They must go through a voting re-registration process through the Secretary of State.<\/p>\n\n    <\/div>\n\n\n\n<p>Having a past <span data-term-id=\"56738937\">felony conviction<\/span> in <span data-term-id=\"56738936\">California<\/span> doesn\u2019t always mean you\u2019ll never be able to vote again. This guide is for people with past convictions seeking to restore their <span data-term-id=\"56738935\">voting rights<\/span>. We will walk you through the current laws for formerly incarcerated individuals and explain the exact steps you need to take to regain your voice in <span data-term-id=\"56738936\">California<\/span> elections.<\/p>\n<h2><strong>The <span data-term-id=\"56738936\">California<\/span> <span data-term-id=\"56738939\">Voting Rights<\/span><span data-term-id=\"56738939\"> Restoration<\/span> Amendment<\/strong><\/h2>\n<p>In 2020, <span data-term-id=\"56738936\">California<\/span> voters approved an amendment to the <span data-term-id=\"56738936\">California<\/span> Constitution. <span data-term-id=\"56738958\">Proposition 17<\/span>, the <span data-term-id=\"56738939\">Voting Rights<\/span><span data-term-id=\"56738939\"> Restoration<\/span> for Persons on Parole Amendment, restored the <span data-term-id=\"56738935\">voting rights<\/span> of all individuals on parole after incarceration.<\/p>\n<p>Prior to this amendment, <span data-term-id=\"56738936\">California<\/span> <span data-term-id=\"56738935\">voting rights<\/span> were restored only to those who had completed their entire sentences, including parole, probation, and <span data-term-id=\"56738976\">supervised release<\/span>. This left a large number of former inmates still completing parole for <span data-term-id=\"56738953\">felony sentences<\/span> who could not legally vote.<\/p>\n<p>The <span data-term-id=\"56738939\">Voting Rights<\/span><span data-term-id=\"56738939\"> Restoration<\/span> Amendment removed a restriction in the <span data-term-id=\"56738936\">California<\/span> Constitution that specifically prevented parolees from voting. This was accomplished by adding the following to <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=CONS&amp;division=&amp;title=&amp;part=&amp;chapter=&amp;article=II\" target=\"_blank\" rel=\"noopener\">Article II, Section 2:<\/a><\/p>\n<p><em>\u201c(b) An elector disqualified from voting while serving a state or <span data-term-id=\"56738945\">federal <\/span><span data-term-id=\"56738955\">prison<\/span><span data-term-id=\"56738955\"> term<\/span>, as described in Section 4, shall have their right to vote restored upon the completion of their <span data-term-id=\"56738955\">prison term<\/span>.\u201d<\/em><\/p>\n<p>The amendment restored <span data-term-id=\"56738935\">voting rights<\/span> to parolees. The only individuals who cannot register or vote are those who are currently serving a <span data-term-id=\"56738955\">prison term<\/span> for <span data-term-id=\"56738978\">conviction of a felony<\/span> in a state or <span data-term-id=\"56738945\">federal prison<\/span> or who are in a local detention facility for a felony <span data-term-id=\"56738948\">criminal conviction<\/span>.<\/p>\n<h2><strong>How To Know if You\u2019re Eligible<\/strong><\/h2>\n<p>The state of <span data-term-id=\"56738936\">California<\/span> has a <a href=\"https:\/\/www.sos.ca.gov\/elections\/voting-rights-restored\" target=\"_blank\" rel=\"noopener\">click-through <span data-term-id=\"56738942\">eligibility<\/span> test <\/a>to let recently released parolees know whether they\u2019re eligible to register to vote in state and <span data-term-id=\"56738957\">local elections<\/span>. You can start this test at the <a href=\"https:\/\/www.sos.ca.gov\/elections\/voting-rights-restored\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56738941\">California<\/span> <span data-term-id=\"56738977\">Secretary of State<\/span><span data-term-id=\"56738977\">\u2019s website<\/span><\/a>. The questions are straightforward:<\/p>\n<ul>\n<li>Are you a <span data-term-id=\"56738936\">California<\/span> resident?<\/li>\n<li>Will you be 18 years of age or older on <span data-term-id=\"56738981\">Election Day<\/span>?<\/li>\n<li>Are you currently incarcerated in a state or <span data-term-id=\"56738945\">federal prison<\/span>?<\/li>\n<li>Has a court found you mentally incompetent?<\/li>\n<\/ul>\n<p>If you can answer \u201cyes\u201d to all questions, you should be approved to vote. A \u201cno\u201d response to any of the queries likely means you won\u2019t be able to successfully reregister to <span data-term-id=\"56738935\">vote right<\/span> now.<\/p>\n<p>That\u2019s all! If you are on parole, probation, or any form of community control or supervision, you can register to vote. The state restores your <span data-term-id=\"56738935\">voting rights<\/span> upon release. All you need to do now is register.<\/p>\n<h2><strong>Restoring Your Right To Vote<\/strong><\/h2>\n<p>Your right to vote is automatically restored when you complete your sentence, but you still need to register. When a person is convicted of a felony, their voting registration is canceled. To register, you can go to the <a href=\"https:\/\/www.sos.ca.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56738977\">Secretary of State\u2019s website<\/span><\/a> or the <span data-term-id=\"56738979\">county election office<\/span>. You can also visit <a href=\"http:\/\/registertovote.ca.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56738951\">RegisterToVote.ca.gov<\/span><\/a> to check your <span data-term-id=\"56738970\">voter information<\/span> and reregister.<\/p>\n<p>If you are still incarcerated, you can request a <span data-term-id=\"56738938\">voter registration<\/span> card from the jail officials. If you ask for one and don&#8217;t receive it, <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contact your attorney<\/a> or a public defender.<\/p>\n<p><span data-term-id=\"56738936\">California<\/span> is a <span data-term-id=\"56738967\">vote-by-mail ballot<\/span> state. If you request a mail-in ballot while still incarcerated but are released before it arrives, you can go to your <span data-term-id=\"56738959\">polling place<\/span> at your home address and ask for a provisional ballot.<\/p>\n<p>If you\u2019re enrolled in <span data-term-id=\"56738936\">California<\/span>\u2019s <a href=\"https:\/\/www.sos.ca.gov\/registries\/safe-home\" target=\"_blank\" rel=\"noopener\">Safe At Home<\/a> program or other confidential address program, <strong>do not register online<\/strong>. The Safe At Home program can help you register to vote after release without losing your privacy. If you\u2019re not sure whether you qualify for this program, <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contact your lawyer<\/a> or public defender.<\/p>\n<h3><strong>If You Lack a Home Address<\/strong><\/h3>\n<p>It\u2019s unfortunate, but many Californians on parole have trouble finding permanent housing. <span data-term-id=\"56738936\">California<\/span>\u2019s voting laws\u00a0<a href=\"https:\/\/thearcca.org\/people-experiencing-homelessness-can-register-to-vote-heres-how\/\" target=\"_blank\" rel=\"noopener\">permit unhoused voters to register and vote,<\/a>\u00a0as long as they have a location where they can receive a ballot and voting information.<\/p>\n<p>The <span data-term-id=\"56738938\">voter registration<\/span> form has two sections for your address. The address where you live can be your street address. If you live in a location without a physical address, such as a campground, unhoused shelter, or vacant lot, you can describe the location in this section. You can put down the cross streets or nearest landmarks, such as \u201cthe camping spot near the church at First and Main.\u201d<\/p>\n<p>Your mailing address is where you normally receive mail. This can be a P.O. Box or a different location than your physical address, as long as you receive mail there. You cannot use a P.O. Box for your living address, but you can use one for your mailing address. Many shelters, churches, and aid centers will hold your mail if you want to use them for voting and other purposes.<\/p>\n<h3><strong>Other Information<\/strong><\/h3>\n<p>You must also include all other information, including:<\/p>\n<ul>\n<li>Whether you are a U.S. citizen<\/li>\n<li>Your full name<\/li>\n<li>Your birthdate, <span data-term-id=\"56738936\">California<\/span> driver\u2019s license number (if any), last four digits of your SS#, and county of residence<\/li>\n<li>Previous registration history (party and address), if any<\/li>\n<li>Current party preference or \u201cno preference,\u201d which affects whether you can vote in <span data-term-id=\"56738936\">California<\/span>\u2019s primary elections<\/li>\n<\/ul>\n<p>If you don\u2019t complete the registration card correctly, you won\u2019t receive a mail-in ballot or appear on the voter roll at the polling station. If <span data-term-id=\"56738964\">election officials<\/span> cannot find your name on <span data-term-id=\"56738981\">election day<\/span>, you can still request a provisional ballot if you can provide ID, such as a current driver\u2019s license, passport, military ID, or other identification.<\/p>\n<p>You can get more information on <a href=\"https:\/\/www.sos.ca.gov\/elections\/voter-registration\" target=\"_blank\" rel=\"noopener\">registering to vote <\/a>at the <span data-term-id=\"56738977\">Secretary of State\u2019s website<\/span>.<\/p>\n<h2><strong>Get Legal Assistance From a <span data-term-id=\"56738936\">California<\/span> Civil Rights Attorney<\/strong><\/h2>\n<p>Voter <span data-term-id=\"56738950\">disenfranchisement<\/span> is still a real part of too many former inmates\u2019 lives.
