People convicted of homicide and <span data-term-id=\"56739179\">sexual offenses<\/span> remain unable to vote.<\/p>\n<p>This rule quickly changed. In March 2019, Gov. <span data-term-id=\"56739219\">Ron DeSantis<\/span> signed <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2019\/07066\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739213\">Senate Bill<\/span> 7066<\/a>, clarifying <span data-term-id=\"56739178\">Amendment 4<\/span>. The new state law required former felons to pay all <span data-term-id=\"56739218\">court-ordered<\/span> costs, fees, fines, and <span data-term-id=\"56739183\">restitution<\/span> before registering to vote. These fees and costs were considered <span data-term-id=\"56739224\">terms of their sentence<\/span> that weren\u2019t addressed in <span data-term-id=\"56739178\">Amendment 4<\/span>.<\/p>\n<p>A series of court proceedings followed. In October 2019, a lower court issued a preliminary injunction blocking SB 7066 as applied to people unable to pay. In May 2020,\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-11th-circuit\/2049250.html\" target=\"_blank\" rel=\"noopener\">U.S. District Judge Robert Hinkle ruled<\/a>\u00a0that conditioning the right to vote on an inability to pay violated the Equal Protection Clause. He also found that these fees, as separate from fines and <span data-term-id=\"56739183\">restitution<\/span>, amounted to a tax on voting in violation of the 24th Amendment.<\/p>\n<p>The state appealed, and the 11th Circuit stayed the district court&#8217;s ruling pending its review. <span data-term-id=\"56739175\">Voting rights<\/span> advocates asked the U.S. Supreme Court to vacate the stay, but the\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/spr-crt-us\/2076566.html\" target=\"_blank\" rel=\"noopener\">Court declined to do so without comment<\/a>.<\/p>\n<p>In September 2020, the full 11th <span data-term-id=\"56739205\">Circuit Court<\/span> issued a split decision (6-4). It ruled that the <span data-term-id=\"56739210\">Florida<\/span><span data-term-id=\"56739210\"> law<\/span> did not violate the due process clause and was not a &#8220;poll tax&#8221; as described by advocates. The matter is over unless there is further action or a <span data-term-id=\"56739204\">constitutional amendment<\/span>. It is now codified as\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0098\/Sections\/0098.0751.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739176\">Florida<\/span> State Statute 98.0751<\/a>.<\/p>\n<h2>The Core Problem: How Do You Know What You Owe?<\/h2>\n<p>One of the main problems SB 7066 faced is that <span data-term-id=\"56739176\">Florida<\/span> lacks a centralized system to connect people with prior convictions to their outstanding fees and fines. There is no state agency that tracks the required <span data-term-id=\"56739183\">restitution<\/span> payments that they made to victims. People leaving prison are also rarely informed about their <span data-term-id=\"56739203\">financial obligations<\/span>. This means the burden of figuring it out falls entirely on them.<\/p>\n<p>If you\u2019re looking to restore your <span data-term-id=\"56739175\">voting rights<\/span>, you\u2019ll need to review your judgment and sentencing documents for each <span data-term-id=\"56739177\">felony conviction<\/span>. These records show what amounts were originally ordered as part of your sentence. Next, you need to determine how much you\u2019ve already paid.<\/p>\n<p>You should contact the clerk of the court in each county where you were convicted, as the law requires you to settle all <span data-term-id=\"56739218\">court-ordered<\/span> costs, fees, and fines. You can request copies of the documents and receive a payment accounting. Once the Department receives a complete form, it will review your record and issue an <span data-term-id=\"56739202\">advisory opinion<\/span> within 90 days.<\/p>\n<h2><span data-term-id=\"56739176\">Florida<\/span>\u2019s \u201cFirst Dollar Policy\u201d<\/h2>\n<p>The <span data-term-id=\"56739189\">Florida<\/span><span data-term-id=\"56739189\"> Division of Elections<\/span> uses the \u201c<a href=\"https:\/\/dos.fl.gov\/elections\/for-voters\/voter-registration\/felon-voting-rights\/\" target=\"_blank\" rel=\"noopener\">first dollar policy<\/a>\u201d to determine whether you\u2019ve met your <span data-term-id=\"56739203\">financial obligations<\/span>. Under this standard, your requirement is to meet the total that\u2019s equal to or exceeds the amount originally ordered in your sentencing documents. Charges incurred after sentencing, such as interest, setup fees for payment plans, and other surcharges, do not count. The clerk\u2019s records may show a higher balance amount than what you actually owe to gain your <span data-term-id=\"56739181\">eligibility<\/span> to vote again.<\/p>\n<p>For example, as part of your sentence, a <span data-term-id=\"56739218\">court ordered<\/span> you to pay $500 in court costs. The clerk later added a $50 payment plan fee. If you\u2019ve paid the $500 in court costs, you can register to vote despite still having a balance of $50 for the financing fee.<\/p>\n<p>If you are still uncertain about your obligations after reviewing your records, you can submit a written request for an <span data-term-id=\"56739202\">advisory opinion<\/span> from the <span data-term-id=\"56739189\">Florida<\/span><span data-term-id=\"56739189\"> Division of Elections<\/span>. Many people with prior convictions remain unable to register due to the state not providing a reliable way to demonstrate that they complied with it.<\/p>\n<h2>A Step-by-Step Guide To Restoring Your <span data-term-id=\"56739175\">Voting Rights<\/span> in <span data-term-id=\"56739176\">Florida<\/span><\/h2>\n<p>The restoration process depends on the type of conviction on your record. Work through the steps below in order.<\/p>\n<h3>Step 1: Determine your conviction type<\/h3>\n<p>The first question is whether your conviction involved murder or a felony <span data-term-id=\"56739179\">sexual offense<\/span>. The <a href=\"https:\/\/dos.fl.gov\/elections\/for-voters\/voter-registration\/felon-voting-rights\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739189\">Florida<\/span><span data-term-id=\"56739189\"> Division of Elections<\/span><\/a> provides guidance on the registration process for people with prior convictions, including information on how to verify your <span data-term-id=\"56739181\">eligibility<\/span> and what documentation to have available.<\/p>\n<p>You can register online through the\u00a0<a href=\"https:\/\/registertovoteflorida.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739189\">Florida<\/span><span data-term-id=\"56739189\"> Division of Elections<\/span><\/a>, by mail, or <span data-term-id=\"56739226\">in person<\/span> at your <span data-term-id=\"56739217\">county <\/span><span data-term-id=\"56739186\">supervisor of <\/span><span data-term-id=\"56739207\">elections<\/span><span data-term-id=\"56739207\"> office<\/span>. Make sure you have documentation of your sentence completion and records showing that you satisfied your <span data-term-id=\"56739203\">financial obligations<\/span>. Keep this documentation on hand after you register.<\/p>\n<p>Certain individuals are not affected by these rules. If you have not been convicted of a felony, your right to vote remains intact. That includes people currently held in pre-trial detention. <span data-term-id=\"56739201\">Misdemeanor<\/span> convictions also do not impact your <span data-term-id=\"56739175\">voting rights<\/span> in <span data-term-id=\"56739176\">Florida<\/span>.<\/p>\n<p>Registration deadlines still apply to you.
