DUI laws are similar across states, but there are a few key legal differences. They include laws for blood alcohol concentration (BAC) limits, DUI checkpoints, and drivers’ implied consent to alcohol and drug testing. If a blood or breath test shows intoxication above the state’s legal limit, a driver will face criminal DUI charges.<\/p>\n\n <\/div>\n\n\n\n

Driving while under the influence of alcohol or drugs (DUI) is a dangerous crime. An intoxicated driver may cause a crash that is fatal to themselves or others. That’s why state laws and penalties for DUIs are strict.<\/p>\n

Even if you don’t feel the effects of alcohol, your\u00a0blood alcohol content<\/a>\u00a0(BAC) may exceed your state’s legal limit. Everyone’s body and alcohol tolerance are different.<\/p>\n

Facing DUI charges can be stressful. A DUI is often a defendant’s first time dealing with criminal charges. DUI Charges Differ in Each State<\/h2>\n

You don’t need to be alcohol-impaired to face a DUI charge. Drunk driving and impaired driving laws have evolved to include various substances and inhalants that can cause intoxication. Impaired drivers can be under the influence of a legally prescribed medication that has altered their ability to drive a motor vehicle safely.<\/p>\n

You may use medical marijuana or live in one of nearly half of U.S. states where recreational cannabis use is legal. This does not mean you can safely drive under its influence.\u00a0Colorado has set a legal limit<\/a>\u00a0of 5 nanograms of delta-9 tetrahydrocannabinol (THC) per milliliter of blood. You are legally intoxicated and subject to arrest if you drive at this level or higher.<\/p>\n

State Laws Set DUI Penalties<\/h3>\n

A DUI conviction can carry serious penalties, varying by state. Arizona, Georgia, and Tennessee are among the states with mandatory jail time for a first offense. California, Connecticut, and Indiana don’t have such a requirement in their drunk driving laws.<\/p>\n

Many states require drivers to install an\u00a0ignition interlock device (IID)<\/a>, even for first-time offenders. An IID requires you to submit a breath sample before starting your vehicle. If it detects alcohol, the car won’t start.<\/p>\n

Often, an IID comes with driving limits, meaning you can only drive to work, school, and essential appointments. For example, you may drive to get substance abuse treatment or meet your probation officer.<\/p>\n
