Your proposed plan must include a fixed monthly amount you will pay\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/what-is-a-trustee-in-bankruptcy-.html\">the trustee<\/a>.<\/p>\n<p>You must start payments within 30 days of filing,\u00a0regardless of whether\u00a0your plan has been\u00a0confirmed by then.\u00a0After confirmation, the trustee will\u00a0disburse your payments to the creditors according to the terms in your approved plan.<\/p>\n<p>This will continue until you have completed your payments. Once the court approves your plan, you must adhere to the payment\u00a0payments. The judge will include a copy of your repayment plan with your\u00a0confirmation order.<\/p>\n<h2>Types of Creditors&#8217; Claims To Include in Your Chapter 13 Plan<\/h2>\n<p>Filing for bankruptcy is one way to rework your finances or\u00a0reorganize your debt. If you&#8217;re looking for a fresh start\u00a0where the U.S. Bankruptcy Court will discharge most of your debt,\u00a0a\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\">Chapter 7 bankruptcy case<\/a>\u00a0might be what you need.<\/p>\n<p>To keep your assets and repay your debts over time, you&#8217;ll want to file a Chapter 13 bankruptcy case. In a\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/filing-for-chapter-13.html\">Chapter 13 bankruptcy<\/a>, you must include all your debts and propose repayment to all of your creditors.<\/p>\n<p>How you propose to\u00a0<a href=\"https:\/\/corporate.findlaw.com\/finance\/bankruptcy-and-the-secured-creditor.html\" target=\"_blank\" rel=\"noopener\">pay your creditors<\/a>\u00a0depends mainly on what type of debt you owe. In bankruptcy, there are three types of claims:<\/p>\n<ul>\n<li><strong data-redactor-tag=\"strong\" data-verified=\"redactor\">Priority claims<\/strong>: Bankruptcy law grants these claims special status. Most tax debts and the cost of the\u00a0<a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/bankruptcy-law.html\">bankruptcy proceeding<\/a>\u00a0are examples of priority debt.<\/li>\n<li><strong data-redactor-tag=\"strong\" data-verified=\"redactor\">Secured claims<\/strong>:\u00a0<a href=\"https:\/\/corporate.findlaw.com\/finance\/bankruptcy-and-the-secured-creditor.html\" target=\"_blank\" rel=\"noopener\">Secured claims<\/a>\u00a0are debts that involve collateral. Creditors can repossess certain property if you do not pay the underlying debt. If you choose to keep any secured assets, you have no choice but to include those debts in your Chapter 13 plan. Secured assets include such things as mortgages and car loans.<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-an-unsecured-creditor\/\"><strong data-redactor-tag=\"strong\" data-verified=\"redactor\">Unsecured claims<\/strong><\/a>: These are claims where the creditor has no special right to collect against a debtor&#8217;s property. These claims include credit card companies and banks that issued you personal loans.<\/li>\n<\/ul>\n<p>When you design your repayment plan under Chapter 13, you must pay your debts according to the federal and state bankruptcy laws.\u00a0<\/p>\n<h2>Importance of Claims in a Chapter 13 Repayment Plan<\/h2>\n<p>Each claim has a different level of importance. The more important a claim is the higher the priority for it to be paid in. Let&#8217;s see how the claims are broken down and ranked.\u200b<\/p>\n<h3>Priority Claims Under the Repayment Plan<\/h3>\n<p>Unless the creditor agrees otherwise, you must pay all priority\u00a0claims, like administrative costs, recent taxes, and domestic support obligations, in full during the repayment plan.\u00a0You must remain current on ongoing domestic support obligations to obtain confirmation and discharge.\u00a0<\/p>\n<h3>Secured\u00a0Claims Under the Repayment Plan<\/h3>\n<p>The bankruptcy laws give you two options when it comes to secured claims. You can either:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure\/alternatives-to-foreclosure.html\">Surrender the property<\/a>\u00a0(i.e., return it to your creditor)<\/li>\n<li>Continue making regular payments as part of your repayment plan and keep the property<\/li>\n<\/ul>\n<p>If a claim is secured by collateral, you must repay at least the\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/whats-fair-market-value\/\">fair market value<\/a>\u00a0of the collateral if you want to keep your property. You must explicitly state that you intend to keep the property in the repayment plan.<\/p>\n<p>There are also instances where you won&#8217;t have to pay the entire balance on a\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/small-business\/what-is-a-secured-creditor\/\">secured debt<\/a>.\u00a0A car loan may be subject to a lesser amount because\u00a0its value depreciates immediately after you buy it. If the court imposes a reduction over the objections of the creditor, it&#8217;s called a &#8220;cramdown.&#8221;<\/p>\n<h3>Unsecured Claims Under the Repayment Plan<\/h3>\n<p>The amount of money you will pay to unsecured creditors depends on your\u00a0disposable income.\u00a0Disposable income is\u00a0the money you have left after paying necessary expenses for you and\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/who-can-claim-the-children-as-dependents-for-tax-purposes.html\">your dependents<\/a>.<\/p>\n<p>You must allocate all of your disposable income to paying your unsecured debts. Unsecured creditors may get some or all the money you owe them, depending on how much disposable income you have. The creditors must receive at least as much as they would have received under a\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/chapter-7-bankruptcy-rules-overview.html\">Chapter 7 bankruptcy<\/a>.<\/p>\n<p>If your current monthly income is below-median, you usually make payments within three years but may go up to five. The plan will typically last five years if your monthly income is above-median, unless unsecured claims are paid sooner in full.<\/p>\n<h2>The 341 Meeting of Creditors<\/h2>\n<p>Before the judge holds your confirmation hearing, creditors can meet with the trustee. At this meeting, which is called the\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-341\/\" target=\"_blank\" rel=\"noopener\">341 meeting of creditors<\/a>, your creditors can either\u00a0agree with\u00a0or object to\u00a0your proposed repayment plan.<\/p>\n<p>A creditor may object to your Chapter 13 plan for a host of reasons, including but not limited to the following:<\/p>\n<ul>\n<li>Your plan is not realistic<\/li>\n<li>A creditor feels your plan treats some creditors unfairly and unequally<\/li>\n<li>Your plan does not serve the creditor&#8217;s best interests<\/li>\n<li>There are mistakes or omissions in your plan that affect the creditor<\/li>\n<\/ul>\n<p>If\u00a0a\u00a0<a href=\"https:\/\/corporate.findlaw.com\/finance\/bankruptcy-and-the-secured-creditor.html\" target=\"_blank\" rel=\"noopener\">creditor<\/a>\u00a0still objects to your plan after the 341 meeting, the court will schedule a special hearing\u00a0for them to\u00a0voice their objections. If a creditor successfully challenges the plan, the judge will instruct you to revise your plan and submit a new plan to the trustee.<\/p>\n<p>Once the court has addressed all creditor objections, it will schedule your confirmation hearing. The hearing must occur within 45 days of the 341 meeting of creditors.<\/p>\n<h2>The Confirmation Hearing<\/h2>\n<p>The judge overseeing your Chapter 13 bankruptcy case will conduct a\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-debt-and-bankruptcy\/what-to-expect-filing-bankruptcy.html\">confirmation hearing<\/a>\u00a0to determine if your repayment plan is possible and that it meets the Bankruptcy Code requirements. At\u00a0the\u00a0court hearing with the\u00a0bankruptcy judge, either the\u00a0creditors or the trustee can raise objections to your plan. The judge will allow both sides to have their say and decide whether your plan fulfills the requirements outlined in the\u00a0Bankruptcy Code.<\/p>\n<h3>Chapter 13 Plan Confirmation Requirements<\/h3>\n<p>Before confirming your plan, the\u00a0judge will determine whether you have complied with the confirmation requirements. They\u00a0will consider the following when determining whether they will approve your plan:<\/p>\n<ul>\n<li>Can you\u00a0afford the proposed\u00a0payments?<\/li>\n<li>Will unsecured creditors get the same or more than they&#8217;d receive in a Chapter 7?<\/li>\n<li>Did you file in\u00a0good faith?<\/li>\n<\/ul>\n<p>If the court confirms the plan, the trustee will distribute the assets to the creditors.<\/p>\n<p>You can file a modified plan if the court doesn&#8217;t confirm your original version. You can also convert the case to a\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/exempt-vs-non-exempt-property-under-chapter-7.html\">liquidation case under Chapter 7<\/a>.<\/p>\n<h3>Do I Have To Attend the Chapter 13 Confirmation Hearing?<\/h3>\n<p>Some courts require debtors to attend the confirmation hearing. In most cases, your\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">bankruptcy attorney<\/a>\u00a0can attend on your behalf and answer the judge&#8217;s questions. If you&#8217;re representing yourself (pro se), you&#8217;ll have\u00a0to attend. Follow your local rules and your trustee&#8217;s instructions. Otherwise, the judge may dismiss your case.<\/p>\n<h2>Making the Repayment Plan Work<\/h2>\n<p>As the debtor, you are responsible for ensuring the repayment plan works. You must make your payments to the trustee according to the plan.<\/p>\n<p>Failure to make timely payments may result in the judge dismissing your case. This is especially true if you don&#8217;t pay your child support and alimony on time or fail to file your taxes.
