Knowing what\u2019s involved and how it works can help clarify your options. Let\u2019s take a look at some of the most common questions about <span data-term-id=\"58345154\">Chapter 13 bankruptcy<\/span>.<\/p>\n<h3>How Long Does It Take To File for Chapter 13?<\/h3>\n<p>There\u2019s no set time for how long it will take to complete your <span data-term-id=\"58345154\">Chapter 13 <\/span><span data-term-id=\"58345187\">bankruptcy<\/span>. Every case is unique. The more assets and debts you have, the longer it will take to work out an acceptable <span data-term-id=\"58345180\">payment plan<\/span>.<\/p>\n<p>On average, a <span data-term-id=\"58345154\">Chapter 13 bankruptcy<\/span> can take about five-and-a-half years to complete. This is assuming that your trustee approves a five-year <span data-term-id=\"58345169\">Chapter 13 plan<\/span>. It also provides for two months to file your actual Chapter 13 petition, start your <span data-term-id=\"58345155\">repayment plan<\/span>, and ultimately receive your bankruptcy discharge.<\/p>\n<h3>How Much Does It Cost to File a <span data-term-id=\"58345154\">Chapter 13 Bankruptcy<\/span>?<\/h3>\n<p>The filing fee is the same for everyone who files a Chapter 13 petition. The uniform filing fee is $313 (as of 2026). The amount you\u2019ll pay in attorney fees will vary. There is nothing you can do to remove this record from your report. The good news is that you can start rebuilding your credit as soon as you complete your <span data-term-id=\"58345169\">Chapter 13 plan<\/span>.<\/p>\n<h3>Can I Keep My Home?<\/h3>\n<p>One of the main reasons people file for Chapter 13 instead of Chapter 7 is because they want to keep their home. Chapter 13 allows a debtor to reorganize their debt so that they can make manageable payments over time and enjoy relief from debt <span data-term-id=\"58345200\">collection efforts<\/span>.<\/p>\n<p>As long as you can catch up on any arrears through your plan, the trustee and judge should approve your petition. If your home is already in <span data-term-id=\"58345156\">foreclosure<\/span>, this may not be possible. For the trustee to approve a <span data-term-id=\"58345155\">repayment plan<\/span> for a property in <span data-term-id=\"58345156\">foreclosure<\/span>, you must demonstrate that you will have sufficient income to pay not only your monthly <span data-term-id=\"58345169\">Chapter 13 plan<\/span> payments but your ongoing <span data-term-id=\"58345194\">mortgage payments<\/span> as well.<\/p>\n<h3>Can I Keep My Car?<\/h3>\n<p>There\u2019s a chance you can keep your motor vehicle if you <span data-term-id=\"58345204\">file Chapter 13<\/span>. However, you must be able to pay both the <span data-term-id=\"58345169\">Chapter 13 plan<\/span> payments along with current payments on any outstanding auto loans.<\/p>\n<p>The other option is to ask for a loan cramdown. This is when the <span data-term-id=\"58345202\">bankruptcy court<\/span> reduces the principal on your debt to the fair market value at the time of your <span data-term-id=\"58345203\">bankruptcy petition<\/span>. This debt then becomes unsecured, and the trustee will negotiate the plan payments on the balance of your <span data-term-id=\"58345186\">car loan<\/span> the same way they do for other unsecured creditors.<\/p>\n<h3>Which Debts Do You Repay in a <span data-term-id=\"58345190\">Chapter 13 Case<\/span>?<\/h3>\n<p>To achieve a Chapter 13 discharge, your trustee must approve your proposed <span data-term-id=\"58345155\">repayment plan<\/span> before submitting the plan to a judge. If the judge and the creditors approve the plan, you will initiate your plan payments within 30 days of your <span data-term-id=\"58345203\">bankruptcy petition<\/span>.<\/p>\n<p>The trustee will only approve your proposed plan if you commit to the following:<\/p>\n<ul>\n<li><strong>Priority debts (in full)<\/strong>: These are debts the trustee deems more important than others, such as <span data-term-id=\"58345158\">unsecured debts<\/span>. These debts receive priority because the courts deem them necessary for human welfare. Common priority debts include <span data-term-id=\"58345159\">child support<\/span>, <span data-term-id=\"58345176\">alimony<\/span>, <span data-term-id=\"58345191\">tax debts<\/span>, and administrative expenses. The trustee must arrange for full payment of these debts from the bankruptcy estate\u2019s assets and funds.<\/li>\n<li><strong><span data-term-id=\"58345172\">Secured debts<\/span> (current plus arrears)<\/strong>: <span data-term-id=\"58345172\">Secured debts<\/span> are those debts that are attached to collateral. For example, a mortgage or <span data-term-id=\"58345186\">car loan<\/span> would qualify as <span data-term-id=\"58345172\">secured debts<\/span> because they are held by collateral. <span data-term-id=\"58345172\">Secured debts<\/span> are paid after priority debts and before <span data-term-id=\"58345158\">unsecured debts<\/span>. The trustee may approve a plan that calls for partial payment of these debts.<\/li>\n<li><strong>Unsecured (based on your <span data-term-id=\"58345175\">disposable income<\/span>)<\/strong>: <span data-term-id=\"58345158\">Unsecured debts<\/span> are bills not attached to any collateral. The most common examples of <span data-term-id=\"58345158\">unsecured debts<\/span> include <span data-term-id=\"58345160\">credit cards<\/span>, <span data-term-id=\"58345205\">personal loans<\/span>, and <span data-term-id=\"58345188\">medical bills<\/span>. These are the last creditors to be paid in any <span data-term-id=\"58345182\">type of bankruptcy<\/span>.<\/li>\n<\/ul>\n<p>The goal of Chapter 13 is to pay off all of your debts.<\/p>\n<h3>What Debts Are Not Paid Through a <span data-term-id=\"58345154\">Chapter 13 Bankruptcy<\/span>?<\/h3>\n<p>While a <span data-term-id=\"58345169\">Chapter 13 plan<\/span> may arrange for repayment of most of your debts over time, there are certain debts that the court will not discharge through a Chapter 13. When your three- to five-year repayment is over, the court will discharge whatever is left unpaid, but certain debts aren\u2019t eligible.<\/p>\n<p>Some of the debts that are not dischargeable through Chapter 13 include:<\/p>\n<ul>\n<li><span data-term-id=\"58345161\">Student loans<\/span><\/li>\n<li>Recent <span data-term-id=\"58345191\">tax debts<\/span><\/li>\n<li><span data-term-id=\"58345159\">Child support<\/span><\/li>\n<li><span data-term-id=\"58345176\">Alimony<\/span><\/li>\n<\/ul>\n<p>While a <span data-term-id=\"58345154\">Chapter 13 bankruptcy<\/span> will allow you to catch up on arrears and avoid further <span data-term-id=\"58345200\">collection efforts<\/span>, it will not eliminate the above bills. Once your bankruptcy is complete, you must continue to make ongoing payments to these creditors.<\/p>\n<h3>How Soon Can I File for Bankruptcy?<\/h3>\n<p>Years ago, it wasn\u2019t difficult to refile bankruptcy every few years and eliminate your debt over and over again. In recent years, <span data-term-id=\"58345166\">bankruptcy laws<\/span>\u00a0have changed regarding the waiting period between <span data-term-id=\"58345179\">bankruptcy filings<\/span>. Under the current Bankruptcy Code, you must wait at least two years before you can file another Chapter 13. As for filing <span data-term-id=\"58345164\">Chapter 7 bankruptcy<\/span>, the waiting period is six years.<\/p>\n<p>If you attempt to file a <span data-term-id=\"58345203\">bankruptcy petition<\/span> before the waiting period is over, the court will dismiss your petition. Any filing fees paid at the time of submission won\u2019t be refunded.<\/p>\n<h2><span data-term-id=\"58345199\">Eligibility<\/span> Requirements for a Chapter 13<\/h2>\n<p>You are required to meet <span data-term-id=\"58345199\">eligibility<\/span> requirements for Chapter 13. There\u2019s no way to know for certain if you meet these criteria until you file your petition and your trustee approves your <span data-term-id=\"58345155\">repayment plan<\/span>.<\/p>\n<p>The basic requirements to file for Chapter 13 include the following:<\/p>\n<ul>\n<li>You must have a <span data-term-id=\"58345167\">regular income<\/span> sufficient to make your <span data-term-id=\"58345169\">Chapter 13 plan<\/span> payments, regardless of the source<\/li>\n<li>Total <span data-term-id=\"58345158\">unsecured debt<\/span> of less than $526,700<\/li>\n<li>Total <span data-term-id=\"58345172\">secured debt<\/span> of less than $1,580,125<\/li>\n<li>Only individual debtors and married couples can file for Chapter 13<\/li>\n<li>No dismissed bankruptcies within 180 days of your petition<\/li>\n<li>Complete a <span data-term-id=\"58345189\">credit counseling<\/span> course from an approved agency within 180 days before you file for bankruptcy, including a copy of your certificate of completion with your <span data-term-id=\"58345154\">Chapter 13 <\/span><span data-term-id=\"58345203\">bankruptcy<\/span><span data-term-id=\"58345203\"> petition<\/span><\/li>\n<li>Complete state and federal tax returns for the four years preceding your <span data-term-id=\"58345179\">bankruptcy filing<\/span>, copies of which must be provided to the trustee<\/li>\n<\/ul>\n<p>It\u2019s a good idea to meet with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">local <span data-term-id=\"58345181\">bankruptcy lawyer<\/span><\/a> before you file your petition.<\/p>\n<h2>Is Chapter 13 Right for You?<\/h2>\n<p>Determining whether Chapter 13 is the right <span data-term-id=\"58345201\">bankruptcy option<\/span> depends on your <span data-term-id=\"58345168\">financial situation<\/span>, your goals, and the type of debts you have. Use this guide to assess whether Chapter 13 is a good fit for your needs.\u00a0<\/p>\n<p>You\u2019ll know if Chapter 13 is the best option for you if the following statements are true:<\/p>\n<ul>\n<li>You want to keep your home and are facing <span data-term-id=\"58345156\">foreclosure<\/span>. Once you file your Chapter 13 petition, the mortgage company must halt any <span data-term-id=\"58345156\">foreclosure<\/span> actions because of the <span data-term-id=\"58345163\">automatic stay<\/span>.<\/li>\n<li>You have a regular, predictable income. If you cannot prove that you earn enough to make your plan payments and your ongoing scheduled payments, the trustee will not approve your bankruptcy.<\/li>\n<li>Your secured and <span data-term-id=\"58345158\">unsecured debts<\/span> fall below the maximum limits under the U.S. Bankruptcy Code. If you owe more than $526,700 in <span data-term-id=\"58345158\">unsecured debts<\/span> or $1,580,125 in <span data-term-id=\"58345172\">secured debts<\/span>, you will not qualify for Chapter 13.<\/li>\n<li>You&#8217;re behind on your mortgage or car payments and need to catch up. Since your <span data-term-id=\"58345203\">bankruptcy petition<\/span> will trigger the <span data-term-id=\"58345163\">automatic stay<\/span>, your creditors must stop all collection activity until your plan is completed.<\/li>\n<li>You have equity in your home or other property. If you don\u2019t have equity in your house, you may want to consider a <span data-term-id=\"58345164\">Chapter 7 bankruptcy<\/span>.<\/li>\n<li>You want to protect co-signers on your debts. If you file a <span data-term-id=\"58345164\">Chapter 7 bankruptcy<\/span>, creditors can still pursue the other people on the loans. They can actually demand that a cosigner pay the debt in full, although they will likely be willing to let the cosigner pay the arrears and continue with the scheduled payments.<\/li>\n<li>Your income is too high to pass the Chapter 7 <span data-term-id=\"58345171\">means test<\/span>. The <span data-term-id=\"58345171\">means test<\/span> requires that you make less than your state\u2019s median income to file <span data-term-id=\"58345164\">Chapter 7 bankruptcy<\/span>. If you make more than this, you should consider Chapter 13 or even debt consolidation.<\/li>\n<li>You can afford the monthly plan payments and still pay your regular bills. If the trustee does not believe you can do this, they will not approve your plan, and the court will dismiss your <span data-term-id=\"58345187\">bankruptcy case<\/span>.<\/li>\n<li>You need to cure <span data-term-id=\"58345191\">tax debt<\/span> or other priority debts, and you need to do it over time. If you are not interested in a long-term <span data-term-id=\"58345180\">payment plan<\/span> (three to five years), Chapter 13 is not for you.<\/li>\n<\/ul>\n<p>If the above statements apply to you and your <span data-term-id=\"58345168\">financial situation<\/span>, then Chapter 13 may be the best solution. Otherwise, you may want to consider <span data-term-id=\"58345164\">Chapter 7 bankruptcy<\/span> or another solution altogether.
