In AT&T Mobility v. Concepcion (2011), the Supreme Court held that companies could use arbitration clauses to block consumer class action lawsuits. Congress reinforced this outcome in 2017 when it repealed a CFPB rule that would have prohibited such clauses.

Bankruptcy’s automatic stay is critical in this environment. Because of these legal and regulatory rollbacks, Section 362 of the Bankruptcy Code is usually the only way to stop:

Eviction

Collection lawsuits

Repossession

Wage garnishment

Foreclosure

Creditor harassment

Civil judges can stop these actions, but will intervene only with clear evidence of serious fraud or other extreme circumstances. The automatic stay applies in full the moment debtors file their voluntary petitions, regardless of the underlying facts. The automatic stay typically remains in effect until the judge closes the bankruptcy case. In a Chapter 13 bankruptcy, that could be up to five years.

Once Section 362’s protection ends, the bankruptcy court discharges most unsecured debts in a Chapter 7 bankruptcy filing, such as:

Medical bills

Credit cards

Revolving charge accounts

Signature loans

SBA loan guarantees

Not all tax debts are dischargeable. Past-due income taxes are priority unsecured debts that can only be eliminated in limited circumstances. Certain other obligations, such as past-due alimony and child support, are not dischargeable.

Types of Consumer Bankruptcy

Chapter 7 is specifically designed for people with more unsecured debts than they can pay. After debtors file their petitions and schedules, the bankruptcy trustee looks for signs of bankruptcy fraud. Such indications include hiding assets, exaggerating exemptions, and income/lifestyle gaps. The trustee requests financial documents, such as tax returns and pay stubs, to assist in this probe.

About six weeks after filing, the trustee meets with the debtor to verify their identity and ask a standard set of questions covering assets, income, and the accuracy of the filed schedules. If everything checks out at this meeting, a judge may sign a discharge order without holding a hearing.

Past-due mortgage payments are another common pressure point. Many people fall behind after a job loss or serious illness. Legally, lenders may begin foreclosure proceedings if even one payment is a single day late.

Chapter 13 helps debtors address these delinquencies on their own terms. Unlike a Chapter 7 filing, Chapter 13 focuses on paying off debts through a structured plan. A Chapter 13 trustee not only reviews the case for fraud but also sets up a monthly repayment plan. Typically, the debtor contributes disposable income to the trustee for three to five years. The trustee distributes those funds among allowed claims, mostly secured debt arrears such as mortgage or car loan shortfalls.

Regardless of whether you file Chapter 7 or Chapter 13, the automatic stay remains in place throughout. This means creditors must wait their turn as long as the debtor stays current on payments.

Am I Eligible for Bankruptcy in Mississippi?

All debtors must meet certain eligibility requirements. In addition, all debtors must take two financial management classes. These courses, which are usually available online, cost a small fee and typically take one to two hours each.

Chapter-specific eligibility requirements also apply. Some of these rules are unwritten and vary by jurisdiction.

Chapter 7 Requirements

Congress significantly changed the Bankruptcy Code in 2005, including the addition of the means test. You’re eligible for Chapter 7 if your income is at or below the median annual income for your household size in Mississippi. As of November 1, 2025, a Mississippi family of four must earn less than $94,965 per year to qualify. This figure is updated approximately every six months. Verify the current threshold before filing.

The means test figure is largely objective, though regional cost-of-living variations may apply. Unless you’re running at least a small monthly deficit, many trustees will question whether Chapter 7 is appropriate for your situation.

Chapter 13 Requirements

A Chapter 13 filer is looking to restructure their debt and stick to a court-approved payment plan. These debtors must have sufficient disposable income to make a monthly debt consolidation payment. The trustee may also ask about recent financial transactions, including transfers made within 90 days before filing for most creditors, or up to two years back for certain transfers made with the intent to defraud. If any of those transactions can be reversed to free up additional assets, the trustee will pursue that.

Chapter 7 is called “liquidation bankruptcy,” but for most Mississippi filers, there is nothing to liquidate. Most filers who qualify don’t have significant nonexempt assets. What they do own is usually protected by the state exemptions described above.

When the trustee liquidates nonexempt assets, the proceeds are distributed in a specific order: administrative expenses first; then priority claims such as certain taxes; and finally general unsecured creditors on a pro rata basis. Once that process is complete or it’s clear there are no nonexempt assets to sell, the court enters a discharge. That typically happens within a few months of filing.

Informal Exemptions

There are a number of exemptions buried deep within various bankruptcy laws that a Mississippi bankruptcy attorney can take advantage of. The best-interest-of-creditors rule is a good example. If the cost of seizing, repairing, and storing the property along with trustee fees would exceed its likely sale price, a trustee is unlikely to pursue it. Either a Chapter 7 discharge or a Chapter 13 plan covers most other debts.

How much debt do you have to have to file Chapter 7?

There is no formal debt requirement in a Chapter 7.
