The <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/\" target=\"_blank\" rel=\"noopener\"><u>U.S. <span data-term-id=\"58206408\">Bankruptcy Code<\/span><\/u><\/a> allows states to enact rules to help residents shield their property from creditors. <span data-term-id=\"58206399\">Montana<\/span> has its own set of exemptions for state residents. When you file for bankruptcy in <span data-term-id=\"58206399\">Montana<\/span>, you must use these exemptions.<\/p>\n<p>To file for bankruptcy in <span data-term-id=\"58206399\">Montana<\/span>, you must have resided in the state for 730 days (two years). If not, you must file under the rules of the state where you resided prior to living in <span data-term-id=\"58206399\">Montana<\/span>, or use the federal exemptions.<\/p>\n<p>Before filing your <span data-term-id=\"58206421\">bankruptcy petition<\/span>, you must complete a <span data-term-id=\"58206433\">credit counseling<\/span> course. You can apply to pay in <span data-term-id=\"58206416\">installments<\/span> or file a fee waiver if your income is below a certain amount.<\/p>\n<h2><span data-term-id=\"58206406\">Filing Bankruptcy<\/span> in <span data-term-id=\"58206399\">Montana<\/span><\/h2>\n<p>There are two basic types of consumer bankruptcy: Chapter 7 and Chapter 13. Debtors should get <span data-term-id=\"58206410\">legal advice<\/span> from a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/montana\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">bankruptcy attorney<\/a> before filing to determine which one best fits their needs.<\/p>\n<h3><span data-term-id=\"58206402\">Chapter 7 Bankruptcy<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/chapter-7-bankruptcy-rules-overview.html\"><span data-term-id=\"58206402\">Chapter 7 bankruptcy<\/span><\/a>, or <span data-term-id=\"58206435\">liquidation<\/span> bankruptcy, is commonly filed by those who have a lot of unsecured debt but few valuable non-exempt assets. In Chapter 7, the <span data-term-id=\"58206429\">bankruptcy trustee<\/span> takes control of your non-<span data-term-id=\"58206407\">exempt property<\/span> and sells it to pay off your <span data-term-id=\"58206430\">unsecured creditors<\/span>. Any unpaid debt is discharged by court order.<\/p>\n<p>To qualify for Chapter 7, debtors must pass a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\"><span data-term-id=\"58206438\">means test<\/span><\/a>. If your annual income is below the median annual income for <span data-term-id=\"58206399\">Montana<\/span>, you automatically qualify. If not, the courts look at your debt load and monthly expenses to determine if you can reasonably pay your debts and still make your monthly living costs. This may allow you to qualify for a Chapter 7. Otherwise, you must file a <span data-term-id=\"58206401\">Chapter 13 bankruptcy<\/span>.<\/p>\n<h3><span data-term-id=\"58206401\">Chapter 13 Bankruptcy<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a>, or <span data-term-id=\"58206442\">reorganization<\/span> bankruptcy, is used by people who have assets they don\u2019t want to lose in <span data-term-id=\"58206435\">liquidation<\/span>. It\u2019s a popular choice for those who don\u2019t want to lose their house for being behind on mortgage payments. Under Chapter 13, you and the <span data-term-id=\"58206429\">bankruptcy trustee<\/span> work out a three- to five-year <span data-term-id=\"58206412\">repayment plan<\/span> that lets you pay off your debts. If you stay current on the <span data-term-id=\"58206423\">payment plan<\/span>, the judge will discharge any remaining deficiencies when it\u2019s done.<\/p>\n<p>To qualify for Chapter 13, you must have a steady income and the ability to meet your monthly living expenses while making your agreed-upon payments to your creditors. If you fall behind on your payments during the bankruptcy, a judge may order you to refile as a Chapter 7.<\/p>\n<h3><span data-term-id=\"58206422\">Automatic Stay<\/span><\/h3>\n<p>Both <span data-term-id=\"58206419\">types of bankruptcy<\/span> begin with an <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><span data-term-id=\"58206422\">automatic stay<\/span><\/a>. The <span data-term-id=\"58206422\">automatic stay<\/span> freezes all <span data-term-id=\"58206440\">debt collection<\/span> activity as soon as you file your <span data-term-id=\"58206403\">bankruptcy case<\/span> and prevents any collection actions from going forward, including:<\/p>\n<ul>\n<li><span data-term-id=\"58206414\">Foreclosures<\/span> and repossessions<\/li>\n<li>Eviction actions<\/li>\n<li><span data-term-id=\"58206436\">Wage garnishments<\/span><\/li>\n<li>Harassing phone calls, emails, and other communications<\/li>\n<\/ul>\n<p>The stay will not last forever. A creditor can file a Motion for Relief from the <span data-term-id=\"58206422\">Automatic Stay<\/span> to have it lifted in some instances. It will prevent immediate action and last during the payment period of a Chapter 13 as long as you are current with your payments.<\/p>\n<h2><span data-term-id=\"58206426\">Montana<\/span><span data-term-id=\"58206426\"> Bankruptcy Exemptions<\/span><\/h2>\n<p>When you file for bankruptcy in <span data-term-id=\"58206399\">Montana<\/span>, you must use the exemptions provided for in state law. The values of property exemptions are updated periodically, so debtors should get <span data-term-id=\"58206432\">legal help<\/span> from a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/montana\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">bankruptcy attorney<\/a> when filing their petition.<\/p>\n<h3><strong><span data-term-id=\"58206420\">Homestead Exemption<\/span><\/strong><\/h3>\n<p>The <a href=\"https:\/\/www.findlaw.com\/state\/montana-law\/montana-homestead-laws.html\"><span data-term-id=\"58206399\">Montana<\/span> <span data-term-id=\"58206420\">homestead exemption<\/span><\/a> protects up to $425,828 in equity from creditors and increases by 4% each year. The exemption extends to one-quarter of a city acre, one acre outside a city, or 320 acres of farmland.<\/p>\n<p>Homeowners must file for a <span data-term-id=\"58206420\">homestead exemption<\/span> before filing for bankruptcy. Homestead filing is done through the County Clerk\u2019s office.<\/p>\n<h3><span data-term-id=\"58206413\">Personal Property<\/span> Exemptions<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/mt\/title-25-civil-procedure\/mt-st-25-13-609\/\" target=\"_blank\" rel=\"noopener\">Property exemptions<\/a> are updated periodically. These reflect the maximum amount available for exemptions:<\/p>\n<ul>\n<li>One <span data-term-id=\"58206415\">motor vehicle<\/span> to the value of $4,000<\/li>\n<li><span data-term-id=\"58206413\">Personal property<\/span>, such as household goods, clothing, books, jewelry, firearms, etc., to a total of $7,000<\/li>\n<li>\u201cTools of the trade\u201d exemption to the value of $4,500<\/li>\n<\/ul>\n<p>These values are current as of 2026. Debtors should always consult a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/montana\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">bankruptcy attorney<\/a> before filing to ensure they have the correct figures.<\/p>\n<p>Filers may receive unlimited exemptions for the following:<\/p>\n<ul>\n<li><span data-term-id=\"58206427\">Life insurance<\/span><\/li>\n<li><span data-term-id=\"58206418\">Alimony<\/span> and <span data-term-id=\"58206411\">child support<\/span> payments to the debtor<\/li>\n<li>Retirement and pension benefits<\/li>\n<li>Public assistance such as <span data-term-id=\"58206437\">Social Security<\/span><\/li>\n<li>Sale of <span data-term-id=\"58206407\">exempt property<\/span><\/li>\n<li>Up to 75% of weekly wages<\/li>\n<\/ul>\n<p><span data-term-id=\"58206439\">Married couples<\/span> filing jointly can double the <span data-term-id=\"58206413\">personal property<\/span> and vehicle exemptions.<\/p>\n<h2>Dischargeable and Non-Dischargeable Debt<\/h2>\n<p>A <span data-term-id=\"58206402\">Chapter 7 bankruptcy<\/span> will eliminate most of your unsecured debt, such as <span data-term-id=\"58206428\">credit card<\/span> debt, medical bills, and personal loans. It will not eliminate any secured debt. These are non-dischargeable debts, such as student loans or tax debt.<\/p>\n<p>In Chapter 13, your <span data-term-id=\"58206423\">payment plan<\/span> may address some of your unsecured debts and repay many of your secured debts. For instance, if you had fallen behind on your mortgage, a Chapter 13 lets you pay less on your mortgage while you pay off your <span data-term-id=\"58206428\">credit card<\/span> bills.
