Washington law allows you to eliminate some debts and protect assets while paying off creditors. Depending on the type of bankruptcy you choose, you may be able to keep most of your property while paying your debts, leaving you with a clean slate after the remainder are discharged.<\/p>\n<h2><span data-term-id=\"58207728\">Washington <\/span><span data-term-id=\"58207706\">Bankruptcy<\/span><span data-term-id=\"58207706\"> Law<\/span><\/h2>\n<p>Under <span data-term-id=\"58207743\">federal law<\/span>, the <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/\" target=\"_blank\" rel=\"noopener\">U.S. <span data-term-id=\"58207721\">Bankruptcy Code<\/span><\/a> governs bankruptcy. Most states have their own list of exemptions that state residents can use to protect their assets from creditors. Washington allows residents to choose between\u00a0federal\u00a0and\u00a0<span data-term-id=\"58207731\">state exemptions<\/span>\u00a0when\u00a0filing for\u00a0bankruptcy.<\/p>\n<p>To file for bankruptcy using <span data-term-id=\"58207707\">Washington <\/span><span data-term-id=\"58207731\">state<\/span><span data-term-id=\"58207731\"> exemptions<\/span>, debtors must have lived in the state for 730 days (two years). Otherwise, you must file through the state where you lived before moving to Washington. Filers always have the option of using <span data-term-id=\"58207752\">federal exemptions<\/span>.<\/p>\n<p>You must also complete a <span data-term-id=\"58207716\">credit counseling<\/span> course within 180 days of filing your <span data-term-id=\"58207730\">bankruptcy petition<\/span>. There is a list of approved courses at the Department of Justice <a href=\"https:\/\/www.justice.gov\/ust\/credit-counseling-debtor-education-information\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207734\">Bankruptcy Trustee<\/span> website<\/a>. After the bankruptcy is discharged, you must also take a financial management course.<\/p>\n<h2>Washington Consumer Bankruptcy<\/h2>\n<p>The type of bankruptcy you file determines the assets you can keep and how long your bankruptcy discharge takes. Two types of consumer bankruptcy are the most commonly used. The one you choose depends on your income and whether you have <span data-term-id=\"58207754\">non-exempt assets<\/span> you want to keep.<\/p>\n<h3><span data-term-id=\"58207704\">Chapter 7 Bankruptcy<\/span><\/h3>\n<p>In a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\"><span data-term-id=\"58207704\">Chapter 7 bankruptcy<\/span><\/a>, also called a <span data-term-id=\"58207750\">liquidation<\/span><span data-term-id=\"58207750\"> bankruptcy<\/span>, the <span data-term-id=\"58207734\">bankruptcy trustee<\/span> takes charge of your property. They\u2019ll sell any <span data-term-id=\"58207754\">non-exempt assets<\/span> to pay your creditors, while you keep all exempt assets and property.<\/p>\n<p>To qualify for a Chapter 7, you must pass a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\"><span data-term-id=\"58207741\">means test<\/span><\/a>. If your income is below Washington\u2019s median annual income, you automatically qualify for a Chapter 7. If not, the courts look at your total debt and disposable income. If your debt load is higher than you can reasonably pay, you may still qualify for a Chapter 7.<\/p>\n<h3><span data-term-id=\"58207711\">Chapter 13 Bankruptcy<\/span><\/h3>\n<p>A <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\"><span data-term-id=\"58207711\">Chapter 13 bankruptcy<\/span><\/a>, or reorganization bankruptcy, lets people who have a steady income create a <span data-term-id=\"58207738\">repayment plan<\/span> for their debts. Under a Chapter 13, debtors work with the trustee to consolidate their debts and pay them off over a period of three to five years. At the end of the repayment period, any remaining debts may be discharged by the court.<\/p>\n<p><span data-term-id=\"58207711\">Chapter 13 bankruptcies<\/span> are preferred by debtors who have valuable <span data-term-id=\"58207754\">non-exempt assets<\/span> and people who have fallen behind on mortgages because of other <span data-term-id=\"58207724\">unsecured debt<\/span> and need to erase <span data-term-id=\"58207747\">dischargeable debt<\/span> while keeping their property. To qualify, you must have a steady income and enough disposable income to make regular <span data-term-id=\"58207755\">monthly payments<\/span> to your creditors while meeting all your living expenses.<\/p>\n<h3><span data-term-id=\"58207727\">Automatic Stay<\/span><\/h3>\n<p>As soon as you file either of these <span data-term-id=\"58207730\">bankruptcy petitions<\/span>, an <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><span data-term-id=\"58207727\">automatic stay<\/span><\/a> goes into effect. The stay halts all creditor collection activities, including <span data-term-id=\"58207709\">foreclosures<\/span>, <span data-term-id=\"58207753\">wage garnishment<\/span>, and lawsuits.<\/p>\n<p>The stay is not permanent. A creditor can file a Motion for Relief from the <span data-term-id=\"58207727\">Automatic Stay<\/span> to bypass it. In a Chapter 7, the stay gives debtors some breathing room to begin the <span data-term-id=\"58207735\">bankruptcy process<\/span>. In a Chapter 13, the stay lasts throughout the repayment period as long as you remain current on your payments.<\/p>\n<p>The stay will not stop all creditor actions or prevent <span data-term-id=\"58207753\">wage garnishment<\/span> for <span data-term-id=\"58207712\">child support<\/span> and <span data-term-id=\"58207762\">alimony<\/span>. It provides some space to begin the <span data-term-id=\"58207735\">bankruptcy process<\/span> and ends harassing phone calls and emails.<\/p>\n<h2><span data-term-id=\"58207728\">Washington <\/span><span data-term-id=\"58207719\">Bankruptcy<\/span><span data-term-id=\"58207719\"> Exemptions<\/span><\/h2>\n<p><a href=\"https:\/\/codes.findlaw.com\/wa\/title-6-enforcement-of-judgments\/wa-rev-code-6-15-010\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207763\">Washington exemptions<\/span><\/a> allow debtors to protect their property up to the value listed in the statutes. These values are amended periodically. Debtors should consider consulting a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/washington\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207715\">bankruptcy lawyer<\/span><\/a> when filing for bankruptcy to ensure they receive all of the exemptions they qualify for. Washington lets <span data-term-id=\"58207742\">married couples<\/span> filing jointly double the <span data-term-id=\"58207731\">state exemptions<\/span> for their exempt property.<\/p>\n<h3><span data-term-id=\"58207714\">Homestead Exemption<\/span><\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/washington-law\/washington-homestead-laws.html\">Washington\u2019s <span data-term-id=\"58207714\">homestead exemption<\/span><\/a> applies to any \u201creal or <span data-term-id=\"58207723\">personal property<\/span> \u2026 used as a residence.\u201d The value of the <span data-term-id=\"58207714\">homestead exemption<\/span> is the greater of the following:<\/p>\n<ul>\n<li>$125,000<\/li>\n<li>The county median sale price of a single-family home in the preceding year<\/li>\n<\/ul>\n<p>The <span data-term-id=\"58207714\">homestead exemption<\/span> applies to the equity in the home, not to the market value of the home.<\/p>\n<h3>Property Exemptions<\/h3>\n<p>Property exemption values vary. Filers should always consider getting <span data-term-id=\"58207744\">legal advice<\/span> before calculating their property exemptions in bankruptcy. As of 2026, you can include these on your petition:<\/p>\n<ul>\n<li>One motor vehicle to the value of $15,000<\/li>\n<li><span data-term-id=\"58207748\">Household goods<\/span> to the value of $6500<\/li>\n<li>Clothing including up to $3500 of jewels and furs<\/li>\n<li>Personal electronics, computers, and cell phones<\/li>\n<li>Up to 75% of weekly disposable income<\/li>\n<li>Pensions, <span data-term-id=\"58207761\">retirement accounts<\/span>, public benefits, <span data-term-id=\"58207712\">child support<\/span> payments<\/li>\n<li>\u201cTools of the trade\u201d exemption to the value of $15,000<\/li>\n<li>A <span data-term-id=\"58207759\">wildcard<\/span> exemption, which allows you to exempt up to $10,000 in other <span data-term-id=\"58207723\">personal property<\/span> that doesn\u2019t fit into one of the other categories<\/li>\n<\/ul>\n<p>Knowing which exemptions you may qualify for can be confusing. If you feel like you\u2019re in over your head, there\u2019s no shame in speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/washington\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58207717\">bankruptcy attorney<\/span><\/a> for assistance.<\/p>\n<h2>Effects of <span data-term-id=\"58207720\">Filing Bankruptcy<\/span><\/h2>\n<p><span data-term-id=\"58207720\">Filing bankruptcy<\/span> can eliminate some <span data-term-id=\"58207757\">types of debts<\/span>, but not all. A Chapter 7 will remove most <span data-term-id=\"58207724\">unsecured debt<\/span>, such as:<\/p>\n<ul>\n<li><span data-term-id=\"58207739\">Credit card<\/span><span data-term-id=\"58207739\"> debt<\/span><\/li>\n<li><span data-term-id=\"58207745\">Medical bills<\/span><\/li>\n<li>Personal loans<\/li>\n<\/ul>\n<p>Chapter 7 will not discharge <span data-term-id=\"58207732\">secured debts<\/span>, which are those that have a lien against the property. A <span data-term-id=\"58207704\">Chapter 7 bankruptcy<\/span> cannot stop collection for:<\/p>\n<ul>\n<li><span data-term-id=\"58207729\">Student loans<\/span> (with some exceptions)<\/li>\n<li><span data-term-id=\"58207712\">Child support<\/span> and <span data-term-id=\"58207762\">alimony<\/span> arrears<\/li>\n<li><span data-term-id=\"58207709\">Foreclosure<\/span> and <span data-term-id=\"58207736\">repossession<\/span><\/li>\n<\/ul>\n<p>In a Chapter 13, <span data-term-id=\"58207732\">secured debts<\/span> are part of your <span data-term-id=\"58207740\">payment plan<\/span>. When your <span data-term-id=\"58207740\">payment plan<\/span> is complete, you should have paid off most of your debts.<\/p>\n<p>Filing for bankruptcy will have a negative effect on your credit rating. How long that lasts depends on the type you filed and if you met all of your requirements. It will be possible for you to rebuild your credit as time passes.<\/p>\n<h2>Get <span data-term-id=\"58207744\">Legal Advice<\/span> From a <span data-term-id=\"58207728\">Washington <\/span><span data-term-id=\"58207717\">Bankruptcy<\/span><span data-term-id=\"58207717\"> Attorney<\/span><\/h2>\n<p>If you\u2019re considering <span data-term-id=\"58207720\">filing bankruptcy<\/span>, speaking with an attorney is a good idea. Exemption values are subject to change. An attorney or bankruptcy accountant can ensure you have the correct amount.<\/p>\n<p>The rules about transferring property before <span data-term-id=\"58207720\">filing bankruptcy<\/span> are strict. An attorney can offer <span data-term-id=\"58207744\">legal advice<\/span> about exempt and <span data-term-id=\"58207758\">non-exempt property<\/span>, appear with you at the creditors\u2019 meeting, and help negotiate with creditors during the <span data-term-id=\"58207735\">bankruptcy process<\/span>. <span data-term-id=\"58207705\">Bankruptcy courts<\/span> have local rules as well as state and federal regulations.
