These\u00a0include\u00a0its value, whether you are currently behind on payments, and your\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/bankruptcy-laws-by-state.html\">state&#8217;s bankruptcy laws<\/a>.<\/p>\n<p>You can often keep your vehicle after your Chapter 7 bankruptcy case is over if you meet the following criteria:<\/p>\n<ul>\n<li>Your equity is exempt and you reaffirm or redeem<\/li>\n<li>You stay current on your car payments<\/li>\n<\/ul>\n<p>If you are late on your car loan, the creditor may decide to\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/consumer-protection\/the-legal-steps-necessary-to-repossess-a-car\/\">repossess your car<\/a>\u00a0and sell it to help pay off your auto loan balance.<\/p>\n<p>In addition to being current on payments, the equity you have in your car must be exempt from\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/debt-collection-laws.html\">debt collection<\/a>.<\/p>\n<h2>Nonexempt Property<\/h2>\n<p>During a Chapter 7 bankruptcy, you can only keep property exempt from your debt schedule. Bankruptcy laws consider some\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/bankruptcy-exemptions-chapter-7.html\">property exempt<\/a>\u00a0so debtors can get\u00a0to work, live in a home, and have a few other of life&#8217;s essentials.<\/p>\n<p>The trustee will arrange to sell all nonexempt property and apply the proceeds toward any\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-an-unsecured-creditor\/\">unsecured debt<\/a>. Unsecured debt means it&#8217;s not backed by collateral,\u00a0such as credit card debt.<\/p>\n<p>Some state laws exempt motor vehicles from bankruptcy, but only up to a certain amount. If your car&#8217;s value exceeds the exemption amount, you may have to sell it or make payment arrangements with the creditor.\u00a0There are other ways to retain nonexempt assets. You can keep a car with an equity value of up to $15,000. The equity value is the\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/whats-fair-market-value\/\">fair market value<\/a>\u00a0of your vehicle minus the amount you still owe on the car.<\/p>\n<p>While the\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/bankruptcy-laws-by-state\/nevada-bankruptcy-exemptions-and-law.html\">exemption amount in Nevada<\/a>\u00a0is $15,000, it is much lower in other states. Wisconsin law, for example, only offers an exemption of $4,000.<\/p>\n<p>You can also take advantage of federal exemptions. A\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/before-you-file\/can-i-file-bankruptcy-without-a-lawyer.html\">bankruptcy lawyer<\/a>\u00a0will explain which exemption is best for your situation.<\/p>\n<h2>Will Bankruptcy Trustees Sell Your Car in Chapter 7 Bankruptcy?<\/h2>\n<p>If the equity in your car is more than your state&#8217;s exemption amount, the\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/what-is-a-trustee-in-bankruptcy.html\">bankruptcy trustee<\/a>\u00a0may sell your vehicle to help pay your debts. Your options may include:<\/p>\n<ul>\n<li>Wait to buy a car in the future<\/li>\n<li>Purchase a lower-priced car<\/li>\n<li>Take out a loan for a lower-priced car<\/li>\n<\/ul>\n<p>Trying\u00a0to finance a new or used car after a\u00a0bankruptcy discharge often means paying a\u00a0much higher\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/state\/consumer-laws\/interest-rates.html\" target=\"_blank\" rel=\"noopener\">interest rate<\/a>. Once the lender sees the bankruptcy on your credit report, they will require either\u00a0a\u00a0sizeable down payment or an inflated interest rate. You can\u00a0refinance your vehicle in a year or two after you&#8217;ve made consecutive on-time payments and begun to rebuilt your credit rating.<\/p>\n<h2>Can Your Bankruptcy Attorney Stop the Trustee from Selling Your Car?<\/h2>\n<p>Many bankruptcy filers have already lost their\u00a0vehicle to\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-finances\/right-of-repossession-basics.html\">repossession<\/a>\u00a0before they file a\u00a0bankruptcy petition. Whether they were unable to\u00a0pay on time or their\u00a0loan balance was\u00a0too high to sell the vehicle, the lending company reached a point of no return and seized the vehicle.<\/p>\n<p>If you still have your car when you file for\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/pros-and-cons-of-declaring-bankruptcy-under-chapter-7.html\">Chapter 7 bankruptcy<\/a>, it&#8217;s likely you&#8217;ll want to keep it if possible. In addition to the\u00a0equity in your car or SUV, you may\u00a0need it to get to work or for getting the kids to school.<\/p>\n<p>If this is the case, you should talk to your bankruptcy attorney about your options, which include:<\/p>\n<ul>\n<li>Using a wildcard exemption<\/li>\n<li>Offering other nonexempt property to cover debt<\/li>\n<li>Paying the trustee the amount of nonexempt equity in your vehicle<\/li>\n<\/ul>\n<p>Utilizing\u00a0an exemption often\u00a0depends on your vehicle&#8217;s fair market value. It&#8217;s much easier to keep a car worth $10,000 than a car worth $85,000. Since a car loan is a\u00a0<a href=\"https:\/\/corporate.findlaw.com\/finance\/bankruptcy-and-the-secured-creditor.html\" target=\"_blank\" rel=\"noopener\">secured debt<\/a>, the auto finance company will have a say in whether you keep your vehicle.<\/p>\n<p>If the bank doesn&#8217;t believe you will make your loan payments post-bankruptcy, it will challenge the trustee&#8217;s decision to let you reaffirm your car loan. It may also allow you to add a\u00a0<a href=\"https:\/\/corporate.findlaw.com\/business-operations\/cosigning-a-loan.html\" target=\"_blank\" rel=\"noopener\">cosigner to the debt<\/a>, but there is no guarantee this will happen.<\/p>\n<h2>Wildcard Exemptions<\/h2>\n<p>A wildcard exemption is what the name suggests it is. It allows you to exempt any asset up to a certain amount. Some states do not allow debtors to apply a wildcard exemption to nonexempt property.<\/p>\n<p>If you live in a state that allows you to apply the wildcard exemption amount to the property of your choice, you can apply it to your\u00a0<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/understanding-vehicle-financing.html\">car loan<\/a>.\u00a0Another option is to combine the wildcard exemption with your state&#8217;s motor vehicle exemption.<\/p>\n<p>If your car has a $10,000 nonexempt value\u00a0and your state allows $5,000 in wildcard exemptions, you can use the $5,000 wildcard exemption and pay the remaining $5,000 to keep the vehicle. As with all aspects of your bankruptcy, it will need to be approved by the trustee.<\/p>\n<h2>Using Other Exemptions to Keep Your Car<\/h2>\n<p>In addition to the wildcard exemption, some states allow you to carry over a balance from other bankruptcy exemptions.
