In fact, there\u2019s a good chance you may receive your bankruptcy discharge in less than six months.<\/p>\n<p>A <span data-term-id=\"58228551\">Chapter 13 bankruptcy<\/span>, on the other hand, takes anywhere from three to five years. The process starts once you file your case.<\/p>\n<p>The reason a Chapter 13 takes so much longer to complete is that you must finish your <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/repayment-plan.html\"><span data-term-id=\"58228555\">repayment plan<\/span><\/a> before the court can discharge your case. Depending on your income and how much you owe your creditors, the trustee will approve a <span data-term-id=\"58228565\">payment plan<\/span> of three to five years.<\/p>\n<p>The general rule is: if you earn less than your state\u2019s median income level, the trustee will approve a three-year <span data-term-id=\"58228555\">repayment plan<\/span>. If your income falls above the median household income, the court will require a five-year <span data-term-id=\"58228555\">repayment plan<\/span>.<\/p>\n<p>The reason for the longer Chapter 13 plan is that people who earn more than the average family should contribute more toward their debts than someone who earns less than the state median income.<\/p>\n<h2>Before You File Your <span data-term-id=\"58228550\">Bankruptcy Case<\/span><\/h2>\n<p>Before you file your <span data-term-id=\"58228570\">bankruptcy petition<\/span>, you must first determine <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-vs-chapter-7-bankruptcy.html\">which <span data-term-id=\"58228576\">type of bankruptcy<\/span> you plan to file<\/a>. This decision will come down to your income, the types of debts you owe, and the amount of your total debt.<\/p>\n<p>To file a Chapter 7, you must pass something called the \u201c<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-bankruptcy-means-test.html\">Means Test<\/a>.\u201d This test requires that you demonstrate to the court that you earn less than your state\u2019s median household income. If you pass this test, you can submit your Chapter 7 <span data-term-id=\"58228570\">bankruptcy petition<\/span>.<\/p>\n<p>If you earn more than the median income, you can still file a Chapter 7. However, you must show that your disposable income is less than that amount. Your disposable income is what you have left once you subtract your basic household bills.<\/p>\n<p>To qualify for a Chapter 13, your income is not that important. However, you must submit <span data-term-id=\"58228583\">financial documents<\/span> showing that your unsecured and <span data-term-id=\"58228599\">secured debts<\/span> are less than the <a href=\"https:\/\/www.uscourts.gov\/court-programs\/bankruptcy\/bankruptcy-basics\/chapter-13-bankruptcy-basics\" target=\"_blank\" rel=\"noopener\">maximum limits<\/a>. As of 2026, the maximum amount of <span data-term-id=\"58228572\">unsecured debt<\/span> you can have to qualify for Chapter 13 is $526,700, and you cannot have more than $1,580,125 of <span data-term-id=\"58228599\">secured debt<\/span>.<\/p>\n<p>If you owe less than these amounts, you should have no problem filing a <span data-term-id=\"58228551\">Chapter 13 <\/span><span data-term-id=\"58228550\">bankruptcy<\/span><span data-term-id=\"58228550\"> case<\/span>. The only other requirement is that you have sufficient regular income to afford a reasonable monthly <span data-term-id=\"58228565\">payment plan<\/span>.<\/p>\n<h3>You Must Attend Mandatory Credit Counseling<\/h3>\n<p>Before you file either <span data-term-id=\"58228576\">type of bankruptcy<\/span>, you must attend a <a href=\"https:\/\/www.justice.gov\/ust\/list-credit-counseling-agencies-approved-pursuant-11-usc-111\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58228562\">credit counseling course<\/span> from an approved provider<\/a>. When you submit your <span data-term-id=\"58228570\">bankruptcy petition<\/span>, you must attach a copy of your Certificate of Completion.<\/p>\n<p>To count toward your <span data-term-id=\"58228571\">bankruptcy filing<\/span>, you must complete your <span data-term-id=\"58228562\">credit counseling course<\/span> within 180 days of the filing date. If it has been longer than 180 days, you must retake the course and secure a new certificate.<\/p>\n<h3>Gathering the Necessary Documentation<\/h3>\n<p>Before you submit your petition to the <span data-term-id=\"58228554\">bankruptcy court<\/span>, you must gather all the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/before-you-file\/checklist-documents-to-show-to-your-bankruptcy-attorney.html\">necessary documentation<\/a>. Regardless of the <span data-term-id=\"58228576\">type of bankruptcy<\/span> you choose, you must provide the trustee with certain documents.<\/p>\n<p>There is a significant amount of information you must provide with your <span data-term-id=\"58228570\">bankruptcy petition<\/span>, including but not limited to the following:<\/p>\n<ul>\n<li>Personal information, including employment information<\/li>\n<li>Six months\u2019 worth of <span data-term-id=\"58228591\">pay stubs<\/span><\/li>\n<li><span data-term-id=\"58228559\">Tax returns<\/span> for the past two years<\/li>\n<li><span data-term-id=\"58228588\">Bank account<\/span> and investment account statements<\/li>\n<li><span data-term-id=\"58228590\">Real estate<\/span> deeds, titles, and recent appraisals<\/li>\n<li>Vehicle title and registration<\/li>\n<li>Insurance policy information<\/li>\n<\/ul>\n<p>You must also provide information regarding your assets, such as:<\/p>\n<ul>\n<li>List of household items (by category)<\/li>\n<li>Value of any personal property<\/li>\n<li>Retirement accounts<\/li>\n<\/ul>\n<p>Finally, you must provide the <span data-term-id=\"58228597\">Chapter 7 trustee<\/span> (or Chapter 13 trustee) with the following:<\/p>\n<ul>\n<li>List of <span data-term-id=\"58228599\">secured debts<\/span> (mortgage, car loan, etc.)<\/li>\n<li>List of <span data-term-id=\"58228572\">unsecured debts<\/span> (<span data-term-id=\"58228564\">credit card<\/span> bills, <span data-term-id=\"58228585\">medical bills<\/span>, etc.)<\/li>\n<li>List of priority debts (<span data-term-id=\"58228582\">child support<\/span>, recent tax debts, etc.)<\/li>\n<li>Contact information for your creditors<\/li>\n<li>Monthly expenses<\/li>\n<li>Any recent large purchases or property transfers<\/li>\n<\/ul>\n<p>One of the reasons so many debtors hire a <span data-term-id=\"58228563\">bankruptcy attorney<\/span> to help with their case is because the <span data-term-id=\"58228558\">bankruptcy process<\/span> can be overwhelming. Just gathering the above information can be intimidating and time-consuming. Plus, if you fail to submit any of the required information, the court may dismiss your case. If that happens, you\u2019ll have to refile with a new <span data-term-id=\"58228580\">filing fee<\/span>.<\/p>\n<h3>Statement of Intention<\/h3>\n<p>If you\u2019re filing a <span data-term-id=\"58228575\">Chapter 7 <\/span><span data-term-id=\"58228550\">bankruptcy case<\/span>, you must also submit something called a \u201cStatement of Intention.\u201d This is where you indicate whether you intend to keep any of your assets or personal property, such as your house, car, or boat.<\/p>\n<p>You must also indicate on this form if you plan on claiming any state or federal bankruptcy <span data-term-id=\"58228577\">exemptions<\/span>. If you fail to do this, you may not be allowed to amend your petition later. This could cause you to lose your property to a forced sale by the trustee.<\/p>\n<h2>Filing Your <span data-term-id=\"58228570\">Bankruptcy Petition<\/span><\/h2>\n<p>When you first submit your <span data-term-id=\"58228570\">bankruptcy petition<\/span> to the court, you must also pay the requisite <span data-term-id=\"58228580\">filing fee<\/span>. The 2026 <span data-term-id=\"58228580\">filing fee<\/span> for a Chapter 7 is $338. For a Chapter 13, the fee is $313. If you don\u2019t submit the fee with your papers, the court will not process your petition.<\/p>\n<p>If you cannot afford the <span data-term-id=\"58228580\">filing fee<\/span>, you can <a href=\"https:\/\/www.uscourts.gov\/forms-rules\/forms\/application-have-chapter-7-filing-fee-waived-0\" target=\"_blank\" rel=\"noopener\">request a fee waiver<\/a>. You can also ask the court if you can pay the fee in <span data-term-id=\"58228594\">installments<\/span>. The maximum number of <span data-term-id=\"58228594\">installments<\/span> the court will allow is four.<\/p>\n<p>Once the court receives your <span data-term-id=\"58228570\">bankruptcy petition<\/span> and supplemental forms, the court clerk will assign you a case number. They will also assign a trustee to your case.<\/p>\n<h2><span data-term-id=\"58228561\">Automatic Stay<\/span><\/h2>\n<p>As soon as the court accepts your <span data-term-id=\"58228571\">bankruptcy filing<\/span>, the \u201c<span data-term-id=\"58228561\">Automatic Stay<\/span>\u201d will kick in. The <span data-term-id=\"58228561\">automatic stay<\/span> is a court order preventing your creditors from taking any collection action against you during bankruptcy proceedings.<\/p>\n<p>Some of the actions the <span data-term-id=\"58228561\">automatic stay<\/span> prohibits include:<\/p>\n<ul>\n<li><span data-term-id=\"58228557\">Foreclosure<\/span><\/li>\n<li><span data-term-id=\"58228589\">Repossession<\/span><\/li>\n<li>Wage <span data-term-id=\"58228587\">garnishment<\/span><\/li>\n<li><span data-term-id=\"58228588\">Bank account<\/span> levy<\/li>\n<li>Sheriff\u2019s sale of real or personal property<\/li>\n<\/ul>\n<p>It is worth noting that the <span data-term-id=\"58228561\">automatic stay<\/span> does not prevent the family courts from collecting <span data-term-id=\"58228582\">child support<\/span> or spousal support\/alimony. All domestic support obligations are exempt from the power of the <span data-term-id=\"58228561\">automatic stay<\/span>.<\/p>\n<h2>30-40 Days After <span data-term-id=\"58228552\">Filing Bankruptcy<\/span><\/h2>\n<p>In the month or so after you file for bankruptcy, several things will happen. If you file a <span data-term-id=\"58228592\">Chapter 13 case<\/span>, the trustee will likely communicate with your <span data-term-id=\"58228560\">bankruptcy lawyer<\/span> about any additional information they need. For example, if you did not provide a recent appraisal on your primary residence, the trustee may demand that you have one done and provide a copy to the court.<\/p>\n<p>Aside from this, you should expect to attend the first \u201c<span data-term-id=\"58228553\">Meeting of Creditors<\/span>.\u201d<\/p>\n<h3>341 Hearing: <span data-term-id=\"58228553\">Meeting of Creditors<\/span><\/h3>\n<p>This meeting, which is known as the <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/what-is-a-341-meeting-in-bankruptcy.html\">341 hearing<\/a>, is where the trustee and your creditors have a chance to question you about your debts, assets, income, and ability to pay.<\/p>\n<p>It is also at this meeting that your creditors have the chance to make any objections to either your Chapter 13 plan or their debt being <span data-term-id=\"58228596\">dischargeable<\/span> by the court. For example, if you took a <span data-term-id=\"58228564\">credit card<\/span> out four months before <span data-term-id=\"58228584\">filing Chapter 7<\/span> bankruptcy and ran up over $10,000 in a matter of days, the <span data-term-id=\"58228564\">credit card<\/span> company will likely object to the discharge of this debt.<\/p>\n<p>The good news is that the <span data-term-id=\"58228553\">Meeting of Creditors<\/span> typically only lasts about five to ten minutes. By this point in your bankruptcy proceedings, the other parties have had a chance to review your paperwork and demand any additional documentation they need.<\/p>\n<p>In many cases, creditors don\u2019t wait until the 341 hearing to object to your plan or discharge. They may contact the trustee or your <span data-term-id=\"58228560\">bankruptcy lawyer<\/span> before the hearing to discuss a possible settlement or other resolution. For example, they may agree to let you reaffirm the debt (agree to pay it outside of bankruptcy.)<\/p>\n<h3>After the <span data-term-id=\"58228553\">Meeting of Creditors<\/span> Is Over<\/h3>\n<p>After the 341 hearing is over, creditors have 60 days to file their objections. During this time, the trustee will evaluate your testimony at the meeting and look at your <span data-term-id=\"58228583\">financial documents<\/span> in detail. If need be, they will ask your attorney for additional information.<\/p>\n<p>Once the 60 days pass, the court will grant your Chapter 7 discharge. If you filed a Chapter 13, you will continue making your payments until the plan is complete. Once you make your final payment, the court will issue your discharge.<\/p>\n<p>Before the court will issue a discharge, you must attend a mandatory debtor education course and provide proof of completion to your trustee. Without this certificate, the court will not approve your Chapter 13 plan or issue your discharge.<\/p>\n<h2>60-90 Days After Filing Your Bankruptcy<\/h2>\n<p>In a Chapter 7 case, it is around this time when the court will issue your bankruptcy discharge. This can happen anytime in the 60-90 days after your <span data-term-id=\"58228553\">Meeting of Creditors<\/span> is complete. The discharge is a court order stating that the discharged debt is no longer open or active, nor is there a balance owed.<\/p>\n<p>This order prohibits creditors from attempting to collect the debt. It also requires creditors and credit reporting agencies to change the status of your account to \u201cDischarged in Bankruptcy.\u201d<\/p>\n<p>In most Chapter 7 cases, the court will discharge the following types of debts:<\/p>\n<ul>\n<li><span data-term-id=\"58228564\">Credit card<\/span> debt<\/li>\n<li>Personal loans<\/li>\n<li><span data-term-id=\"58228585\">Medical bills<\/span><\/li>\n<li>Payday loans<\/li>\n<li>Utility bills<\/li>\n<li>Past-due rent<\/li>\n<li>Other unsecured consumer credit accounts<\/li>\n<\/ul>\n<p>There are certain debts that are not <span data-term-id=\"58228596\">dischargeable<\/span> in bankruptcy, regardless of the Chapter you file. Some of these are:<\/p>\n<ul>\n<li><span data-term-id=\"58228568\">Student loans<\/span><\/li>\n<li>Recent tax debts (within two years of your filing date)<\/li>\n<li>Criminal restitution<\/li>\n<li>Money owed on a civil judgment for a case involving DUI<\/li>\n<li>Fines or debts arising out of fraud or other criminal activity<\/li>\n<\/ul>\n<p>Overall, from the date you file your petition to the date the court issues your Chapter 7 discharge, your case should take about five or six months. There are some things that can delay your bankruptcy proceedings. For example, if you don\u2019t take your debtor education course, the court will not grant your discharge.<\/p>\n<p>You can also delay proceedings by not submitting necessary paperwork to the court or failing to attend your 341 hearing. This is why having an experienced <span data-term-id=\"58228560\">bankruptcy lawyer<\/span> is a good idea. They\u2019ll make sure you don\u2019t do things that may cause an undue delay in your discharge.<\/p>\n<h2>Chapter 13 Timeline: 3-5 Year <span data-term-id=\"58228565\">Payment Plan<\/span><\/h2>\n<p>You file your <span data-term-id=\"58228551\">Chapter 13 <\/span><span data-term-id=\"58228570\">bankruptcy<\/span><span data-term-id=\"58228570\"> petition<\/span> the same way you file a Chapter 7 petition. Like a Chapter 7 filer, you will have to attend the <span data-term-id=\"58228553\">Meeting of Creditors<\/span>. The trustee and creditors will ask you questions similar to someone in a Chapter 7 case.<\/p>\n<p>The key difference in a <span data-term-id=\"58228592\">Chapter 13 case<\/span> is that, in the month or two following your <span data-term-id=\"58228571\">bankruptcy filing<\/span>, the court will not issue a discharge. Instead, it will confirm your <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-13\/chapter-13-reorganization-bankruptcy.html\">Chapter 13 <span data-term-id=\"58228555\">repayment plan<\/span><\/a>. Once you file the plan, you will start making your monthly payments within 30 days to the trustee.<\/p>\n<p>The trustee will distribute the money to your creditors and, once you complete your payments, do a final accounting. After this is complete, the court will wait to receive proof that you completed the debtor education class. Once it receives this, the court will issue your final discharge as well.<\/p>\n<h2>How Long Will It Take for My Credit to Recover?<\/h2>\n<p>One question many debtors have is, \u201cHow long will it take for me to fix my credit?\u201d It\u2019s only natural to want to know <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/after-bankruptcy\/how-soon-will-my-credit-score-improve-after-bankruptcy.html\">when your credit will start to recover<\/a> after a bankruptcy. The answer to this question is that it depends.<\/p>\n<p>If you file a <span data-term-id=\"58228575\">Chapter 7 <\/span><span data-term-id=\"58228550\">bankruptcy case<\/span>, the court should issue your discharge within five to six months from the date of filing. At this time, your credit report will update your accounts to show that they were discharged in bankruptcy.<\/p>\n<p>Creditors and potential lenders will see this. Naturally, they will be reluctant to issue credit to someone who just filed for bankruptcy. However, over time, this will change. You will have to first accept <span data-term-id=\"58228564\">credit cards<\/span> with higher interest rates, low spending limits, and higher fees. You may even have to accept a few secured <span data-term-id=\"58228564\">credit cards<\/span> to get things moving in the right direction.<\/p>\n<p>After one or two years have passed, you should be able to qualify for a mortgage and car loan.
