Some people charge <span data-term-id=\"58403697\">medical bills<\/span> to <span data-term-id=\"58403702\">credit cards<\/span>, which only makes the situation worse with interest charges. Fortunately, both <span data-term-id=\"58403697\">medical bills<\/span> and <span data-term-id=\"58403660\">credit card<\/span><span data-term-id=\"58403660\"> debt<\/span> are dischargeable in bankruptcy because:<\/p>\n<ul>\n<li>\n<p><strong>There is no collateral.<\/strong> You did not provide security like a house or other assets before acquiring the debt, so the creditors must wait for a judgment to receive payment.<\/p>\n<\/li>\n<li>\n<p><strong>Because there is no collateral, it is \u201cnon-priority.\u201d<\/strong> A creditor who has a claim on your house or bank account has priority. Your debt management results will vary depending on which <span data-term-id=\"58403686\">type of bankruptcy<\/span> you file.<\/p>\n<p>Whether you file a <span data-term-id=\"58403712\">Chapter 7 bankruptcy<\/span> or a Chapter 13, it will affect your credit rating for at least ten years. The question before all bankruptcy filers is whether the <span data-term-id=\"58403692\">amount of <\/span><span data-term-id=\"58403698\">medical debt<\/span> justifies filing for bankruptcy. If your <em>only<\/em> major financial debt load is the <span data-term-id=\"58403698\">medical debt<\/span> and you could reasonably pay off your <span data-term-id=\"58403697\">medical bills<\/span> without <span data-term-id=\"58403709\">filing bankruptcy<\/span>, you should consider doing so.<\/p>\n<p>Some ways to pay off your <span data-term-id=\"58403704\">health care<\/span><span data-term-id=\"58403704\"> costs<\/span> without bankruptcy can include:<\/p>\n<ul>\n<li>\n<p>Negotiating directly with the insurance companies or healthcare providers. If you have only one or two creditors, working out a <span data-term-id=\"58403666\">payment plan<\/span> with the providers directly can have almost the same financial effect as a bankruptcy. If your creditors agree, you may work out a payment agreement that lets you pay a smaller sum over a longer period of time.<\/p>\n<\/li>\n<li>\n<p>If you have multiple creditors but can still make regular payments, <span data-term-id=\"58403698\">medical debt<\/span> settlement companies can help you consolidate your debts and negotiate a <span data-term-id=\"58403666\">payment plan<\/span>. These companies take your payment and parcel it out to various creditors over time. Be careful, as not all are reputable. Some are scammers and some don\u2019t do anything your attorney could not do for you.<\/p>\n<\/li>\n<li>\n<p>Hospital <span data-term-id=\"58403672\">financial assistance<\/span> programs will sometimes work with lower-income families to offset some of the bills. They may work with their doctors to forgive some of your bills. The hospital financial office can give you more information if the hospital has this program.<\/p>\n<\/li>\n<\/ul>\n<p>Before leaping into bankruptcy because your finances seem hopeless, get <span data-term-id=\"58403688\">legal advice<\/span> and consider all your options first. You may not need to file a bankruptcy immediately.<\/p>\n<h2><strong>When Bankruptcy Makes Sense for <span data-term-id=\"58403698\">Medical Debt<\/span><\/strong><\/h2>\n<p>If you have more than one source of major debt, then bankruptcy is probably the best option. Bankruptcy is a way to clear your financial slate and start over free of all debt. If you have <span data-term-id=\"58403698\">medical debt<\/span>, <span data-term-id=\"58403660\">credit card<\/span><span data-term-id=\"58403660\"> debts<\/span>, or concerns about <span data-term-id=\"58403684\">foreclosure<\/span> because you cannot pay all your bills and pay your living expenses, then bankruptcy will remove the extra burden and let you get back on track.<\/p>\n<h3><strong>Filing Chapter 7 for <span data-term-id=\"58403698\">Medical Debt<\/span><\/strong><\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/chapter-7-bankruptcy-rules-overview.html\" target=\"_blank\" rel=\"noopener\">Chapter 7<\/a>, or &#8220;liquidation&#8221; bankruptcy, will discharge all <span data-term-id=\"58403698\">medical debt<\/span>. There is no limit on allowable <span data-term-id=\"58403668\">medical costs<\/span>, and you will not create a <span data-term-id=\"58403666\">payment plan<\/span>. However, you must give the trustee access to all your assets. The trustee sells anything of value to pay your secured creditors.<\/p>\n<p>There is a means test to qualify for <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58403712\">Chapter 7 bankruptcy<\/span><\/a>. Your <span data-term-id=\"58403682\">household income<\/span> must fall below your state\u2019s annual median income. There are other requirements, such as the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/exempt-vs-non-exempt-property-under-chapter-7.html\" target=\"_blank\" rel=\"noopener\">exemption list<\/a>, which varies by state, and rules for filing.
