The stay remains in place throughout, as long as you keep up with your plan payments and the lender doesn&#8217;t successfully move to lift it.<\/p>\n<p>Once a\u00a0<span data-term-id=\"58426919\">foreclosure proceeding<\/span>\u00a0begins, your creditor controls the\u00a0process. In a bankruptcy, you may be able to retain control of the property until the\u00a0<span data-term-id=\"58426920\">bankruptcy case<\/span>\u00a0is finalized through the\u00a0<span data-term-id=\"58426916\">automatic stay<\/span>\u00a0order.<\/p>\n<h2>How Chapter 13 Can Stop Foreclosure Permanently<\/h2>\n<p>An <span data-term-id=\"58426916\">automatic stay<\/span> stops creditor collection activity the moment you file.\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-background-and-advantages.html\"><span data-term-id=\"58426918\">Chapter 13 bankruptcy<\/span><\/a>\u00a0may let you keep your home by restructuring your debts. Although Chapter 7 may eliminate <span data-term-id=\"58426959\">mortgage debt<\/span>, it doesn\u2019t prevent the lender from proceeding with the sale at some point.<\/p>\n<p>You can propose a repayment schedule, but must also continue making your <span data-term-id=\"58426946\">regular <\/span><span data-term-id=\"58426915\">mortgage payments<\/span> at the same time. As long as you complete the <span data-term-id=\"58426976\">Chapter 13 plan<\/span>, the foreclosure does not move forward.<\/p>\n<p>Chapter 13 also allows you to eliminate second or third mortgages through a process called <a href=\"https:\/\/www.superlawyers.com\/resources\/bankruptcy\/ohio\/what-is-lien-stripping\/\" target=\"_blank\" rel=\"noopener\">lien stripping<\/a>. To qualify, your home\u2019s value should be equal to or less than what you owe on your <span data-term-id=\"58426949\">first mortgage<\/span>, with no remaining equity for the second or third mortgage to attach to. If the condition is met, the court may treat the junior lien as <span data-term-id=\"58426923\">unsecured debt<\/span>, which often receives little or no repayment under the plan.<\/p>\n<h2>Does Chapter 7 Stop Foreclosure?<\/h2>\n<p>Chapter 7 can remove your personal liability on a <span data-term-id=\"58426959\">mortgage debt<\/span>, but it doesn\u2019t remove the lender\u2019s lien on the property. Once the <span data-term-id=\"58426916\">automatic stay<\/span> expires at the end of your case, the lender can resume <a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure\/foreclosure-process.html\"><span data-term-id=\"58426919\">foreclosure proceedings<\/span><\/a>. Debt discharged through bankruptcy is\u00a0generally <a href=\"https:\/\/www.irs.gov\/newsroom\/home-foreclosure-and-debt-cancellation\" target=\"_blank\" rel=\"noopener\">not treated as taxable income<\/a>\u00a0by the IRS, unlike debt forgiven outside of bankruptcy.<\/p>\n<p>In <span data-term-id=\"58426927\">Chapter 7 bankruptcy<\/span>\u00a0proceedings, there\u2019s no <span data-term-id=\"58426917\">repayment plan<\/span>. Instead, the trustee collects all the debtor&#8217;s non-exempt assets and sells them. The trustee then uses the proceeds of the sale to pay creditors in accordance with the provisions of the <span data-term-id=\"58426964\">Bankruptcy Code<\/span>.<\/p>\n<h3>Chapter 7 May Not Save Your Home<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/chapter-7-bankruptcy-rules-overview.html\">Chapter 7<\/a>\u200b is not designed to keep you from losing your home. It forgives some or all of your debt, but that&#8217;s all it does. When you enter into a mortgage, you&#8217;re agreeing to use your home as collateral in case you default on your payments.<\/p>\n<p>Chapter 13 keeps <span data-term-id=\"58426919\">foreclosure proceedings<\/span> on hold while you catch up on payments through your <span data-term-id=\"58426917\">repayment plan<\/span>, which may allow you to save your home. Chapter 7\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/pros-and-cons-of-declaring-bankruptcy-under-chapter-7.html\">forgives your<\/a> debts\u200b but doesn\u2019t eliminate the lender&#8217;s lien. Once the stay is lifted, the lender can proceed with foreclosure.<\/p>\n<h3>Other Considerations for Chapter 7<\/h3>\n<p>Since the court\u2019s aim is to compensate creditors for their losses, the\u00a0<span data-term-id=\"58426970\">bankruptcy trustee<\/span>\u00a0may distribute funds from the sale of certain other valuable assets to the creditors. This can include your house. If you have a valuable wedding ring worth more than the dollar amount allowed under the jewelry\u00a0<span data-term-id=\"58426934\">exemption<\/span>, the trustee can sell it.<\/p>\n<p>Filing for Chapter 7 is not automatic. The\u00a0<a href=\"https:\/\/www.uscourts.gov\/court-programs\/bankruptcy\/bankruptcy-basics\/chapter-7-bankruptcy-basics\" target=\"_blank\" rel=\"noopener\">Bankruptcy Abuse Prevention and Consumer Protection Act of 2005<\/a>\u00a0introduced a <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\">means test<\/a> to determine who qualifies. If your average monthly income over the six months before filing exceeds the state median for a household of your size, your case goes through additional scrutiny to determine whether a Chapter 7 filing would be an abuse of the process. These factors include your:<\/p>\n<ul>\n<li>Income<\/li>\n<li>Debts<\/li>\n<li>Living expenses<\/li>\n<\/ul>\n<p>The main difference is that you may be able to experience\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/debt-relief.html\"><span data-term-id=\"58426944\">debt relief<\/span><\/a>\u200b and keep your home through bankruptcy. Here are some other differences to consider:<\/p>\n<h3>Who Initiates the Case<\/h3>\n<p>In\u00a0<span data-term-id=\"58426920\">bankruptcy cases<\/span>, you start the process by filing a\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-debt-and-bankruptcy\/bankruptcy-forms-and-contracts.html\"><span data-term-id=\"58426945\">bankruptcy petition<\/span><\/a>. In a foreclosure, the <span data-term-id=\"58426924\">mortgage lender<\/span> initiates the proceeding to repossess and sell the property.<\/p>\n<h3>What Happens After the Case<\/h3>\n<p>There is a chance you can keep your home after bankruptcy, but it&#8217;s not always possible. A Chapter 7 discharge does not restore your ability to make <span data-term-id=\"58426915\">mortgage payments<\/span>. Without sufficient income to cover the <span data-term-id=\"58426935\">monthly payments<\/span>, losing the property may be unavoidable regardless of the filing.<\/p>\n<p>The main difference between bankruptcy and foreclosure is what happens if the property is sold. If granted, you won\u2019t receive the extra three to four months.\u00a0If they fail, the postponement may provide meaningful additional time before a sale can proceed.<\/p>\n<h3>If the Foreclosure Notice Has Already Been Filed<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure\/state-specific-information-on-foreclosure.html\">Most states<\/a>\u200b have laws requiring lenders to give\u00a0<span data-term-id=\"58426921\">homeowners<\/span>\u00a0a certain amount of notice before selling their property. A bankruptcy&#8217;s\u00a0<span data-term-id=\"58426916\">automatic stay<\/span>\u00a0won&#8217;t stop the clock on this advance notice, but it stops the scheduled <span data-term-id=\"58426929\">foreclosure sale<\/span> unless the creditor is granted relief from the stay.<\/p>\n<p>For instance,\u00a0<a href=\"https:\/\/www.courts.ca.gov\/1048.htm\" target=\"_blank\" rel=\"noopener\">California law<\/a>\u00a0requires a lender to wait at least three months after recording a Notice of Default before issuing a Notice of Sale, followed by an additional minimum 20-day period before the sale itself can occur.\u00a0If a California <span data-term-id=\"58426921\">homeowner<\/span> files for bankruptcy two months into that required notice period, only one month remains on the clock when they file. The lender may be able to seek permission from the court to proceed with the sale shortly after. As a result, the lender could file a motion to lift the stay and ask the court&#8217;s permission to schedule the\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure\/alternatives-to-foreclosure.html\">foreclosure<\/a>.<\/p>\n<h2>How Bankruptcy Will Affect Your Credit<\/h2>\n<p>Although bankruptcy and foreclosure both\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/bankruptcy-credit-counseling.html\">damage your credit<\/a>, filing for bankruptcy can be a wise choice when trying to rebuild credit. Foreclosure will damage your\u00a0<span data-term-id=\"58426937\">credit score<\/span>\u00a0for years and may still leave you saddled with\u00a0<span data-term-id=\"58426959\">mortgage debt<\/span>. Most mortgage creditors will not consider you for future mortgages if you have a foreclosure on your\u00a0<span data-term-id=\"58426975\">credit history<\/span>.<\/p>\n<p>In contrast, bankruptcy lets you start fresh. It still damages your credit, but allows you to begin rebuilding good credit sooner. It can also serve as proof that you have learned how to manage your money. Although bankruptcy has negative consequences and may not save you from losing your home, it can be\u00a0<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/what-is-bankruptcy\/benefits-of-bankruptcy.html\">the best option<\/a>\u200b for starting fresh with no debt, getting back on your feet, and saving money.<\/p>\n<h2>Worst Case Scenario: Losing the House and Still in Debt<\/h2>\n<p>In some cases, bankruptcy can&#8217;t prevent the\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure\/prevent-and-manage-foreclosure-faqs.html\">loss of your home<\/a>. This doesn\u2019t make a <span data-term-id=\"58426931\">bankruptcy filing<\/span> pointless. A discharge can eliminate the <span data-term-id=\"58426959\">mortgage debt<\/span> that would otherwise follow you after the sale, along with other unsecured obligations like <span data-term-id=\"58426955\">credit card<\/span><span data-term-id=\"58426955\"> debt<\/span> and <span data-term-id=\"58426940\">medical bills<\/span>. It won\u2019t affect obligations like <span data-term-id=\"58426968\">child support<\/span> or alimony.<\/p>\n<p>Even if you can&#8217;t keep your home, bankruptcy can help you dig out from under\u00a0<span data-term-id=\"58426959\">mortgage debts<\/span>\u00a0and\u00a0<a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/tax-collections-and-debt.html\">tax liability<\/a>, an important first step towards getting back on your feet.
