Unlike a <span data-term-id=\"58327352\">Chapter 7 bankruptcy<\/span>, a Chapter 13 filing allows debtors to keep their property and pay their creditors under a court-approved monthly <span data-term-id=\"58327347\">repayment plan<\/span>.<\/p>\n<p>Both <span data-term-id=\"58327363\">types of bankruptcy<\/span> are forms of judicial debt relief, but work in different ways. In a <span data-term-id=\"58327352\">Chapter 7 bankruptcy<\/span>, the court discharges all of your included debt. Once your <span data-term-id=\"58327352\">Chapter 7 <\/span><span data-term-id=\"58327349\">bankruptcy<\/span><span data-term-id=\"58327349\"> case<\/span> is complete, you no longer owe money to your creditors.<\/p>\n<p>With a <span data-term-id=\"58327356\">Chapter 13 case<\/span>, you settle your debts by meeting them in a <span data-term-id=\"58327376\">monthly <\/span><span data-term-id=\"58327373\">payment<\/span><span data-term-id=\"58327373\"> plan<\/span>. This plan typically lasts anywhere from three to five years, depending on your income. Before your <span data-term-id=\"58327396\">Chapter 13 trustee<\/span> will approve your <span data-term-id=\"58327385\">bankruptcy plan<\/span>, they must confirm that it is feasible and acceptable to your creditors.<\/p>\n<h2>Your <span data-term-id=\"58327347\">Repayment Plan<\/span> and the <span data-term-id=\"58327395\">Confirmation Hearing<\/span><\/h2>\n<p>If the trustee approves your plan, they will schedule a \u201c<span data-term-id=\"58327395\">confirmation hearing<\/span>.\u201d This is when your trustee presents the proposed plan to the judge and your creditors. The judge reviews the plan, and the creditors have the opportunity to object to it.<\/p>\n<p>The hope is that the judge will approve (confirm), but there\u2019s a chance they\u2019ll order the trustee to make modifications. Depending on the creditors\u2019 objections, the judge might dismiss your case. However, this is rare. The trustee knows what the <span data-term-id=\"58327354\">bankruptcy courts<\/span> expect and should be able to devise an acceptable <span data-term-id=\"58327347\">repayment plan<\/span>.<\/p>\n<p>Once your trustee and the <span data-term-id=\"58327354\">bankruptcy court<\/span> approve your plan, you begin making payments to your creditors. If you don\u2019t make your payments on time, you run the risk of the trustee dismissing your <span data-term-id=\"58327373\">payment plan<\/span>. If this happens, you will have to pay all\u00a0<span data-term-id=\"58327389\">past-due<\/span>\u00a0amounts to your creditors immediately, or they will resume collection activity.<\/p>\n<h2>Chapter 13 <span data-term-id=\"58327381\">Eligibility Requirements<\/span>: Quick Checklist<\/h2>\n<p>It can be difficult to decide which\u00a0<span data-term-id=\"58327363\">type of bankruptcy<\/span>\u00a0is best\u00a0for your financial situation. If you owe a lot of <span data-term-id=\"58327348\">unsecured debt<\/span> and own little to no property, Chapter 7 is probably your best option. However, if you own property and want to keep it, you should consider a <span data-term-id=\"58327345\">Chapter 13 bankruptcy<\/span>.<\/p>\n<p>It\u2019s important to keep in mind that just because you want to file a Chapter 13, that doesn\u2019t necessarily mean you\u2019ll qualify for a <span data-term-id=\"58327390\">reorganization<\/span> bankruptcy. Deciding to file for bankruptcy is not something you should take lightly. It\u2019s a big decision that will impact the rest of your life.<\/p>\n<p>Filing your <span data-term-id=\"58327345\">Chapter 13 <\/span><span data-term-id=\"58327401\">bankruptcy<\/span><span data-term-id=\"58327401\"> petition<\/span> and paying the <span data-term-id=\"58327374\">filing fee<\/span> only to learn that you don\u2019t qualify for this <span data-term-id=\"58327363\">type of bankruptcy<\/span> is not your best option. This option is not available to corporations and <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/incorporation-and-legal-structures\/limited-liability-corporation-faq.html\">limited <span data-term-id=\"58327361\">liability<\/span> companies (LLCs)<\/a>. Business entities can file for <span data-term-id=\"58327387\">Chapter 11\u00a0bankruptcy<\/span> <span data-term-id=\"58327390\">reorganization<\/span> instead.<\/p>\n<p>This doesn\u2019t mean that <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/incorporation-and-legal-structures\/sole-proprietorships.html\">sole proprietors<\/a> and members of partnerships don\u2019t qualify for Chapter 13. They can file a Chapter 13 petition to reorganize their personal debts.<\/p>\n<p>As far as businesses are concerned, the following types of business entities are barred from filing for Chapter 13:<\/p>\n<ul>\n<li>Corporations<\/li>\n<li>Limited <span data-term-id=\"58327361\">liability<\/span> companies (LLCs)<\/li>\n<li>Partnerships (as entities)<\/li>\n<li>Stockbrokers<\/li>\n<li>Commodity brokers<\/li>\n<\/ul>\n<p>If you own a business and aren\u2019t sure what your options are for bankruptcy, contact a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">local bankruptcy lawyer<\/a>.<\/p>\n<h3>You Must Have <span data-term-id=\"58327357\">Regular Income<\/span><\/h3>\n<p>Chapter 13 requires that <span data-term-id=\"58327394\">filers<\/span> have a <span data-term-id=\"58327357\">regular income<\/span>, which means they receive a predictable, recurring source of funds. The debtor\u2019s income must be reliable enough to make the <span data-term-id=\"58327376\">monthly payments<\/span> under their three- to five-year <span data-term-id=\"58327347\">repayment plan<\/span>.<\/p>\n<p>The <span data-term-id=\"58327366\">Bankruptcy Code<\/span> does not require that a debtor earn a minimum amount of income. The only requirement is that their income be sufficient to cover their living expenses and the proposed plan payments.<\/p>\n<p><span data-term-id=\"58327357\">Regular income<\/span> can come from many sources, including:<\/p>\n<ul>\n<li>Wages or salary<\/li>\n<li>Spouse&#8217;s income, whether the spouse is filing joint bankruptcy or not<\/li>\n<li><span data-term-id=\"58327364\">Self-employment<\/span> income<\/li>\n<li><span data-term-id=\"58327359\">Social Security<\/span> benefits<\/li>\n<li>Unemployment benefits<\/li>\n<li>Pension or retirement income<\/li>\n<li>Disability benefits<\/li>\n<li>Rental income from investment properties<\/li>\n<li><span data-term-id=\"58327380\">Alimony<\/span> or <span data-term-id=\"58327362\">child support<\/span> received<\/li>\n<li>Regular commission income<\/li>\n<li>Consistent gig economy earnings<\/li>\n<\/ul>\n<p>Your income must be predictable and ongoing for the duration of your <span data-term-id=\"58327347\">repayment plan<\/span>. One-time windfalls (inheritance, lawsuit settlement) do not constitute <span data-term-id=\"58327357\">regular income<\/span> under the federal <span data-term-id=\"58327384\">bankruptcy laws<\/span>.<\/p>\n<p>Your income doesn&#8217;t have to be the same amount every month. Seasonal workers and <span data-term-id=\"58327364\">self-employed<\/span> individuals with fluctuating income can still qualify for Chapter 13 if they can show an average income over time.<\/p>\n<h3>Your Debts Must Be Under the Federal Maximum<\/h3>\n<p>Chapter 13 requirements impose a limit on the amount of a <span data-term-id=\"58327394\">filer<\/span>&#8216;s debt. This is the case for both secured and <span data-term-id=\"58327348\">unsecured debt<\/span>. <span data-term-id=\"58327348\">Unsecured debt<\/span> includes money you owe for non-collateralized debts. For example, <span data-term-id=\"58327371\">medical bills<\/span> and <span data-term-id=\"58327375\">credit card<\/span> bills are <span data-term-id=\"58327348\">unsecured debt<\/span>, as is a personal loan that\u2019s not attached to collateral.<\/p>\n<p>A <span data-term-id=\"58327346\">secured debt<\/span> is debt secured by personal or real property as collateral. The most common types of <span data-term-id=\"58327346\">secured debt<\/span> include mortgages and <span data-term-id=\"58327400\">car loans<\/span>. If you fail to repay these debts, the creditor can repossess the collateral. For instance, if you don\u2019t pay your mortgage, your loan will go into <span data-term-id=\"58327353\">foreclosure<\/span>, and the bank can seize your home.<\/p>\n<p>The federal <span data-term-id=\"58327384\">bankruptcy laws<\/span> limit how much you can owe in unsecured and <span data-term-id=\"58327346\">secured debts<\/span>. The government adjusts these limits every three years to account for inflation.<\/p>\n<p>Under the 2026 limits, a Chapter 13 debtor\u2019s <span data-term-id=\"58327348\">unsecured debts<\/span> cannot exceed $526,700. Your <span data-term-id=\"58327346\">secured debts<\/span> cannot exceed $1,580,125. When you meet with your <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58327402\">bankruptcy attorney<\/span><\/a>, ask them to explain the current <span data-term-id=\"58327399\">debt limits<\/span> to determine if <span data-term-id=\"58327345\">Chapter 13 bankruptcy<\/span> is an option for you.<\/p>\n<h3>You Have No Recent Bankruptcies<\/h3>\n<p>You cannot file for <span data-term-id=\"58327345\">Chapter 13 bankruptcy<\/span> if you\u2019ve already done so within the last two years. This is also true for people who have filed a <span data-term-id=\"58327352\">Chapter 7 <\/span><span data-term-id=\"58327349\">bankruptcy<\/span><span data-term-id=\"58327349\"> case<\/span> within the last four years. These rules prevent debtors from abusing the bankruptcy system and ensure that debtors make a good-faith effort to repay their creditors before seeking bankruptcy relief again.<\/p>\n<p>There is a possible exemption to this rule. If your previous <span data-term-id=\"58327355\">Chapter 13 plan<\/span> paid off 100% of your <span data-term-id=\"58327348\">unsecured debt<\/span>, or at least 70% in good faith, the court may waive the above waiting periods.<\/p>\n<h3>You Have No Recent Bankruptcy Dismissals<\/h3>\n<p>In general, you cannot file a <span data-term-id=\"58327401\">bankruptcy petition<\/span> for at least 180 days after the <span data-term-id=\"58327354\">bankruptcy court<\/span> dismisses your <span data-term-id=\"58327349\">bankruptcy case<\/span>. This rule applies if the judge dismissed your case for either of the following reasons:<\/p>\n<ul>\n<li>A willful violation of a court order or failure to appear before the court<\/li>\n<li>You requested that the court dismiss your case after a creditor asked the court to lift an <span data-term-id=\"58327377\">automatic stay<\/span><\/li>\n<\/ul>\n<p>If the court dismissed your case for other reasons, such as not qualifying or for making an honest mistake, you may be able to file again immediately.<\/p>\n<p>Uncertain of your ability to file? Consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58327402\">bankruptcy attorney<\/span><\/a> for legal advice.<\/p>\n<h3>You Have Fulfilled the <span data-term-id=\"58327358\">Credit Counseling<\/span> Requirement<\/h3>\n<p>You must complete a court-approved <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/credit-counseling-and-counseling-organizations.html\"><span data-term-id=\"58327358\">credit counseling<\/span><\/a> course within 180 days before you file for Chapter 13. You will receive a certificate from the course proving you completed the class. The <span data-term-id=\"58327358\">credit counseling<\/span> agency will also help you create your debt management plan.<\/p>\n<p>You must include both a copy of the certificate and the proposed plan with your <span data-term-id=\"58327401\">bankruptcy petition<\/span>. If you fail to attach these documents with your petition, the court will give you 15 days to submit this information.<\/p>\n<p>You must meet the following <span data-term-id=\"58327358\">credit counseling<\/span> requirements before filing for Chapter 13:<\/p>\n<ul>\n<li>You must complete the course within 180 days of your petition<\/li>\n<li>You must use an approved <span data-term-id=\"58327358\">credit counseling<\/span> agency (check the U.S. Trustee&#8217;s website for approved providers)<\/li>\n<\/ul>\n<p>Most <span data-term-id=\"58327358\">credit counseling<\/span> sessions last about 60-90 minutes, and you can complete the sessions online, by phone, or in person. The cost of these sessions is typically between $25 and $50. Once you complete the course, you will receive your Certificate of Completion.<\/p>\n<p>In addition to your <span data-term-id=\"58327358\">credit counseling<\/span> session, you must also meet two other requirements:<\/p>\n<ul>\n<li><strong>Pre-filing <span data-term-id=\"58327358\">credit counseling<\/span><\/strong>: You must complete this before your <span data-term-id=\"58327360\">bankruptcy filing<\/span><\/li>\n<li><strong>Debtor education course<\/strong>: This is required before you receive your discharge, and you usually take this course near the end of your <span data-term-id=\"58327347\">repayment plan<\/span><\/li>\n<\/ul>\n<p>Don&#8217;t confuse these two requirements, as both are mandatory. If you fail to submit proof that you completed these courses, the court will dismiss your <span data-term-id=\"58327401\">bankruptcy petition<\/span>.<\/p>\n<h3>You Have Filed Your <span data-term-id=\"58327370\">Income <\/span><span data-term-id=\"58327350\">Tax<\/span><span data-term-id=\"58327350\"> Returns<\/span><\/h3>\n<p>To qualify for Chapter 13, you must submit copies of your <span data-term-id=\"58327350\">tax returns<\/span> for the last four years. This includes both state and federal <span data-term-id=\"58327370\">income <\/span><span data-term-id=\"58327350\">tax<\/span><span data-term-id=\"58327350\"> returns<\/span>. You must give your bankruptcy trustee a copy of your <span data-term-id=\"58327350\">tax returns<\/span> at least seven days before the first <span data-term-id=\"58327367\">meeting of creditors<\/span>.<\/p>\n<p>If you haven\u2019t filed taxes for the past four years, you can\u2019t file your <span data-term-id=\"58327401\">bankruptcy petition<\/span>. You must file all missing returns before filing for bankruptcy. This doesn\u2019t mean that you have to pay your taxes for the last four years. You just have to show that you filed them.<\/p>\n<h3>Your Income Must Support Your <span data-term-id=\"58327347\">Repayment Plan<\/span><\/h3>\n<p>The purpose of a Chapter 13 <span data-term-id=\"58327373\">payment plan<\/span> is to let you pay off your debts while still having enough money to pay your bills. The court and bankruptcy trustee will review your plan and <span data-term-id=\"58327351\">disposable income<\/span>\u00a0to ensure you&#8217;ll have enough money to live.<\/p>\n<p>Your income must cover your living expenses and mandatory payments to creditors.
