A list of qualified courses is available at the <a href=\"https:\/\/www.justice.gov\/ust\/list-credit-counseling-agencies-approved-pursuant-11-usc-111\" target=\"_blank\" rel=\"noopener\">U.S. Department of Justice<\/a> DOJ). Most can be completed online within a few hours.<\/p>\n<p>You can file for bankruptcy in <span data-term-id=\"58207539\">Utah<\/span> if you have lived there for at least 180 days. To use <span data-term-id=\"58207539\">Utah<\/span>&#8216;s exemptions, you must be a <span data-term-id=\"58207539\">Utah<\/span> resident with at least two years&#8217; residency.<\/p>\n<p>Most <span data-term-id=\"58207539\">Utah<\/span> debtors will file one of two <span data-term-id=\"58207551\">types of bankruptcy<\/span>. Let\u2019s examine each one.<\/p>\n<h3><span data-term-id=\"58207541\">Chapter 7 Bankruptcy<\/span><\/h3>\n<p>Also known as a \u201cliquidation bankruptcy,\u201d <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\">Chapter 7<\/a> is used when a debtor has mostly <span data-term-id=\"58207582\">unsecured debts<\/span> such as medical bills and <span data-term-id=\"58207555\">credit card<\/span> debt. In a Chapter 7, a <span data-term-id=\"58207554\">bankruptcy trustee<\/span> takes over your non-<span data-term-id=\"58207561\">exempt property<\/span> (called the \u201cbankruptcy estate\u201d) and sells it to repay your creditors. Any remaining debt is discharged by the <span data-term-id=\"58207545\">bankruptcy court<\/span>.<\/p>\n<p>To qualify for Chapter 7, debtors must pass a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\">means test<\/a>. If your income is below the median annual income for your area, you\u2019ll automatically qualify. The court will examine your living expenses and other factors in your case if your income is slightly above that level, but you have substantial debt.<\/p>\n<h3><span data-term-id=\"58207540\">Chapter 13 Bankruptcy<\/span><\/h3>\n<p>In a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\">Chapter 13<\/a>, or reorganization bankruptcy, you and the <span data-term-id=\"58207554\">bankruptcy trustee<\/span> develop a <span data-term-id=\"58207557\">repayment plan<\/span> to repay your secured creditors. Your debts are consolidated so that you only make one payment through the trustee. The payment plan lasts from three to five years. You must have a stable income sufficient to cover your living expenses and the payment plan for the duration of the plan.<\/p>\n<p><span data-term-id=\"58207540\">Chapter 13 bankruptcies<\/span> are ideal for homeowners who are behind on mortgages and need to pay off secured and <span data-term-id=\"58207563\">unsecured creditors<\/span> without losing their home. They are also used by debtors who have valuable non-<span data-term-id=\"58207561\">exempt property<\/span> they don\u2019t want to lose in a Chapter 7.<\/p>\n<p>To <span data-term-id=\"58207568\">file Chapter<\/span> 13, you cannot have more than $1,580,125 in secured debt and $526,700 in <span data-term-id=\"58207582\">unsecured debt<\/span>. These totals include current and past-due obligations.<\/p>\n<h3>Automatic Stay<\/h3>\n<p>Both <span data-term-id=\"58207551\">types of bankruptcy<\/span> have an <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\">automatic stay<\/a> that immediately halts collection actions against the debtor. The automatic stay is temporary, but acts as an emergency stop on:<\/p>\n<ul>\n<li><span data-term-id=\"58207575\">Foreclosure<\/span> and eviction actions<\/li>\n<li>Repossession<\/li>\n<li>Lien placement and wage <span data-term-id=\"58207570\">garnishment<\/span><\/li>\n<li>Phone calls and collection actions<\/li>\n<\/ul>\n<p>The automatic stay will not halt all actions, prevent an active <span data-term-id=\"58207575\">foreclosure<\/span>, or stop an eviction if a landlord has a judgment of removal. <span data-term-id=\"58207570\">Garnishment<\/span> for <span data-term-id=\"58207547\">child support<\/span> payments is also exempt. A creditor can ask the <span data-term-id=\"58207545\">bankruptcy court<\/span> to lift the stay by filing a motion for relief from the automatic stay, and the court may grant relief for &#8220;cause,&#8221; such as lack of adequate protection.<\/p>\n<p>If you file for Chapter 13, the stay remains in place as long as you are current on your <span data-term-id=\"58207557\">repayment plan<\/span>. The automatic stay gives debtors breathing room to continue pursuing their bankruptcy.<\/p>\n<h2><span data-term-id=\"58207542\">Utah<\/span><span data-term-id=\"58207542\"> Bankruptcy<\/span> Exemptions<\/h2>\n<p><span data-term-id=\"58207539\">Utah<\/span> is an \u201copt-out\u201d state, meaning that residents must use the state exemptions listed in the <span data-term-id=\"58207539\">Utah<\/span> Exemptions Act rather than the federal exemptions in the <span data-term-id=\"58207548\">Bankruptcy Code<\/span>. These include the following:<\/p>\n<h3><span data-term-id=\"58207576\">Utah<\/span><span data-term-id=\"58207576\"> Homestead Exemption<\/span><\/h3>\n<p>The <a href=\"https:\/\/www.findlaw.com\/state\/utah-law\/utah-homestead-laws.html\"><span data-term-id=\"58207576\">Utah<\/span><span data-term-id=\"58207576\"> homestead exemption<\/span><\/a> protects a homeowner\u2019s equity in their <span data-term-id=\"58207572\">primary residence<\/span>. The exact amount that can be exempted as of 2026 is $53,700 for an <span data-term-id=\"58207566\">individual debtor<\/span> and $107,400 for couples filing jointly. To qualify for the exemption, you must have lived in <span data-term-id=\"58207539\">Utah<\/span> for at least 730 days (two years).<\/p>\n<p>The values are adjusted annually according to the Consumer Price Index. Debtors should consult a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/utah\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207560\">bankruptcy attorney<\/span><\/a> before filing to confirm their total exemption amount.<\/p>\n<h3><span data-term-id=\"58207539\">Utah<\/span> Property Exemptions<\/h3>\n<p>The purpose of a Chapter 7 is to give debtors a chance to start over when the bankruptcy discharge is done. Debtors can exempt some <span data-term-id=\"58207552\">personal property<\/span> for this purpose. You usually keep your property in a Chapter 13, but exemptions and non-exempt value still matter. Your plan must pay <span data-term-id=\"58207563\">unsecured creditors<\/span> at least as much as they would receive in a Chapter 7 liquidation.<\/p>\n<p>Property exemptions may include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"58207587\">Real property<\/span> (not homestead property)<\/strong>: If you do not have a <span data-term-id=\"58207572\">primary residence<\/span>, you may claim up to $6,400 (in 2026) in other <span data-term-id=\"58207587\">real property<\/span><\/li>\n<li><strong><span data-term-id=\"58207583\">Motor vehicle<\/span> exemption<\/strong>: Up to $3,000 of vehicle equity, or $5,000 if the vehicle is a business or commercial vehicle (There is an unlimited exemption for vehicles modified for disabled individuals)<\/li>\n<li><strong>Household goods valued at $1,000 or less, such as clothing, furniture, appliances<\/strong>: Personal items like books, <span data-term-id=\"58207564\">musical instruments<\/span>, pets, etc.<\/li>\n<li><strong>Retirement accounts<\/strong>: Examples include defined contribution plans(IRAs), defined benefit plans (pensions), and college savings plans if they are worth less than $200,000<\/li>\n<li><strong>Burial plots<\/strong><\/li>\n<li><strong>Health aids necessary for healthcare and employment<\/strong><\/li>\n<li><strong>Public benefits, retirement funds, insurance payments, and <span data-term-id=\"58207588\">personal injury<\/span> settlements<\/strong><\/li>\n<li><strong>Up to 75% of your current wages<\/strong><\/li>\n<\/ul>\n<p>Valuable artwork and non-sentimental <span data-term-id=\"58207565\">heirlooms<\/span>, more than one firearm (of each type), and more than one residence cannot be exempted.<\/p>\n<h2>After the Bankruptcy<\/h2>\n<p>After filing for Chapter 7, any <span data-term-id=\"58207582\">unsecured debts<\/span> that cannot be paid off are discharged by the court. A Chapter 7 takes about three to six months to complete. You will lose any <span data-term-id=\"58207573\">non-exempt assets<\/span>.<\/p>\n<p>In Chapter 13, you have three to five years to pay off all secured creditors. If you stay current and make a good-faith effort to repay all debts, the court will discharge any remaining deficiencies.<\/p>\n<p>Some debts cannot be discharged in either <span data-term-id=\"58207551\">type of bankruptcy<\/span>. If debt remains after discharge or repayment, you must still pay it. Furthermore, they can only take your money and fill out forms. They cannot offer any advice. They certainly cannot provide legal representation.<\/p>\n<p>A partnership with a Utah bankruptcy lawyer is more expensive than a DIY or BPP filing. But the investment pays off. For example, an attorney can unlock some upper-level bankruptcy options which, in many cases, could save you thousands of dollars.
