High credit card bills and other unsecured debts, like student loans, cause much of this stress. Delinquent secured debt accounts, like past-due mortgage payments, add to it.&nbsp;For many California families, filing bankruptcy is&nbsp;<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/benefits-of-bankruptcy.html\">a way out<\/a>.<\/blockquote>\n\n\n\n<p>California <span data-term-id=\"58204980\">bankruptcy laws<\/span> are governed by the federal <span data-term-id=\"58204981\">bankruptcy code<\/span>, but they also include state exemptions that allow debtors to keep most of their personal assets. The purpose of a bankruptcy is to give debtors a <span data-term-id=\"58204988\">fresh start<\/span> and eliminate unpayable debts, not to wipe them out completely. The <span data-term-id=\"58204993\">type of bankruptcy<\/span> you file depends on the nature of your debts and what you want to accomplish by filing.<\/p>\n<p>If you have valuable assets and a substantial amount of undischargeable debt, bankruptcy may not be ideal. For everyone else, the <span data-term-id=\"58205012\">bankruptcy process<\/span> is a way to eliminate much of the financial stress in their lives and start over.<\/p>\n<h2>Qualifying for a California Bankruptcy<\/h2>\n<p>Having high <span data-term-id=\"58204979\">credit card<\/span> debt and overdue mortgage payments may not be enough to qualify for bankruptcy. Federal and state <span data-term-id=\"58204980\">bankruptcy laws<\/span> require those filing for bankruptcy to meet certain qualifications, known as a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\"><span data-term-id=\"58204998\">means test<\/span><\/a>. The state of California <a href=\"https:\/\/selfhelp.courts.ca.gov\/bankruptcy-guide\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58204974\">bankruptcy court<\/span><\/a> reminds people that bankruptcy should be a last resort, used only after other methods of clearing debt have failed.<\/p>\n<h3>Who should file for bankruptcy?<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/benefits-of-bankruptcy.html\">You should consider bankruptcy<\/a> if:<\/p>\n<ul>\n<li>You have <span data-term-id=\"58205020\">unsecured debt<\/span>, like <span data-term-id=\"58204979\">credit card<\/span> bills and <span data-term-id=\"58205015\">medical bills<\/span>, that you cannot realistically pay off<\/li>\n<li>Creditors are already garnishing your wages, threatening to sue, or taking other action, such as <span data-term-id=\"58204986\">foreclosure<\/span> or <span data-term-id=\"58205014\">repossession<\/span><\/li>\n<li>You have few assets or equity<\/li>\n<li>You have already tried other options (<span data-term-id=\"58204999\">credit counseling<\/span>, debt consolidation), and they have not worked<\/li>\n<\/ul>\n<p>You should not consider bankruptcy if:<\/p>\n<ul>\n<li>Most of your debt will not be discharged by a bankruptcy, such as <span data-term-id=\"58204985\">student loans<\/span> or delinquent <span data-term-id=\"58204990\">child support<\/span><\/li>\n<li>You have assets that may not be protected, and you don\u2019t want to lose them<\/li>\n<li>Your financial difficulties are temporary, such as large credit purchases just before being laid off, while you have a promising job prospect on the horizon<\/li>\n<\/ul>\n<p>You should discuss your options and alternatives with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58204987\">bankruptcy attorney<\/span><\/a> before filing to ensure you have <span data-term-id=\"58205022\">dischargeable debts<\/span>. You may have other options, even with a substantial debt burden, if your debts cannot be discharged in bankruptcy.<\/p>\n<h3>Formal Qualifications for Popular <span data-term-id=\"58204993\">Types of Bankruptcy<\/span><\/h3>\n<p><span data-term-id=\"58204983\">Federal law<\/span> has specialized options for businesses (Chapter 11) and for family farmers and fishermen (Chapter 12). These bankruptcies are tailored for operating businesses or those with seasonal incomes and high-equity property. The majority of <span data-term-id=\"58204989\">filers<\/span> need either a Chapter 7 or <span data-term-id=\"58204984\">Chapter 13 bankruptcy<\/span>.<\/p>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\">Chapter 7<\/a> is for people with low incomes and high <span data-term-id=\"58205020\">unsecured debt<\/span> loads. Chapter 7 <span data-term-id=\"58204989\">filers<\/span> must pass a <span data-term-id=\"58204998\">means test<\/span> and have a household income below the state median income. After April 1, 2026, the median income for a four-person household is $139,071. <span data-term-id=\"58204976\">Chapter 7 bankruptcy<\/span> <span data-term-id=\"58204989\">filers<\/span> must have received <span data-term-id=\"58204999\">credit counseling<\/span> from an approved agency within the past six months.<\/p>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a> allows those with income above the cutoff to\u00a0file for\u00a0bankruptcy. In a Chapter 13, the <span data-term-id=\"58204989\">filer<\/span>\u2019s total debt burden is more important than their income. <span data-term-id=\"58204989\">Filers<\/span> must have debt below a certain threshold ($1,580,125 <span data-term-id=\"58205033\">secured debt<\/span>, $526,700 <span data-term-id=\"58205020\">unsecured debt<\/span> as of 2025). <span data-term-id=\"58204989\">Filers<\/span> must have sufficient income to commit to a three- to five-year <span data-term-id=\"58205000\">repayment plan<\/span> and be current on their <span data-term-id=\"58205025\">tax returns<\/span>. Like Chapter 7 <span data-term-id=\"58204989\">filers<\/span>, they must complete a <span data-term-id=\"58204999\">credit counseling<\/span> course.<\/p>\n<h2>Property Exemption Laws in California<\/h2>\n<p>A property exemption is an allowance that state and federal\u00a0<span data-term-id=\"58204980\">bankruptcy laws<\/span>\u00a0grant\u00a0<span data-term-id=\"58204989\">filers<\/span>\u00a0to allow them to avoid losing all their property. In a bankruptcy proceeding, the <span data-term-id=\"58205008\">bankruptcy trustee<\/span> sells the debtor\u2019s assets, if possible, to pay creditors. If the debtor needs those assets, the laws permit them to keep them if the value is under a certain amount or if they are essential to the debtor\u2019s business.<\/p>\n<h3>What Does Exemption Mean?<\/h3>\n<p>In a <span data-term-id=\"58204977\">liquidation<\/span>, your nonexempt property is sold to pay off creditors. The value of your property is the \u201cfair market value\u201d of the items and property, which means your equity is the appraised value minus whatever liens are still outstanding against it. Artwork, jewelry, and other items also have fair market value and can be appraised. Common <span data-term-id=\"58205003\">household goods<\/span> are valued by what you could sell them for on the day of the bankruptcy filing.<\/p>\n<p>So while your home is appraised at $750,000 and the antique Ming vase is worth $3,500, your great-grandmother\u2019s heirloom toaster may only be worth a dollar. The <span data-term-id=\"58205008\">bankruptcy trustee<\/span> is more interested in monetary value than in sentimental value.<\/p>\n<p>Many people delay filing for bankruptcy because they fear losing all their property. In California, only <span data-term-id=\"58205002\">nonexempt assets<\/span> are taken to pay creditors. Creditors can keep property subject to certain exemptions and state homestead laws. California has two exemption code sections. Debtors must pick one; they cannot mix and match exemptions.<\/p>\n<h3>Section 703 Exemptions<\/h3>\n<p>This option is better for renters or recent homeowners. It offers a lower home equity exemption and a \u201cwildcard\u201d exemption that allows debtors to claim a flat exemption for any property, up to the exemption amount. In 2025, Section 703 exemptions were:<\/p>\n<ul>\n<li><span data-term-id=\"58204997\">Homestead exemption<\/span>: $36,750<\/li>\n<li><span data-term-id=\"58205026\">Motor vehicle<\/span> equity: $8,625<\/li>\n<li>Home health aids: No limit<\/li>\n<li>Household items (clothing, books, furniture, appliances, etc.): Up to $925 per item<\/li>\n<li>Jewelry: Up to $2,175<\/li>\n<li><span data-term-id=\"58205018\">Retirement accounts<\/span>, Social Security, life insurance policies, and other benefits: No limit<\/li>\n<li>Unused vacation pay, sick leave, or unpaid wages: Up to $8,625<\/li>\n<li><span data-term-id=\"58205032\">Wildcard exemption<\/span>: Up to $1,950 for any asset<\/li>\n<\/ul>\n<p>There are additional exemptions for \u201c<span data-term-id=\"58205024\">tools of the trade<\/span>\u201d and some <span data-term-id=\"58204990\">child support<\/span> and <span data-term-id=\"58204992\">alimony<\/span> payments (not arrearages). A <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58204987\">bankruptcy attorney<\/span><\/a> can explain how to list these on your filing.<\/p>\n<h3>Section 704 Exemptions<\/h3>\n<p>Long-term homeowners may prefer the Section 704 exemptions, since the <span data-term-id=\"58204997\">homestead exemption<\/span> is considerably higher. The 704 exemptions are also more extensive for\u00a0<span data-term-id=\"58204982\">personal property<\/span>\u00a0and <span data-term-id=\"58205003\">household goods<\/span>. In 2025, the exemptions were:<\/p>\n<ul>\n<li><span data-term-id=\"58204997\">Homestead exemption<\/span>: Between $371,547 to $743,459, with the amount depending on the average property value in your location (you may exempt any primary residence, including a house, boat, condo, or <span data-term-id=\"58205027\">mobile home<\/span>)<\/li>\n<li><span data-term-id=\"58205026\">Motor vehicle<\/span> equity: $8,625<\/li>\n<li>Health aids, <span data-term-id=\"58205003\">household goods<\/span>, and personal items: No limit<\/li>\n<li>Building materials for repair to the residence: Up to $4,400<\/li>\n<li>Jewelry, art, heirlooms: Up to $10,950<\/li>\n<li>Deposit accounts: Up to $2,170<\/li>\n<li>Cemetery and burial plot: No limit<\/li>\n<\/ul>\n<p>Section 704 includes exemptions for personal life insurance, homeowner\u2019s insurance, professional licenses, and other property-related payments. Your attorney can give you <span data-term-id=\"58205004\">legal advice<\/span> on what other assets may be protected under this option.<\/p>\n<h2>Cost of Filing a Bankruptcy<\/h2>\n<p>In California, the actual <span data-term-id=\"58205007\">filing fee<\/span> for your bankruptcy is $338 for a Chapter 7 and $313 for a Chapter 13, plus a $50 fee for the required <span data-term-id=\"58204999\">credit counseling<\/span> course. Low-income debtors can request a fee <span data-term-id=\"58205010\">waiver<\/span>.<\/p>\n<p>If you have an attorney\u2019s help, you can expect to pay another $2,500 to $4,000, depending on the lawyer. It is possible to file for bankruptcy yourself, but not advisable. <span data-term-id=\"58205001\">California bankruptcy exemptions<\/span> differ from federal exemptions, and missing any would be unfortunate.
