They\u2019ll review your financial situation and advise you on how best to proceed.<\/p>\n<h2><span data-term-id=\"58225408\">Bankruptcy Basics<\/span>: Chapter 7 vs Chapter 13<\/h2>\n<p>People often file for <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\"><span data-term-id=\"58225377\">Chapter 7 bankruptcy<\/span><\/a> to get rid of their debts and enjoy a <span data-term-id=\"58225389\">fresh start<\/span>. In most <span data-term-id=\"58225377\">Chapter 7 <\/span><span data-term-id=\"58225384\">bankruptcy<\/span><span data-term-id=\"58225384\"> cases<\/span>, the debtor has significant <span data-term-id=\"58225415\">credit card<\/span><span data-term-id=\"58225415\"> debt<\/span>, <span data-term-id=\"58225417\">medical bills<\/span>, and other <span data-term-id=\"58225392\">unsecured debt<\/span>. At the end of their bankruptcy, the trustee or bankruptcy judge discharges most, if not all, of this debt.<\/p>\n<p>Debtors who file a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58225393\">Chapter 13 bankruptcy<\/span><\/a> are interested in reorganizing or restructuring their debt, not eliminating it. This is usually because the individual has a home they want to keep or other valuable personal property. At the completion of a Chapter 13 <span data-term-id=\"58225410\">repayment plan<\/span>, the person still owes their debts, but they are in a much better position to manage their monthly payments.<\/p>\n<p>If you&#8217;re overwhelmed by debt and don\u2019t have much in the way of real estate or personal property, Chapter 7 may be your best option. If the\u00a0<span data-term-id=\"58225418\">bankruptcy trustee<\/span>\u00a0approves your filing, the\u00a0<span data-term-id=\"58225378\">bankruptcy court<\/span>\u00a0will discharge the debts you listed on your bankruptcy schedule, and you will emerge debt-free.<\/p>\n<p>If you do pursue a <span data-term-id=\"58225377\">Chapter 7 <\/span><span data-term-id=\"58225384\">bankruptcy<\/span><span data-term-id=\"58225384\"> case<\/span>, you must pay the requisite <span data-term-id=\"58225422\">filing fee<\/span>. Fees change periodically, but you should expect to pay around $350. If you cannot afford to pay the fee in full, you can request a fee waiver or pay it in <span data-term-id=\"58225424\">installments<\/span>.<\/p>\n<p>You must also submit proof that you attended a mandatory <span data-term-id=\"58225423\">credit counseling<\/span> course within 180 days of filing your bankruptcy.<\/p>\n<h2>What Is a Chapter 7 Debt Discharge?<\/h2>\n<p>A <span data-term-id=\"58225377\">Chapter 7 <\/span><span data-term-id=\"58225390\">bankruptcy<\/span><span data-term-id=\"58225390\"> discharge<\/span> is a permanent court order banning <span data-term-id=\"58225406\">lenders<\/span> from taking <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/debt-collection-laws.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58225414\">collection action<\/span><\/a> on debts you included in your <span data-term-id=\"58225435\">bankruptcy petition<\/span>. Furthermore, creditors can no longer negatively report the account on your credit report.<\/p>\n<p>A <span data-term-id=\"58225390\">bankruptcy discharge<\/span> prevents creditors from engaging in the following:<\/p>\n<ul>\n<li>\n<p>Making collection calls<\/p>\n<\/li>\n<li>\n<p>Issuing a wage <span data-term-id=\"58225434\">garnishment<\/span><\/p>\n<\/li>\n<li>\n<p>Sending dunning or demand letters<\/p>\n<\/li>\n<li>\n<p>Charging a debtor interest or late fees<\/p>\n<\/li>\n<li>\n<p>Reporting an open balance on a discharged account<\/p>\n<\/li>\n<li>\n<p>Reporting the status of an account as anything other than \u201cDischarged in Bankruptcy\u201d<\/p>\n<\/li>\n<\/ul>\n<p>If you notice that one of your creditors does any of the above either during bankruptcy proceedings or after your case is closed, let your <span data-term-id=\"58225387\">bankruptcy attorney<\/span> know immediately. This is a violation of the <span data-term-id=\"58225397\">bankruptcy laws<\/span>, the Fair Credit Reporting Act (FCRA), and the Fair Debt Collection Practices Act (FDCPA).<\/p>\n<p>Once the <span data-term-id=\"58225378\">bankruptcy court<\/span> discharges your <span data-term-id=\"58225401\">Chapter 7 case<\/span>, your delinquent accounts will change to \u201cDischarged in Bankruptcy\u201d status on your credit report. Of course, when <span data-term-id=\"58225406\">lenders<\/span> see this on your credit history, they may be reluctant to loan you money. However, over time, you will begin rebuilding your credit and, hopefully, find yourself in a much better financial position.<\/p>\n<h2>When Does the Discharge Happen?<\/h2>\n<p>The <span data-term-id=\"58225399\">bankruptcy process<\/span> can take time. It&#8217;s not just a matter of filing paperwork with the court. Depending on the <span data-term-id=\"58225411\">type of <\/span><span data-term-id=\"58225384\">bankruptcy<\/span><span data-term-id=\"58225384\"> case<\/span> you file, it may take months or even a year to resolve. This means the timing of your <span data-term-id=\"58225390\">bankruptcy discharge<\/span> varies.<\/p>\n<p>In a <span data-term-id=\"58225440\">liquidation<\/span> <span data-term-id=\"58225384\">bankruptcy<\/span><span data-term-id=\"58225384\"> case<\/span>, the court usually grants the discharge promptly after one of the two following events:<\/p>\n<ul>\n<li>\n<p>The time limit for creditors to object to bankruptcy passes<\/p>\n<\/li>\n<li>\n<p>The deadline for creditors to file a motion to dismiss your case for substantial abuse has passed<\/p>\n<\/li>\n<\/ul>\n<p>In most cases, your creditors have 60 days from the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/what-happens-when-you-file-for-bankruptcy.html\" target=\"_blank\" rel=\"noopener\">First Meeting of Creditors<\/a> to challenge the discharge or file a motion to dismiss.<\/p>\n<p>Most <span data-term-id=\"58225377\">Chapter 7 <\/span><span data-term-id=\"58225391\">bankruptcy<\/span><span data-term-id=\"58225391\"> filings<\/span> are completed within three to four months. However, some cases take longer. For example, if the trustee has to investigate your assets, it may delay your discharge. The same thing may happen if your creditors challenge your ability to include their debts in your <span data-term-id=\"58225435\">bankruptcy petition<\/span>.<\/p>\n<h2>Which Debts Are Dischargeable in <span data-term-id=\"58225377\">Chapter 7 Bankruptcy<\/span>?<\/h2>\n<p>When you file your <span data-term-id=\"58225435\">bankruptcy petition<\/span>, you must attach schedules of your debts and assets. The different types of schedules are as follows:<\/p>\n<ul>\n<li>\n<p><strong>Schedule D: <\/strong>Creditors with secured claims (mortgages, <span data-term-id=\"58225431\">car loans<\/span>, etc.)<\/p>\n<\/li>\n<li>\n<p><strong>Schedule E: <\/strong>Creditors holding priority <span data-term-id=\"58225392\">unsecured debts<\/span> (recent <span data-term-id=\"58225396\">tax debt<\/span>, <span data-term-id=\"58225379\">child support<\/span>, etc.)<\/p>\n<\/li>\n<li>\n<p><strong>Schedule F:<\/strong> Non-priority unsecured claimants (<span data-term-id=\"58225415\">credit card<\/span><span data-term-id=\"58225415\"> debt<\/span>, <span data-term-id=\"58225388\">personal loans<\/span>, <span data-term-id=\"58225417\">medical bills<\/span>, etc.)<\/p>\n<\/li>\n<\/ul>\n<p>Some of the more common types of <span data-term-id=\"58225380\">dischargeable debts<\/span> include:<\/p>\n<ul>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/can-filing-for-bankruptcy-clear-credit-card-debt.html\"><span data-term-id=\"58225415\">Credit card<\/span><span data-term-id=\"58225415\"> debt<\/span><\/a><\/p>\n<\/li>\n<li>\n<p>Unsecured <span data-term-id=\"58225388\">personal loans<\/span><\/p>\n<\/li>\n<li>\n<p><span data-term-id=\"58225430\">Payday loans<\/span><\/p>\n<\/li>\n<li>\n<p><span data-term-id=\"58225436\">Past-due<\/span> <span data-term-id=\"58225429\">utility bills<\/span><\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/can-you-clear-medical-debt-in-bankruptcy.html\"><span data-term-id=\"58225417\">Medical bills<\/span><\/a><\/p>\n<\/li>\n<\/ul>\n<p>Unless there are special circumstances, the trustee should have no problem discharging the above debts in your <span data-term-id=\"58225377\">Chapter 7 <\/span><span data-term-id=\"58225384\">bankruptcy<\/span><span data-term-id=\"58225384\"> case<\/span>.<\/p>\n<p>Generally, the debts included on your Schedule F are dischargeable. For people who file <span data-term-id=\"58225377\">Chapter 7 bankruptcy<\/span>, these make up a lion\u2019s share of their debt. Debts that fall under Schedules D and E are <span data-term-id=\"58225386\">non-dischargeable<\/span>.<\/p>\n<h2>Debts That Cannot Be Discharged<\/h2>\n<p>According to <span data-term-id=\"58225397\">bankruptcy law<\/span>, there are certain <span data-term-id=\"58225383\">types of debts<\/span> that you cannot include in your <span data-term-id=\"58225435\">bankruptcy petition<\/span>. Even if you do include them on your schedule, the trustee will likely either tell you to amend your petition or convert your case to a <span data-term-id=\"58225393\">Chapter 13 bankruptcy<\/span>.<\/p>\n<p>There are 19 separate categories of <span data-term-id=\"58225420\">nondischargeable<\/span><span data-term-id=\"58225420\"> debt<\/span>. Some of these are always <span data-term-id=\"58225386\">nondischargeable<\/span> while others become <span data-term-id=\"58225386\">nondischargeable<\/span> if a creditor objects to the discharge.<\/p>\n<p>Below we look at the types of <span data-term-id=\"58225420\">non-<\/span><span data-term-id=\"58225380\">dischargeable<\/span><span data-term-id=\"58225420\"> debts<\/span> in more detail.<\/p>\n<h3>Debts That Are Always <span data-term-id=\"58225386\">Non-Dischargeable<\/span><\/h3>\n<p>When the <span data-term-id=\"58225418\">bankruptcy trustee<\/span> reviews your schedules and lists of debts, they will highlight any\u00a0<span data-term-id=\"58225420\">nondischargeable<\/span><span data-term-id=\"58225420\"> debts<\/span>. They will notify your\u00a0<span data-term-id=\"58225387\">bankruptcy attorney<\/span>\u00a0of these debts and give you the opportunity to refile your\u00a0<span data-term-id=\"58225384\">bankruptcy case<\/span>\u00a0without them listed on your schedules.<\/p>\n<p>You may also have the option to convert your\u00a0<span data-term-id=\"58225401\">Chapter 7 case<\/span>\u00a0to a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-bankruptcy-law-checklist.html\"><span data-term-id=\"58225393\">Chapter 13 <\/span><span data-term-id=\"58225384\">bankruptcy<\/span><span data-term-id=\"58225384\"> case<\/span><\/a>. While this may be a good option if you have exempt assets, it may not be a workable solution for you, depending on the amount of debt you owe and your ability to commit to a Chapter 13 <span data-term-id=\"58225441\">payment plan<\/span>.<\/p>\n<p>The debts that are almost always <span data-term-id=\"58225386\">nondischargeable<\/span> in a <span data-term-id=\"58225377\">Chapter 7 bankruptcy<\/span> include the following:<\/p>\n<ul>\n<li>\n<p><span data-term-id=\"58225382\">Alimony<\/span> and <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-and-bankruptcy.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58225379\">child support<\/span><\/a><\/p>\n<\/li>\n<li>\n<p>Certain <span data-term-id=\"58225396\">tax debts<\/span> (especially <span data-term-id=\"58225396\">tax debts<\/span> that are less than two years old)<\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/student-loan-relief-and-bankruptcy.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58225385\">Student loans<\/span><\/a> (unless you can prove an <span data-term-id=\"58225405\">undue hardship<\/span>, which is usually denied)<\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p>Debts you owe from a <span data-term-id=\"58225398\">personal injury<\/span> lawsuit involving DUI<\/p>\n<\/li>\n<li>\n<p>Criminal restitution<\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/divorce\/spousal-support-alimony-basics.html\" target=\"_blank\" rel=\"noopener\">Spousal maintenance<\/a> (<span data-term-id=\"58225382\">alimony<\/span>)<\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p>Debts arising out of fraud or some other crime<\/p>\n<\/li>\n<li>\n<p>Debts you do not list when you file your <span data-term-id=\"58225435\">bankruptcy petition<\/span><\/p>\n<\/li>\n<\/ul>\n<p>You must repay these debts in accordance with state and federal law.<\/p>\n<h3>Debts That May Be <span data-term-id=\"58225386\">Non-Dischargeable<\/span> If a Creditor Objects<\/h3>\n<p>While the above debts are almost always <span data-term-id=\"58225386\">nondischargeable<\/span>, other\u00a0<span data-term-id=\"58225383\">types of debt<\/span> may become <span data-term-id=\"58225386\">nondischargeable<\/span> if the creditor objects to their discharge.<\/p>\n<p>At some point during your bankruptcy proceedings, you must attend something called the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/what-is-a-341-meeting-in-bankruptcy.html\">341 Meeting of Creditors<\/a>. This is where the trustee and your creditors may ask you questions about your finances and the debts you are seeking to have discharged by the court.<\/p>\n<p>During this hearing, a creditor may object to the discharge of their debt. If they do challenge your discharge, they must do so in a separate <span data-term-id=\"58225426\">adversary proceeding<\/span>.<\/p>\n<p>Objections to discharge are more common with the following types of financial obligations:<\/p>\n<ul>\n<li>\n<p>Debts resulting from fraud<\/p>\n<\/li>\n<li>\n<p>Income tax (depends on the individual&#8217;s circumstances)<\/p>\n<\/li>\n<li>\n<p>Certain debts for luxury goods or services bought 90 days before filing<\/p>\n<\/li>\n<li>\n<p>Certain cash advances taken within 70 days of filing<\/p>\n<\/li>\n<li>\n<p>Debts from willful and malicious acts<\/p>\n<\/li>\n<li>\n<p>Debts from willful and malicious injury to property<\/p>\n<\/li>\n<li>\n<p>Debts from embezzlement, theft, or breach of fiduciary duty<\/p>\n<\/li>\n<li>\n<p>Debts from a divorce settlement or court decree where the detriment to the recipient would be greater than the benefit to you<\/p>\n<\/li>\n<\/ul>\n<p>Your <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/before-you-file\/attorney-intake-questionnaire-hiring-a-bankruptcy-attorney.html\"><span data-term-id=\"58225432\">bankruptcy lawyer<\/span><\/a> can challenge these objections and will, as long as there are grounds to do so. This is why it\u2019s so important to have a lawyer review your <span data-term-id=\"58225435\">bankruptcy petition<\/span> before you submit it to the court. They\u2019ll look for any questionable debts and discuss your options.<\/p>\n<h3><span data-term-id=\"58225431\">Car Loans<\/span> and Other <span data-term-id=\"58225394\">Secured Debts<\/span><\/h3>\n<p>Typically, the court will not allow you to discharge <span data-term-id=\"58225394\">secured debts<\/span>, such as your <span data-term-id=\"58225431\">car loan<\/span>. However, there are times when the trustee and judge agree to discharge a <span data-term-id=\"58225394\">secured debt<\/span>. This rarely occurs, and you will have to make certain concessions to make it happen.<\/p>\n<p>With a <span data-term-id=\"58225431\">car loan<\/span>, for example, the court may agree to discharge the balance on your loan, but in exchange you will have to surrender the vehicle through voluntary <span data-term-id=\"58225413\">repossession<\/span>. Or you may be able to keep your car if the <span data-term-id=\"58225406\">lender<\/span> allows you to enter a <span data-term-id=\"58225433\">reaffirmation agreement<\/span>.<\/p>\n<h2><span data-term-id=\"58225433\">Reaffirmation Agreements<\/span><\/h2>\n<p>Sometimes, a bankruptcy <span data-term-id=\"58225419\">filer<\/span> wishes to keep a piece of property, such as their car, despite filing for bankruptcy. Perhaps you need your vehicle to get back and forth to work. Or you may want to keep your car for convenience&#8217;s sake or sentimental reasons.<\/p>\n<p>If this is the case, you can ask the creditor for a <span data-term-id=\"58225433\">reaffirmation agreement<\/span>.
