When the estate is solvent, the personal representative or executor must pay creditors in the order required under state law.<\/p>\n<h3>Prepare a Checklist of Documents<\/h3>\n<p>Thoughtful preparation includes compiling a checklist of documents and other important information. Create a master list of account information. You can create files for each account. This allows you to drop information into the file if you don&#8217;t have time to update the master list.<\/p>\n<p>It is critical to provide an updated document containing all relevant financial information. In the event of your death or incapacity, someone else might need to access that information. You should include details about your personal retirement accounts, investments, insurance, and workplace or government benefits if you become disabled or die.<\/p>\n<p>Disability and death could happen at any time. These can include:<\/p>\n<ul>\n<li>Pension plans<\/li>\n<li>Retirement accounts<\/li>\n<li>Stock options<\/li>\n<\/ul>\n<p>After putting in long days at work year after year, you want to ensure your loved ones can benefit from the assets earned through your work. Be sure to list these assets in the document you prepare for use in your incapacity or death.<\/p>\n<p>You may invest in any number of retirement plans. Your union or employer may sponsor a pension plan or offer a retirement plan with employer contribution as a SEP-IRA (simplified employee pension) or SIMPLE IRA.<\/p>\n<p>There are also a variety of individual retirement accounts for self-employed individuals and small-business owners. The list includes:<\/p>\n<ul>\n<li>Traditional IRAs<\/li>\n<li>Roth IRAs<\/li>\n<li><a href=\"https:\/\/dictionary.findlaw.com\/definition\/keogh-plan.html\" target=\"_blank\" rel=\"noopener\">Keogh plans<\/a><\/li>\n<li>401(k)s<\/li>\n<\/ul>\n<p>Don&#8217;t forget tax-deferred annuities that provide income.<\/p>\n<h3>Naming Beneficiaries for Retirement Accounts<\/h3>\n<p>Most\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/faq-pension-plans-and-erisa.html\">retirement accounts<\/a>\u00a0allow you to name a beneficiary. Your beneficiary will receive any money in your retirement account without going through probate court.<\/p>\n<p>For some retirement accounts, the law requires that you name your spouse as your beneficiary. A spouse may sign a form to give up that right. If you live in a\u00a0<a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-estate-planning-laws.html\">community property state<\/a>, even if you choose not to name your spouse, they are entitled to half the money earned in the account while married.<\/p>\n<p>In most cases, you will need the following information to access the retirement plan:<\/p>\n<ul>\n<li>The name of the entity that offers or manages the retirement savings plan<\/li>\n<li>Contact information (phone number, address, website)<\/li>\n<li>The account number or account identifier<\/li>\n<li>Whether you are currently receiving retirement benefits and how much<\/li>\n<li>The named beneficiary of the account<\/li>\n<\/ul>\n<p>Each financial institution or account custodian can advise you of specific account access requirements.<\/p>\n<h3>Social Security Benefits<\/h3>\n<p>Your surviving family members may be eligible to receive your\u00a0<a href=\"https:\/\/www.findlaw.com\/socialsecurity\/retirement-planning\/social-security-and-retirement-faqs.html\">Social Security<\/a>\u00a0or other benefits from the federal government after your death. Leave instructions for your loved ones to check for any\u00a0<a href=\"https:\/\/unclaimed.org\/\" target=\"_blank\" rel=\"noopener\">unclaimed assets<\/a>, too.<\/p>\n<p>The National Association of Unclaimed Property Administrators reports that $3 billion in unclaimed funds are returned yearly to their rightful owners. Yet tens of billions of dollars in unclaimed cash and property remain untouched.
