The goal of bankruptcy is to give debtors a <span data-term-id=\"58207157\">fresh start<\/span>, not to wipe them out completely. In <span data-term-id=\"58207154\">Oregon<\/span>, there are two primary <span data-term-id=\"58207166\">types of bankruptcy<\/span> filings.<\/p>\n<h3><span data-term-id=\"58207162\">Chapter 7 Bankruptcy<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\">Chapter 7,<\/a> sometimes known as a <span data-term-id=\"58207177\">liquidation<\/span> bankruptcy, is used by debtors with few assets and a large amount of unsecured debt, such as <span data-term-id=\"58207205\">medical bills<\/span> and <span data-term-id=\"58207165\">credit card<\/span> debt. In <span data-term-id=\"58207162\">Chapter 7 bankruptcy<\/span>, the\u00a0<span data-term-id=\"58207180\">bankruptcy trustee<\/span>\u00a0takes charge of your assets and sells them to pay\u00a0your creditors. Your unsecured debts are discharged.<\/p>\n<p>To file a Chapter 7, you must pass a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\"><span data-term-id=\"58207183\">means test<\/span><\/a>. If your annual household income is below the state median, you automatically qualify for Chapter 7. If it is slightly above that amount, the trustee looks at your overall <span data-term-id=\"58207193\">financial situation<\/span>.<\/p>\n<h3><span data-term-id=\"58207159\">Chapter 13 Bankruptcy<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\"><span data-term-id=\"58207159\">Chapter 13 bankruptcy<\/span><\/a> is also called a \u201creorganization.\u201d It is used by people facing <span data-term-id=\"58207163\">foreclosure<\/span> who do not want to lose their house, and others with valuable non-exempt assets. In a Chapter 13, the debtor and trustee arrange a three- to five-year\u00a0<span data-term-id=\"58207164\">repayment plan<\/span>\u00a0to pay the creditors. As long as you stay current on the monthly <span data-term-id=\"58207200\">payment plan<\/span>, the remaining debt is discharged at the end of the repayment period.<\/p>\n<p>A Chapter 13 plan requires a stable income and the ability to make the monthly payments. It is ideal for homeowners who have fallen behind on their mortgage due to other outstanding debts and need breathing room to clear those debts and catch up on their payments.<\/p>\n<h3>Automatic Stay<\/h3>\n<p>After filing either <span data-term-id=\"58207166\">type of bankruptcy<\/span>, an <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\">automatic stay<\/a> goes into effect. The automatic stay immediately stops most kinds of debt collection efforts, such as:<\/p>\n<ul>\n<li><span data-term-id=\"58207163\">Foreclosure<\/span> and <span data-term-id=\"58207168\">repossession<\/span><\/li>\n<li>Lien placement and lawsuits<\/li>\n<li>Wage <span data-term-id=\"58207174\">garnishment<\/span><\/li>\n<li>Eviction actions<\/li>\n<li>Utility shutoff<\/li>\n<\/ul>\n<p>The automatic stay is not absolute. Creditors can file a Motion for Relief From Stay and have the stay lifted if they can show the lack of adequate protection of an interest in property. A landlord can sometimes proceed with an eviction if they have received a court judgment and eviction order. Still, the stay gives debtors time to plan their next move in court.<\/p>\n<h2><span data-term-id=\"58207154\">Oregon<\/span> <span data-term-id=\"58207190\">Bankruptcy Exemptions<\/span><\/h2>\n<p>Whether you file a Chapter 7 or Chapter 13, the trustee takes charge of your <span data-term-id=\"58207181\">non-exempt property<\/span>. <span data-term-id=\"58207154\">Oregon<\/span> debtors are explicitly allowed to choose between the full <a href=\"https:\/\/codes.findlaw.com\/or\/title-2-procedure-in-civil-proceedings\/or-rev-st-sect-18-300\/\" target=\"_blank\" rel=\"noopener\">state <span data-term-id=\"58207190\">bankruptcy exemptions<\/span><\/a> or the full federal <span data-term-id=\"58207190\">bankruptcy exemption<\/span> list.<\/p>\n<p>To <span data-term-id=\"58207175\">file bankruptcy<\/span> in <span data-term-id=\"58207154\">Oregon<\/span> as an <span data-term-id=\"58207154\">Oregon<\/span> resident, you must have lived in <span data-term-id=\"58207154\">Oregon<\/span> for at least 730 days (two years). Otherwise, you must file as a resident of your prior state.<\/p>\n<ul>\n<li><strong><span data-term-id=\"58207172\">Homestead exemption<\/span>:<\/strong> Equity up to $158,300 for single <span data-term-id=\"58207184\">filers<\/span> and $316,700 for joint <span data-term-id=\"58207184\">filers<\/span>. If the debts are due to <span data-term-id=\"58207179\">child support<\/span> arrears, the exemption is limited to $40,000<\/li>\n<li><strong><span data-term-id=\"58207192\">Motor vehicle<\/span> exemption:<\/strong> Up to $10,000 <span data-term-id=\"58207192\">motor vehicle<\/span> equity<\/li>\n<li><strong>Household Goods:<\/strong> Up to $3,000 in furniture, clothing, appliances, and everyday household items<\/li>\n<li><strong>Tools of the Trade:<\/strong> Up to $5,000 of work-related implements<\/li>\n<li><strong>Wage Protections:<\/strong> Typically protects 75% of your earned but unpaid wages from court seizure or <span data-term-id=\"58207174\">garnishment<\/span><\/li>\n<li><strong><span data-term-id=\"58207167\">Retirement Accounts<\/span>:<\/strong> 401k, <span data-term-id=\"58207170\">IRAs<\/span>, and Social Security and other government benefits are fully exempt<\/li>\n<li><strong><span data-term-id=\"58207198\">Wildcard exemption<\/span>:<\/strong> <span data-term-id=\"58207154\">Oregon<\/span> has a small <span data-term-id=\"58207198\">wildcard exemption<\/span> of $400, allowing <span data-term-id=\"58207184\">filers<\/span> to protect <span data-term-id=\"58207181\">non-exempt property<\/span><\/li>\n<\/ul>\n<p>These figures are updated every three years <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-104\/\" target=\"_blank\" rel=\"noopener\">by <span data-term-id=\"58207176\">Oregon<\/span><span data-term-id=\"58207176\"> law<\/span><\/a>. Bankruptcy <span data-term-id=\"58207184\">filers<\/span> should consult an attorney to confirm they are using the correct figures.<\/p>\n<h2><span data-term-id=\"58207175\">Filing Bankruptcy<\/span> in <span data-term-id=\"58207154\">Oregon<\/span><\/h2>\n<p>Before filing for bankruptcy in <span data-term-id=\"58207154\">Oregon<\/span>, you must complete a <span data-term-id=\"58207194\">credit counseling<\/span> course. <a href=\"https:\/\/www.justice.gov\/ust\/credit-counseling-debtor-education-information\" target=\"_blank\" rel=\"noopener\">The U.S. Department of Justice<\/a> has a list of approved classes. The amount of paperwork and the level of detail required for a successful bankruptcy filing are considerable, and an attorney can ensure you follow the local rules on the format of filing your documents.<\/p>\n<p>You should also have an attorney for the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/what-is-a-341-meeting-in-bankruptcy.html\">creditors\u2019 meeting<\/a> and any negotiations with the <span data-term-id=\"58207180\">bankruptcy trustee<\/span>.<\/p>\n<h3>Fees and Costs<\/h3>\n<p>Bankruptcy filing fees in <span data-term-id=\"58207154\">Oregon<\/span> are:<\/p>\n<ul>\n<li>$338 for Chapter 7<\/li>\n<li>$313 for Chapter 13<\/li>\n<\/ul>\n<p>You can apply for installments or fee waivers if necessary. The costs of the mandatory courses range from $20 to $50, and most can be taken online.<\/p>\n<h2>After Bankruptcy<\/h2>\n<p>Bankruptcy discharge will eliminate most unsecured debt, such as <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/can-you-clear-medical-debt-in-bankruptcy.html\"><span data-term-id=\"58207205\">medical bills<\/span><\/a>, <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/can-filing-for-bankruptcy-clear-credit-card-debt.html\"><span data-term-id=\"58207165\">credit card<\/span> debt<\/a>, personal loans, and some other types of debt. A Chapter 7 discharge <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/after-bankruptcy\/can-you-legally-remove-bankruptcy-from-a-credit-report.html\">remains on your credit report <\/a>for seven to ten years. After the <span data-term-id=\"58207164\">repayment plan<\/span> in a Chapter 13, if you have made all monthly payments, the judge will discharge any remaining deficiencies.<\/p>\n<p>Bankruptcies of either kind will <strong>not<\/strong> eliminate <span data-term-id=\"58207187\">secured debts<\/span>.
