It only takes about three to six months to complete a <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span>, whereas it takes anywhere from three to five years to complete a <span data-term-id=\"58266020\">Chapter 13 bankruptcy<\/span> plan.<\/p>\n<p>As soon as the court receives your <span data-term-id=\"58266014\">Chapter 7 <\/span><span data-term-id=\"58266052\">bankruptcy<\/span><span data-term-id=\"58266052\"> petition<\/span>, the <span data-term-id=\"58266028\">automatic stay<\/span> goes into effect. That\u2019s not always the case. There\u2019s a good chance you can begin opening new accounts again within one to three years of your discharge. A <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> will damage your credit initially, but the <span data-term-id=\"58266015\">fresh start<\/span> often allows you to rebuild your credit faster than you would if you were still struggling with unpaid debts. While difficult, it&#8217;s not impossible in cases of severe permanent disability or other extreme circumstances. Still, don\u2019t plan on being successful if you try.<\/p>\n<h3>No Debt Limits<\/h3>\n<p>There is no limit to how much secured and <span data-term-id=\"58266022\">unsecured debt<\/span> you can include in a <span data-term-id=\"58266014\">Chapter 7 <\/span><span data-term-id=\"58266021\">bankruptcy<\/span><span data-term-id=\"58266021\"> filing<\/span>. This isn\u2019t the case with Chapter 13. Under a reorganization bankruptcy, you cannot have more than $1,580,125 in <span data-term-id=\"58266023\">secured debt<\/span> and $526,700 in <span data-term-id=\"58266022\">unsecured debt<\/span>.<\/p>\n<h2>Disadvantages of <span data-term-id=\"58266014\">Chapter 7 Bankruptcy<\/span><\/h2>\n<p>There are many benefits of filing a <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span>. As with most <span data-term-id=\"58266076\">legal processes<\/span>, there are disadvantages as well. Be sure to weigh the pros and the cons of this <span data-term-id=\"58266043\">type of bankruptcy<\/span> before you file your petition. Here are some negative aspects to consider.<\/p>\n<h3>Long-Term Credit Impact<\/h3>\n<p>A <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> will stay on your <span data-term-id=\"58266026\">credit report<\/span> for up to ten years. This is longer than Chapter 13, which remains for seven years. Future <span data-term-id=\"58266047\">lenders<\/span>, landlords, and even potential employers will see the bankruptcy on your record and may hold it against you.<\/p>\n<h3>Potential Loss of Property<\/h3>\n<p>Depending on how much equity you have in your property, you may not be able to save it. Certain property is non-exempt from sale by the <span data-term-id=\"58266029\">bankruptcy trustee<\/span>, such as luxury possessions. If you have a lot of equity in your home, the trustee may sell it to pay your creditors.<\/p>\n<h3><span data-term-id=\"58266016\">Credit Card<\/span> Closures<\/h3>\n<p>Once you file your <span data-term-id=\"58266014\">Chapter 7 <\/span><span data-term-id=\"58266052\">bankruptcy<\/span><span data-term-id=\"58266052\"> petition<\/span>, you will not be able to use your <span data-term-id=\"58266016\">credit cards<\/span>. The <span data-term-id=\"58266016\">credit card<\/span> companies will close any accounts you include in your bankruptcy. You can apply for new cards after your bankruptcy, but it may take a while. Banks are reluctant to approve <span data-term-id=\"58266016\">credit cards<\/span>, loans, and lines of credit for people who have recently filed bankruptcy.<\/p>\n<p>It\u2019s often harder to get new <span data-term-id=\"58266016\">credit cards<\/span> with a Chapter 7 on your <span data-term-id=\"58266026\">credit report<\/span> than with a Chapter 13. <span data-term-id=\"58266047\">Lenders<\/span> would rather provide credit to people who paid their debts back through Chapter 13 when compared to debtors who discharged their debts.<\/p>\n<h3>Difficulty Getting a Mortgage<\/h3>\n<p>Unless you already have an open home loan, <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> will make it nearly impossible to get a mortgage until you begin rebuilding your credit. Most conventional <span data-term-id=\"58266047\">lenders<\/span> require that you wait two to four years post-discharge before applying for a mortgage.<\/p>\n<h3>Waiting Period Between Filings<\/h3>\n<p>Declaring bankruptcy now might make it harder to file later if your <span data-term-id=\"58266059\">financial situation<\/span> worsens. You can&#8217;t file another <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> for at least eight years from your previous filing date.<\/p>\n<h3>Support Obligations Not Discharged<\/h3>\n<p><span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> will not relieve you of your domestic support obligations such as <span data-term-id=\"58266034\">alimony<\/span> or <span data-term-id=\"58266027\">child support<\/span>. These debts survive bankruptcy and must continue to be paid. It takes a family court order to suspend an <span data-term-id=\"58266034\">alimony<\/span> or <span data-term-id=\"58266027\">child support<\/span> obligation.<\/p>\n<h3><span data-term-id=\"58266032\">Student Loans<\/span> Not Dischargeable<\/h3>\n<p>As a general rule, you can&#8217;t discharge <span data-term-id=\"58266032\">student loans<\/span> in bankruptcy. <span data-term-id=\"58266032\">Student loan<\/span> debt requires a separate adversary proceeding and proof of <span data-term-id=\"58266070\">undue hardship<\/span>, which courts interpret very strictly. There is also a very high chance that the <span data-term-id=\"58266032\">student loan<\/span> company will object to the discharge of your loans.<\/p>\n<h3>You Must Pay Your <span data-term-id=\"58266023\">Secured Debts<\/span> To Keep Property<\/h3>\n<p>To keep your collateral, you may still have to pay some of your debts, such as a mortgage lien. This process is called reaffirmation, and you will remain personally liable for these debts even after bankruptcy.<\/p>\n<h2>How Does a <span data-term-id=\"58266014\">Chapter 7 Bankruptcy<\/span> Work?<\/h2>\n<p>Before deciding whether the pros outweigh the cons, it&#8217;s essential to understand the basics of how <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> works. People file a <span data-term-id=\"58266014\">Chapter 7 bankruptcy<\/span> to get rid of debts they can&#8217;t pay. If there&#8217;s no objection to your petition, the <span data-term-id=\"58266038\">bankruptcy court<\/span> will discharge your debts.
