It\u2019s difficult, if not impossible, to get a\u00a0<span data-term-id=\"58207332\">fresh start<\/span>\u00a0if you are still paying\u00a0<span data-term-id=\"58207363\">unsecured debts<\/span>, such as:<\/p>\n<ul>\n<li>Payday loans<\/li>\n<li><span data-term-id=\"58207330\">Credit cards<\/span><\/li>\n<li>Signature loans<\/li>\n<li>Medical bills<\/li>\n<\/ul>\n<p>A bankruptcy judge can\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief.html\">discharge<\/a>\u00a0these debts once you finish the <span data-term-id=\"58207367\">bankruptcy process<\/span>. \u201cDischarge&#8221; means the judge eliminates the legal obligation to pay the debts.<\/p>\n<p>The possibility of discharge gives your lawyer leverage in debt negotiations. Creditors know that unless they make a favorable deal, they may end up with little or nothing. This makes coming to an agreement more enticing.<\/p>\n<h2><strong>Types of\u00a0<span data-term-id=\"58207324\">South Carolina<\/span>\u00a0Consumer Bankruptcies<\/strong><\/h2>\n<p><span data-term-id=\"58207330\">Credit cards<\/span>\u00a0and the other aforementioned obligations are\u00a0<span data-term-id=\"58207363\">unsecured debts<\/span> with no collateral attached to the loan. In an unsecured loan, the\u00a0<span data-term-id=\"58207349\">lender<\/span>\u00a0doesn\u2019t have the option of taking back property if you fail to make payments on time. In a\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\"><span data-term-id=\"58207376\">Chapter 7<\/span><\/a><span data-term-id=\"58207376\">\u00a0case<\/span>, the court discharges\u00a0<span data-term-id=\"58207363\">unsecured debts<\/span>\u00a0in as little as six months. The discharge applies broadly to all eligible <span data-term-id=\"58207363\">unsecured debts<\/span>.<\/p>\n<p>Debtors may voluntarily reaffirm certain debts, agreeing to remain personally liable if they wish to preserve a particular creditor relationship. If a person has a good relationship with their doctor, they might want to pay their bill, even though it\u2019s\u00a0<span data-term-id=\"58207371\">dischargeable<\/span>\u00a0in bankruptcy.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a>\u00a0is usually ideal for people dealing with past-due mortgage payments and other\u00a0<span data-term-id=\"58207340\">secured debt<\/span>\u00a0delinquency. This form of bankruptcy gives these debtors up to five years to discharge their obligations. Since the\u00a0<span data-term-id=\"58207347\">automatic stay<\/span>\u00a0remains in effect, creditors must accept the\u00a0<span data-term-id=\"58207352\">payment plan<\/span>\u00a0proposal, as long as it meets certain legal requirements.<\/p>\n<h2><strong>Am I Eligible for Bankruptcy in\u00a0<span data-term-id=\"58207324\">South Carolina<\/span>?<\/strong><\/h2>\n<p>Most people qualify for bankruptcy in the Palmetto State. However, there are specific\u00a0<span data-term-id=\"58207337\">eligibility<\/span>\u00a0requirements for the different types of bankruptcy.<\/p>\n<h3><strong>Official\u00a0<span data-term-id=\"58207337\">Eligibility<\/span><\/strong><\/h3>\n<p>All debtors must meet nonfinancial and financial\u00a0<span data-term-id=\"58207337\">eligibility<\/span>\u00a0requirements. You must complete a pre-filing\u00a0<span data-term-id=\"58207364\">credit counseling<\/span>\u00a0course and a post-filing credit management class. These brief and inexpensive courses are available online.<\/p>\n<p>A Chapter 7 debtor must pass the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\">means test<\/a>. Their annual income must be below the\u00a0<a href=\"https:\/\/www.justice.gov\/ust\/eo\/bapcpa\/20260401\/bci_data\/median_income_table.htm\" target=\"_blank\" rel=\"noopener\">median for <span data-term-id=\"58207324\">South Carolina<\/span><\/a>. As of April 2026, a <span data-term-id=\"58207324\">South Carolina<\/span> family of four must earn less than $116,314 to pass the first step of the means test.<\/p>\n<p>These figures are updated approximately every six months, so verify the current numbers with your attorney or on the Department of Justice&#8217;s\u00a0<a href=\"https:\/\/www.justice.gov\/ust\/means-testing\" target=\"_blank\" rel=\"noopener\">means testing page<\/a>. If you\u2019re at or above the median income level, you may still pass after the trustee calculates your disposable income.<\/p>\n<p>Debt ceilings apply in Chapter 13. As of April 1, 2025, debtors must have <span data-term-id=\"58207363\">unsecured\u00a0<\/span><a href=\"https:\/\/www.uscourts.gov\/court-programs\/bankruptcy\/bankruptcy-basics\/chapter-13-bankruptcy-basics\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207363\">debt<\/span> of less than $526,700<\/a>\u00a0and <span data-term-id=\"58207340\">secured debt<\/span> of less than $1,580,125. A provision applied during the pandemic temporarily raised and combined the limits into one threshold of $2,750,000, but it expired on June 21, 2024. As a result, the separate secured and unsecured limits, prior to the 2025 adjustment, were raised to their current levels. These amounts reset every three years, so confirm the current figures with your <span data-term-id=\"58207368\">bankruptcy lawyer<\/span>.<\/p>\n<h3><strong>Unofficial\u00a0<span data-term-id=\"58207337\">Eligibility<\/span><\/strong><\/h3>\n<p>The informal filing requirements vary by jurisdiction. Most experienced\u00a0<span data-term-id=\"58207324\">South Carolina<\/span> <span data-term-id=\"58207368\">bankruptcy lawyers<\/span>\u00a0are familiar with them.<\/p>\n<p>Chapter 7 is for people who need to eliminate <span data-term-id=\"58207363\">unsecured debt<\/span> and regain financial stability. Unless this burden is measurable (i.e., the debtor is in the red every month on an income\/expense basis), the trustee might question the need for Chapter 7.<\/p>\n<p>Chapter 13 debtors must have sufficient disposable income to fund a monthly debt consolidation payment. This payment must erase all allowed claims within the time prescribed by <span data-term-id=\"58207343\">state law<\/span> (between three and five years).<\/p>\n<p>The trustee does more than review paperwork and set up\u00a0<span data-term-id=\"58207352\">payment plans<\/span>. It\u2019s common for them to request obscure financial documents with little notice. Unless debtors produce them quickly, the judge could dismiss the case.<\/p>\n<h2><strong><span data-term-id=\"58207357\">South Carolina<\/span><span data-term-id=\"58207357\"> Bankruptcy Exemptions<\/span><\/strong><\/h2>\n<p>Outside bankruptcy, creditors often don\u2019t need court orders to seize your hard-earned assets. In a bankruptcy, property exemptions protect your property.<\/p>\n<h3><strong>Formal Exemptions<\/strong><\/h3>\n<p><span data-term-id=\"58207324\">South Carolina<\/span>\u00a0doesn\u2019t allow debtors to use\u00a0<span data-term-id=\"58207379\">federal exemptions<\/span>. The formal state bankruptcy exemptions are found in the\u00a0<a href=\"https:\/\/www.scstatehouse.gov\/code\/t15c041.php\" target=\"_blank\" rel=\"noopener\">Civil Remedies and Procedures Code<\/a>. <a href=\"https:\/\/www.scstatehouse.gov\/code\/t15c041.php\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207373\">Exemption amounts<\/span><\/a> are adjusted for inflation on July 1 of each even-numbered year. The figures below reflect the amounts in effect as of July 1, 2026:<\/p>\n<ul>\n<li><strong><span data-term-id=\"58207372\">Homestead exemption<\/span><\/strong>:\u00a0<span data-term-id=\"58207342\">South Carolina<\/span><span data-term-id=\"58207342\"> law<\/span> protects up to $80,125 of equity for single bankruptcy <span data-term-id=\"58207356\">filers<\/span>, or $160,250 for those filing jointly. Unless you have owned your home for more than half the loan period, you probably have little home equity. This helps <span data-term-id=\"58207356\">filers<\/span> keep their home.<\/li>\n<li><strong><span data-term-id=\"58207333\">Motor vehicle<\/span><\/strong>: The <span data-term-id=\"58207333\">motor vehicle<\/span> equity exemption is $8,000 for a single <span data-term-id=\"58207356\">filer<\/span>, or $16,000 for a married couple filing jointly.\u00a0Most used vehicles have a limited dollar value, especially if they need work or have been in a minor accident.<\/li>\n<li><strong><span data-term-id=\"58207331\">Personal property<\/span><\/strong>: Debtors may protect up to $6,400 worth of clothing, appliances, household furnishings, and other <span data-term-id=\"58207366\">household goods<\/span>, plus up to $1,600 in jewelry. The as-is cash value of individual items is usually small.\u00a0These values must be declared on Schedule C.<\/li>\n<li><strong><span data-term-id=\"58207351\">Retirement accounts<\/span><\/strong>:\u00a0Public and private retirement nest eggs are normally 100% exempt, no matter how much money they contain. The exemption might not apply to inherited\u00a0<span data-term-id=\"58207351\">retirement accounts<\/span>.<\/li>\n<li><strong>Government payments<\/strong>:\u00a0Some families depend on VA disability,\u00a0<span data-term-id=\"58207348\">Social Security<\/span>, and other government benefits. These payments are 100% exempt. Most insurance payments and personal injury settlements are protected as well.<\/li>\n<li><strong><span data-term-id=\"58207369\">Wildcard<\/span><\/strong>:<strong>\u00a0<\/strong><span data-term-id=\"58207324\">South Carolina<\/span> debtors may apply up to $8,000 of unused exemptions to savings accounts, vacation timeshares, and other <span data-term-id=\"58207336\">nonexempt property<\/span>. This allows someone who doesn\u2019t own a home to still protect up to $8,000 in savings.<\/li>\n<\/ul>\n<p>Other exemptions include all business partnership property, tools of the trade (up to $2,400), and wages. <span data-term-id=\"58207373\">Exemption amounts<\/span> adjust every two years. In addition, a little-known bankruptcy loophole known as the \u201cBest Interests of Creditors\u201d sometimes applies. This often applies to worthless items being offered in <span data-term-id=\"58207338\">liquidation<\/span>.<\/p>\n<h2>Recent Developments in <span data-term-id=\"58207324\">South Carolina<\/span> <span data-term-id=\"58207334\">Bankruptcy Law<\/span><\/h2>\n<p>There have been recent changes to\u00a0the <a href=\"https:\/\/www.scb.uscourts.gov\/news\/local-rules-effective-december-1-2025\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207367\">bankruptcy process<\/span> in <span data-term-id=\"58207324\">South Carolina<\/span><\/a>. On December 1, 2025, the <span data-term-id=\"58207353\">District of <\/span><span data-term-id=\"58207324\">South Carolina<\/span> adopted amended local bankruptcy rules and updated forms. The updates include a new\u00a0<a href=\"https:\/\/www.scb.uscourts.gov\/pdf\/Local_Rules\/TrusteesNoticeofPlanPaymentChange.pdf\" target=\"_blank\" rel=\"noopener\">Trustee&#8217;s Notice of Plan Payment Change<\/a>\u00a0for Chapter 13 cases. The trustee collects and distributes plan payments, and revised procedures for self-represented <span data-term-id=\"58207356\">filers<\/span> are in place.<\/p>\n<p>The District also set a new\u00a0<a href=\"https:\/\/www.scb.uscourts.gov\/news\/chapter-13-interest-rate-3\" target=\"_blank\" rel=\"noopener\">presumptive interest rate<\/a>\u00a0for secured claims in <span data-term-id=\"58207377\">Chapter 13 plans<\/span>. For cases filed on or after December 17, 2025, that rate is 8.25%. The rate dropped following Federal Reserve reductions. A lower rate often means lower monthly payments on <span data-term-id=\"58207340\">secured debts<\/span> you repay through your plan, such as a mortgage.<\/p>\n<p>At the state level, the <span data-term-id=\"58207324\">South Carolina<\/span> Senate passed legislation in February 2026 that would expand the property tax <span data-term-id=\"58207372\">homestead exemption<\/span> for homeowners 65 and older. Under the bill, the\u00a0<a href=\"https:\/\/www.scpolicycouncil.org\/s_c_senate_moves_to_expand_property_tax_homestead_exemption\" target=\"_blank\" rel=\"noopener\">exemption could increase<\/a>\u00a0from $50,000 to $75,000 or $150,000 of fair market value, depending on how long you\u2019ve lived in the state. The measure was sent to the House for consideration and had not been signed into law as of early 2026.<\/p>\n<p>This property tax exemption is separate from the bankruptcy <span data-term-id=\"58207372\">homestead exemption<\/span>, but the two are easy to mix up. Unless you have a strong background in financial law, a DIY bankruptcy is a bad idea.
