The chance of discharge depends on whether you\u2019re <span data-term-id=\"58226896\">filing Chapter<\/span> 7\u00a0or\u00a0a <span data-term-id=\"58226890\">Chapter 13\u00a0<\/span><span data-term-id=\"58226884\">bankruptcy<\/span><span data-term-id=\"58226884\"> case<\/span>. This article reviews which <span data-term-id=\"58226934\">types of <\/span><span data-term-id=\"58226877\">tax<\/span><span data-term-id=\"58226877\"> debt<\/span> are more likely to be dischargeable. You should discuss your plans with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">skilled <span data-term-id=\"58226883\">bankruptcy attorney<\/span><\/a> if you still have questions about your <span data-term-id=\"58226884\">bankruptcy case<\/span>.<\/p>\n<h2><strong><span data-term-id=\"58226927\">Types of Bankruptcy<\/span> and <span data-term-id=\"58226877\">Tax Debt<\/span><\/strong><\/h2>\n<p>The courts are more likely to <span data-term-id=\"58226889\">discharge <\/span><span data-term-id=\"58226877\">tax debt<\/span> in a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7.html\"><span data-term-id=\"58226880\">Chapter 7 bankruptcy<\/span><\/a> than in a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13.html\"><span data-term-id=\"58226890\">Chapter 13 bankruptcy<\/span><\/a>. In a Chapter 7, debtors liquidate their assets to pay off secured and unsecured creditors, but lack sufficient income to make monthly payments. In a Chapter 13, debtors have some ability to continue making payments to creditors.<\/p>\n<h3><strong><span data-term-id=\"58226895\">Automatic Stay<\/span><\/strong><\/h3>\n<p>In all bankruptcy actions, filing a petition initiates <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/the-automatic-stay-stopping-creditors-with-bankruptcy.html\">an <span data-term-id=\"58226895\">automatic stay<\/span><\/a> on some <span data-term-id=\"58226915\">collection actions<\/span>. The stay applies to <span data-term-id=\"58226913\">IRS <\/span><span data-term-id=\"58226877\">tax<\/span><span data-term-id=\"58226877\"> debt<\/span> collection (such as <span data-term-id=\"58226885\">tax liens<\/span> on your property), but it does not stop tax audits, tax deficiency notices, or <span data-term-id=\"58226878\">tax return<\/span> demands.<\/p>\n<h3><strong><span data-term-id=\"58226880\">Chapter 7 Bankruptcy<\/span><\/strong><\/h3>\n<p>A <span data-term-id=\"58226880\">Chapter 7 bankruptcy<\/span>, also called a <span data-term-id=\"58226905\">liquidation<\/span> bankruptcy, lets you discharge secured and <span data-term-id=\"58226923\">unsecured debts<\/span>. <span data-term-id=\"58226906\">Credit card<\/span> debts, medical bills, and personal loans are examples of <span data-term-id=\"58226914\">dischargeable debt<\/span>. Some debts cannot be discharged, such as <span data-term-id=\"58226918\">student loans<\/span> and most <span data-term-id=\"58226902\">federal <\/span><span data-term-id=\"58226877\">tax<\/span><span data-term-id=\"58226877\"> debt<\/span>. You can discharge some <span data-term-id=\"58226888\">income <\/span><span data-term-id=\"58226877\">tax<\/span><span data-term-id=\"58226888\"> debt<\/span> under certain conditions:<\/p>\n<ul>\n<li>The discharge is for <span data-term-id=\"58226879\">income taxes<\/span> only, not <span data-term-id=\"58226903\">payroll taxes<\/span> or penalties for fraud<\/li>\n<li>You <span data-term-id=\"58226922\">filed <\/span><span data-term-id=\"58226878\">tax returns<\/span> for the previous two <span data-term-id=\"58226899\">tax years<\/span> before <span data-term-id=\"58226881\">filing bankruptcy<\/span><\/li>\n<li>Your <span data-term-id=\"58226894\">tax liability<\/span> is at least three years old<\/li>\n<li>You did not commit tax fraud or tax evasion, such as filing <span data-term-id=\"58226928\">fraudulent returns<\/span>, failing to pay taxes for more than one year, or lying about concealed <span data-term-id=\"58226901\">bank accounts<\/span><\/li>\n<li>You meet the <span data-term-id=\"58226926\">240-day rule<\/span>, which states the IRS must have assessed the <span data-term-id=\"58226877\">tax debt<\/span> at least 240 days (eight months) before you file for bankruptcy (a court may extend the date if the <span data-term-id=\"58226911\">bankruptcy petition<\/span> suspended the IRS activity)<\/li>\n<\/ul>\n<p>If you qualify, you can discharge:<\/p>\n<ul>\n<li><span data-term-id=\"58226902\">Federal taxes<\/span><\/li>\n<li>State taxes<\/li>\n<li>Penalties for dischargeable taxes<\/li>\n<\/ul>\n<p>Each bankruptcy is different and unique.<\/p>\n<p>Even if you meet the requirements for a <span data-term-id=\"58226920\">Chapter 7 discharge<\/span>, some <span data-term-id=\"58226934\">types of <\/span><span data-term-id=\"58226877\">tax<\/span><span data-term-id=\"58226877\"> debt<\/span> will not qualify. These include:<\/p>\n<ul>\n<li><span data-term-id=\"58226898\">Nondischargeable<\/span> <span data-term-id=\"58226877\">tax debt<\/span> like <span data-term-id=\"58226903\">payroll taxes<\/span> or <span data-term-id=\"58226910\">trust fund taxes<\/span><\/li>\n<li>Tax penalties from <span data-term-id=\"58226898\">nondischargeable<\/span> taxes<\/li>\n<li><span data-term-id=\"58226877\">Tax debts<\/span> from unfiled <span data-term-id=\"58226878\">tax returns<\/span><\/li>\n<li>Tax <span data-term-id=\"58226931\">fraud penalties<\/span><\/li>\n<li><span data-term-id=\"58226885\">Tax liens<\/span><\/li>\n<li>Recent <span data-term-id=\"58226877\">tax debt<\/span> (within the deadlines)<\/li>\n<\/ul>\n<p>The IRS can resume collection on all taxes not discharged by your bankruptcy. You can request an <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/the-irs-installment-agreement.html\"><span data-term-id=\"58226919\">installment agreement<\/span><\/a> or make an <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-an-offer-in-compromise.html\"><span data-term-id=\"58226886\">offer in compromise<\/span><\/a>. You may want <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">an attorney\u2019s advice<\/a> to help you with these alternatives.<\/p>\n<h3><strong><span data-term-id=\"58226890\">Chapter 13 Bankruptcy<\/span><\/strong><\/h3>\n<p>A <span data-term-id=\"58226890\">Chapter 13 bankruptcy<\/span>, also known as a reorganization, allows a debtor to keep most of their property, and create a <span data-term-id=\"58226907\">repayment plan<\/span> to pay off most of their creditors over a three to five year period. In a Chapter 13, <span data-term-id=\"58226877\">tax debt<\/span> is part of a <span data-term-id=\"58226907\">repayment plan<\/span> with other secured debts.<\/p>\n<p>As with a Chapter 7, your <span data-term-id=\"58226877\">tax debts<\/span> must meet the same time deadlines. You must pay off all priority <span data-term-id=\"58226877\">tax debt<\/span> with your <span data-term-id=\"58226907\">repayment plan<\/span>. \u201cPriority\u201d taxes are those that do not fall within the 240\/2\/3 timeline. Non-priority taxes are dischargeable at the end of the repayment period.<\/p>\n<p>The IRS may garnish your <span data-term-id=\"58226912\">tax refunds<\/span> during the <span data-term-id=\"58226907\">repayment plan<\/span> period to cover part of the <span data-term-id=\"58226907\">repayment plan<\/span>. On the plus side, the bankruptcy suspends <span data-term-id=\"58226909\">wage garnishment<\/span> during the same time period. Penalties and interest do not accrue on past taxes during your <span data-term-id=\"58226882\">payment plan<\/span>.<\/p>\n<p>A <span data-term-id=\"58226890\">Chapter 13 bankruptcy<\/span> is preferable if your <span data-term-id=\"58226936\">tax obligations<\/span> include an extensive amount of older, non-priority taxes that are dischargeable at the end of the <span data-term-id=\"58226907\">repayment plan<\/span>. You may also prefer a Chapter 13 if you intend to keep your assets during the bankruptcy and you have less concern over clearing your <span data-term-id=\"58226877\">tax debt<\/span>.<\/p>\n<h2><strong>Important Times to Remember<\/strong><\/h2>\n<p>There are three important rules to keep in mind when you\u2019re considering putting your <span data-term-id=\"58226877\">tax debt<\/span> in your bankruptcy filing.<\/p>\n<ul>\n<li>The <strong>three-year rule<\/strong> means that the <span data-term-id=\"58226877\">tax debt<\/span> must be three or more years old for discharge<\/li>\n<li>The <strong>two-year rule<\/strong> means you may only include <span data-term-id=\"58226877\">tax debt<\/span> from <span data-term-id=\"58226878\">tax returns<\/span> filed more than two years before your <span data-term-id=\"58226911\">bankruptcy petition<\/span><\/li>\n<li>The <strong><span data-term-id=\"58226926\">240-day rule<\/span><\/strong> means the IRS must assess any taxes included in the petition at least 240 days before your bankruptcy filing<\/li>\n<\/ul>\n<p>What does this really mean in practice? Here\u2019s an example with real numbers:<\/p>\n<p>The <span data-term-id=\"58226899\">tax year<\/span> is 2019. Your taxes were due (with extensions) on or before July 15, 2020. You filed your returns on April 1, 2020. The IRS assessed the returns on January 1, 2021. You <span data-term-id=\"58226881\">filed bankruptcy<\/span> August 1, 2024.<\/p>\n<p>Your <span data-term-id=\"58226877\">tax debt<\/span> is four years old (the <strong>three-year rule<\/strong>), you filed three years ago (the <strong>two-year rule<\/strong>), and the IRS assessed the taxes three years ago (more than <strong>240 days ago<\/strong>). These taxes can be included in your bankruptcy.<\/p>\n<p>If your <span data-term-id=\"58226894\">tax liability<\/span> doesn\u2019t meet all three requirements, the court will exclude it from your petition. For instance, suppose you filed for <span data-term-id=\"58226899\">tax year<\/span> 2019 in 2023 and <span data-term-id=\"58226881\">filed bankruptcy<\/span> in 2024. Although the debt meets the three-year rule, the filing would not meet the two-year rule. As a result, the court would probably exclude that debt.<\/p>\n<h2><strong><span data-term-id=\"58226885\">Tax Liens<\/span><\/strong><\/h2>\n<p>Bankruptcy can discharge your <span data-term-id=\"58226900\">personal liability<\/span> for <span data-term-id=\"58226877\">tax debt<\/span>. <a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-a-tax-lien-.html\"><span data-term-id=\"58226902\">Federal <\/span><span data-term-id=\"58226885\">tax<\/span><span data-term-id=\"58226885\"> liens<\/span><\/a> on your property are not discharged. You must pay off the <span data-term-id=\"58226885\">tax lien<\/span>, or else request a removal of the lien through other legal action.<\/p>\n<ul>\n<li>Your attorney can request a discharge of a specific lien. The IRS has different code provisions for exempting certain properties.<\/li>\n<li>A <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/understanding-a-federal-tax-lien#:~:text=A%20%22withdrawal%22%20removes%20the%20public%20Notice%20of%20Federal%20Tax%20Lien\" target=\"_blank\" rel=\"noopener\">withdrawal of public notice<\/a> helps ensure there are no other creditors on the property, making it easier for you to pay off the tax. There are several methods for doing this. Consider <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">consulting an attorney<\/a> before trying this method.<\/li>\n<\/ul>\n<p>Courts will not discharge\u00a0<a href=\"https:\/\/www.findlaw.com\/tax\/federal-taxes\/what-is-a-tax-lien-.html\"><span data-term-id=\"58226902\">federal <\/span><span data-term-id=\"58226885\">tax<\/span><span data-term-id=\"58226885\"> liens<\/span><\/a>\u00a0from before your <span data-term-id=\"58226884\">bankruptcy case<\/span>.<\/p>\n<h2><strong>State vs. <span data-term-id=\"58226902\">Federal <\/span><span data-term-id=\"58226877\">Tax<\/span><span data-term-id=\"58226877\"> Debt<\/span><\/strong><\/h2>\n<p>Similar rules apply to <span data-term-id=\"58226925\">state <\/span><span data-term-id=\"58226879\">income taxes<\/span> and state <span data-term-id=\"58226885\">tax liens<\/span>. <span data-term-id=\"58226925\">State <\/span><span data-term-id=\"58226879\">income taxes<\/span> are dischargeable in a <span data-term-id=\"58226892\">bankruptcy discharge<\/span>, but <span data-term-id=\"58226885\">tax liens<\/span> aren\u2019t. <span data-term-id=\"58226933\">Bankruptcy laws<\/span> differ by state regarding property taxes and other taxes.<\/p>\n<p>It\u2019s important to note that if the IRS or state filed a <span data-term-id=\"58226878\">tax return<\/span> on your behalf, you cannot claim those taxes on your bankruptcy.<\/p>\n<h2><strong>What Happens After Discharge?<\/strong><\/h2>\n<p>If your discharge is successful, the IRS will stop <span data-term-id=\"58226930\">collection efforts<\/span> on the discharged taxes. Any taxes not cleared by the bankruptcy remain active, and you must pay them. All <span data-term-id=\"58226885\">tax liens<\/span> remain, and you must either pay them or arrange for their removal through legal means.<\/p>\n<p>You must continue to file all future <span data-term-id=\"58226878\">tax returns<\/span> and make any <span data-term-id=\"58226929\">tax payments<\/span> and installment payments you arranged during your bankruptcy.<\/p>\n<p>A Chapter 7 is a chance at a <span data-term-id=\"58226897\">fresh start<\/span>, but you still need to keep up with your debts and payments. Your attorney can explain in more detail what happens after your <span data-term-id=\"58226892\">bankruptcy discharge<\/span>.<\/p>\n<h2><strong>When You May Want or Need a Lawyer<\/strong><\/h2>\n<p><span data-term-id=\"58226891\">Taxpayers<\/span> may not always need an attorney when they <span data-term-id=\"58226881\">file bankruptcy<\/span>, even when it involves their taxes. If your filing meets the 3\/2\/240 rule, you can put your <span data-term-id=\"58226877\">tax debts<\/span> in your bankruptcy filing and see what the judge says. You may want an attorney\u2019s advice if any of these situations apply to you:<\/p>\n<ul>\n<li><strong>Late filing<\/strong>: If you filed your returns late, it changes the timing of the 3\/2\/240 rule. It may also impact whether the state or IRS filed a substitute return for you. Before filing, have your attorney check whether your tax filing falls into the rule, and whether the IRS filed on your behalf.<\/li>\n<li><strong>Offers in Compromise<\/strong>: An OIC is an offer to pay a lump sum that is less than you owe in total. The IRS is often willing to accept OICs, but you should have your attorney review your offer before sending it in.<\/li>\n<li><strong>Pay by installment<\/strong>: If you do not qualify or your debt is not discharged, the IRS may accept an <span data-term-id=\"58226919\">installment agreement<\/span>. The IRS website allows you to select <span data-term-id=\"58226882\">payment plans<\/span> that let you pay monthly and lets you arrange bank transfers.<\/li>\n<li><strong>Can\u2019t meet payments<\/strong>: Currently not collectible status requires that you prove your current income does not meet your monthly living expenses and also pay your <span data-term-id=\"58226877\">tax debt<\/span>. The CNC status is not permanent, and penalties and interest continue accruing while <span data-term-id=\"58226915\">collection action<\/span> is stayed.<\/li>\n<\/ul>\n<p>Taxes are complicated enough. Adding bankruptcy on top of that is a legal labyrinth. If you have old <span data-term-id=\"58226877\">tax debt<\/span> adding to your financial nightmare, it\u2019s a good idea to speak with a <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">local <span data-term-id=\"58226924\">bankruptcy lawyer<\/span><\/a>. States have specific laws about bankruptcy <span data-term-id=\"58226935\">exemptions<\/span>, so your attorney must know local rules before heading to <span data-term-id=\"58226904\">bankruptcy
