State rules for <span data-term-id=\"57645647\">in-person<\/span><span data-term-id=\"57645647\"> voting<\/span> and taking photos in and around <span data-term-id=\"57645625\">polling places<\/span> are also covered.<\/p>\n<h2>What Is <span data-term-id=\"57645626\">Electioneering<\/span>?<\/h2>\n<p><span data-term-id=\"57645626\">Electioneering<\/span> happens when political groups try to persuade registered voters to vote for or against a <span data-term-id=\"57645628\">political party<\/span>, candidate, or ballot initiative. <span data-term-id=\"57645626\">Electioneering<\/span> is legal during election season or at a distance from the polls. It becomes illegal and an attempt to influence voters as these advocates get closer to the polls and those trying to cast their votes.<\/p>\n<p><span data-term-id=\"57645626\">Electioneering<\/span> near <span data-term-id=\"57645625\">polling places<\/span> and drop boxes on <span data-term-id=\"57645630\">election day<\/span> is illegal in most states, though a few still permit it. State boards of election monitor this activity, as <span data-term-id=\"57645626\">electioneering<\/span> activities can impact election results. They can also become <span data-term-id=\"57645652\">voter intimidation<\/span> and even election fraud.<\/p>\n<h2><span data-term-id=\"57645638\">Electioneering<\/span><span data-term-id=\"57645638\"> Laws<\/span>: Restrictions on Polling Sites<\/h2>\n<p>Each state has some version of the law that regulates <span data-term-id=\"57645626\">electioneering<\/span> near <span data-term-id=\"57645625\">polling places<\/span> on Election Day. For instance, Delaware law prohibits wearing any button, banner, or other object that refers to issues, candidates, or partisan topics. <a href=\"https:\/\/codes.findlaw.com\/mn\/elections-ch-200-212\/mn-st-sect-204c-06.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57645643\">Minnesota<\/span>\u2019s <span data-term-id=\"57645638\">electioneering<\/span><span data-term-id=\"57645638\"> laws<\/span><\/a>\u00a0restrict such things as:<\/p>\n<ul>\n<li>The presence of unauthorized persons at a <span data-term-id=\"57645625\">polling place<\/span><\/li>\n<li>Campaigning within 100 feet of a <span data-term-id=\"57645625\">polling place<\/span><\/li>\n<li>The manner and location where exit polling can take place<\/li>\n<li>The location and conduct of news media representatives at <span data-term-id=\"57645625\">polling places<\/span><\/li>\n<\/ul>\n<p>As of March 2026, these are some of the restrictions that apply at state <span data-term-id=\"57645625\">polling places<\/span>:<\/p>\n<ul>\n<li>46 states and Washington, D.C., prohibit campaign materials, banners, signs, or other literature<\/li>\n<li>38 states prohibit influencing voters, political persuasion, or soliciting votes<\/li>\n<li>27 states prohibit <span data-term-id=\"57645645\">campaign apparel<\/span>, buttons, <span data-term-id=\"57645635\">stickers<\/span>, or placards<\/li>\n<li>23 states and Washington, D.C., prohibit circulating petitions or soliciting signatures<\/li>\n<li>11 states prohibit projecting sounds referring to candidates or issues<\/li>\n<li>21 states prohibit <span data-term-id=\"57645652\">voter intimidation<\/span> or interference with voters<\/li>\n<li>26 states prohibit obstructing the entrance or hindering voters<\/li>\n<li>11 states prohibit loitering<\/li>\n<li>Eight states prohibit polls or exit polls<\/li>\n<li>\n<p>Five states prohibit peddling or advertising<\/p>\n<\/li>\n<\/ul>\n<p>The\u00a0<a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/electioneering-prohibitions\" target=\"_blank\" rel=\"noopener\">National Conference of State Legislatures (NCSL)<\/a>\u00a0website provides detailed guidance.<\/p>\n<h3>Apparel Requirements at Polling Sites<\/h3>\n<p>Some states ban registered voters from wearing <span data-term-id=\"57645645\">campaign apparel<\/span> near polling stations. In\u00a0<a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/electioneering-prohibitions#:~:text=Table%202%3A%20Electioneering%20Apparel%20Restrictions\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57645637\">New York<\/span><\/a>, the law prohibits wearing <span data-term-id=\"57645645\">campaign apparel<\/span>, buttons, <span data-term-id=\"57645635\">stickers<\/span>, or placards within 100 feet of entrances to buildings where the election is held. As of April 2026, these are:<\/p>\n<ul>\n<li>Arkansas<\/li>\n<li><span data-term-id=\"57645650\">California<\/span><\/li>\n<li>Colorado<\/li>\n<li>Delaware<\/li>\n<li>Hawaii<\/li>\n<li>Indiana<\/li>\n<li>Kansas<\/li>\n<li>Maine<\/li>\n<li>Massachusetts<\/li>\n<li>Michigan<\/li>\n<li><span data-term-id=\"57645643\">Minnesota<\/span><\/li>\n<li>Montana<\/li>\n<li>Nebraska<\/li>\n<li>Nevada<\/li>\n<li>New Hampshire<\/li>\n<li>New Jersey<\/li>\n<li>New Mexico<\/li>\n<li><span data-term-id=\"57645637\">New York<\/span><\/li>\n<li>North Dakota<\/li>\n<li>Ohio<\/li>\n<li>Oklahoma<\/li>\n<li>Rhode Island<\/li>\n<li>South Carolina<\/li>\n<li><span data-term-id=\"57645646\">Tennessee<\/span><\/li>\n<li><span data-term-id=\"57645639\">Texas<\/span><\/li>\n<li>Vermont<\/li>\n<\/ul>\n<p>The U.S. Supreme Court addressed the issue of apparel restrictions at <span data-term-id=\"57645625\">polling places<\/span> in a\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/16-1435.html\" target=\"_blank\" rel=\"noopener\">2018 decision<\/a>. The Court ruled that states can\u2019t give broad prohibitions on wearing apparel in <span data-term-id=\"57645625\">polling places<\/span>. The decision found that the law was unconstitutionally vague and overbroad because it didn\u2019t clearly define what &#8220;political&#8221; apparel constituted. It allows some restrictions on voter attire at polling sites, but emphasizes that the law should include clear guidelines on what is prohibited.<\/p>\n<h3><span data-term-id=\"57645636\">State Laws<\/span> on Photography in <span data-term-id=\"57645625\">Polling Places<\/span><\/h3>\n<p>As of March 2026, laws on taking photos of yourself with your ballot, taking pictures of the interior of polling stations, and videotaping in and around polling sites <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/social-media-and-voting-update-on-ballot-selfie-laws\/\">are all over the map<\/a>. According to the National Conference of State Legislatures, even in states where \u201cballot selfies\u201d are permitted, other laws against privacy violations still apply. You cannot take pictures of <span data-term-id=\"57645632\">poll workers<\/span> or other voters.<\/p>\n<ul>\n<li>Ballot selfies are <strong>prohibited<\/strong> in: Alaska, Louisiana, Massachusetts, <span data-term-id=\"57645643\">Minnesota<\/span>, Mississippi, Missouri, Nevada, New Jersey, <span data-term-id=\"57645637\">New York<\/span>, North Carolina, Ohio, South Carolina, South Dakota, and Wisconsin.<\/li>\n<li>Ballot selfies are <strong>permitted<\/strong> by statute or regulation in: Alabama, <span data-term-id=\"57645650\">California<\/span>, Colorado, Hawaii, Iowa, Kentucky, Michigan, Nebraska, New Hampshire, New Mexico, Oklahoma, Oregon, and Utah.<\/li>\n<li>The status of ballot selfies is unclear or probably permitted in: Arkansas, Connecticut, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Kansas, Maine, Maryland, Montana, North Dakota, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, Wyoming, and the District of Columbia.<\/li>\n<li>Ballot selfies are prohibited for <span data-term-id=\"57645647\">in-person<\/span><span data-term-id=\"57645647\"> voting<\/span>, but the law is silent as to absentee ballots in: Arizona, Maryland, Michigan, <span data-term-id=\"57645646\">Tennessee<\/span>, <span data-term-id=\"57645639\">Texas<\/span>, and West Virginia.<\/li>\n<\/ul>\n<p>The\u00a0<a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/secrecy-of-the-ballot-and-ballot-selfies\" target=\"_blank\" rel=\"noopener\">laws on photography<\/a>, including ballot selfies and other forms of videotaping devices in <span data-term-id=\"57645625\">polling places<\/span>,\u00a0<a href=\"https:\/\/www.cnn.com\/interactive\/2020\/10\/politics\/ballot-selfie-trnd\/\" target=\"_blank\" rel=\"noopener\">vary from state to state<\/a>. Campaign material is any item or document that displays:<\/p>\n<ul>\n<li>A <span data-term-id=\"57645640\">candidate\u2019s name<\/span>, likeness, or logo<\/li>\n<li>A ballot measure, initiative number, or title<\/li>\n<li>Any other material with issues, candidates, or campaign topics<\/li>\n<\/ul>\n<p>This can include water bottles or candy bars with \u201cProvided by the Campaign to Elect John Doe\u201d on the items if handed out to voters at the polls.<\/p>\n<h3>Buffer Zones and Distance Requirements<\/h3>\n<p>All states have a designated area around their <span data-term-id=\"57645625\">polling places<\/span> where no\u00a0<span data-term-id=\"57645626\">electioneering<\/span>\u00a0or other activity is permitted. The distances average 100 feet from the entrance, but range from \u201cthe walks and driveways\u201d in Vermont to 500 feet in South Carolina. These laws can change rapidly, and your safest bet is to check with your election board or the <a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/electioneering-prohibitions\" target=\"_blank\" rel=\"noopener\">NCSL<\/a> before heading to the polls.<\/p>\n<h3>Other Prohibited <span data-term-id=\"57645626\">Electioneering<\/span> Activities<\/h3>\n<p>More than half of all states have other prohibited activities in their buffer zones, including:<\/p>\n<ul>\n<li>No soliciting signatures for next year\u2019s ballot initiatives<\/li>\n<li>No use of loudspeakers or megaphones<\/li>\n<li>No loitering in or around the polls<\/li>\n<li>No exit polls (asking people how they voted when they leave)<\/li>\n<li>No vending or selling any items<\/li>\n<\/ul>\n<p><span data-term-id=\"57645652\">Voter intimidation<\/span> remains a serious issue.
