This takes effect the moment you <span data-term-id=\"58403878\">file bankruptcy<\/span> and prohibits creditors from garnishing your wages or pursuing other <span data-term-id=\"58403888\">collection activities<\/span>. This stay prevents creditors, collections agencies, and even some government entities from pursuing you for the debts you owe while your <span data-term-id=\"58403874\">bankruptcy case<\/span> is in progress. The purpose of the <span data-term-id=\"58403869\">automatic stay<\/span> is to give you some time and breathing room while the trustee overseeing your case looks over your <span data-term-id=\"58403889\">bankruptcy petition<\/span>, debts, assets, and income.<\/p>\n<h3>When Does the <span data-term-id=\"58403869\">Automatic Stay<\/span> Begin?<\/h3>\n<p>The <span data-term-id=\"58403869\">automatic stay<\/span> triggers the moment you <span data-term-id=\"58403878\">file bankruptcy<\/span>, no matter which type you file. It applies to both businesses and individuals.<\/p>\n<p>Creditors must stop garnishing your wages and other <span data-term-id=\"58403888\">collection activities<\/span> as soon as they receive notification from the <span data-term-id=\"58403876\">bankruptcy court<\/span> or your lawyer. The federal <span data-term-id=\"58403876\">bankruptcy court<\/span> can charge creditors with contempt if they do not pause their <span data-term-id=\"58403904\">collection actions<\/span>.<\/p>\n<p>Certain <span data-term-id=\"58403877\">types of debt<\/span> can still be garnished during the <span data-term-id=\"58403869\">automatic stay<\/span>. High-priority,\u00a0<span data-term-id=\"58403890\">non-dischargeable debts<\/span>,\u00a0such as\u00a0<span data-term-id=\"58403871\">child support<\/span>\u00a0and\u00a0<span data-term-id=\"58403872\">alimony<\/span>\/spousal support, must be paid during the <span data-term-id=\"58403869\">automatic stay<\/span>.<\/p>\n<p>In\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\"><span data-term-id=\"58403884\">Chapter 13 bankruptcy<\/span><\/a>, a special <span data-term-id=\"58403869\">automatic stay<\/span> provision protects co-debtors from collection efforts, such as co-signers on loans. Creditors can ask the court to allow <span data-term-id=\"58403868\">wage garnishment<\/span> to continue through a Motion for Relief from <span data-term-id=\"58403869\">Automatic Stay<\/span>.<\/p>\n<h3>How Long Does the <span data-term-id=\"58403869\">Automatic Stay<\/span> Last?<\/h3>\n<p>In a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\"><span data-term-id=\"58403875\">Chapter 7<\/span><\/a><span data-term-id=\"58403875\"> bankruptcy<\/span>, the <span data-term-id=\"58403869\">automatic stay<\/span> lasts until you receive a <span data-term-id=\"58403905\">bankruptcy discharge<\/span> or your case is dismissed. Once you get the discharge, any creditors not included in the discharge may resume garnishing your wages.<\/p>\n<p>In a <span data-term-id=\"58403884\">Chapter 13 bankruptcy<\/span>, you will create a <span data-term-id=\"58403886\">repayment plan<\/span> that includes the one garnishing your wages. As long as you keep your payments current, the creditor cannot garnish your wages. Once you finish the plan, in three to five years, the remaining debt is discharged, and the <span data-term-id=\"58403868\">wage garnishment<\/span> is over. <span data-term-id=\"58403870\">Student loans<\/span> and other <span data-term-id=\"58403890\">non-dischargeable debt<\/span> can continue to be garnished during a stay if the creditor wins a motion for relief from the stay.<\/p>\n<h3>Creditor Violation<\/h3>\n<p>Sometimes, creditors take more money from paychecks than they are legally allowed to. Federal law states that creditors can only garnish the lower of:<\/p>\n<ul>\n<li>25% of your disposable earnings, which is\u00a0your gross income minus any legally required deductions<\/li>\n<li>The difference between your disposable earnings and 30 times the federal minimum wage<\/li>\n<\/ul>\n<p><span data-term-id=\"58403871\">Child support<\/span> and <span data-term-id=\"58403872\">alimony<\/span> debts can garnish a significant percentage of your wages. Some states also have laws allowing for less of your paycheck to be subject to <span data-term-id=\"58403868\">wage garnishment<\/span>, so check out the laws of your state.<\/p>\n<p>There\u2019s a chance that the creditor may be in violation of the law. You could stop the process if they did not follow the correct procedure in seeking <span data-term-id=\"58403868\">wage garnishment<\/span>, such as not notifying you properly of the lawsuit or hearing. If creditors attempt to garnish your wages during the <span data-term-id=\"58403869\">automatic stay<\/span> or the <span data-term-id=\"58403886\">repayment plan<\/span>, it is unenforceable. Courts will not issue an order to <span data-term-id=\"58403881\">garnish wages<\/span> while a debtor has a stay in place.<\/p>\n<h2>What Is <span data-term-id=\"58403868\">Wage Garnishment<\/span>?<\/h2>\n<p><span data-term-id=\"58403868\">Wage garnishment<\/span> means a <span data-term-id=\"58403873\">court order<\/span> instructs your employer to send a certain amount of money from your paychecks directly to your creditor. Funds can also be directly\u00a0<a href=\"https:\/\/www.consumerfinance.gov\/ask-cfpb\/can-a-debt-collector-take-or-garnish-my-wages-or-benefits-en-1439\/\" target=\"_blank\" rel=\"noopener\">taken from your <span data-term-id=\"58403906\">bank account<\/span><\/a>.\u00a0Creditors can use these funds to collect different <span data-term-id=\"58403877\">types of debt<\/span>, including:<\/p>\n<ul>\n<li><span data-term-id=\"58403897\">Credit card<\/span><span data-term-id=\"58403897\"> debt<\/span><\/li>\n<li><span data-term-id=\"58403895\">Medical bills<\/span><\/li>\n<li><span data-term-id=\"58403908\">Personal loans<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-and-bankruptcy.html\"><span data-term-id=\"58403871\">Child support<\/span><\/a>\u00a0and <span data-term-id=\"58403872\">alimony<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/your-options-when-you-can-t-repay-student-loans.html\"><span data-term-id=\"58403870\">Student loans<\/span><\/a><\/li>\n<li>Taxes<\/li>\n<\/ul>\n<p>Your creditor must sue you over the debt. A court hearing and judgment must occur before a judge can order your employer to <span data-term-id=\"58403881\">garnish wages<\/span>. Your creditor must also inform you of the hearing and allow you to oppose the garnishment.<\/p>\n<p>In most states, <span data-term-id=\"58403871\">child support<\/span> and some types of <span data-term-id=\"58403872\">alimony<\/span> or spousal support are automatically deducted from the payor\u2019s wages when the support agreement is finalized. <span data-term-id=\"58403870\">Student loan<\/span> payors who have not defaulted on their loans can pay by automatic payment or wage deduction.<\/p>\n<h2>Types of Garnishment Bankruptcy Can Stop<\/h2>\n<p>Bankruptcy cannot end all types of <span data-term-id=\"58403868\">wage garnishment<\/span>. The <span data-term-id=\"58403869\">automatic stay<\/span> temporarily stops all\u00a0<span data-term-id=\"58403904\">collection actions<\/span>, but creditors can resume some. Debtors should keep in mind that the <span data-term-id=\"58403869\">automatic stay<\/span> provides only some breathing room, even in a <span data-term-id=\"58403875\">Chapter 7 bankruptcy<\/span>. The stay stops <span data-term-id=\"58403911\">eviction<\/span>, immediate garnishment, repossessions, and <span data-term-id=\"58403909\">foreclosures<\/span>.<\/p>\n<p>Bankruptcy can eliminate:<\/p>\n<ul>\n<li><span data-term-id=\"58403897\">Credit card<\/span><span data-term-id=\"58403897\"> debt<\/span>, <span data-term-id=\"58403895\">medical bills<\/span>, and some <span data-term-id=\"58403908\">personal loans<\/span><\/li>\n<li>Civil judgments and <span data-term-id=\"58403873\">court-ordered<\/span> garnishments<\/li>\n<li>Deficiency balances after repossessions and <span data-term-id=\"58403909\">foreclosures<\/span><\/li>\n<li>Some types of <span data-term-id=\"58403899\">tax debts<\/span><\/li>\n<\/ul>\n<p>These can be confusing to understand. In some instances, they may be able to resume during the process. These can include:<\/p>\n<ul>\n<li><span data-term-id=\"58403871\">Child support<\/span> and <span data-term-id=\"58403872\">alimony<\/span><\/li>\n<li>Criminal restitution, fines, and court costs<\/li>\n<li>Recent <span data-term-id=\"58403899\">tax debts<\/span><\/li>\n<li>Tax levies, which must be lifted through a separate court action<\/li>\n<li><span data-term-id=\"58403870\">Student loans<\/span>, which can resume after the bankruptcy<\/li>\n<\/ul>\n<p>Bankruptcy will not magically discharge all of your debts.<\/p>\n<h2>Garnishment in Chapter 7 vs Chapter 13<\/h2>\n<p>Ending <span data-term-id=\"58403868\">wage garnishment<\/span> works differently depending on whether you file a Chapter 7 or a Chapter 13. The purpose of each type of bankruptcy filing differs.<\/p>\n<p>In a Chapter 7, also called a liquidation bankruptcy, the purpose of the bankruptcy is to discharge (eliminate) your unsecured debt and pay off as many of your secured creditors as possible by selling your non-exempt assets. <span data-term-id=\"58403868\">Wage garnishment<\/span> stops when the debt is discharged, and you no longer need to pay your creditors.<\/p>\n<p>In a Chapter 13, also known as a reorganization, your debts are consolidated into a three- to five-year payment plan. The payment plan includes the same creditors who were garnishing your wages, so the garnishment amounts become part of the payment plan. As long as you stay current with your payment plan, the creditors cannot resume garnishing your wages. At the end of the payment plan, your debts are all paid off, and any deficiency is usually discharged.<\/p>\n<p>The end result is that your wages are no longer being garnished. The route to get there depends on the bankruptcy chapter.<\/p>\n<h2>Other Ways To Stop <span data-term-id=\"58403868\">Wage Garnishment<\/span><\/h2>\n<p>Bankruptcy is not the only way to stop <span data-term-id=\"58403868\">wage garnishment<\/span>. You can take many steps to eliminate or reduce <span data-term-id=\"58403868\">wage garnishment<\/span>, such as:<\/p>\n<ul>\n<li><strong>Economic Hardship<\/strong>: You can limit <span data-term-id=\"58403868\">wage garnishment<\/span> by petitioning the court and letting the judge know that you need more of your paycheck to cover your basic expenses<\/li>\n<li><strong>Trusteeship<\/strong>: In some states, you can ask the court to appoint a trustee who will pay your creditors based on one lump payment you make to the trustee<\/li>\n<li><strong><span data-term-id=\"58403885\">Exemption<\/span><\/strong>: <span data-term-id=\"58403868\">Wage garnishment<\/span> <span data-term-id=\"58403885\">exemption<\/span> laws exist at the state level and may allow <span data-term-id=\"58403885\">exemptions<\/span> for people receiving government assistance, such as food stamps or medical assistance<\/li>\n<li><strong>Debt Counseling<\/strong>: A non-profit\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief\/bankruptcy-vs--credit-counseling--what-s-the-right-choice-for-yo.html\">consumer <span data-term-id=\"58403901\">credit counseling<\/span> service<\/a>\u00a0(CCS) may be able to help you avoid <span data-term-id=\"58403868\">wage garnishment<\/span> by negotiating a settlement with your creditor in which you pay off your debt over time, but be wary of for-profit <span data-term-id=\"58403883\">debt relief<\/span> companies charging fees for a\u00a0service\u00a0that might not get you the desired results<\/li>\n<\/ul>\n<p>Dealing with <span data-term-id=\"58403868\">wage garnishment<\/span> is not something to take chances on. Meeting with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58403882\">bankruptcy attorney<\/span><\/a> may be your wisest option.<\/p>\n<h2>Recovering Previously <span data-term-id=\"58403881\">Garnished Wages<\/span><\/h2>\n<p>Bankruptcy lets you recover some <span data-term-id=\"58403881\">garnished wages<\/span>, but you must act quickly. You cannot recover all <span data-term-id=\"58403881\">garnished wages<\/span>, as <span data-term-id=\"58403871\">child support<\/span> and other garnishments not affected by bankruptcy are not available.<\/p>\n<p>You can recover any wages taken within 90 days of the bankruptcy filing if the total amount of <span data-term-id=\"58403881\">garnished wages<\/span> exceeds $600. You must show that these wages are exempt, meaning they are protected by state or federal law. If the employer has withheld your wages but has not sent them to the creditor, they must return them to you when they get notice of your filing.<\/p>\n<p>If the creditor has received payment and refuses to repay you, either you or your attorney may need to file an adversary proceeding to receive payment. In cases where the total amount of your <span data-term-id=\"58403881\">garnished wages<\/span> is small, it may cost more to recover them than you will get back. Your attorney can explain the costs and benefits of an adversary proceeding.<\/p>\n<h2>After You File<\/h2>\n<p>Although the <span data-term-id=\"58403869\">automatic stay<\/span> legally stops all <span data-term-id=\"58403888\">collection activity<\/span> against you, you should take some proactive steps to get your <span data-term-id=\"58403868\">wage garnishment<\/span> ended. Once you file, you\u2019ll receive a certified copy of the bankruptcy documents with a case number and filing date. You should send a copy to your employer\u2019s payroll or HR department so that any garnishments will stop.<\/p>\n<p>If there are judgment liens or levies against you through the sheriff\u2019s or marshal\u2019s office, you should ask your attorney to inform them of the bankruptcy filing. The stay places <span data-term-id=\"58403909\">foreclosure<\/span> and <span data-term-id=\"58403911\">eviction<\/span> proceedings on hold, but you can notify the sheriff\u2019s office as well.<\/p>\n<h2>If Your Case Is Dismissed<\/h2>\n<p>If your bankruptcy is discharged, the <span data-term-id=\"58403868\">wage garnishments<\/span> also end. If your case is dismissed, any stays end, and your creditors can reactivate the garnishments. They may or may not do that. Some will automatically restart. In other cases, the creditor may need to re-file their claim. Any garnishments that were not affected by your bankruptcy, such as <span data-term-id=\"58403871\">child support<\/span>, and debts not dischargeable in bankruptcy, like <span data-term-id=\"58403870\">student loans<\/span>, will continue whether your case is dismissed or discharged.<\/p>\n<h2>Do I Need a Lawyer To File for Bankruptcy?<\/h2>\n<p>If <span data-term-id=\"58403868\">wage garnishment<\/span> is causing you financial stress, it\u2019s normal to wonder if filing for bankruptcy is a good option. This important decision is best approached with the guidance of an attorney familiar with bankruptcy forms and bankruptcy law.<\/p>\n<p>Bankruptcy can give people a fresh start. However, it also damages your credit score, and many debt situations do not qualify.<\/p>\n<p>You don&#8217;t need a lawyer to file for bankruptcy, but it\u2019s a complex <span data-term-id=\"58403910\">legal process<\/span> with many strict requirements.
