It also provides a state-by-state guide to probate courts across the country.<\/p>\n<h2>What Is Probate?<\/h2>\n<p>Probate has two meanings. Technically, it refers to the legal process of making sure a last will and testament is\u00a0<a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/what-is-a-valid-will.html\">valid<\/a>. It also refers to the\u00a0<a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/probate-and-estate-administration.html\">general process of distributing a deceased person&#8217;s estate<\/a>\u00a0(estate administration).<\/p>\n<p>The distribution of the decedent&#8217;s property in the probate estate takes place under the supervision of a probate court. It is carried out by a person known as the decedent&#8217;s\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-a-personal-representative-6-important-questions-and-answers\/\">personal representative<\/a>.<\/p>\n<p>If the representative is nominated in the decedent&#8217;s will, they are sometimes known as an executor. If appointed by the probate court without\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/wills\/what-happens-if-i-die-without-a-will-.html\">a will<\/a>, they are sometimes called an administrator. The executor or personal representative owes a\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/breach-of-fiduciary-duty.html#:~:text=When%20one%20party%20has%20an,to%20as%20a%20fiduciary%20duty.\">fiduciary duty<\/a>\u00a0to the estate and, therefore, the named beneficiaries.<\/p>\n<p>If a valid will exists, the terms of the will control the distribution of probate assets. If a\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/probate\/probate-process-without-a-will.html\">will does not exist<\/a>, probate is carried out according to\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/state-laws-estates-probate.html\">state laws of intestate succession<\/a>\u00a0in the state&#8217;s probate code.<\/p>\n<p>There is also the possibility that a small estate procedure can apply to the estate. States have\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/probate\/simplified-or-summary-probate-for-small-estates.html\">small estate procedures<\/a>\u00a0for estates not exceeding a certain amount. One small estate procedure involves the transfer of property by affidavit.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/probate\/the-probate-basics.html\">probate process<\/a>\u00a0normally includes the following steps:<\/p>\n<ul>\n<li>Filing a Petition for Probate<\/li>\n<li>Validating the decedent&#8217;s will, if one exists<\/li>\n<li>Swearing in a personal representative<\/li>\n<li>Inventorying and appraising the decedent&#8217;s probate assets, including personal property<\/li>\n<li>Giving notice to interested parties<\/li>\n<li>Paying estate debts and taxes<\/li>\n<li>Distributing remaining assets to beneficiaries named in the will or, if a will does not exist, to heirs according to\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/intestate-succession-laws-by-state.html#:~:text=When%20a%20person%20dies%20without,at%20the%20time%20of%20death.\">intestacy laws<\/a><\/li>\n<\/ul>\n<h2>Probate: Pros and Cons<\/h2>\n<p>Nearly all probate cases go smoothly. That said, the main downside of probate is that it can sometimes be time-consuming and expensive. Many states require waiting periods ranging from 30 to 90 days as part of the probate process. These waiting periods are generally designed to allow interested parties to contest the estate distribution before it is finalized.<\/p>\n<p>For example, creditors may hold up estate distribution if they remain unpaid. If there is not enough cash in the estate to pay off debts, some assets may need to be liquidated to cover the expense.<\/p>\n<p>Similarly, a\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/disinherit.html\" target=\"_blank\" rel=\"noopener\">disinherited heir<\/a>\u00a0may try to contest the validity of the will and seek to have the estate distributed according to intestacy laws instead. Such issues can drive up probate time and costs, which may be deducted from the estate&#8217;s value.<\/p>\n<p>Probate also serves as an important procedural safeguard. For example, if a will is invalid, the probate process is designed to find out. If the decedent left\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/wills\/changing-a-will.html\">a more recent will<\/a>, probate may be the only way to ensure the decedent&#8217;s actual wishes are identified and carried out. If the\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/estate-administration\/paying-the-debts-of-a-deceased-relative-who-is-responsible.html\">decedent was indebted<\/a>, the probate process can also give surviving relatives some peace of mind. The probate process helps resolve creditors&#8217; claims sooner rather than later.<\/p>\n<h3>Some Assets Do Not Go Through Probate<\/h3>\n<p>Some of the decedent&#8217;s assets avoid probate by the operation of law. For example, if real estate was owned as a\u00a0<a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/whats-the-difference-between-joint-tenants-with-survivorship-and-.html\">joint tenancy with the right of survivorship<\/a>, it would remain with the joint tenant following the decedent&#8217;s death. Thus, if a husband and wife owned the marital residence as\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/buying-a-home\/joint-tenancy-faq.html#:~:text=Two%20or%20more%20people%20can,people%20have%2050%2F50%20shares\">joint tenants<\/a>\u00a0and the husband died, the surviving spouse would become the sole owner of the real estate.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/what-is-a-beneficiary.html#:~:text=the%20probate%20court.-,Understanding%20Beneficiaries,or%20entity%20as%20a%20beneficiary.\">Beneficiary designations<\/a>\u00a0are used to transfer certain types of property. The types of property often transferred by beneficiary designations include:<\/p>\n<ul>\n<li>Retirement accounts<\/li>\n<li>Life insurance policies<\/li>\n<li>Bank accounts with transfer on death or payable on death orders<\/li>\n<\/ul>\n<p>Keeping beneficiary designations and other legal documents is critical.
