jurors\u2019 jobs, beliefs, and life experiences. They can also ask them about any biases or prejudices they hold.<\/p>\n<p>The prosecutor and the defense attorney both have the chance to challenge jurors they believe would be harmful to their case. Each attorney has a specific number of \u201c<a href=\"https:\/\/constitution.findlaw.com\/amendment6\/annotation05.html\" target=\"_self\" rel=\"noopener\">challenges<\/a>\u201d they can use to excuse a particular juror. The number of challenges depends on the jurisdiction.<\/p>\n<p>Once both sides conduct their \u201c<a href=\"https:\/\/dictionary.findlaw.com\/definition\/voir-dire.html\" target=\"_self\" rel=\"noopener\">voir dire<\/a>,\u201d the judge will assign the jury.<\/p>\n<h2><a id=\"opening\"><\/a>Opening Statements<\/h2>\n<p>Once the parties select a jury, each side will make its opening statement. The state has the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/burden-of-proof.html\" target=\"_blank\" rel=\"noopener\">burden of proof<\/a>, so the prosecutor makes their opening statement first. Their opening statement is usually more detailed than the defense attorney\u2019s statement.<\/p>\n<p>In some cases, the defense may wait until the conclusion of the prosecution\u2019s case before making its <a href=\"https:\/\/dictionary.findlaw.com\/definition\/opening-statement.html\" target=\"_self\" rel=\"noopener\">opening statement<\/a>.<\/p>\n<p>During the opening statement, the <a href=\"https:\/\/dictionary.findlaw.com\/definition\/prosecutor.html\" target=\"_self\" rel=\"noopener\">prosecutor<\/a> and defense lawyer provide the jury with a roadmap of how they will present their case. This usually includes a summary of the facts of the case and the attorney\u2019s theory of what happened. The final part of the opening statement is usually a plea to the jury to find in favor of the state or the defendant.<\/p>\n<h2><a id=\"witnesses\"><\/a>Witness Testimony and Cross-Examination<\/h2>\n<p>At the heart of any criminal trial is the <a href=\"https:\/\/dictionary.findlaw.com\/definition\/case-in-chief.html\" target=\"_self\" rel=\"noopener\">case-in-chief<\/a>. This is the stage at which each side presents the jury with its key evidence. In its case-in-chief, the government sets forth evidence to convince the jury &#8220;beyond a reasonable doubt&#8221; that the defendant committed the crime. This is the highest burden of proof in the U.S. legal system.<\/p>\n<h3>The Prosecutor Presents DUI Evidence<\/h3>\n<p>The prosecutor will call eyewitnesses and <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/who-qualifies-as-an-expert-witness\/\" target=\"_self\">experts<\/a> to testify. The prosecutor will introduce the witness and ask them direct questions. The defense attorney will then have the chance for cross-examination. They can ask the state\u2019s witness questions about the statements they made during their direct testimony.<\/p>\n<p>In addition to calling witness and expert testimony, the prosecutor will introduce the state\u2019s <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/real-and-demonstrative-evidence.html\" target=\"_self\">physical evidence<\/a>, such as photographs, documents, and medical reports.<\/p>\n<h3>The Defense Can Respond<\/h3>\n<p>After the government concludes its case-in-chief, the defense gets a turn to present the defendant\u2019s case-in-chief. In some cases, the defense chooses not to offer a\u00a0case-in-chief.\u00a0Instead, the defense attorney makes their key points through <a href=\"https:\/\/www.findlaw.com\/legalblogs\/strategist\/cross-examination-tips-that-will-help-your-case\/\" target=\"_self\">cross-examination<\/a> and challenges to the government\u2019s evidence. Or they might bring in their own experts to testify, such as an accident reconstruction expert or an independent toxicologist.<\/p>\n<h2><a id=\"closing\"><\/a>Closing Arguments<\/h2>\n<p>Once the prosecution and defense have had an opportunity to present their case and challenge the <a href=\"https:\/\/www.findlaw.com\/legal\/practice\/practice-support\/rules-of-evidence.html#:~:text=FindLaw%20provides%20conscise%2C%20easily%20digestible%20summaries%20of%20rules,to%20rules%20of%20evidence%20for%20the%20first%20time%3F\" target=\"_self\">evidence<\/a> presented by the other, both sides\u00a0rest.\u00a0Once this happens, the two sides will make their closing arguments.<\/p>\n<p><a href=\"https:\/\/dictionary.findlaw.com\/definition\/closing-argument.html\" target=\"_self\" rel=\"noopener\">Closing arguments<\/a>\u00a0offer the government and defense a chance to summarize their case. During closing arguments, the prosecutor and defense attorney recap the evidence supporting their case and make a final plea to the jury to decide the case in their favor.\u00a0<\/p>\n<h2><a id=\"verdict\"><\/a>The Jury Decides the Verdict<\/h2>\n<p>After both sides of the case have had a chance to present their evidence and make a closing argument, the next step toward a verdict is the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/jury-instructions.html\" target=\"_self\" rel=\"noopener\">jury\u2019s instruction<\/a>. In this process, the judge gives the jury the legal standards to decide whether the defendant is guilty.<\/p>\n<p>The judge also instructs the jury on findings it must make based on these legal standards. The judge also describes critical concepts, such as &#8220;guilt beyond a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/reasonable-doubt.html\" target=\"_self\" rel=\"noopener\">reasonable doubt<\/a>,&#8221; and\u00a0defines any crimes the jury may consider, based on the evidence presented at trial.<\/p>\n<p>Once the judge gives the jury its instructions, deliberations begin. The jury will go to a conference room to discuss the case and, hopefully, come to a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/verdict.html\" target=\"_self\" rel=\"noopener\">verdict<\/a>.<\/p>\n<p>In most DUI cases, the jury\u2019s options are simple; the defendant is either guilty or not guilty. There are some cases where the jury must make other determinations, such as levels of guilt. However, this rarely happens with DUI cases.<\/p>\n<p>The jury must unanimously find the defendant guilty or not guilty. If the jury fails to reach a unanimous verdict (known as a &#8220;hung jury&#8221;), the judge may declare a <a title=\"mistrial\" href=\"https:\/\/dictionary.findlaw.com\/definition\/mistrial.html\" target=\"false\" rel=\"noopener\">mistrial<\/a>. Prosecutors will then decide whether to retry the defendant.
