The <span data-term-id=\"58376184\">bankruptcy process<\/span> typically lasts three to six months.<\/p>\n<p>After filing, a <span data-term-id=\"58376187\">bankruptcy trustee<\/span> will oversee your <span data-term-id=\"58376157\">bankruptcy case<\/span>. You will need to provide proof of the following:<\/p>\n<ul>\n<li>Your business lenders<\/li>\n<li>The amount of each claim<\/li>\n<li>Your total annual income and frequency of your income (for seasonal operations)<\/li>\n<li>Your property and assets<\/li>\n<li>Your expenses per month (e.g., utilities for buildings, taxes, transportation of workers or products, medicine and food for fish or animals, fertilizer, etc.)<\/li>\n<\/ul>\n<p>Like other <span data-term-id=\"58376155\">types of bankruptcy<\/span>, Chapter 12 <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-109\/\" target=\"_blank\" rel=\"noopener\">has eligibility requirements and debt thresholds<\/a>.<\/p>\n<h2>Chapter 9 Bankruptcy: For <span data-term-id=\"58376182\">Municipalities<\/span><\/h2>\n<p>Chapter 9 bankruptcy is for <span data-term-id=\"58376182\">municipalities<\/span>, <span data-term-id=\"58376202\">school districts<\/span>, and cities. It protects <span data-term-id=\"58376182\">municipalities<\/span> from creditors while they negotiate a plan to resolve existing debt. This <span data-term-id=\"58376155\">type of bankruptcy<\/span> may negatively affect public employees and other stakeholders.<\/p>\n<p><a href=\"https:\/\/www.ebsco.com\/research-starters\/history\/detroit-files-bankruptcy-largest-municipal-bankruptcy-filing-us-history\" target=\"_blank\" rel=\"noopener\">Chapter 9 cases<\/a>\u00a0are rare. Since 1950, only about 60 cities, towns, villages, and counties have filed under Chapter 9.\u00a0<a href=\"https:\/\/www.chicagofed.org\/publications\/chicago-fed-letter\/2013\/november-316?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\">Detroit, Michigan, filed for Chapter 9 protection<\/a>\u00a0on July 18, 2013, making it the largest municipal bankruptcy in U.S. history by debt, with estimates ranging from $18 to $20 billion. Before Detroit,\u00a0<a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2011\/11\/10\/142207044\/alabama-county-bankruptcy-filing-is-biggest-in-u-s-history\" target=\"_blank\" rel=\"noopener\">Jefferson County, Alabama<\/a>,\u00a0held the record after its 2011 filing of roughly $4 billion in debt.<\/p>\n<p>Chapter 9 <a href=\"https:\/\/uscode.house.gov\/view.xhtml?path=\/prelim@title11\/chapter9&amp;edition=prelim\" target=\"_blank\" rel=\"noopener\">gives <span data-term-id=\"58376182\">municipalities<\/span> broad discretion<\/a> over their <span data-term-id=\"58376153\">reorganization<\/span> plans.<\/p>\n<h2><span data-term-id=\"58376199\">Chapter 15 Bankruptcy<\/span>: International Cases<\/h2>\n<p><a href=\"https:\/\/www.uscourts.gov\/court-programs\/bankruptcy\/bankruptcy-basics\/chapter-15-bankruptcy-basics\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58376199\">Chapter 15 bankruptcy<\/span><\/a> is available in both foreign and U.S. courts. It allows them to communicate and cooperate if foreign bankruptcy filings somehow affect financial interests in the United States. This is the only <span data-term-id=\"58376155\">type of bankruptcy<\/span> that does not provide for discharge or <span data-term-id=\"58376153\">reorganization<\/span>. Instead, these rules determine how to handle foreign bankruptcy proceedings involving U.S. assets.<\/p>\n<p>Chapter 15 was enacted in 2005 as part of the <a href=\"https:\/\/www.congress.gov\/bill\/109th-congress\/senate-bill\/256\" target=\"_blank\" rel=\"noopener\">Bankruptcy Abuse Prevention and Consumer Protection Act<\/a> and is based on the <a href=\"https:\/\/uncitral.un.org\/en\/texts\/insolvency\/modellaw\/cross-border_insolvency\" target=\"_blank\" rel=\"noopener\">UNCITRAL Model Law on Cross-Border Insolvency<\/a>. It does not provide a path to debt discharge on its own, but creates a framework for cooperation between U.S. <span data-term-id=\"58376158\">bankruptcy courts<\/span> and foreign proceedings. Most individuals and businesses will never interact with Chapter 15.<\/p>\n<h2>Which <span data-term-id=\"58376155\">Type of Bankruptcy<\/span> Should You File?<\/h2>\n<p>The right chapter depends on who you are, the <span data-term-id=\"58376180\">types of debt<\/span> you owe, and the assets you are trying to protect. Let\u2019s take a closer look.<\/p>\n<h3><strong>For Individuals<\/strong><\/h3>\n<p>Most individuals will choose between Chapter 7 and Chapter 13. The following is the general guide:<\/p>\n<ul>\n<li><strong><span data-term-id=\"58376156\">Chapter 7<\/span><\/strong><span data-term-id=\"58376156\"> bankruptcy<\/span> is an appropriate option if you have low or limited income, few substantial assets to safeguard, and primarily <span data-term-id=\"58376160\">unsecured debts<\/span> such as <span data-term-id=\"58376163\">credit card<\/span> balances or medical expenses.
