If everything\u2019s in order, they\u2019ll recommend that the bankruptcy judge discharge <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-an-unsecured-creditor\/\"><span data-term-id=\"58207293\">unsecured debts<\/span><\/a>. Some of your\u00a0<span data-term-id=\"58207313\">secured debts<\/span>\u00a0may be discharged as well, but it depends on the specifics of your case. Even if you don&#8217;t lose any assets, your credit rating will be negatively affected.<\/p>\n<h3><span data-term-id=\"58207282\">Chapter 13 <\/span><span data-term-id=\"58207290\">Bankruptcy<\/span><span data-term-id=\"58207290\"> Case<\/span><\/h3>\n<p>In a Chapter 13 case, the <span data-term-id=\"58207312\">filer<\/span> is seeking a manageable <span data-term-id=\"58207305\">payment plan<\/span> for their debts. <span data-term-id=\"58207283\">Filing bankruptcy<\/span> can create a viable plan, allow them to stay in their home, and stop aggressive <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/debt-collection-laws.html\"><span data-term-id=\"58207315\">debt collection<\/span> activity<\/a>.<\/p>\n<p>When filing a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\"><span data-term-id=\"58207282\">Chapter 13 <\/span><span data-term-id=\"58207290\">bankruptcy<\/span><span data-term-id=\"58207290\"> case<\/span><\/a>, you must provide the trustee with a list of your debts and assets. The trustee then reviews your income and basic living expenses. Your disposable income is then used to pay your creditors.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/filing-for-chapter-13.html\"><span data-term-id=\"58207282\">Chapter 13 bankruptcy<\/span><\/a> allows you to spread your debts out over a three-to-five-year period, during which you\u2019ll make monthly payments to the trustee. The trustee distributes this money to your creditors in order of seniority.<\/p>\n<p>The order in which your creditors receive payment in a Chapter 13 is as follows:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/small-business\/what-is-a-secured-creditor\/\">Secured creditors<\/a> (Mortgage company, auto lender, etc.)<\/li>\n<li>Priority unsecured creditors (<span data-term-id=\"58207311\">Alimony<\/span>, <span data-term-id=\"58207292\">child support<\/span>, tax debts, etc.)<\/li>\n<li>Non-priority unsecured creditors (<span data-term-id=\"58207280\">Credit card<\/span> companies, loan companies, etc.)<\/li>\n<\/ul>\n<p>Once you complete your <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-repayment-plan-and-confirmation-hearing.html\"><span data-term-id=\"58207308\">repayment plan<\/span><\/a>, the trustee will determine which debts the court should discharge, which ones you will continue paying, and which ones are deemed settled or paid in full. While <span data-term-id=\"58207292\">child support<\/span> and <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/spousal-support-alimony-forms-and-information-by-state.html\"><span data-term-id=\"58207311\">alimony<\/span><\/a> are <span data-term-id=\"58207321\">non-dischargeable debts<\/span> in a <span data-term-id=\"58207275\">Chapter 7 bankruptcy<\/span>, you can include past-due support obligations in your Chapter 13 <span data-term-id=\"58207308\">repayment plan<\/span>.<\/p>\n<h2>Are There Debts That Are Non-Dischargeable in Bankruptcy?<\/h2>\n<p>Some debts aren\u2019t dischargeable in bankruptcy, regardless of the chapter. <span data-term-id=\"58207283\">Filing bankruptcy<\/span> to rid yourself of overwhelming <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/should-student-loans-be-discharged-in-bankruptcy\/\"><span data-term-id=\"58207291\">student loans<\/span><\/a> is extremely unlikely to work, as <span data-term-id=\"58207279\">bankruptcy courts<\/span> rarely discharge them. Other <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/debts-that-remain-after-a-chapter-7-discharge.html\"><span data-term-id=\"58207321\">non-dischargeable debts<\/span><\/a> in your <span data-term-id=\"58207276\">Rhode Island<\/span><span data-term-id=\"58207276\"> bankruptcy<\/span> include:<\/p>\n<ul>\n<li><span data-term-id=\"58207311\">Alimony<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-and-bankruptcy.html\"><span data-term-id=\"58207292\">Child support<\/span><\/a><\/li>\n<li>Most recent tax debts<\/li>\n<li>Other domestic support obligations<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/restitution.html\">Criminal restitution<\/a><\/li>\n<li>Debts from fraud or misconduct<\/li>\n<li>Debts arising from luxury goods and services<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-524\/\" target=\"_blank\" rel=\"noopener\">Reaffirmed debts<\/a><\/li>\n<li>Personal injury judgments arising from a DUI<\/li>\n<li>Government and civil fines and penalties<\/li>\n<\/ul>\n<p>For the most part, bankruptcy won\u2019t provide <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/bankruptcy-vs-debt-relief.html#:~:text=Bankruptcy%20and%20debt%20relief%20are%20two%20distinct%20ways,pros%20and%20cons%20to%20debtors%20who%20need%20relief.\"><span data-term-id=\"58207288\">debt relief<\/span><\/a> for these obligations. The <span data-term-id=\"58207307\">bankruptcy process<\/span> is meant to help people seek relief from traditional debts they incur in good faith.<\/p>\n<p>After you submit your <span data-term-id=\"58207298\">bankruptcy petition<\/span>, you must attend something called a \u201c<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/what-is-a-341-meeting-in-bankruptcy.html\">341 <span data-term-id=\"58207320\">Meeting of Creditors<\/span><\/a>.\u201d This is where the trustee and your creditors can question you about your debts, assets, and income as they relate to your bankruptcy filing. <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-debt-discharge-in-bankruptcy-faq.html\">Creditors can object<\/a> to the court\u2019s discharging their debt as part of your bankruptcy. If the judge allows them to file a formal objection, they must do so through a separate, adversary proceeding.<\/p>\n<h2>Eligibility Requirements for Bankruptcy Under <span data-term-id=\"58207274\">Rhode Island<\/span> Law<\/h2>\n<p>To <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-debt-and-bankruptcy\/what-to-expect-filing-bankruptcy.html\"><span data-term-id=\"58207283\">file bankruptcy<\/span><\/a>, you must meet certain eligibility requirements. These differ between the two types of <span data-term-id=\"58207290\">bankruptcy cases<\/span>.<\/p>\n<p>To qualify for <span data-term-id=\"58207275\">Chapter 7 bankruptcy<\/span>, you must pass the \u201c<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\"><span data-term-id=\"58207306\">Means Test<\/span><\/a>.\u201d This requires you to show that your income is less than your state\u2019s median household income. As of 2026, the <a href=\"https:\/\/www.justice.gov\/ust\/eo\/bapcpa\/20260401\/bci_data\/median_income_table.htm\" target=\"_blank\" rel=\"noopener\">median incomes for <span data-term-id=\"58207274\">Rhode Island<\/span><\/a> are as follows:<\/p>\n<ul>\n<li>One-person household: $77,653<\/li>\n<li>Two-person household: $98,736<\/li>\n<li>Three-person household: $119,419<\/li>\n<li>Four-person household: $137,479<\/li>\n<\/ul>\n<p>If your household exceeds four people, add $11,100 for each person. As long as your income falls below the above thresholds and you file the proper <a href=\"https:\/\/www.rib.uscourts.gov\/forms\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207304\">bankruptcy forms<\/span><\/a>, you should qualify for a Chapter 7 in <span data-term-id=\"58207274\">Rhode Island<\/span>.<\/p>\n<p>The requirements for Chapter 13 are markedly different. You must prove the following to file a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/filing-for-chapter-13.html\"><span data-term-id=\"58207282\">Chapter 13 <\/span><span data-term-id=\"58207298\">bankruptcy<\/span><span data-term-id=\"58207298\"> petition<\/span><\/a>:<\/p>\n<ul>\n<li>Your total secured and <span data-term-id=\"58207293\">unsecured debt<\/span> must fall below the maximum thresholds set by <span data-term-id=\"58207318\">federal law<\/span>, <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-109\/\" target=\"_blank\" rel=\"noopener\">11 U.S.C. Section 109<\/a>(e). These thresholds are as follows for 2026:\n<ul>\n<li><span data-term-id=\"58207313\">Secured debt<\/span> maximum: $1,580,125<\/li>\n<li><span data-term-id=\"58207293\">Unsecured debt<\/span> maximum: $526,700<\/li>\n<\/ul>\n<\/li>\n<li>You have sufficient regular income to pay your monthly payments during your <span data-term-id=\"58207308\">repayment plan<\/span><\/li>\n<\/ul>\n<p>As long as the debts you list on your <a href=\"https:\/\/www.rib.uscourts.gov\/court-info\/faq?page=1\" target=\"_blank\" rel=\"noopener\">Schedules D, E, and F<\/a> are below the above totals, you should qualify for Chapter 13. Chapter 13 will also negatively affect your credit rating, but not as severely as Chapter 7 will.<\/p>\n<h2>Where Should You File Your <span data-term-id=\"58207276\">Rhode Island<\/span> <span data-term-id=\"58207290\">Bankruptcy<\/span><span data-term-id=\"58207290\"> Case<\/span>?<\/h2>\n<p>If you plan to file for bankruptcy, you must do so in one of the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/united-states-bankruptcy-courts.html\"><span data-term-id=\"58207303\">federal courts<\/span><\/a> that handles <span data-term-id=\"58207290\">bankruptcy cases<\/span>. In <span data-term-id=\"58207274\">Rhode Island<\/span>, this means the <a href=\"https:\/\/www.rib.uscourts.gov\/welcome-rhode-island-bankruptcy-court\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207299\">U.S. <\/span><span data-term-id=\"58207279\">Bankruptcy Court<\/span> for the <span data-term-id=\"58207294\">District of <\/span><span data-term-id=\"58207274\">Rhode Island<\/span><\/a> in <span data-term-id=\"58207281\">Providence<\/span>. After registering online, you can upload your forms and check the status of your case through the Electronic Case Filing (ECF) system.<\/p>\n<p>The <a href=\"https:\/\/www.consumeraffairs.com\/finance\/how-much-does-it-cost-to-file-bankruptcy.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207314\">filing fee<\/span><\/a> for a Chapter 7 case is $338, while it costs $313 to file Chapter 13. If you can\u2019t afford the <span data-term-id=\"58207314\">filing fee<\/span>, request a fee waiver from the court.
