These efforts often focus on helping elderly voters or people who live in remote areas ensure their ballot gets in on time.<\/p>\n\n    <\/div>\n\n\n\n<p>An increasing number of states have made mail-in and <span data-term-id=\"58131124\">absentee voting<\/span> more accessible to citizens. This allows more people to vote by\u00a0<span data-term-id=\"58131110\">absentee ballot<\/span>. Not every voter can easily deliver their <span data-term-id=\"58131110\">absentee ballot<\/span> to an official polling station or postal facility, so <span data-term-id=\"58131111\">ballot collection<\/span> is allowed by law in most states.<\/p>\n<p>In all states that allow mail-in and <span data-term-id=\"58131110\">absentee ballots<\/span>, each ballot is marked with a unique barcode. The barcode allows voters to track their vote\u2019s status and also prevents a voter from voting more than once in any election. If a voter wants to use a <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/what-are-the-provisional-ballot-laws-by-state.html\">provisional ballot<\/a> to correct a voting error on an\u00a0<span data-term-id=\"58131110\">absentee ballot<\/span>, the barcode allows\u00a0<span data-term-id=\"58131108\">election officials<\/span>\u00a0to easily void the\u00a0<span data-term-id=\"58131114\">mailed ballot<\/span>.<\/p>\n<p>The use of barcodes prevents the type of individual voter fraud that the media and politicians fear could result from <span data-term-id=\"58131107\">ballot harvesting<\/span>. Despite claims, there\u2019s no evidence of widespread voter fraud using <span data-term-id=\"58131107\">ballot harvesting<\/span>.<\/p>\n<h2>Who Can Return an <span data-term-id=\"58131110\">Absentee Ballot<\/span>?<\/h2>\n<p>Some voters can have someone else submit their <span data-term-id=\"58131110\">absentee ballot<\/span> for them, such as:<\/p>\n<ul>\n<li>A <span data-term-id=\"58131109\">family member<\/span><\/li>\n<li>A <span data-term-id=\"58131152\">legal guardian<\/span><\/li>\n<li>A <span data-term-id=\"58131121\">caregiver<\/span><\/li>\n<\/ul>\n<p>The rules depend on where you live. Some states, like Rhode Island and <span data-term-id=\"58131160\">Wyoming<\/span>, don\u2019t have policies addressing <span data-term-id=\"58131110\">absentee ballot<\/span> returns. Most <span data-term-id=\"58131130\">state laws<\/span> include regulations on who can deliver an <span data-term-id=\"58131110\">absentee ballot<\/span>.<\/p>\n<p>According to the\u00a0<a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/table-10-ballot-collection-laws\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58131150\">National Conference of <\/span><span data-term-id=\"58131115\">State Legislatures<\/span><\/a>, 35 states explicitly allow someone to return an <span data-term-id=\"58131110\">absentee ballot<\/span> on another voter\u2019s behalf. Those states include:<\/p>\n<ul>\n<li><span data-term-id=\"58131125\">Arizona<\/span><\/li>\n<li>Arkansas<\/li>\n<li><span data-term-id=\"58131112\">California<\/span><\/li>\n<li><span data-term-id=\"58131136\">Colorado<\/span><\/li>\n<li><span data-term-id=\"58131144\">Georgia<\/span><\/li>\n<li>Illinois<\/li>\n<li>Kansas<\/li>\n<li>Michigan<\/li>\n<li>New York<\/li>\n<\/ul>\n<p>Some states specify that only a <span data-term-id=\"58131109\">family member<\/span>, <span data-term-id=\"58131121\">caregiver<\/span>, or &#8220;designated bearer&#8221; can turn in someone else\u2019s <span data-term-id=\"58131110\">absentee ballot<\/span>. <span data-term-id=\"58131111\">Ballot collection<\/span>, also known as\u00a0<span data-term-id=\"58131107\">ballot harvesting<\/span>, occurs in states that do not dictate who can deliver <span data-term-id=\"58131110\">absentee ballots<\/span>.<\/p>\n<h2>What Is <span data-term-id=\"58131107\">Ballot Harvesting<\/span>?<\/h2>\n<p>Various organizations have coordinated efforts to collect absentee <span data-term-id=\"58131137\">voters\u2019 ballots<\/span> during elections. These are dropped off at <span data-term-id=\"58131122\">polling places<\/span> or <span data-term-id=\"58131134\">election offices<\/span>.<\/p>\n<p>This practice, known as <span data-term-id=\"58131111\">ballot collecting<\/span> or <span data-term-id=\"58131107\">ballot harvesting<\/span>, has been effective at increasing voter participation. It has also generated controversy and concern about election fraud in the form of unsubstantiated fraud claims. The practice of <span data-term-id=\"58131111\">ballot collection<\/span> as a voter service that can help many groups, such as:<\/p>\n<ul>\n<li>Elderly voters<\/li>\n<li>People with disabilities<\/li>\n<li>Native American voters living on remote reservations<\/li>\n<\/ul>\n<p>Beginning with the 2020 national elections, allegations of\u00a0<span data-term-id=\"58131107\">ballot harvesting<\/span>\u00a0were reported in the media, tied to election fraud.<\/p>\n<p><span data-term-id=\"58131107\">Ballot harvesting<\/span>, or <span data-term-id=\"58131111\">ballot collection<\/span>, is allowed by law in most states if the voter is unable to deliver a mail-in or <span data-term-id=\"58131110\">absentee ballot<\/span> to the polling station themselves. Whether <span data-term-id=\"58131107\">ballot harvesting<\/span> is legal depends on your state\u2019s <span data-term-id=\"58131124\">absentee <\/span><span data-term-id=\"58131147\">voting<\/span><span data-term-id=\"58131147\"> laws<\/span> and mail-in voting rules.<\/p>\n<h3><span data-term-id=\"58131124\">Absentee Voting<\/span><\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/who-can-vote-in-the-u-s--.html\">Nearly every U.S. citizen<\/a>\u00a0has the right to vote. Not everyone can get to a <span data-term-id=\"58131122\">polling place<\/span> during election time to vote\u00a0<span data-term-id=\"58131129\">in person<\/span>. This can happen for various reasons, such as:<\/p>\n<ul>\n<li>Military service<\/li>\n<li>Injury or illness<\/li>\n<li>Vacation<\/li>\n<li>Business travel<\/li>\n<\/ul>\n<p>All states have protocols for <span data-term-id=\"58131133\">early voting<\/span> and\u00a0<a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/absentee-voting-laws.html\"><span data-term-id=\"58131124\">absentee voting<\/span><\/a>\u00a0in general and <span data-term-id=\"58131149\">primary elections<\/span>. There are different types of <span data-term-id=\"58131110\">absentee ballots<\/span>. Some have different rules than others. The two main types of <span data-term-id=\"58131124\">absentee voting<\/span> are &#8220;no-excuse&#8221; and &#8220;qualified.&#8221;<\/p>\n<p>Most states in the U.S. do not require a voter to give a reason they can\u2019t vote <span data-term-id=\"58131129\">in person<\/span> on <span data-term-id=\"58131116\">Election Day<\/span>. These &#8220;no-excuse&#8221; states will mail a paper ballot to voters upon request. Voters can then fill out the ballot and return it to the <span data-term-id=\"58131134\">election office<\/span>. <a href=\"https:\/\/dictionary.findlaw.com\/definition\/elector.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58131159\">Electors<\/span><\/a>\u00a0can also place the <span data-term-id=\"58131139\">completed ballot<\/span> in a <span data-term-id=\"58131132\">ballot drop box<\/span>.<\/p>\n<p>Other states require voters to meet\u00a0<a href=\"https:\/\/www.vote.org\/absentee-voting-rules\/\" target=\"_blank\" rel=\"noopener\">specific requirements<\/a>\u00a0before they are eligible to receive an <span data-term-id=\"58131110\">absentee ballot<\/span>. For example,\u00a0<a href=\"https:\/\/codes.findlaw.com\/ar\/title-7-elections\/ar-code-sect-7-5-402.html\" target=\"_blank\" rel=\"noopener\">Arkansas<\/a> voters are only eligible for an <span data-term-id=\"58131110\">absentee ballot<\/span> if they are:<\/p>\n<ul>\n<li>\u201cUnavoidably absent&#8221; from their polling site on the day of the election<\/li>\n<li>Experiencing an illness or physical disability<\/li>\n<li>Unable to attend due to a religious holiday or service during the entire 12 hours the polls are open<\/li>\n<li>Serving in the armed forces or being a dependent <span data-term-id=\"58131109\">family member<\/span> of someone who is serving<\/li>\n<li>Temporarily living outside of the U.S. during an election<\/li>\n<\/ul>\n<p>Each state has different laws. You can find your state\u2019s <span data-term-id=\"58131147\">voting laws<\/span> at <a href=\"https:\/\/www.findlaw.com\/voting.html\">FindLaw\u2019s Voting Center<\/a>.<\/p>\n<h3>Mail-in Voting<\/h3>\n<p>There are currently\u00a0<a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/table-18-states-with-all-mail-elections\" target=\"_blank\" rel=\"noopener\">eight states<\/a>\u00a0in the U.S. and the District of Columbia that conduct state and federal voting entirely by <span data-term-id=\"58131140\">mail-in ballot<\/span>:<\/p>\n<ul>\n<li><span data-term-id=\"58131112\">California<\/span><\/li>\n<li><span data-term-id=\"58131136\">Colorado<\/span><\/li>\n<li><span data-term-id=\"58131161\">Hawaii<\/span><\/li>\n<li><span data-term-id=\"58131154\">Nevada<\/span><\/li>\n<li>Oregon<\/li>\n<li>Utah<\/li>\n<li>Vermont<\/li>\n<li>Washington<\/li>\n<\/ul>\n<p>These states automatically mail election ballots to registered voters a few weeks before the election. Voters can then fill out their ballots and deposit them in a nearby ballot mailbox before the election. In some regions, people other than voters are legally allowed to submit\u00a0<span data-term-id=\"58131137\">voter ballots<\/span>, which can facilitate <span data-term-id=\"58131107\">ballot harvesting<\/span>.<\/p>\n<h2>Is <span data-term-id=\"58131107\">Ballot Harvesting<\/span> Legal?<\/h2>\n<p>Jurisdictions that allow <span data-term-id=\"58131111\">ballot collection<\/span> differ in the methods they allow. For example, some states ban compensation based on the number of <span data-term-id=\"58131110\">absentee ballots<\/span> returned.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/al\/title-17-elections\/al-code-sect-17-11-9\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58131145\">Alabama<\/span><\/a>\u00a0specifies that only the absentee voter may return their own <span data-term-id=\"58131114\">mail ballot<\/span>. <span data-term-id=\"58131107\">Ballot harvesting<\/span> can only happen in states that do not restrict who can turn in <span data-term-id=\"58131110\">absentee ballots<\/span>.\u00a0In <a href=\"https:\/\/codes.findlaw.com\/pa\/title-25-ps-elections-electoral-districts\/pa-st-sect-25-3146-6.html#:~:text=the%20elector%20shall%20send%20same%20by%20mail%2C%20postage%20prepaid%2C%20except%20where%20franked%2C%20or%20deliver%20it%20in%20person%20to%20said%20county%20board%20of%20election.\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58131171\">Pennsylvania<\/span><\/a>\u00a0and\u00a0<a href=\"https:\/\/codes.findlaw.com\/wi\/elections-ch-5-to-12\/wi-st-6-87\/#:~:text=The%20envelope%20shall%20be%20mailed%20by%20the%20elector%2C%20or%20delivered%20in%20person%2C%20to%20the%20municipal%20clerk%20issuing%20the%20ballot%20or%20ballots.\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58131168\">Wisconsin<\/span><\/a>, voters must return their own ballot, except under certain exemptions.<\/p>\n<p>Other states limit the <span data-term-id=\"58131128\">number of ballots<\/span> people can collect and deliver per election cycle. These states include:<\/p>\n<ul>\n<li>Arkansas (2)<\/li>\n<li><span data-term-id=\"58131136\">Colorado<\/span> (10)<\/li>\n<li><span data-term-id=\"58131158\">Florida<\/span> (2)<\/li>\n<li><span data-term-id=\"58131138\">Iowa<\/span> (2)<\/li>\n<li>Minnesota (3)<\/li>\n<li><span data-term-id=\"58131127\">Montana<\/span> (6)<\/li>\n<li><span data-term-id=\"58131157\">New Jersey<\/span> (Up to five if they are <span data-term-id=\"58131166\">immediate <\/span><span data-term-id=\"58131109\">family<\/span><span data-term-id=\"58131109\"> members<\/span> living in the same household; otherwise, no more than three)<\/li>\n<li><span data-term-id=\"58131156\">North Dakota<\/span> (4)<\/li>\n<li>Vermont (25)<\/li>\n<li>West Virginia (2)<\/li>\n<\/ul>\n<p>Some practices that are uniformly illegal across the nation include:<\/p>\n<ul>\n<li>Filling out a ballot for another voter<\/li>\n<li>Intimidating a voter into voting for or against a candidate<\/li>\n<li>Influencing a voter\u2019s decision<\/li>\n<\/ul>\n<p>In practice, <span data-term-id=\"58131107\">ballot harvesting<\/span> tends to increase the number of votes tallied within a given election without much controversy. <span data-term-id=\"58131147\">Voting laws<\/span> vary from state to state, and slight differences can dramatically affect an election. Let\u2019s take a look at <span data-term-id=\"58131107\">ballot harvesting<\/span> laws in Louisiana, New Hampshire, and Texas.<\/p>\n<h3>Louisiana Laws on <span data-term-id=\"58131107\">Ballot Harvesting<\/span><\/h3>\n<p>Louisiana has <a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-18-sect-1308\/\" target=\"_blank\" rel=\"noopener\">complex rules<\/a> about anyone other than a <span data-term-id=\"58131109\">family member<\/span> who delivers a <span data-term-id=\"58131139\">completed ballot<\/span>. An <span data-term-id=\"58131159\">elector<\/span> may designate someone. Unless they are a\u00a0<span data-term-id=\"58131109\">family member<\/span>, a commercial courier, or the Post Office, that person must sign a statement prepared by the\u00a0<span data-term-id=\"58131148\">Secretary of State<\/span>\u00a0certifying that they have the voter&#8217;s authorization and consent to hand-deliver the marked ballot.<\/p>\n<h3>New Hampshire Laws on <span data-term-id=\"58131107\">Ballot Harvesting<\/span><\/h3>\n<p>Like Louisiana, New Hampshire permits non-<span data-term-id=\"58131109\">family members<\/span> to deposit ballots <a href=\"https:\/\/gc.nh.gov\/rsa\/html\/lxiii\/657\/657-17.htm\" target=\"_blank\" rel=\"noopener\">under certain circumstances<\/a>. If the <span data-term-id=\"58131159\">elector<\/span> is a resident of a care facility, a staff member can deliver the ballot with a photo ID and a completed government form.<\/p>\n<h3>Texas Laws on <span data-term-id=\"58131107\">Ballot Harvesting<\/span><\/h3>\n<p>Assistants other than <span data-term-id=\"58131109\">family members<\/span> must complete a certificate attached to the ballot envelope. Envelopes may not be collected and stored at one location before delivery to the <span data-term-id=\"58131133\">early voting<\/span> clerk. If they are collected and stored with the intent to defraud the voter or impact the outcome of the election, the <span data-term-id=\"58131142\">board of elections<\/span> can refer the person who did so to the <a href=\"https:\/\/codes.findlaw.com\/tx\/election-code\/elec-sect-86-006\/\" target=\"_blank\" rel=\"noopener\">state attorney general\u2019s office<\/a> for prosecution.<\/p>\n<h2><span data-term-id=\"58131107\">Ballot Harvesting<\/span> and National Elections<\/h2>\n<p>In 2024, <a href=\"https:\/\/www.justsecurity.org\/104174\/election-top-10-oct-23\/#:~:text=Voter%20Eligibility%20Challenges-,In%20multiple%20states%2C,-Republicans%20are%20challenging\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"58131113\">Republican<\/span> Party<\/a> filed challenges to the Uniformed and Overseas Citizens <span data-term-id=\"58131124\">Absentee Voting<\/span> Act (UOCAVA) and other laws that allow spouses and adult children of service members to vote absentee in their home states. Challenges were filed in Michigan, <span data-term-id=\"58131117\">North Carolina<\/span>, and <span data-term-id=\"58131171\">Pennsylvania<\/span>. All three challenges were eventually dismissed by judges.<\/p>\n<p>In 2026, a <a href=\"https:\/\/www.courthousenews.com\/fifth-circuit-finds-texas-ban-on-ballot-harvesting-constitutional\/\" target=\"_blank\" rel=\"noopener\">federal court upheld the state of Texas\u2019s ban<\/a> on paid <span data-term-id=\"58131107\">ballot harvesting<\/span>, ruling that the law was not unconstitutionally vague. The decision stated that a reasonable distinction could be made between trinkets given to volunteers assisting in <span data-term-id=\"58131111\">ballot collection<\/span> and taking money to influence undecided voters.<\/p>\n<p>Notwithstanding claims of extensive voting fraud due to <span data-term-id=\"58131107\">ballot harvesting<\/span>\u00a0<span style=\"margin: 0px;padding: 0px\">in vote-by-mail campaigns, the conservative Heritage Foundation and the more liberal Brookings Institution both agree that the\u00a0<a href=\"https:\/\/www.brookings.edu\/articles\/mail-voting-in-the-us-data-points-to-very-low-fraud-and-significant-benefits-to-voters\/\" target=\"_blank\" rel=\"noopener\">total number of fraudulent ballots<\/a> cast between 2000 and 2022 was less than 0.000043% of the total\u00a0<\/span>returns.<\/p>\n<h2>So, Who Can Return My Ballot?<\/h2>\n<p>Even in states that allow <span data-term-id=\"58131109\">family members<\/span> or <span data-term-id=\"58131146\">household members<\/span> to <span data-term-id=\"58131118\">return ballots<\/span>, the definitions of these terms vary. Some states specifically include &#8216;domestic partners&#8217; in their definition of family, while others do not.<\/p>\n<p>What counts as a &#8216;<span data-term-id=\"58131121\">caregiver<\/span>&#8216; can also be unclear. Some states require professional caregiving relationships, while others allow informal <span data-term-id=\"58131121\">caregivers<\/span>, such as neighbors, to regularly assist elderly voters. Roommates may qualify as <span data-term-id=\"58131146\">household members<\/span> in some jurisdictions but not others. Voters should contact their <span data-term-id=\"58131162\">local <\/span><span data-term-id=\"58131134\">election<\/span><span data-term-id=\"58131134\"> office<\/span> if they&#8217;re unsure whether someone helping them return their ballot meets their state&#8217;s legal requirements.<\/p>\n<h2>What Voters Should Know<\/h2>\n<p><span data-term-id=\"58131130\">State laws<\/span> on mail-in voting, <span data-term-id=\"58131110\">absentee ballots<\/span>, and other election requirements change regularly. The most recent laws on mail-in voting and <span data-term-id=\"58131164\">redistricting<\/span> are awaiting the\u00a0<span data-term-id=\"58131169\">U.S. <\/span><span data-term-id=\"58131119\">Supreme Court<\/span>&#8216;s ruling. To stay up to date on who is authorized to collect and deliver ballots in your state, check your local voter registration office or election board, the <span data-term-id=\"58131148\">Secretary of State<\/span>\u2019s office, or an online source such as the <a href=\"https:\/\/www.ncsl.org\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58131150\">National Conference of <\/span><span data-term-id=\"58131115\">State Legislatures<\/span><\/a>, which has the most current data.<\/p>\n<p>States that permit designated deliveries do not allow anyone to take more than two or three ballots at a time, except in Vermont. No one should be going door to door to gather ballots to take them to the polls. If you suspect something unlawful or suspicious is happening in your area, contact the election board, law enforcement, or the state attorney general\u2019s office.<\/p>\n<p>Contact your <span data-term-id=\"58131162\">local <\/span><span data-term-id=\"58131134\">election<\/span><span data-term-id=\"58131134\"> office<\/span> if you\u2019re unsure how to handle your ballot during an election.
