This is known as \u201cexempt property.&#8221;<\/p>\n<p>The\u00a0<span data-term-id=\"58205328\">Bankruptcy Code<\/span>\u00a0offers\u00a0<span data-term-id=\"58205354\">federal exemptions<\/span>, but\u00a0<span data-term-id=\"58205326\">Florida<\/span>\u00a0residents <a href=\"https:\/\/codes.findlaw.com\/fl\/title-xv-homestead-and-exemptions\/fl-st-sect-222-20\/\" target=\"_blank\" rel=\"noopener\">are required to use state exemptions<\/a>. <span data-term-id=\"58205326\">Florida<\/span> has &#8220;opted out&#8221; of the <span data-term-id=\"58205354\">federal exemption<\/span> system. Instead, <span data-term-id=\"58205363\">state law<\/span> governs what you can protect. In many cases, it protects more than the <span data-term-id=\"58205354\">federal exemptions<\/span>.<\/p>\n<p><span data-term-id=\"58205326\">Florida<\/span>\u2019s exemptions are among the most favorable in the country, but they only apply to filers who meet strict residency requirements. You must have lived in <span data-term-id=\"58205326\">Florida<\/span> for at least two years before filing for bankruptcy. They can provide you with crucial <span data-term-id=\"58205345\">legal advice<\/span>.<\/p>\n<h2><strong>The Two Types of Consumer Bankruptcy<\/strong><\/h2>\n<p>To understand how the exemption process works, it helps to know that there are two commonly used types of personal bankruptcy. These are:<\/p>\n<ul>\n<li><strong><span data-term-id=\"58205324\">Chapter 7 Bankruptcy<\/span><\/strong>: <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\">Chapter 7<\/a>\u00a0allows you to eliminate most of your\u00a0<span data-term-id=\"58205347\">unsecured debt<\/span>. It\u2019s only available if your income is under the state median for a household of your size or if you can pass a <span data-term-id=\"58205327\">means test<\/span>. While you\u2019ll lose all of your\u00a0<span data-term-id=\"58205340\">non-exempt assets<\/span>, Chapter 7 can erase most of your non-<span data-term-id=\"58205365\">secured debts<\/span>.<\/li>\n<li><strong><span data-term-id=\"58205330\">Chapter 13 Bankruptcy<\/span><\/strong>:<strong>\u00a0<\/strong><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a>\u00a0lets you reorganize your debt into a plan paid off over three to five years. Any remaining debt after that time is usually discharged. Chapter 13 is a popular choice for people who want to keep most or all of their property, but need more time or better terms to pay their debts.<\/li>\n<\/ul>\n<p>Regardless of which type you choose, the court issues an\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><span data-term-id=\"58205341\">automatic stay<\/span><\/a> when you file. This stops any\u00a0<span data-term-id=\"58205356\">collection actions<\/span>\u00a0against you, including\u00a0<span data-term-id=\"58205329\">foreclosures<\/span>\u00a0and most court cases. The stay gives you breathing room to resolve your debt problems without being harassed by creditors.<\/p>\n<h2><strong>Secured vs.\u00a0<span data-term-id=\"58205347\">Unsecured Debt<\/span><\/strong><\/h2>\n<p>Under Chapter 7 and\u00a0<span data-term-id=\"58205330\">Chapter 13 bankruptcies<\/span>, your debt will be divided into two categories: secured and unsecured. Each type is treated differently during bankruptcy.<\/p>\n<p>With\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/unsecured-claim.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58205347\">unsecured debt<\/span><\/a>, creditors don\u2019t have the right to repossess your property for failure to pay. These debts are the most likely to be significantly reduced or eliminated during the\u00a0<span data-term-id=\"58205331\">bankruptcy process<\/span>.\u00a0<span data-term-id=\"58205344\">Credit card<\/span>\u00a0debt, court judgments,\u00a0<span data-term-id=\"58205350\">medical bills<\/span>, and some unpaid income taxes are common examples of\u00a0<span data-term-id=\"58205347\">unsecured debt<\/span>. Others, such as unpaid\u00a0<span data-term-id=\"58205336\">child support<\/span>, can\u2019t be eliminated in bankruptcy and must be repaid in full.<\/p>\n<p><a href=\"https:\/\/dictionary.findlaw.com\/definition\/secured-debt.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58205365\">Secured debt<\/span><\/a> means a creditor has the right to seize your property if you fail to pay. Home mortgages, car loans, and property liens are the most common types of\u00a0<span data-term-id=\"58205365\">secured debt<\/span>.<\/p>\n<p><span data-term-id=\"58205324\">Chapter 7 bankruptcy<\/span> can eliminate most or all of your\u00a0<span data-term-id=\"58205347\">unsecured debt<\/span>. Creditors holding\u00a0<span data-term-id=\"58205365\">secured debt<\/span>\u00a0can still repossess your property for non-payment. You may lose your home, car, or other property to secured lenders in Chapter 7.<\/p>\n<p>There are usually three options for dealing with secured creditors:<\/p>\n<ul>\n<li><strong>Give back the property<\/strong>:<strong>\u00a0<\/strong>You\u2019ll lose the secured property, but won\u2019t need to make additional payments<\/li>\n<li><strong>Make payments<\/strong>:<strong>\u00a0<\/strong><span data-term-id=\"58205326\">Florida<\/span>\u2019s generous\u00a0<span data-term-id=\"58205346\">homestead exemption<\/span> can help you keep property<\/li>\n<li><strong>Buy the property outright<\/strong>:<strong>\u00a0<\/strong>Rare in Chapter 7, as most lack the funds for such a payment<\/li>\n<\/ul>\n<p><span data-term-id=\"58205330\">Chapter 13 bankruptcy<\/span>\u00a0lets you create a plan for repaying your creditors. Current mortgage payments are separate and not part of the <span data-term-id=\"58205334\">repayment plan<\/span>. A trustee can often negotiate a repayment agreement if you fall behind. <span data-term-id=\"58205347\">Unsecured debts<\/span>\u00a0are repaid with whatever income is left after the secured creditors have been paid. Any non-mortgage debt will be eliminated once you have completed the plan.<\/p>\n<h2><strong>Am I Eligible for Bankruptcy in\u00a0<span data-term-id=\"58205326\">Florida<\/span>?<\/strong><\/h2>\n<p>If you meet\u00a0<span data-term-id=\"58205326\">Florida<\/span>\u2019s two-year residency requirement, you must also <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\">pass a\u00a0<span data-term-id=\"58205327\">means test<\/span><\/a>\u00a0to file for Chapter 7. There are two\u00a0<span data-term-id=\"58205327\">means tests<\/span>\u00a0used.<\/p>\n<p>The first stage looks at your household income. You take your income from the past six months, average it, then annualize it. If that number is less than the <span data-term-id=\"58205326\">Florida<\/span> median for a household of your size, you qualify.<\/p>\n<p>The\u00a0U.S. Trustee Program\u00a0updates the median figures every six months. For cases filed on or after November 1, 2025, the\u00a0<a href=\"https:\/\/www.justice.gov\/ust\/eo\/bapcpa\/20251101\/bci_data\/median_income_table.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58205326\">Florida<\/span> <span data-term-id=\"58205361\">median income<\/span><\/a>\u00a0figures are:<\/p>\n<ul>\n<li>One-person household: $68,085<\/li>\n<li>Two-person household: $84,305<\/li>\n<li>Three-person household: $95,039<\/li>\n<li>Four-person household: $111,819<\/li>\n<\/ul>\n<p>Larger households add $11,100 per additional member.<\/p>\n<p>If your income exceeds the state median, you may still qualify under the second stage based on your <span data-term-id=\"58205379\">disposable income<\/span>. Calculate your monthly <span data-term-id=\"58205379\">disposable income<\/span> by subtracting allowable expenses from your\u00a0<a href=\"https:\/\/www.uscourts.gov\/court-programs\/bankruptcy\/bankruptcy-basics\/chapter-7-bankruptcy-basics\" target=\"_blank\" rel=\"noopener\">current monthly income<\/a> and project that figure over 60 months. If your projected <span data-term-id=\"58205379\">disposable income<\/span> over 60 months is less than $10,275, you can\u00a0<a href=\"https:\/\/www.uscourts.gov\/court-programs\/bankruptcy\/bankruptcy-basics\/chapter-7-bankruptcy-basics\" target=\"_blank\" rel=\"noopener\">file under Chapter 7<\/a>. Otherwise, you\u2019ll be required to file for Chapter 13 instead.<\/p>\n<p>To file for bankruptcy under\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a>, your <span data-term-id=\"58205347\">unsecured debts<\/span> can\u2019t be above $526,700. <span data-term-id=\"58205365\">Secured debts<\/span> can\u2019t exceed $1,580,125. These limits apply to cases <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title11-section109&amp;num=0&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">filed on or after April 1, 2025<\/a>.<\/p>\n<h2><strong><span data-term-id=\"58205353\">Florida<\/span><span data-term-id=\"58205353\"> Bankruptcy Exemptions<\/span><\/strong><\/h2>\n<p><span data-term-id=\"58205326\">Florida<\/span>\u00a0has its own\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0200-0299\/0222\/0222.html\" target=\"_blank\" rel=\"noopener\">bankruptcy <span data-term-id=\"58205378\">exemption laws<\/span><\/a>. Many of the\u00a0<span data-term-id=\"58205326\">Florida<\/span> exemptions are more generous than those offered under\u00a0<span data-term-id=\"58205343\">federal law<\/span>. The state\u2019s strict residency rules are in place to prevent out-of-staters from taking advantage of the exemptions.<\/p>\n<h3><strong><span data-term-id=\"58205346\">Homestead Exemption<\/span><\/strong><\/h3>\n<p><span data-term-id=\"58205326\">Florida<\/span>&#8216;s <span data-term-id=\"58205346\">homestead exemption<\/span> is one of the strongest in the country. It lets you protect the full equity in your <span data-term-id=\"58205383\">primary residence<\/span>, with no cap on the dollar amount. If you own a home valued at $1 million with no mortgage, your creditors cannot force you to sell.<\/p>\n<p>The exemption covers homes on properties of a half-acre or less in a municipality, or on properties of 160 acres or less elsewhere. FindLaw\u2019s\u00a0<a href=\"https:\/\/www.findlaw.com\/state\/florida-law\/florida-homestead-laws.html\"><span data-term-id=\"58205326\">Florida<\/span> <span data-term-id=\"58205346\">Homestead Exemptions<\/span><\/a>\u00a0article can answer any questions you have on the subject.<\/p>\n<p>To claim the unlimited exemption, you must have owned the home for\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">at least 1,215 days<\/a>\u00a0(around three years and four months) before filing. If you have owned it for less than that, a federal cap limits how much equity you can protect. The current cap is $214,000 for cases filed between April 1, 2025, and March 31, 2028.<\/p>\n<h3><strong>Wage Exemption<\/strong><\/h3>\n<p>If you qualify as a head of family, your wages are fully <a href=\"https:\/\/www.flsenate.gov\/Laws\/Statutes\/2024\/0222.11\" target=\"_blank\" rel=\"noopener\">exempt from garnishment<\/a>. Disposable earnings at or below $750 per week are automatically protected. Earnings above that amount are equally protected unless you signed a written waiver allowing otherwise.<\/p>\n<p>If you do not qualify as head of family, garnishment is limited to either 25% of your disposable earnings or the amount by which your earnings exceed 30 times the federal minimum wage per week, whichever is less. These limits are set by the federal\u00a0<a href=\"https:\/\/www.ojp.gov\/ncjrs\/virtual-library\/abstracts\/consumer-credit-protection-act-public-law-90-321-approved-may-29\" target=\"_blank\" rel=\"noopener\">Consumer Credit Protection Act<\/a>. Exempt wages you deposit into a bank account stay protected for up to six months after the deposit.<\/p>\n<h3><strong><span data-term-id=\"58205376\">Personal Property<\/span><span data-term-id=\"58205376\"> Exemptions<\/span><\/strong><\/h3>\n<p><span data-term-id=\"58205338\">Personal property<\/span>\u00a0that falls into one of the following categories will be exempt in\u00a0<span data-term-id=\"58205326\">Florida<\/span>:<\/p>\n<ul>\n<li><span data-term-id=\"58205338\">Personal property<\/span>\u00a0of up to $1,000, which increases to $4,000 if you do not use the\u00a0<span data-term-id=\"58205346\">homestead exemption<\/span> (includes items like furniture, art, and electronics)<\/li>\n<li>Health savings, education savings, and hurricane savings<\/li>\n<li>Tax credits and refunds<\/li>\n<li>Prescribed home health aids<\/li>\n<li>Money you have placed in <span data-term-id=\"58205326\">Florida<\/span>&#8216;s Preneed Funeral Contract Consumer Protection Trust Fund to cover funeral expenses<\/li>\n<li>Some of the property in a business partnership<\/li>\n<\/ul>\n<p>Other exemptions may also be available.<\/p>\n<h3><strong>Wildcard Exemption<\/strong><\/h3>\n<p>If you don\u2019t use the\u00a0<span data-term-id=\"58205346\">homestead exemption<\/span>, you can use a \u201cwildcard\u201d exemption on up to $4,000 of\u00a0<span data-term-id=\"58205338\">personal property<\/span>. The exemption doubles to $8,000 if you file jointly with your spouse. It can also be claimed if you own your home but have no equity to protect with the\u00a0<span data-term-id=\"58205346\">homestead exemption<\/span>. This happens when you owe the mortgage holder more than the home is worth.<\/p>\n<h3><strong>Motor Vehicle Exemption<\/strong><\/h3>\n<p>A 2024 legislative change increased <span data-term-id=\"58205326\">Florida<\/span>&#8216;s motor vehicle exemption, allowing you to protect up to\u00a0<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0200-0299\/0222\/Sections\/0222.25.html\" target=\"_blank\" rel=\"noopener\">$5,000 of equity in a single vehicle<\/a>. If you don\u2019t claim the <span data-term-id=\"58205346\">homestead exemption<\/span>, the $4,000 can be stacked on top, providing up to $9,000 in vehicle protection.<\/p>\n<h3><strong>Pension Exemptions<\/strong><\/h3>\n<p>Most types of pension and retirement funds are exempt, including:<\/p>\n<ul>\n<li>Tax-exempt retirement accounts under\u00a0<a href=\"https:\/\/codes.findlaw.com\/fl\/title-xv-homestead-and-exemptions\/fl-st-sect-222-21\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58205326\">Florida<\/span> law<\/a>, including 401(k)s, 403(b)s, profit-sharing plans, money purchase plans, SEP and SIMPLE IRAs, and traditional and Roth IRAs (IRA and Roth IRA balances are also protected under <span data-term-id=\"58205343\">federal law<\/span>\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/02\/04\/2025-02207\/adjustment-of-certain-dollar-amounts-applicable-to-bankruptcy-cases\" target=\"_blank\" rel=\"noopener\">up to $1,711,975 per person<\/a>\u00a0for cases filed between April 1, 2025, and March 31, 2028)<\/li>\n<li>Teachers\u2019 retirement benefits<\/li>\n<li>Public employee retirement benefits<\/li>\n<li>Firefighter and municipal police pensions<\/li>\n<\/ul>\n<p>If you\u2019re uncertain about an exemption, speak with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/florida\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58205373\">Florida<\/span> <span data-term-id=\"58205337\">bankruptcy attorney<\/span><\/a>.<\/p>\n<h3><strong>Insurance and Benefits Exemptions<\/strong><\/h3>\n<p><span data-term-id=\"58205326\">Florida<\/span>\u00a0residents may exempt the following:<\/p>\n<ul>\n<li>The proceeds from a life insurance policy payable to a specified beneficiary<\/li>\n<li>Disability income benefits<\/li>\n<li>The cash surrender value of a life insurance policy<\/li>\n<li>The proceeds of an annuity contract, except for annuities set up for lottery winners<\/li>\n<li>Fraternal society benefits<\/li>\n<\/ul>\n<p><span data-term-id=\"58205326\">Florida<\/span>\u2019s exemptions offer more protection than those of other states.<\/p>\n<h3><strong>Public Benefits Exemption<\/strong><\/h3>\n<p>The following benefits are exempt from bankruptcy in\u00a0<span data-term-id=\"58205326\">Florida<\/span>:<\/p>\n<ul>\n<li><span data-term-id=\"58205381\">Social Security<\/span>\u00a0benefits<\/li>\n<li>Veterans\u2019 benefits<\/li>\n<li>Workers\u2019 compensation and unemployment benefits<\/li>\n<li>Crime victim\u2019s compensation benefits unless you are trying to\u00a0<span data-term-id=\"58205369\">discharge debt<\/span>\u00a0related to a crime-related injury.<\/li>\n<li>Local public assistance benefits<\/li>\n<li>Reemployment assistance benefits<\/li>\n<\/ul>\n<h3><strong><span data-term-id=\"58205364\">Alimony<\/span>\u00a0and\u00a0<span data-term-id=\"58205336\">Child Support<\/span>\u00a0Exemptions<\/strong><\/h3>\n<p><span data-term-id=\"58205336\">Child support<\/span>\u00a0payments and\u00a0<span data-term-id=\"58205364\">alimony<\/span>\u00a0are exempt to the extent they are reasonably necessary for your support.<\/p>\n<h3><strong>Exemption for Some Damage Awards<\/strong><\/h3>\n<p>Damages for injuries received while working in a hazardous occupation are exempt. All other proceeds from lawsuits or pending legal claims belong to the\u00a0<span data-term-id=\"58205374\">bankruptcy estate<\/span>. If the lawsuit wasn\u2019t resolved when you filed, the trustee can retain an attorney and decide whether to settle or proceed to trial.<\/p>\n<h2><strong>What Happens to Non-Exempt Property?<\/strong><\/h2>\n<p>If you file for Chapter 7, the <span data-term-id=\"58205351\">bankruptcy trustee<\/span> can sell any property not covered by an exemption and use the proceeds to pay your creditors.
