Congress added\u00a0<a href=\"https:\/\/www.justice.gov\/crt\/language-minority-citizens\" target=\"_blank\" rel=\"noopener\">Section 203<\/a>, which requires certain jurisdictions to provide <span data-term-id=\"58126129\">language assistance<\/span> during elections.<\/p>\n<p>If a jurisdiction fails to comply with Section 203, the U.S.\u00a0<span data-term-id=\"58126150\">Department of Justice<\/span>\u00a0can take action, including filing\u00a0a lawsuit in federal court. <span data-term-id=\"58126137\">Election officials<\/span> are legally responsible for providing these services.<\/p>\n<h2>When Does the Federal Government Require Bilingual Ballots?<\/h2>\n<p><span data-term-id=\"58126129\">Language assistance<\/span> rights under\u00a0<a href=\"https:\/\/www.justice.gov\/crt\/language-minority-citizens\" target=\"_blank\" rel=\"noopener\">Section 203<\/a>\u00a0depend on your place of residence, not individual circumstances. If your jurisdiction is covered, all voters there have the right to access <span data-term-id=\"58126124\">election materials<\/span> in the covered language, regardless of their <span data-term-id=\"58126132\">English language<\/span> proficiency.<\/p>\n<p>Every five years, the <span data-term-id=\"58126127\">Census Bureau<\/span> determines which areas need language help through data from the\u00a0<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:52+section:10503+edition:prelim)\" target=\"_blank\" rel=\"noopener\">American Community Survey<\/a>. An area is covered for a language group if it meets at least one of these conditions:<\/p>\n<ul>\n<li>The proportion of <span data-term-id=\"58126126\">voting-age citizens<\/span> with <span data-term-id=\"58126135\">limited English proficiency<\/span> (LEP) in that language group exceeds 5% of the jurisdiction&#8217;s total voting-age population<\/li>\n<li>There are more than 10,000 LEP <span data-term-id=\"58126126\">voting-age citizens<\/span> in that language group within the jurisdiction<\/li>\n<\/ul>\n<p>The group must have a higher <span data-term-id=\"58126157\">illiteracy rate<\/span>, defined as people who have not finished fifth grade, compared to the national average. If these requirements are met, the area must provide language help to that group. Under Section 203, the term &#8220;language minorities&#8221; or &#8220;<span data-term-id=\"58126125\">language minority group<\/span>&#8221; refers to persons who are <span data-term-id=\"58126131\">Alaskan Native<\/span>, <span data-term-id=\"58126142\">American Indian<\/span>, Asian, or <span data-term-id=\"58126143\">Hispanic<\/span>.<\/p>\n<h2>Which Languages Are Available?<\/h2>\n<p>The\u00a0<a href=\"https:\/\/www.census.gov\/programs-surveys\/decennial-census\/about\/voting-rights\/voting-rights-determination-file.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58126127\">Census Bureau<\/span><\/a>\u00a0reviews determine how many places need to offer\u00a0<span data-term-id=\"58126151\">multilingual ballots<\/span>\u00a0and other\u00a0<span data-term-id=\"58126124\">election materials<\/span>. In December 2021,\u00a0<span data-term-id=\"58126176\">Census data<\/span>\u00a0showed that\u00a0<a href=\"https:\/\/www.voanews.com\/a\/6736617.html\" target=\"_blank\" rel=\"noopener\">331 jurisdictions<\/a>\u00a0met the requirements. In these places,\u00a0<span data-term-id=\"58126137\">election officials<\/span> must provide\u00a0<span data-term-id=\"58126133\">voting materials<\/span>\u00a0in multiple languages. The Census released this information before the 2022 midterm elections. This is the highest number of jurisdictions ever covered by Section 203, 68 more than in 2016.<\/p>\n<p>Most of these jurisdictions are counties and cities, but three entire states (California, Florida, and <span data-term-id=\"58126177\">Texas<\/span>) are also included. Statewide <span data-term-id=\"58126124\">election materials<\/span> in these states must have\u00a0<span data-term-id=\"58126121\">Spanish<\/span>\u00a0translations. Cities and counties are not required to provide translations unless they have enough people from an eligible language group.<\/p>\n<p>The\u00a0<span data-term-id=\"58126127\">Census Bureau<\/span>\u00a0listed eight covered languages within the\u00a0<span data-term-id=\"58126178\">Asian American<\/span>\u00a0category:<\/p>\n<ul>\n<li>Asian Indian<\/li>\n<li>Bengali<\/li>\n<li>Cambodian<\/li>\n<li><span data-term-id=\"58126148\">Chinese<\/span> (including Taiwanese)<\/li>\n<li>Hmong<\/li>\n<li><span data-term-id=\"58126140\">Korean<\/span><\/li>\n<li><span data-term-id=\"58126159\">Filipino<\/span><\/li>\n<li><span data-term-id=\"58126139\">Vietnamese<\/span><\/li>\n<\/ul>\n<p>The following <span data-term-id=\"58126154\">Native American<\/span> languages are among those covered under the 2021 determinations:<\/p>\n<ul>\n<li>Apache<\/li>\n<li>Choctaw<\/li>\n<li>Hopi<\/li>\n<li>Navajo<\/li>\n<li>Paiute<\/li>\n<li>Pueblo<\/li>\n<li>Seminole<\/li>\n<li>Ute<\/li>\n<\/ul>\n<p>Four <span data-term-id=\"58126131\">Alaskan Native<\/span> languages:<\/p>\n<ul>\n<li>Alaska Athabascan<\/li>\n<li>Aleut<\/li>\n<li>Inupiat<\/li>\n<li>Yup\u2019ik<\/li>\n<\/ul>\n<p>While most\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/12\/08\/2021-26547\/voting-rights-act-amendments-of-2006-determinations-under-section-203\" target=\"_blank\" rel=\"noopener\">jurisdictions on the <span data-term-id=\"58126176\">census data<\/span><\/a>\u00a0must provide materials for one language group, some diverse urban areas have several. For instance, <span data-term-id=\"58126149\">Los Angeles County<\/span>, California, must provide translations for the following groups:<\/p>\n<ul>\n<li>Cambodian<\/li>\n<li><span data-term-id=\"58126148\">Chinese<\/span> (including Taiwanese)<\/li>\n<li><span data-term-id=\"58126159\">Filipino<\/span><\/li>\n<li><span data-term-id=\"58126143\">Hispanic<\/span><\/li>\n<li><span data-term-id=\"58126140\">Korean<\/span><\/li>\n<li><span data-term-id=\"58126139\">Vietnamese<\/span><\/li>\n<\/ul>\n<p>This list is not exclusive. The rules may vary depending on\u00a0<span data-term-id=\"58126145\">local election<\/span>\u00a0requirements and county <span data-term-id=\"58126160\">demographics<\/span>. Check your\u00a0<span data-term-id=\"58126173\">county clerk<\/span>\u2019s office for the latest information on available <span data-term-id=\"58126129\">language assistance<\/span>.<\/p>\n<h2>How To Find Out if Your Area Is Covered<\/h2>\n<p>You can check the <a href=\"https:\/\/www.justice.gov\/crt\/page\/file\/1460416\/dl?inline\" target=\"_blank\" rel=\"noopener\">DOJ&#8217;s full list of jurisdictions required to provide <span data-term-id=\"58126153\">bilingual <\/span><span data-term-id=\"58126124\">election<\/span><span data-term-id=\"58126124\"> materials<\/span><\/a> or contact your <span data-term-id=\"58126173\">county clerk<\/span>&#8216;s office directly to find out whether your area qualifies and which languages are available. The <span data-term-id=\"58126127\">Census Bureau<\/span> updates coverage determinations every five years. The next revised list will be published in December 2026, so the current lists will be in effect for the 2026 midterm elections.<\/p>\n<h2>What <span data-term-id=\"58126153\">Bilingual <\/span><span data-term-id=\"58126124\">Election<\/span><span data-term-id=\"58126124\"> Materials<\/span> Cover<\/h2>\n<p>All <span data-term-id=\"58126163\">voter information<\/span> given to <span data-term-id=\"58126174\">English-speaking voters<\/span> must also be available in the covered minority language. This includes not just ballots, but also:<\/p>\n<ul>\n<li><span data-term-id=\"58126144\">Sample ballots<\/span><\/li>\n<li>Absentee ballots<\/li>\n<li><span data-term-id=\"58126123\">Voter registration<\/span> forms<\/li>\n<li>Instructional materials<\/li>\n<li><span data-term-id=\"58126134\">Polling place<\/span> notices<\/li>\n<li><span data-term-id=\"58126130\">Election information<\/span> pamphlets<\/li>\n<\/ul>\n<p>The <span data-term-id=\"58126122\">Voting Rights Act<\/span> also requires <span data-term-id=\"58126136\">bilingual poll workers<\/span>, <span data-term-id=\"58126168\">interpreters<\/span>, and trained staff to help voters who do not speak English.<\/p>\n<p><span data-term-id=\"58126129\">Language assistance<\/span> must meet the same standard as English materials. Incomplete translations, missing signage, or absent <span data-term-id=\"58126136\">bilingual poll workers<\/span> are not just administrative shortfalls. They violate <span data-term-id=\"58126155\">federal law<\/span>.<\/p>\n<h2>State-Specific Rights and Variations<\/h2>\n<p>Some states have enacted stronger laws to bolster the\u00a0<span data-term-id=\"58126164\">federal <\/span><span data-term-id=\"58126122\">Voting Rights Act<\/span>, which requires translation for some language groups. California, for instance, requires precincts to provide translations to language groups that comprise 3% or more of their population, rather than the federal 5% minimum in a qualified category. <span data-term-id=\"58126137\">Election\u00a0officials<\/span>\u00a0should also make a &#8220;good faith effort&#8221; to recruit\u00a0<span data-term-id=\"58126136\">bilingual poll workers<\/span>\u00a0to assist those groups on\u00a0<span data-term-id=\"58126146\">Election Day<\/span>.<\/p>\n<p>Florida\u2019s bilingual ballots have a very different history. A 2019 federal court ruling marked a significant development by ordering\u00a0<a href=\"https:\/\/www.wuwf.org\/local-news\/2021-02-09\/after-flawless-cycles-florida-ballots-to-stay-bilingual\" target=\"_blank\" rel=\"noopener\">32 counties to\u00a0provide <span data-term-id=\"58126152\">Spanish<\/span><span data-term-id=\"58126152\">-language<\/span><\/a>\u00a0<span data-term-id=\"58126144\">sample ballots<\/span>\u00a0before the 2020\u00a0<span data-term-id=\"58126170\">primary elections<\/span>. This court order aimed to accommodate the growing\u00a0<span data-term-id=\"58126143\">Hispanic<\/span>\u00a0population in Florida. It also emphasized the importance of ensuring that all eligible voters can participate in the\u00a0<span data-term-id=\"58126128\">electoral process<\/span>\u00a0regardless of language barriers.<\/p>\n<p>Voters should check their own state\u2019s election laws, since many states offer more protections than the federal rules. <span data-term-id=\"58126145\">Local election<\/span> offices or the county <span data-term-id=\"58126175\">board of elections<\/span> may also have extra policies. Your <span data-term-id=\"58126173\">county clerk<\/span>\u2019s office is a good place to start for local information.<\/p>\n<h2>How To Access <span data-term-id=\"58126129\">Language Assistance<\/span><\/h2>\n<p>If you need <span data-term-id=\"58126129\">language assistance<\/span> when voting, the following steps can help you exercise your rights effectively:<\/p>\n<ul>\n<li><strong>Contact your <span data-term-id=\"58126173\">county clerk<\/span> or <span data-term-id=\"58126145\">local elections<\/span> office before <span data-term-id=\"58126146\">Election Day<\/span><\/strong>: Ask whether your jurisdiction is covered under Section 203. You can also ask which languages are available and whether <span data-term-id=\"58126136\">bilingual poll workers<\/span> will be present at your polling location.<\/li>\n<li><strong>Request translated materials in advance where possible<\/strong>: Absentee ballots, <span data-term-id=\"58126123\">voter registration<\/span> forms, and instructional materials in covered languages should be available ahead of <span data-term-id=\"58126146\">Election Day<\/span>. Requesting them early reduces the risk of delays.<\/li>\n<li><strong>Know that you may bring a helper to the polls<\/strong>: Section 208 of the <span data-term-id=\"58126141\">VRA<\/span> allows voters who are blind, have a disability, or cannot read or write to\u00a0<a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote-\/what-are-voter-rights-.html\">choose someone to assist them at the polls<\/a>. This includes voters who have difficulty understanding English. The only people you cannot bring are your employer, an agent of your employer, or an officer or agent of your union.<\/li>\n<li><strong>Ask to speak with the <span data-term-id=\"58126134\">polling place<\/span> supervisor on-site<\/strong>: If you arrive at a <span data-term-id=\"58126134\">polling place<\/span> and bilingual assistance is not available, ask to speak with the <span data-term-id=\"58126134\">polling place<\/span> supervisor on-site. You can also contact your <span data-term-id=\"58126166\">county elections<\/span> office directly to request immediate support.<\/li>\n<\/ul>\n<p>Language barriers should not keep you from casting a vote.<\/p>\n<h2>What To Do if Your Rights Are Violated<\/h2>\n<p>If you think a covered area is not meeting its Section 203 duties, there are legal options to address it. You may file a complaint with the DOJ&#8217;s\u00a0<a href=\"https:\/\/www.justice.gov\/crt\/voting-section\" target=\"_blank\" rel=\"noopener\">Voting Section of the <span data-term-id=\"58126167\">Civil Rights<\/span> Division<\/a>, which is responsible for enforcing Section 203. You can submit complaints online or by calling the DOJ&#8217;s voting rights toll-free hotline at 1-800-253-3931.<\/p>\n<p>There are several other resources available to help:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.usa.gov\/state-election-office\" target=\"_blank\" rel=\"noopener\">Your state or <span data-term-id=\"58126166\">county election<\/span> office<\/a><\/li>\n<li><a href=\"https:\/\/866ourvote.org\/\" target=\"_blank\" rel=\"noopener\">Election Protection Hotline (nonpartisan)<\/a>: 1-866-OUR-VOTE (1-866-687-8683)<\/li>\n<li><a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">A <span data-term-id=\"58126167\">civil rights<\/span> attorney<\/a><\/li>\n<\/ul>\n<p>No matter which option you choose, keeping records will help your case. Write down the date, <span data-term-id=\"58126134\">polling place<\/span>, names of officials you spoke with, and exactly how they denied or did not provide you with help. This information can support a complaint or legal action.<\/p>\n<h2>When To Seek Legal Advice<\/h2>\n<p>The rules about\u00a0<span data-term-id=\"58126151\">multilingual ballots<\/span>\u00a0under the\u00a0<span data-term-id=\"58126141\">VRA<\/span>\u00a0can be complicated.
