With your mind focused on discharging your debts and starting over, it can be difficult to worry about what happens afterward. It\u2019s not a bad idea to take a few minutes and consider these facts about bankruptcies:<\/p>\n<ul>\n<li>When you file your bankruptcy, an <span data-term-id=\"58374302\">automatic stay<\/span> halts all collection proceedings, garnishments, and <span data-term-id=\"58374289\">foreclosures<\/span>. The stay does <strong>not<\/strong> halt your <span data-term-id=\"58374322\">monthly <\/span><span data-term-id=\"58374287\">mortgage payments<\/span>. To keep your home, you must continue making <span data-term-id=\"58374287\">mortgage payments<\/span>.<\/li>\n<li>Bankruptcy provides <span data-term-id=\"58374311\">debt relief<\/span> for <span data-term-id=\"58374296\">unsecured debt<\/span> like <span data-term-id=\"58374294\">credit cards<\/span> and <span data-term-id=\"58374305\">medical bills<\/span>. It will not eliminate <span data-term-id=\"58374334\">secured debt<\/span>, such as mortgages and <span data-term-id=\"58374324\">car loans<\/span>.<\/li>\n<li>A Chapter 7 <span data-term-id=\"58374316\">liquidation<\/span> will dispose of all <span data-term-id=\"58374304\">non-exempt<\/span> property, including other <span data-term-id=\"58374309\">real estate<\/span>. Chapter 13 focuses on a payment plan that\u2019s spread over three to five years.<\/li>\n<\/ul>\n<p>A bankruptcy discharge will not reduce your mortgage balance, principal, or interest. Nor will it eliminate any <span data-term-id=\"58374313\">past-due<\/span> amounts. If you fall behind on your payments, it will not prevent a future <span data-term-id=\"58374289\">foreclosure<\/span>. However, a bankruptcy can free up your <span data-term-id=\"58374335\">disposable income<\/span> by removing <span data-term-id=\"58374296\">unsecured debt<\/span> that has drained your ability to make your <span data-term-id=\"58374287\">mortgage payments<\/span>.<\/p>\n<h2><strong>Keeping Your Home With Chapter 7 (Liquidation)<\/strong><\/h2>\n<p>In a <span data-term-id=\"58374290\">Chapter 7 bankruptcy<\/span> (<span data-term-id=\"58374316\">liquidation<\/span>), the <span data-term-id=\"58374299\">bankruptcy trustee<\/span> sells your <span data-term-id=\"58374304\">non-exempt<\/span> assets to pay creditors. Whether the trustee can liquidate your home depends on the equity you have relative to the allowable <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/exempt-vs-non-exempt-property-under-chapter-7.html\"><span data-term-id=\"58374292\">homestead exemption<\/span><\/a>.<\/p>\n<p>Each state has its own section of the bankruptcy code that determines what assets are exempt or <span data-term-id=\"58374304\">non-exempt<\/span>. Some states, like Florida and Texas, have <a href=\"https:\/\/www.findlaw.com\/state\/property-and-real-estate-laws\/details-on-state-homestead-protections.html\">unlimited <span data-term-id=\"58374292\">homestead exemptions<\/span><\/a>, meaning that you can claim the full amount of equity in your home in your bankruptcy. There\u2019s no shame in meeting with a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/ask-a-lawyer-can-bankruptcy-clear-lawsuit-judgments.html\"><span data-term-id=\"58374310\">bankruptcy attorney<\/span><\/a> if you feel like you\u2019re getting in over your head.<\/p>\n<h2><strong>Keeping Your Home With a Chapter 13 (Repayment Plan)<\/strong><\/h2>\n<p>Under Chapter 13, <span data-term-id=\"58374326\">bankruptcy filers<\/span> must create a <span data-term-id=\"58374293\">repayment plan<\/span>. <span data-term-id=\"58374298\">Homeowners<\/span> have more flexibility to protect their\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/exempt-property-in-a-chapter-13-bankruptcy.html\"><span data-term-id=\"58374319\">personal property<\/span><\/a>, since the goal is to repay secured and\u00a0<span data-term-id=\"58374330\">unsecured creditors<\/span>\u00a0over a three- to five-year period. Chapter 13 can be better for some <span data-term-id=\"58374298\">homeowners<\/span>. It has a much higher equity allowance and provides a mechanism for debtors to catch up <span data-term-id=\"58374329\">missed payments<\/span>.<\/p>\n<p>You should consider a Chapter 13 to keep your home if:<\/p>\n<ul>\n<li>You are behind on your mortgage, possibly facing <span data-term-id=\"58374289\">foreclosure<\/span>, and need time to catch up<\/li>\n<li>Your equity is greater than the Chapter 7 exemption in your state<\/li>\n<li>Your income can cover your payment plan plus your <span data-term-id=\"58374328\">arrears<\/span><\/li>\n<\/ul>\n<p>If you have an unsecured <span data-term-id=\"58374314\">second mortgage<\/span>, a Chapter 13 provides a method of \u201cstripping\u201d that mortgage during your <span data-term-id=\"58374293\">repayment plan<\/span>.<\/p>\n<p>When you file a Chapter 13, the <span data-term-id=\"58374302\">automatic stay<\/span> lasts the duration of your payment plan as long as you remain current with your payments. The <span data-term-id=\"58374291\">lender<\/span> can ask the court to lift the stay if you miss any payments, often without an adversary proceeding. If you cannot remain current,\u00a0<span data-term-id=\"58374289\">foreclosure<\/span>\u00a0proceedings may resume immediately.<\/p>\n<p>As of July 2026, <span data-term-id=\"58374288\">Chapter 13 bankruptcies<\/span> have a debt limit that prevents debtors from filing if their <span data-term-id=\"58374334\">secured debt<\/span> exceeds $1,580,125 and their <span data-term-id=\"58374296\">unsecured debt<\/span> is more than $526,700. Legislation currently before Congress would raise the limit to a total debt of $2,750,000 secured and unsecured.<\/p>\n<h2><strong>When You Should Walk Away<\/strong><\/h2>\n<p>In some cases, it may be better to let the trustee take your home. Walking away from your house is a major consideration, but it\u2019s an option you may need to consider when your bankruptcy numbers just aren\u2019t adding up. Some signs that surrendering your home is the better option can include:<\/p>\n<ul>\n<li><strong>You cannot afford your payment plan<\/strong>: If your mortgage remains unaffordable after you\u2019ve completed a Chapter 13 and eliminated all other sources of debt, you may have to consider surrender. Your mortgage should not consume more than one-half of your take-home pay. If your payment is taking too much of your income, a fresh start is better without your debt dragging you down.<\/li>\n<li><strong>The house is underwater<\/strong>: This means that you owe substantially more than the house is worth. You are not building any equity, and the house is costing you money. The <span data-term-id=\"58374337\">bankruptcy process<\/span> will not harm you more than leaving the home at this point.<\/li>\n<li><strong>Unsustainable long-term expenses<\/strong>: Adjustable rate is increasing? Property taxes escalating? House needs maintenance you can\u2019t afford? <span data-term-id=\"58374287\">Mortgage payments<\/span> beyond your means? It might be time to admit that the house is a money pit and costing you more than you can ever get back from it.<\/li>\n<\/ul>\n<p>Despite the terminology of \u201cwalk away,\u201d you can\u2019t abandon your house. You must indicate your intention to surrender the home to the <span data-term-id=\"58374291\">lender<\/span> in your bankruptcy filing. If you\u2019ve been making payments, stop doing so upon filing. The <span data-term-id=\"58374291\">lender<\/span> will foreclose on the house and then sell it. The \u201cdeficiency balance\u201d (the difference between the amount of the mortgage and the sale price of the house) will be discharged in the bankruptcy.<\/p>\n<p>For instance, if you owe $300K on the mortgage, and the <span data-term-id=\"58374291\">lender<\/span> sells the home for $250K, the remaining $50,000 deficiency is discharged. In a <span data-term-id=\"58374289\">foreclosure<\/span> outside of bankruptcy, the <span data-term-id=\"58374291\">lender<\/span> could sue you for that $50,000.<\/p>\n<h2><strong>State-Specific Considerations<\/strong><\/h2>\n<p>All states have different restrictions on allowable <span data-term-id=\"58374312\">bankruptcy exemptions<\/span>, as\u00a0<a href=\"https:\/\/www.findlaw.com\/state\/property-and-real-estate-laws\/details-on-state-homestead-protections.html\"><span data-term-id=\"58374292\">homestead exemptions<\/span><\/a> and\u00a0<span data-term-id=\"58374300\">home equity<\/span>\u00a0limits vary by jurisdiction. <a href=\"https:\/\/www.findlaw.com\/bankruptcy.html\"><span data-term-id=\"58374333\">State laws<\/span><\/a> regarding community property and <span data-term-id=\"58374300\">home equity<\/span> can affect how you claim certain properties.<\/p>\n<p>For example, <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/bankruptcy-laws-by-state\/california-bankruptcy-exemptions-and-law.html\">California<\/a> uses two exemption systems: \u201cSystem 1\u201d and \u201cSystem 2\u201d.
