Georgia has chosen to implement its own rules on exempt property, which is what you can keep. While some states let you choose between the federal exemptions provided in the <span data-term-id=\"58205416\">Bankruptcy Code<\/span> and their state law exemptions, <a href=\"https:\/\/codes.findlaw.com\/ga\/title-44-property\/ga-code-sect-44-13-100\/\" target=\"_blank\" rel=\"noopener\">Georgia requires<\/a> you to use the state exemptions.<\/p>\n<p>To better understand the role exemptions play in the <span data-term-id=\"58205431\">bankruptcy process<\/span>, it helps to familiarize yourself with the two types of personal bankruptcy:<\/p>\n<ul>\n<li><strong><span data-term-id=\"58205387\">Chapter 7 bankruptcy<\/span><\/strong> is sometimes known as \u201c<span data-term-id=\"58205390\">liquidation<\/span>\u201d bankruptcy. It requires turning over the property you can\u2019t protect with an exemption to a bankruptcy trustee, who sells the property and uses the proceeds to pay your creditors. Exemptions can play a significant role in cases under <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/chapter-7-bankruptcy-rules-overview.html\">Chapter 7<\/a>. In return for giving up your <span data-term-id=\"58205430\">nonexempt property<\/span>, you will usually exit bankruptcy free from nearly all of your debt. Chapter 7 comes with strict income thresholds to qualify.<\/li>\n<li><strong><span data-term-id=\"58205401\">Chapter 13 bankruptcy<\/span> <\/strong>lets people who have a steady income reorganize most of their debt and pay it off in three to five years. The payments are made under a court-approved plan that may eliminate some of your debt. <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a> is popular with homeowners because they can often keep their homes.<\/li>\n<\/ul>\n<p>The court issues an\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><span data-term-id=\"58205404\">automatic stay<\/span><\/a> when you file. This stops almost all creditor collection activity, including <span data-term-id=\"58205393\">foreclosures<\/span> and court cases, and prevents collection agencies from continuing to harass you.<\/p>\n<h2><strong>Secured vs. <span data-term-id=\"58205409\">Unsecured Debt<\/span><\/strong><\/h2>\n<p>When you declare bankruptcy, your debts are usually categorized as <a href=\"https:\/\/dictionary.findlaw.com\/definition\/secured-debt.html\" target=\"_blank\" rel=\"noopener\">secured<\/a> or <a href=\"https:\/\/dictionary.findlaw.com\/definition\/unsecured-claim.html\" target=\"_blank\" rel=\"noopener\">unsecured<\/a>. The designation is significant because the two types of debt are treated differently in Chapter 7 and Chapter 13, which will dictate how much debt you can eliminate.<\/p>\n<h3><strong><span data-term-id=\"58205409\">Unsecured Debt<\/span><\/strong><\/h3>\n<p>Debt is considered to be unsecured when a creditor has no right to <span data-term-id=\"58205411\">repossess<\/span> your property for failure to pay. <span data-term-id=\"58205402\">Credit card<\/span> debt, court judgments, and medical debt are among the most common types of <span data-term-id=\"58205409\">unsecured debt<\/span>.<\/p>\n<p>Since your unsecured creditors hold no collateral for their debts, <span data-term-id=\"58205409\">unsecured debt<\/span> is the most likely to be eliminated through bankruptcy. Some priority <span data-term-id=\"58205409\">unsecured debts<\/span>, like child and spousal support, can\u2019t be discharged without an order from a family court.<\/p>\n<h3><strong><span data-term-id=\"58205435\">Secured Debt<\/span><\/strong><\/h3>\n<p>A secured creditor has the right to <span data-term-id=\"58205411\">repossess<\/span> your property if you don\u2019t repay what you owe. <span data-term-id=\"58205435\">Secured debt<\/span> is often the result of a contract. If you sign a car purchase or lease agreement,\u00a0the lender retains a security interest in the vehicle and can <span data-term-id=\"58205411\">repossess<\/span> it if you fall behind on payments.<\/p>\n<p>Because secured creditors retain their right to <span data-term-id=\"58205411\">repossess<\/span> the property in bankruptcy, you\u2019ll usually need to give up the property or work out a payment plan with the creditor. Home mortgages and <span data-term-id=\"58205438\">car loans<\/span> are the most common types of <span data-term-id=\"58205435\">secured debt<\/span>.<\/p>\n<h3><strong>How Secured and <span data-term-id=\"58205409\">Unsecured Debt<\/span> Work in Bankruptcy<\/strong><\/h3>\n<p>When you file for <span data-term-id=\"58205387\">Chapter 7 bankruptcy<\/span>, you can usually discharge most of your <span data-term-id=\"58205409\">unsecured debt<\/span>. It\u2019s not as easy to discharge <span data-term-id=\"58205435\">secured debt<\/span>, which is rarely eliminated in a <span data-term-id=\"58205394\">Chapter 7 case<\/span>. In most instances, you\u2019ll need to choose from one of the following options:<\/p>\n<ul>\n<li><strong>Return the property to the creditor<\/strong>: You\u2019ll lose the property, but won\u2019t be required to make additional payments<\/li>\n<li><strong>Keep the property and continue making payments<\/strong>: Sometimes possible when a state exemption covers the equity you have in the item<\/li>\n<li><strong>Purchase the property outright<\/strong>: Rare in <span data-term-id=\"58205394\">Chapter 7 cases<\/span>, as most people who file under this chapter lack the assets to purchase the property<\/li>\n<\/ul>\n<p><span data-term-id=\"58205401\">Chapter 13 bankruptcy<\/span> lets you create a plan to repay your secured creditors over three to five years. The court must approve your plan and may force creditors to reduce or restructure your debt. If you want to keep your home, you\u2019ll need to continue making mortgage payments outside of the plan. The trustee may negotiate a payment agreement with the lender if you\u2019re behind.<\/p>\n<p>In Chapter 13, unsecured creditors are paid with the disposable income that\u2019s left over after you\u2019ve repaid your secured creditors. Any <span data-term-id=\"58205409\">unsecured debt<\/span> not paid under the plan is discharged at the end of the plan.<\/p>\n<h2><strong>Am I Eligible for Bankruptcy in Georgia?<\/strong><\/h2>\n<p>To file under Chapter 7 in Georgia, you must show that your income is low enough to qualify. This is usually done using one of two &#8220;<span data-term-id=\"58205389\">means tests<\/span>.&#8221;<\/p>\n<p>The first <span data-term-id=\"58205389\">means test<\/span> is simple: If your household income is less than the median household income for similarly sized households in your state, you qualify. The <a href=\"https:\/\/www.justice.gov\/ust\/eo\/bapcpa\/20250515\/bci_data\/median_income_table.htm\" target=\"_blank\" rel=\"noopener\">U.S. Trustee Program<\/a> updates these <span data-term-id=\"58205421\">median income<\/span> figures periodically.<\/p>\n<p>For cases filed beginning in 2025, the Georgia medians are approximately:<\/p>\n<ul>\n<li>$62,401 for a one-person household<\/li>\n<li>$81,309 for a two-person household<\/li>\n<li>$98,564 for a three-person household<\/li>\n<li>$114,618 for a four-person household<\/li>\n<li>An additional $11,100 per person beyond four<\/li>\n<\/ul>\n<p>If you live in a three-person household earning less than about $98,564 a year, you\u2019ll likely pass the first stage of the Chapter 7 <span data-term-id=\"58205389\">means test<\/span> in Georgia. You can still qualify under Chapter 7 based on your <a href=\"https:\/\/dictionary.findlaw.com\/definition\/disposable-income.html\" target=\"_blank\" rel=\"noopener\">disposable income<\/a> if you are above the median. Calculate your disposable income by subtracting your monthly expenses from your monthly income. If the calculation shows that you have little disposable income each month, you can file under Chapter 7.<\/p>\n<p>To file under Chapter 13, you\u2019ll need to show that you have a steady income and that your debts fall within the limits. Every three years, the Judicial Conference adjusts these figures to reflect inflation. For cases filed between April 1, 2025, and March 31, 2028, your noncontingent, <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/02\/04\/2025-02207\/adjustment-of-certain-dollar-amounts-applicable-to-bankruptcy-cases?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\">liquidated <span data-term-id=\"58205409\">unsecured debts<\/span><\/a> can\u2019t be more than $526,700. <span data-term-id=\"58205435\">Secured debts<\/span> can\u2019t exceed $1,580,125.<\/p>\n<h2><strong><span data-term-id=\"58205399\">Georgia Bankruptcy Exemptions<\/span><\/strong><\/h2>\n<p>Anyone filing for bankruptcy in the state can use Georgia\u2019s <a href=\"https:\/\/codes.findlaw.com\/ga\/title-44-property\/ga-code-sect-44-13-100.html\" target=\"_blank\" rel=\"noopener\">exemption system<\/a>. If your property falls within one of the exemptions, you can protect it from creditors and use it to start over after completing your <span data-term-id=\"58205386\">bankruptcy case<\/span>.<\/p>\n<p>When a <span data-term-id=\"58205422\">married couple<\/span> files for bankruptcy together in Georgia, each spouse is usually allowed to claim a complete set of exemptions. Filing for joint bankruptcy with your spouse may allow you to double most state exemptions if you own the property together.<\/p>\n<h3><strong>Georgia Residency Requirements for Using State Exemptions<\/strong><\/h3>\n<p>There are required qualifications to access Georgia&#8217;s exemptions. Under\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">11 <span data-term-id=\"58205428\">U.S.C<\/span>. \u00a7 522(b)(3)(A)<\/a>, you must have lived in the state for the whole 730-day period (two years) immediately before you file the <span data-term-id=\"58205398\">bankruptcy petition<\/span>. If you are a new resident of Georgia, you\u2019ll use the exemptions of the state where you lived within the 180-day period before the 730-day period.<\/p>\n<p>There is a separate federal rule that limits the <span data-term-id=\"58205391\">homestead exemption<\/span>. If you acquired your home interest within 1,215 days (around 40 months) before filing, your homestead protection is <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">capped at $214,000<\/a>. This cap applies to cases filed between April 1, 2025, and March 31, 2028, and is adjusted every three years. The cap doesn\u2019t apply if you rolled the proceeds from selling a previous Georgia home into the current one.<\/p>\n<h3><strong><span data-term-id=\"58205391\">Homestead Exemption<\/span><\/strong><\/h3>\n<p>As of July 1, 2026, Georgia allows you to exempt up to $50,000 of the equity you have in the residence you use as a home when you file for bankruptcy. That doubles to $100,000 if you and your spouse both own the home and file for bankruptcy together. This is also equivalent to 30 times the hourly minimum wage at the state or federal levels, whichever is higher. A <span data-term-id=\"58205429\">bankruptcy judge<\/span> may allow some low-income <span data-term-id=\"58205407\">filers<\/span> to keep more of their earnings.<\/p>\n<h3><strong><span data-term-id=\"58205414\">Motor Vehicle<\/span> Exemption<\/strong><\/h3>\n<p>You can exempt up to $5,000 of the equity you have in one or more <span data-term-id=\"58205414\">motor vehicles<\/span>.<\/p>\n<h3><strong><span data-term-id=\"58205442\">Wildcard<\/span> Exemption<\/strong><\/h3>\n<p>Georgia has a <span data-term-id=\"58205442\">wildcard<\/span> exemption that you can use to protect any property you own up to $1,200 in value. If you don\u2019t take full advantage of the state\u2019s <span data-term-id=\"58205391\">homestead exemption<\/span>, you may use up to $10,000 of the unused <span data-term-id=\"58205391\">homestead exemption<\/span> amount to protect other property.<\/p>\n<h3><strong><span data-term-id=\"58205408\">Personal Property<\/span> Exemptions<\/strong><\/h3>\n<p>The following household items are exempt up to a combined total of $5,000, not to exceed $300 per item:<\/p>\n<ul>\n<li>Furnishings<\/li>\n<li><span data-term-id=\"58205397\">Household goods<\/span><\/li>\n<li>Clothes<\/li>\n<li>Appliances<\/li>\n<li>Books<\/li>\n<li>Animals<\/li>\n<li><span data-term-id=\"58205425\">Musical instruments<\/span><\/li>\n<li>Crops<\/li>\n<\/ul>\n<p>The state will also allow you to keep up to $500 in jewelry.<\/p>\n<h3><strong>Tools of the Trade Exemption<\/strong><\/h3>\n<p>You can exempt up to $1,500 of the implements, books, or tools you need to pursue your trade or occupation.<\/p>\n<h3><strong>Insurance Benefits Exemption<\/strong><\/h3>\n<p>Payments under <span data-term-id=\"58205412\">life insurance<\/span> contracts that insured an individual upon whom you depended for support are exempt to the extent they are reasonably necessary to support you and any dependents.<\/p>\n<h3><strong>Pension and Retirement Exemption<\/strong><\/h3>\n<p>Most pension and retirement plans are exempt in Georgia, including:<\/p>\n<ul>\n<li>Tax-exempt retirement accounts such as 401(k)s, <span data-term-id=\"58205443\">IRAs<\/span>, and defined benefit plans<\/li>\n<li>Public officer or employee plans<\/li>\n<li>Reasonably necessary payments made on account of illness, disability, death, age, or length of service under a pension or annuity plan<\/li>\n<\/ul>\n<h3><strong>Public Benefit Exemptions<\/strong><\/h3>\n<p>The following public benefits are exempt in full:<\/p>\n<ul>\n<li><span data-term-id=\"58205434\">Social Security<\/span> benefits<\/li>\n<li>Unemployment benefits<\/li>\n<li>Disability benefits<\/li>\n<li><span data-term-id=\"58205424\">Veterans\u2019 benefits<\/span><\/li>\n<li>Local public assistance benefits<\/li>\n<\/ul>\n<h3><strong>Other Exemptions<\/strong><\/h3>\n<ul>\n<li><span data-term-id=\"58205400\">Alimony<\/span> and <span data-term-id=\"58205396\">child support<\/span> to the extent reasonably necessary for support<\/li>\n<li>Money from a health savings account or medical savings account<\/li>\n<li>Professionally prescribed health aids<\/li>\n<li>Payments for the wrongful death of an individual upon whom you were dependent to the extent they are reasonably necessary for your support<\/li>\n<li>Up to $10,000 of payments for personal bodily injury, not including payments for pain, suffering, or financial loss<\/li>\n<li>Payments as compensation for the loss of future earnings that are reasonably necessary for your support<\/li>\n<\/ul>\n<p>If you\u2019re uncertain about an exemption, speak with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/georgia\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">Georgia <span data-term-id=\"58205406\">bankruptcy attorney<\/span><\/a>.<\/p>\n<h2><strong>How Do I Start Bankruptcy in Georgia?<\/strong><\/h2>\n<p>Regardless of which state you file in, you must first complete a <span data-term-id=\"58205413\">credit counseling<\/span> course within 180 days of filing. The course is designed to help you assess whether you can pay your debts outside of bankruptcy.<\/p>\n<p>If you plan to file under Chapter 13, you may be asked to prepare a <span data-term-id=\"58205392\">repayment plan<\/span> to file with the court as part of the course. You must file a course completion certificate along with your bankruptcy filing.<\/p>\n<p>Most people start bankruptcy by finding a qualified <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/georgia\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58205406\">bankruptcy attorney<\/span><\/a>.
