Under the U.S. <span data-term-id=\"58206693\">Bankruptcy Code<\/span>, there are two main types of personal bankruptcy: <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-vs-chapter-7-bankruptcy.html\">Chapter 7 and Chapter 13<\/a>.<\/p>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\"><span data-term-id=\"58206680\">Chapter 7 bankruptcy<\/span><\/a> is ideal for people looking to eliminate their debt through <span data-term-id=\"58206683\">liquidation<\/span>. <span data-term-id=\"58206680\">Chapter 7 <\/span><span data-term-id=\"58206691\">bankruptcy<\/span><span data-term-id=\"58206691\"> cases<\/span> are often resolved within four to six months. Once your case is completed, the bankruptcy judge will discharge most, if not all, of your debts. You can then begin rebuilding your credit, which will take years.<\/p>\n<p>In a <span data-term-id=\"58206686\">Chapter 13 <\/span><span data-term-id=\"58206691\">bankruptcy<\/span><span data-term-id=\"58206691\"> case<\/span>, you\u2019ll address your financial <span data-term-id=\"58206712\">liabilities<\/span> by paying off most, if not all, of them. A bankruptcy trustee approves and manages a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/repayment-plan.html\">three-to-five-year <span data-term-id=\"58206699\">repayment plan<\/span><\/a>. You\u2019ll make monthly payments to your Chapter 13 trustee, who distributes the money to your secured and unsecured creditors.<\/p>\n<h3>How Do <span data-term-id=\"58206680\">Chapter 7 <\/span><span data-term-id=\"58206691\">Bankruptcy<\/span><span data-term-id=\"58206691\"> Cases<\/span> Work?<\/h3>\n<p>To <span data-term-id=\"58206718\">file <\/span><span data-term-id=\"58206680\">Chapter<\/span><span data-term-id=\"58206680\"> 7 bankruptcy<\/span>, you must meet certain criteria. Unlike a <span data-term-id=\"58206721\">Chapter 13 case<\/span>, you\u2019ll need to prove you can\u2019t afford a <span data-term-id=\"58206699\">repayment plan<\/span> by passing a \u201c<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\"><span data-term-id=\"58206687\">Means Test<\/span><\/a>.\u201d According to the <span data-term-id=\"58206687\">Means Test<\/span>, you must earn less than your state\u2019s <span data-term-id=\"58206715\">median income<\/span> to qualify for <span data-term-id=\"58206680\">Chapter 7 bankruptcy<\/span>. The <a href=\"https:\/\/www.justice.gov\/ust\/eo\/bapcpa\/20260401\/bci_data\/median_income_table.htm\" target=\"_blank\" rel=\"noopener\">median household incomes<\/a> for <span data-term-id=\"58206679\">New Hampshire<\/span> for 2026 are as follows:<\/p>\n<ul>\n<li><strong>One-person household<\/strong>: $87,287<\/li>\n<li><strong>Two-person household<\/strong>: $109,324<\/li>\n<li><strong>Three-person household<\/strong>: $141,531<\/li>\n<li><strong>Four-person household<\/strong>: $155,203<\/li>\n<\/ul>\n<p>If your household income falls below the above threshold(s), you can file for Chapter 7. If you can\u2019t afford the fee, you can request a fee waiver from the court or ask to pay the fee in four equal installments.<\/p>\n<p>Once you file your bankruptcy petition, the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/what-is-a-trustee-in-bankruptcy.html\">trustee<\/a> will review your paperwork and notify your creditors of the bankruptcy filing. As long as the trustee approves your petition and none of your creditors file an objection during the 341 Meeting of Creditors, the judge will finalize your case and discharge your debts.<\/p>\n<p>There may be <span data-term-id=\"58206711\">non-dischargeable debts<\/span> that you\u2019ll still owe after the conclusion of your <span data-term-id=\"58206691\">bankruptcy case<\/span>. In a <span data-term-id=\"58206721\">Chapter 13 case<\/span>, you must also provide the trustee with a proposed <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-repayment-plan-and-confirmation-hearing.html\"><span data-term-id=\"58206699\">repayment plan<\/span><\/a>.<\/p>\n<p>The <span data-term-id=\"58206696\">bankruptcy process<\/span> can be difficult to navigate, especially if you have a lot of debts and assets. This activates the \u201c<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><span data-term-id=\"58206697\">Automatic Stay,<\/span><\/a>\u201d a bankruptcy mechanism that prohibits creditors from taking adverse action against the debtor.<\/p>\n<p>Some of the types of <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/debt-collection-laws.html\">collection activity<\/a> the <span data-term-id=\"58206697\">automatic stay<\/span> prohibits include:<\/p>\n<ul>\n<li>Wage <span data-term-id=\"58206709\">garnishments<\/span><\/li>\n<li>Bank account levies<\/li>\n<li>Civil lawsuits<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure.html\"><span data-term-id=\"58206689\">Foreclosure<\/span><\/a><\/li>\n<li>Repossession<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/eviction.html\">Eviction<\/a><\/li>\n<li>Sheriff\u2019s sale<\/li>\n<\/ul>\n<p>It also bans creditors from contacting you through endless phone calls. They must go through your attorney.<\/p>\n<h2>Secured vs. <span data-term-id=\"58206698\">Unsecured Debt<\/span><\/h2>\n<p>When you <span data-term-id=\"58206692\">file bankruptcy<\/span>, the court will categorize your debts as either <a href=\"https:\/\/dictionary.findlaw.com\/definition\/secured-debt.html\" target=\"_blank\" rel=\"noopener\">secured<\/a> or <a href=\"https:\/\/dictionary.findlaw.com\/definition\/unsecured-claim.html\" target=\"_blank\" rel=\"noopener\">unsecured<\/a>. Secured debts are collateralized by property. For example, a mortgage or car loan is a secured debt. Either can be seized to pay creditors.<\/p>\n<p><span data-term-id=\"58206698\">Unsecured debts<\/span> are not tied to collateral. Common examples of <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-an-unsecured-creditor\/\"><span data-term-id=\"58206698\">unsecured debt<\/span><\/a> include:<\/p>\n<ul>\n<li><span data-term-id=\"58206716\">Credit card<\/span><span data-term-id=\"58206716\"> debt<\/span><\/li>\n<li><span data-term-id=\"58206701\">Medical bills<\/span><\/li>\n<li>Utility bills<\/li>\n<li>Personal loans<\/li>\n<li><a href=\"https:\/\/www.ncsl.org\/financial-services\/payday-lending-state-statutes\" target=\"_blank\" rel=\"noopener\">Payday loans<\/a><\/li>\n<\/ul>\n<p>In a <span data-term-id=\"58206707\">Chapter 7 case<\/span>, the court often discharges most of your <span data-term-id=\"58206698\">unsecured debts<\/span>. Secured debts are a little trickier and not often dismissed. It requires proving substantial financial hardship.
