We break down these prohibitions by public and private employers below.<\/p>\n<h3>Public Employers<\/h3>\n<p>Solely due to your bankruptcy, government employers may not do any of the following:<\/p>\n<ul>\n<li>Fire you<\/li>\n<li>Refuse to hire you<\/li>\n<li>Deny you a promotion or benefits<\/li>\n<li>Otherwise <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/employment-discrimination.html\">discriminate with respect to employment<\/a> (like demoting you, cutting your pay, reducing your hours, disciplining you, or taking any other adverse action)<\/li>\n<\/ul>\n<p>Federal policy also prohibits denying or revoking a security clearance solely because of bankruptcy. While security clearance investigators may request an explanation, bankruptcy itself rarely results in a clearance denial.<\/p>\n<h3>Private Employers<\/h3>\n<p>Private employers have a bit more flexibility. Regardless, a private employer cannot, solely because of your bankruptcy:<\/p>\n<ul>\n<li>Fire you<\/li>\n<li>Otherwise discriminate with respect to employment (like demoting you, cutting your pay, reducing your hours, disciplining you, or taking any other adverse action)<\/li>\n<\/ul>\n<p>Most <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/us-federal-court-system.html\"><span data-term-id=\"58334975\">federal courts<\/span><\/a> have ruled that this doesn\u2019t protect job applicants; it only protects existing employees. As such, the breakdown below represents what housing providers can and can\u2019t do under federal law.<\/p>\n<h3>Private Landlords<\/h3>\n<p>Because bankruptcy status isn\u2019t a protected category under<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-federal-laws.html\"> federal housing law<\/a>, private landlords are free to consider it as they see fit. This means that they may:<\/p>\n<ul>\n<li>Refuse to rent to someone because they filed for bankruptcy<\/li>\n<li>Refuse to renew a lease because of bankruptcy<\/li>\n<li>Deny an application because of a low <span data-term-id=\"58334932\">credit score<\/span> caused by bankruptcy<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/eviction.html\">File an eviction<\/a> because of a past bankruptcy (if state law allows no\u2011fault evictions, as most states do)<\/li>\n<\/ul>\n<p>During an active <span data-term-id=\"58334920\">bankruptcy case<\/span>, a private landlord often can\u2019t start or continue an eviction unless they have already obtained a judgment for possession before you filed. However, they can file a motion for relief from the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\"><span data-term-id=\"58334933\">automatic stay<\/span><\/a>. <span data-term-id=\"58334926\">Bankruptcy courts<\/span> often grant these motions, particularly if you\u2019re not paying rent during the case.<\/p>\n<h3>Government-Subsidized Housing<\/h3>\n<p>Providers of government housing in certain jurisdictions often may not deny someone housing solely because of a bankruptcy. They include:<\/p>\n<ul>\n<li>A public housing authority<\/li>\n<li>A government-run housing program<\/li>\n<li>A government agency administering rental assistance<\/li>\n<\/ul>\n<p>Regardless, finding rental housing can be more difficult after a Chapter 7. To allay a housing provider\u2019s concerns, you may <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/rent-security-deposits.html\">offer a larger deposit<\/a>, provide proof of steady income, or provide references.<\/p>\n<h3>Homeowners<\/h3>\n<p>If you were facing <a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure.html\"><span data-term-id=\"58334963\">foreclosure<\/span><\/a> before filing, the <span data-term-id=\"58334933\">automatic stay<\/span> may have delayed it.
