Let\u2019s take a look at how each type works.<\/p>\n<h3><span data-term-id=\"58206725\">Chapter 7 Bankruptcy<\/span><\/h3>\n<p>Chapter 7, also called a <span data-term-id=\"58206729\">liquidation<\/span> bankruptcy, requires debtors to pass a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/who-can-file-for-chapter-7-bankruptcy.html\"><span data-term-id=\"58206754\">means test<\/span><\/a>. If your income falls below the median income in your state, you automatically qualify for <span data-term-id=\"58206725\">Chapter 7 bankruptcy<\/span>. If you make more than that, the court considers your living expenses and other factors to determine whether you qualify.<\/p>\n<p>In a <span data-term-id=\"58206733\">Chapter 7 case<\/span>, your assets become the property of the \u201cbankruptcy estate.\u201d A bankruptcy trustee sells any non-exempt assets to pay off your creditors. A Chapter 13 combines your <span data-term-id=\"58206771\">secured debts<\/span> and pays them off over three to five years. You must stay current on the <span data-term-id=\"58206761\">payment plan<\/span>.<\/p>\n<p>At the end of the payment period, the court may grant a discharge of many remaining <span data-term-id=\"58206759\">dischargeable debts<\/span>. Some debts are not dischargeable, and some liens can survive.<\/p>\n<p>Chapter 13 is the best choice for homeowners facing <span data-term-id=\"58206730\">foreclosure<\/span> or those with non-exempt assets they wish to keep. To qualify for Chapter 13, you must have a steady income that can support a <span data-term-id=\"58206767\">monthly <\/span><span data-term-id=\"58206761\">payment<\/span><span data-term-id=\"58206761\"> plan<\/span> and cover your living expenses.<\/p>\n<h3><span data-term-id=\"58206749\">New Mexico<\/span><span data-term-id=\"58206749\"> Bankruptcy Exemptions<\/span><\/h3>\n<p><span data-term-id=\"58206724\">New Mexico<\/span> is a \u201cchoice\u201d state, meaning you can choose either the <span data-term-id=\"58206749\">New Mexico<\/span><span data-term-id=\"58206749\"> bankruptcy exemptions<\/span> or the federal exemptions, but not both. You need to include the certificate of completion with your filing.<\/p>\n<p>You must also pay the <span data-term-id=\"58206727\">bankruptcy <\/span><span data-term-id=\"58206736\">filing<\/span><span data-term-id=\"58206736\"> fee<\/span>. As of 2026, the <span data-term-id=\"58206736\">filing fee<\/span> for <span data-term-id=\"58206725\">Chapter 7 bankruptcy<\/span> is $338. For <span data-term-id=\"58206728\">Chapter 13 bankruptcy<\/span>, it\u2019s $313. You can ask to pay in <span data-term-id=\"58206753\">installments<\/span> or request a fee <span data-term-id=\"58206770\">waiver<\/span> if you cannot afford the full fee.<\/p>\n<p>Immediately after filing, an <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><u><span data-term-id=\"58206740\">automatic stay<\/span><\/u><\/a> goes into effect. The stay halts all collection actions and lawsuits related to your bankruptcy, including:<\/p>\n<ul>\n<li><span data-term-id=\"58206730\">Foreclosure<\/span> or eviction<\/li>\n<li>Wage <span data-term-id=\"58206751\">garnishment<\/span> related to collection actions<\/li>\n<li>Repossession efforts<\/li>\n<li>Lien action<\/li>\n<\/ul>\n<p>The <span data-term-id=\"58206740\">automatic stay<\/span> does not halt all actions. It won\u2019t affect wage <span data-term-id=\"58206751\">garnishments<\/span> for <span data-term-id=\"58206737\">child support<\/span> or similar court-ordered payments, nor can it halt an eviction if the landlord has already received a judgment and order for eviction. Creditors can file a Motion for Relief from Stay to remove the stay if they can demonstrate immediate harm if it remains in place.<\/p>\n<h2>Debts Not Covered in Bankruptcy<\/h2>\n<p>A <span data-term-id=\"58206725\">Chapter 7 Bankruptcy<\/span> only discharges unsecured debts. A <span data-term-id=\"58206756\">Chapter 13 plan<\/span> pays off as many debts as you can through the <span data-term-id=\"58206767\">monthly <\/span><span data-term-id=\"58206761\">payment<\/span><span data-term-id=\"58206761\"> plan<\/span>. In both types of bankruptcy, some debts cannot be removed, no matter what you choose. Debts that cannot be discharged include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"58206735\">Student loans<\/span><\/strong> (a new program may allow you to show \u201cundue hardship\u201d and meet a very narrow set of criteria for clearance, but it\u2019s still rare)<\/li>\n<li><strong>Tax liens<\/strong><\/li>\n<li><strong><span data-term-id=\"58206737\">Child support<\/span> and <span data-term-id=\"58206746\">alimony<\/span> arrearages<\/strong><\/li>\n<li><strong>Court-ordered restitution and fines<\/strong><\/li>\n<\/ul>\n<p>Choosing the best plan for your situation is crucial.
