It is a <span data-term-id=\"57655489\">federal crime<\/span> under 18 <span data-term-id=\"57655482\">U.S.C<\/span>. 594, and all states also have laws prohibiting this conduct. Common examples include physically blocking <span data-term-id=\"57655456\">polling places<\/span>, using threatening language, spreading <span data-term-id=\"57655483\">misinformation<\/span> about voting requirements, and harassing voters or <span data-term-id=\"57655473\">election workers<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<p>As an American citizen, you have certain rights, including the right to vote. As long as you\u2019re an\u00a0<span data-term-id=\"57655492\">eligible voter<\/span>, both federal and\u00a0<span data-term-id=\"57655462\">state law<\/span>\u00a0protect your\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/voting-rights.html\">voting rights<\/a>\u00a0and prohibit anyone from interfering with these rights. That doesn\u2019t mean that people and groups won\u2019t try to influence your vote. In some instances, this is perfectly legal. In others, it breaks the law.<\/p>\n<p>This article explains what <span data-term-id=\"57655455\">voter intimidation<\/span> entails and how you can combat it. You should also seek legal advice if you have any other questions about the <span data-term-id=\"57655475\">voting process<\/span>.<\/p>\n<h2>What Is <span data-term-id=\"57655455\">Voter Intimidation<\/span>?<\/h2>\n<p>In general, <span data-term-id=\"57655455\">voter intimidation<\/span> refers to behavior that makes another person uncomfortable voting for the party or candidate of their choice. <span data-term-id=\"57655455\">Voter intimidation<\/span> typically involves a person using threats, coercion, or other types of pressure to intimidate another voter or interfere with that person\u2019s <a href=\"https:\/\/www.findlaw.com\/voting.html\">right to vote<\/a> for their chosen candidate. It\u2019s <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-594.html\" target=\"_blank\" rel=\"noopener\">a <span data-term-id=\"57655489\">federal crime<\/span><\/a>.<\/p>\n<p>Voters have reported intimidation in recent elections in many jurisdictions, including <span data-term-id=\"57655479\">Texas<\/span>, <span data-term-id=\"57655500\">New Hampshire<\/span>, North Carolina, <span data-term-id=\"57655464\">Arizona<\/span>, Ohio, <span data-term-id=\"57655485\">Nevada<\/span>, and <span data-term-id=\"57655467\">Pennsylvania<\/span>. For example, several lawsuits were filed in the lead-up to the 2016 election alleging that \u201c<span data-term-id=\"57655486\">poll watching<\/span>\u201d activities intimidated voters. Those complaints alleged that unauthorized <span data-term-id=\"57655461\">poll watchers<\/span> were following people into the parking lots of polling stations to interrogate them, record their <span data-term-id=\"57655476\">license plates<\/span>, and call 911 to report them for committing a felony by voting.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/voter-intimidation-what-is-it-and-what-to-do.html\"><span data-term-id=\"57655455\">Voter intimidation<\/span><\/a> can take many forms. However, some are more common than others.<\/p>\n<p>Some intimidation tactics include:<\/p>\n<ul>\n<li>Physically blocking <span data-term-id=\"57655456\">polling places<\/span> or <span data-term-id=\"57655502\">election offices<\/span><\/li>\n<li>Using threatening language or brandishing weapons in or near a <span data-term-id=\"57655456\">polling place<\/span><\/li>\n<li>Yelling at people or calling them names while they are in line to vote<\/li>\n<li>Disrupting or interrogating voters<\/li>\n<li>Threatening <span data-term-id=\"57655473\">election workers<\/span><\/li>\n<li>Looking over people\u2019s shoulders while they are voting<\/li>\n<li>Questioning voters about their political choices, citizenship status, or criminal record<\/li>\n<li>Displaying false or misleading signage<\/li>\n<li>Spreading <span data-term-id=\"57655483\">misinformation<\/span> or <span data-term-id=\"57655478\">false information<\/span> about <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/who-can-vote-in-the-u-s.html\">voting requirements<\/a> and procedures<\/li>\n<li>Posting fake news on <span data-term-id=\"57655498\">social media<\/span><\/li>\n<\/ul>\n<p>If you experience or witness any of the above, notify <a href=\"https:\/\/www.eac.gov\/sites\/default\/files\/2023-08\/2023_Complete_Poll_Worker_Compendium.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655463\">poll workers<\/span><\/a> immediately. You should also talk to a <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655470\">civil rights<\/span> attorney<\/a> if you believe someone has violated your voting rights.<\/p>\n<h2>History of <span data-term-id=\"57655455\">Voter Intimidation<\/span> in the United States<\/h2>\n<p>The history of voting in America is full of examples of <span data-term-id=\"57655504\">voter suppression<\/span> and <span data-term-id=\"57655455\">voter intimidation<\/span>. After the Civil War, <a href=\"https:\/\/www.splcenter.org\/learning-for-justice\/understanding-voter-suppression-in-todays-election-process\/#:~:text=From%20purging%20voter%20rolls%2C%20restrictive%20identification%20rules%2C%20redistricting,obstacles%20to%20voting%2C%20especially%20for%20communities%20of%20color.\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655504\">voter suppression<\/span> campaigns<\/a> were so successful that only 3% of eligible African Americans in the South were registered to vote. In 1940, Congress recognized that this behavior undermined democratic principles and passed a\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-594.html\" target=\"_blank\" rel=\"noopener\">law criminalizing <span data-term-id=\"57655455\">voter intimidation<\/span><\/a>.<\/p>\n<p><span data-term-id=\"57655457\">Federal law<\/span> makes it illegal to intimidate, coerce, or threaten another person to interfere with their right to vote for whomever they choose. It is also illegal to try to force another individual to vote a particular way.<\/p>\n<p>Under this law, any person who engages in the above behavior is subject to fines and up to one year in federal prison. While this law applies only to\u00a0<a href=\"https:\/\/codes.findlaw.com\/cfr\/title-11-federal-elections\/\" target=\"_blank\" rel=\"noopener\">federal elections<\/a>, other state and\u00a0<span data-term-id=\"57655457\">federal laws<\/span>\u00a0prohibit\u00a0<span data-term-id=\"57655455\">voter intimidation<\/span>\u00a0in all\u00a0elections.<\/p>\n<h3>Other <span data-term-id=\"57655457\">Federal Laws<\/span> Against <span data-term-id=\"57655455\">Voter Intimidation<\/span><\/h3>\n<p>The federal government has passed several pieces of legislation that prohibit <span data-term-id=\"57655455\">voter intimidation<\/span>. In addition to the above law, there are other laws protecting citizens\u2019 right to vote, free from <a href=\"https:\/\/www.congress.gov\/crs_external_products\/LSB\/PDF\/LSB10781\/LSB10781.5.pdf\" target=\"_blank\" rel=\"noopener\">harassment<\/a> and threats of violence.<\/p>\n<p>Some of the other <span data-term-id=\"57655455\">voter intimidation<\/span>-related <span data-term-id=\"57655457\">federal laws<\/span> include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.senate.gov\/artandhistory\/history\/common\/image\/EnforcementAct_1870_Page_1.htm\" target=\"_blank\" rel=\"noopener\">The\u00a0<span data-term-id=\"57655488\">Ku Klux Klan Act<\/span>\u00a0of 1871<\/a>\u00a0protected newly freed slaves from harassment at\u00a0<span data-term-id=\"57655480\">polling locations<\/span>\u00a0on\u00a0<span data-term-id=\"57655459\">election day<\/span><\/li>\n<li>The\u00a0<a href=\"https:\/\/www.archives.gov\/milestone-documents\/voting-rights-act\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655465\">Voting Rights Act<\/span> of 1965<\/a> banned intimidation, threats, and coercion<\/li>\n<\/ul>\n<p>It\u2019s the job of <span data-term-id=\"57655458\">election officials<\/span> and <span data-term-id=\"57655460\">law enforcement<\/span> to prevent\u00a0<span data-term-id=\"57655455\">voter intimidation<\/span>.<\/p>\n<h3><span data-term-id=\"57655455\">Voter Intimidation<\/span> vs. <span data-term-id=\"57655504\">Voter Suppression<\/span><\/h3>\n<p><span data-term-id=\"57655455\">Voter intimidation<\/span> and <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/voter-suppression-and-voter-id-laws.html\"><span data-term-id=\"57655504\">voter suppression<\/span><\/a> are sometimes used interchangeably, but they are two very different things. <span data-term-id=\"57655455\">Voter intimidation<\/span> occurs when someone takes measures to interfere with another person\u2019s ability to vote.<\/p>\n<p><span data-term-id=\"57655504\">Voter suppression<\/span>, on the other hand, involves individuals or groups using legal and extralegal tactics or strategies to limit voter participation by certain groups. In many situations involving <span data-term-id=\"57655504\">voter suppression<\/span>, an individual or group targets members of a specific race, socioeconomic class, or other marginalized group. The goal of <span data-term-id=\"57655455\">voter intimidation<\/span> is to force a person to vote (or not vote) in a particular way, while the goal of <a href=\"https:\/\/govfacts.org\/elections-voting\/voting-rights-reform\/barriers-to-voting-voter-suppression\/voter-roll-purges-what-due-process-protections-the-law-requires\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655504\">voter suppression<\/span><\/a> is to prevent people from voting altogether.<\/p>\n<h2>State <span data-term-id=\"57655455\">Voter <\/span><span data-term-id=\"57655505\">Intimidation<\/span><span data-term-id=\"57655505\"> Laws<\/span><\/h2>\n<p>All states have <span data-term-id=\"57655455\">voter <\/span><span data-term-id=\"57655505\">intimidation<\/span><span data-term-id=\"57655505\"> laws<\/span>. The purpose of these laws is to increase <a href=\"https:\/\/worldpopulationreview.com\/state-rankings\/voter-turnout-by-state\" target=\"_blank\" rel=\"noopener\">voter turnout<\/a> and participation in the <span data-term-id=\"57655481\">election process<\/span>. Over time, the states have done what they can to increase <span data-term-id=\"57655484\">voter eligibility<\/span>. For example, literacy tests and laws requiring that voters read and write English no longer exist in this country. There is also a long history of voter <span data-term-id=\"57655497\">advocacy<\/span> in this country.<\/p>\n<p>This does not mean that problems with <span data-term-id=\"57655455\">voter intimidation<\/span> don\u2019t still exist. Some people, including political candidates, will go any length to prevent certain groups of voters from casting their ballots.<\/p>\n<p>As a result, <span data-term-id=\"57655496\">state officials<\/span> have passed laws ensuring that citizens can participate in the <span data-term-id=\"57655475\">voting process<\/span> without fear of harm or retaliation. For example, <span data-term-id=\"57655508\">Florida<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/fl\/title-ix-electors-and-elections\/fl-st-sect-104-0615.html\" target=\"_blank\" rel=\"noopener\">Voter Protection Act<\/a> prohibits people from engaging in <span data-term-id=\"57655455\">voter intimidation<\/span> or suppression by using force, violence, or intimidation to push others to vote (or not vote) in a certain way.<\/p>\n<p>Other jurisdictions, such as <span data-term-id=\"57655507\">Georgia<\/span> and <a href=\"https:\/\/www.findlaw.com\/voting\/wisconsin-voting-guide.html\"><span data-term-id=\"57655493\">Wisconsin<\/span><\/a>, also have <span data-term-id=\"57655462\">state laws<\/span> that prohibit this sort of behavior. The <span data-term-id=\"57655487\">criminal penalties<\/span> for violating these laws vary by state and the type of intimidation used.<\/p>\n<h2><span data-term-id=\"57655461\">Poll Watchers<\/span> and <span data-term-id=\"57655455\">Voter Intimidation<\/span><\/h2>\n<p><a href=\"https:\/\/www.cnn.com\/2016\/10\/29\/politics\/poll-watchers-monitors\/index.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655486\">Poll watching<\/span><\/a>\u00a0helps ensure a <span data-term-id=\"57655501\">fair election<\/span>, but unauthorized <span data-term-id=\"57655461\">poll watchers<\/span> sometimes resort to\u00a0<span data-term-id=\"57655455\">voter intimidation<\/span>. A political party or party nominee appoints specific people to serve as <span data-term-id=\"57655461\">poll watchers<\/span>. These individuals undergo training and hold certifications. <span data-term-id=\"57655461\">Poll watchers<\/span> must register to vote in the state, county, or district they track. Some states limit the number of <span data-term-id=\"57655461\">poll watchers<\/span> allowed in the <span data-term-id=\"57655456\">polling place<\/span> at any given time.<\/p>\n<p>In many states, <span data-term-id=\"57655461\">poll watchers<\/span> inspect the signature rosters and observe vote-counting activity. In some jurisdictions, <span data-term-id=\"57655461\">poll watchers<\/span> can challenge <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote.html\"><span data-term-id=\"57655503\">voters\u2019 right<\/span> to vote<\/a>. In others, only <span data-term-id=\"57655463\">poll workers<\/span> may challenge a voter. Learn more about the specific rules in each state on\u00a0<span data-term-id=\"57655461\">poll watchers<\/span> and voter challenges\u00a0at the <a href=\"https:\/\/www.nass.org\/resources\/2018-election-information\/Poll-Watchers-Voter-Challenges\" target=\"_blank\" rel=\"noopener\">National Association of Secretaries of State<\/a>.<\/p>\n<h2>Certified <span data-term-id=\"57655461\">Poll Watchers<\/span> vs. Self-Appointed Poll Monitors<\/h2>\n<p>Some people undergo training and certification to become legal\u00a0<span data-term-id=\"57655461\">poll watchers<\/span>. Their job is to ensure that voters are free to cast their ballot without interference and harassment. The government tasks these people with protecting the integrity of the <a href=\"https:\/\/www.findlaw.com\/voting\/how-u-s-elections-work.html\"><span data-term-id=\"57655475\">voting process<\/span><\/a>.<\/p>\n<p>Certified <span data-term-id=\"57655461\">poll watchers<\/span> are not technically <span data-term-id=\"57655473\">election workers<\/span>. However, they are allowed to be present in the <span data-term-id=\"57655456\">polling places<\/span> to monitor voters\u2019 behavior. While they cannot interfere with the <a href=\"https:\/\/www.findlaw.com\/voting\/how-u-s-elections-work\/what-is-the-contingent-election-and-voting-process.html\"><span data-term-id=\"57655481\">election process<\/span><\/a>, they can point out irregularities and violations of election procedures.<\/p>\n<p>There are also people who consider themselves self-appointed <span data-term-id=\"57655463\">poll workers<\/span>. They are not trained, nor do they carry the necessary certifications. They typically dress in tactical gear and harass voters both inside and outside the <span data-term-id=\"57655456\">polling place<\/span>. These self-appointed <a href=\"https:\/\/archive.findlaw.com\/blog\/how-do-you-become-a-poll-worker-or-election-judge\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655463\">poll workers<\/span><\/a> often engage in illegal behavior and may face <span data-term-id=\"57655487\">criminal penalties<\/span> under both federal and <span data-term-id=\"57655462\">state law<\/span>. If you\u2019re confronted in this manner, alert the <span data-term-id=\"57655463\">poll workers<\/span>, <span data-term-id=\"57655458\">election officials<\/span>, or <span data-term-id=\"57655460\">law enforcement<\/span>.<\/p>\n<h2><span data-term-id=\"57655455\">Voter Intimidation<\/span> Isn\u2019t Limited to the <span data-term-id=\"57655456\">Polling Place<\/span><\/h2>\n<p><span data-term-id=\"57655455\">Voter intimidation<\/span> isn\u2019t limited to your local <span data-term-id=\"57655480\">polling location<\/span>. It happens at all levels of the <span data-term-id=\"57655475\">voting process<\/span>, including voting <span data-term-id=\"57655477\">drop boxes<\/span> and <a href=\"https:\/\/www.vote.org\/polling-place-locator\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655466\">voter registration<\/span> centers<\/a>. You may see it happen at the Department of Motor Vehicles, a government agency that now handles automatic <span data-term-id=\"57655466\">voter registration<\/span> in many states.<\/p>\n<p>Some of the places you may experience or witness <span data-term-id=\"57655455\">voter intimidation<\/span> include:<\/p>\n<ul>\n<li><span data-term-id=\"57655480\">Polling locations<\/span><\/li>\n<li><span data-term-id=\"57655477\">Drop boxes<\/span><\/li>\n<li><a href=\"https:\/\/nationalvoterregistrationday.org\/state-voter-guides\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655466\">Voter registration<\/span> drives<\/a><\/li>\n<li>Government agencies where people register to vote<\/li>\n<li><span data-term-id=\"57655502\">Election offices<\/span><\/li>\n<\/ul>\n<p>If you witness or experience <span data-term-id=\"57655455\">voter intimidation<\/span> at any of these locations (or any other place), report it immediately.<\/p>\n<h2>What Should You Do if You Have Experienced <span data-term-id=\"57655455\">Voter Intimidation<\/span>?<\/h2>\n<p>If someone intimidates or harasses you while you\u2019re in line to vote or inside a polling station, you can call for immediate help. You can also report instances of <span data-term-id=\"57655463\">poll workers<\/span> intimidating other voters. Some options you have are:<\/p>\n<ul>\n<li>Notify a <span data-term-id=\"57655463\">poll worker<\/span> of the intimidation tactic you observed.\u00a0Talk to the election supervisor or call your state <span data-term-id=\"57655469\">board of elections<\/span> to report the activity. You can also report it to the election commissioner.<\/li>\n<li>You can report intimidation to the <a href=\"https:\/\/866ourvote.org\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57655490\">Election Protection Hotline<\/span><\/a>: 1-866-OUR-VOTE.\u00a0To report in Spanish, call 1-888-VE-Y-VOTA.<\/li>\n<li>Call the\u00a0<span data-term-id=\"57655471\">U.S. Department of Justice<\/span> voting rights hotline at 1-800-253-3931. You can also report incidents at the <a href=\"https:\/\/www.justice.gov\/crt\/voting-section\" target=\"_blank\" rel=\"noopener\">DOJ\u2019s website<\/a>.<\/li>\n<li>Report\u00a0<span data-term-id=\"57655455\">voter intimidation<\/span> to your local police.
