Although expungement removes the first conviction from <a title=\"public records accessible to employers\" href=\"https:\/\/www.findlaw.com\/dui\/cases\/dui-and-employment-background-checks.html\" target=\"false\">public records accessible to employers<\/a> and landlords, it still counts as a prior offense for sentencing purposes.<\/p>\n<h3>Does a Second DUI Always Mean Jail Time?<\/h3>\n<p>Not necessarily. Whether jail time is mandatory depends on the circumstances, state law, and judicial discretion.<\/p>\n<p>For example, a driver convicted of a <a title=\"second DUI in Pennsylvania\" href=\"https:\/\/www.findlaw.com\/state\/pennsylvania-law\/pennsylvania-dui-laws.html\" target=\"false\">second DUI in Pennsylvania<\/a> may avoid jail if they qualify for alternative sentencing.
