A <span data-term-id=\"56739707\">convicted felon<\/span> must finish their incarceration, parole, and supervision, and pay all fines, fees, and restitution to be permitted to vote.<\/p>\n\n    <\/div>\n\n\n\n<p><span data-term-id=\"56739718\">Texas<\/span><span data-term-id=\"56739718\"> law<\/span> permits all its residents who are 18 years or older,\u00a0<span data-term-id=\"56739736\">U.S. citizens<\/span>, and residents of the county where they\u2019re registered in to\u00a0vote. Texans who cannot vote include those convicted of a felony and those still serving a <span data-term-id=\"56739715\">felony sentence<\/span>, including parole or probation.<\/p>\n<p><span style=\"color: initial\">The Texas\u00a0<\/span><a href=\"https:\/\/codes.findlaw.com\/tx\/election-code\/elec-sect-11-002.html\" target=\"_blank\" rel=\"noopener\">Election Code<\/a><span style=\"color: initial\"> lists<\/span>\u00a0voter qualifications and prohibitions. <span data-term-id=\"56739695\">Texas<\/span> code bars <span data-term-id=\"56739707\">convicted felons<\/span> from voting until they complete all terms of their court-ordered sentence and have their <span data-term-id=\"56739716\">civil rights<\/span> restored.<\/p>\n<p>If you\u2019re on <span data-term-id=\"56739721\">deferred adjudication<\/span> or diversion or have not received a <span data-term-id=\"56739709\">final <\/span><span data-term-id=\"56739696\">felony conviction<\/span> (if your case is on appeal), you can still vote. A conviction for a <span data-term-id=\"56739702\">misdemeanor<\/span> will not prevent you from voting. Any parole, probation, or <span data-term-id=\"56739711\">supervised release<\/span> after incarceration is considered part of your sentence, and you will not receive <span data-term-id=\"56739712\">voting rights<\/span><span data-term-id=\"56739712\"> restoration<\/span> until you\u2019ve completed the full term.<\/p>\n<h2>Losing and Regaining Your <span data-term-id=\"56739697\">Voting Rights<\/span> in <span data-term-id=\"56739695\">Texas<\/span><\/h2>\n<p>In <span data-term-id=\"56739695\">Texas<\/span>, you lose your <span data-term-id=\"56739697\">voting rights<\/span> after a <span data-term-id=\"56739717\">criminal conviction<\/span> for a felony. Those who are facing criminal charges can still register and vote if:<\/p>\n<ul>\n<li>They have been charged or indicted but have not been convicted<\/li>\n<li>They have been convicted of a <span data-term-id=\"56739702\">misdemeanor<\/span><\/li>\n<li>They are on <span data-term-id=\"56739721\">deferred adjudication<\/span> or pretrial detention<\/li>\n<li>They have not lost their <span data-term-id=\"56739697\">voting rights<\/span> for any other reason, such as having been adjudicated mentally incompetent<\/li>\n<\/ul>\n<p>When you receive a final <span data-term-id=\"56739715\">felony sentence<\/span> in <span data-term-id=\"56739695\">Texas<\/span>, your <span data-term-id=\"56739697\">voting rights<\/span> (and some other <span data-term-id=\"56739716\">civil rights<\/span>) are automatically suspended.<\/p>\n<h3>Components of a Criminal Sentence in <span data-term-id=\"56739695\">Texas<\/span><\/h3>\n<p>A criminal sentence has three components. You\u2019ll need to complete all of them before you can fully discharge your sentence and have your <span data-term-id=\"56739697\">voting rights<\/span> restored. <span data-term-id=\"56739718\">Texas<\/span><span data-term-id=\"56739718\"> law<\/span> describes this as \u201cincluding any term of incarceration, parole, supervision, or period of probation ordered by any court.\u201d <span data-term-id=\"56739695\">Texas<\/span> courts have also interpreted this to mean that you must repay all fines, fees, and <a href=\"https:\/\/www.tdcj.texas.gov\/documents\/Restitution_Brochure.pdf\" target=\"_blank\" rel=\"noopener\">restitution<\/a> related to the conviction before you can receive a full discharge.<\/p>\n<p>For example, an individual is convicted of a felony offense. They received a sentence of 10 years\u2019 incarceration plus five years of <span data-term-id=\"56739728\">community supervision<\/span>. Fines and restitution totaled $15,500. They could not apply for restoration of <span data-term-id=\"56739697\">voting rights<\/span> until they completed all five years of <span data-term-id=\"56739728\">community supervision<\/span> and provided proof of payment for the full $15,500.<\/p>\n<p>Let\u2019s take a closer look at each of these required elements.<\/p>\n<h3>Steps One and Two<\/h3>\n<p>You must complete your <span data-term-id=\"56739730\">full sentence<\/span> to receive a complete discharge. That means checking in with your parole officer and following all their requirements, including completing all your classes and drug tests. If you\u2019ve been released on probation, the same applies. If you have a two-year probation and must take anger management classes and complete your GED, then you must do that before you can request a discharge.<\/p>\n<h3>Step Three<\/h3>\n<p>This step has sometimes been called a \u201cmodern poll tax\u201d by voting reform advocates. You must repay all court-ordered fines, even fines that are unrelated to the most recent offense. If you had parking tickets or fines from a long-ago DUI, you have to find them and pay them.<\/p>\n<p>If fines did not get entered into the Secretary of State\u2019s database, you may have paid off fines that did not get recorded. This becomes a problem when you attempt to re-register after completing your sentence.<\/p>\n<h2>Who Tracks Your <span data-term-id=\"56739697\">Voting Rights<\/span><\/h2>\n<p>The\u00a0<a href=\"https:\/\/www.sos.state.tx.us\/index.shtml\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739699\">Texas<\/span><span data-term-id=\"56739699\"> Secretary of State<\/span><\/a>\u00a0is the organization that determines voting <span data-term-id=\"56739700\">eligibility<\/span> rights in <span data-term-id=\"56739695\">Texas<\/span>. Every week, the\u00a0<a href=\"https:\/\/www.dps.texas.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739695\">Texas<\/span> Department of Safety<\/a>\u00a0sends <span data-term-id=\"56739696\">felony conviction<\/span> data to the Secretary of State. That agency matches the data with the listed files for <span data-term-id=\"56739713\">registered voters<\/span>. If it finds a match, it notifies the county.<\/p>\n<p>This database cross-checks all new <span data-term-id=\"56739698\">voter registrations<\/span> and re-registrations and flags anything that shows unpaid fines or other issues. If you have <span data-term-id=\"56739700\">eligibility<\/span> problems due to data errors, you may need legal assistance to correct them.<\/p>\n<h2><span data-term-id=\"56739729\">Restore Your Vote<\/span><\/h2>\n<p>When you complete your incarceration, parole, or probation, you should receive a Discharge Certificate from the <span data-term-id=\"56739695\">Texas<\/span> Department of Criminal Justice. Make sure to request it if it\u2019s not provided. This is proof that you\u2019ve completed all court-ordered incarceration, parole\/probation, and other orders, such as courses and classes.<\/p>\n<p>Before you try to re-register, verify your financial compliance. Do your best to locate all past due fines, fees, and unpaid restitution, even for cases unrelated to your most current incarceration. The Secretary of State\u2019s office will find all of them, so you need to ensure you\u2019ve paid everything.<\/p>\n<p>To avoid a complicated slog through the <span data-term-id=\"56739695\">Texas<\/span> Department of Justice\u2019s record system, consider contacting a <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739716\">civil rights<\/span><\/a> or <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739727\">criminal defense<\/span> attorney<\/a>. They can perform a complete records search and determine if you have any outstanding fines or fees. They can also check whether you have any missed court dates or warrants that have slipped through the cracks. An attorney can help deal with any other issues that may pop up as well.<\/p>\n<p>Once you\u2019ve taken care of all money owed, you can re-register to vote. You can register at the <a href=\"https:\/\/www.votetexas.gov\/register-to-vote\/index.html\" target=\"_blank\" rel=\"noopener\">Secretary of State\u2019s website<\/a> or <span data-term-id=\"56739714\">in-person<\/span> at your county <span data-term-id=\"56739742\">voter registrar<\/span>\u2019s office. <span data-term-id=\"56739698\">Voter registration<\/span> forms are available at government offices, libraries, and other public locations. You may have received one as part of your <span data-term-id=\"56739740\">reentry<\/span> packet when leaving your facility.<\/p>\n<h2>Felon Voter <span data-term-id=\"56739700\">Eligibility<\/span> in States<\/h2>\n<p>In a landmark decision in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/418\/24.html\" target=\"_blank\" rel=\"noopener\"><em>Richardson v. Ramirez<\/em><\/a>\u00a0(1974), the Supreme Court held that it doesn\u2019t violate the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment14.html\" target=\"_blank\" rel=\"noopener\">Fourteenth Amendment<\/a>\u00a0to keep felons from voting, even if they have served their sentences. <a href=\"https:\/\/constitution.findlaw.com\/article1\/annotation18.html\" target=\"_blank\" rel=\"noopener\">Article I, Section 4, Clause I<\/a> (the Elections Clause) prevents Congress from regulating state voting standards. This includes <span data-term-id=\"56739739\">felony\u00a0<\/span><a href=\"https:\/\/dictionary.findlaw.com\/definition\/disfranchise.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739739\">disenfranchisement<\/span><\/a>\u00a0in state elections.<\/p>\n<p><span data-term-id=\"56739720\">State laws<\/span> differ on <span data-term-id=\"56739703\">felon <\/span><span data-term-id=\"56739697\">voting<\/span><span data-term-id=\"56739697\"> rights<\/span>. <span data-term-id=\"56739704\">Vermont<\/span>, <span data-term-id=\"56739708\">Maine<\/span>, and Washington, D.C., are the only states where felons never lose their <span data-term-id=\"56739697\">voting rights<\/span>, even while serving a prison sentence. Others, like <span data-term-id=\"56739734\">Arizona<\/span>, <span data-term-id=\"56739731\">Tennessee<\/span>, <span data-term-id=\"56739732\">Mississippi<\/span>, and <span data-term-id=\"56739735\">Alabama<\/span>, permanently bar some individuals from voting even after they have completed their sentences. For detailed information on how states restore the rights of felons, please refer to the <a href=\"http:\/\/www.ncsl.org\/research\/elections-and-campaigns\/felon-voting-rights.aspx\" target=\"_blank\" rel=\"noopener\">summary compiled<\/a> by the National Conference of State Legislatures.<\/p>\n<h2>When To Contact a <span data-term-id=\"56739695\">Texas<\/span> <span data-term-id=\"56739716\">Civil Rights<\/span> Attorney<\/h2>\n<p>If you had a relatively short term of incarceration or completed a sentence of probation and paid off all your court-ordered restitution, you might be able to re-register without legal assistance. If you have other concerns, you may want help from a <span data-term-id=\"56739695\">Texas<\/span> <span data-term-id=\"56739716\">civil rights<\/span> attorney or a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/texas\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56739727\">criminal defense<\/span> attorney<\/a>.<\/p>\n<p>There are many scenarios where having an attorney can make a huge difference. If your registration was denied and you think your sentence was fully discharged, a lawyer can help obtain a Certificate of Discharge and send a copy to the Secretary of State\u2019s office.<\/p>\n<p>Having debts spread across multiple counties (or more than one state) can be a nightmare to find and pay off. If planning to request an <a href=\"https:\/\/guides.sll.texas.gov\/expunctions-and-non-disclosure\" target=\"_blank\" rel=\"noopener\">Order of Nondisclosure<\/a> for some offenses, having a lawyer to assist you is essential. Nondisclosure (sealing) prevents some businesses and agencies from seeing your criminal record. Nondisclosures and expungements can help you mask your background when seeking jobs and housing. You will need an attorney\u2019s assistance to complete this request.<\/p>\n<p>A criminal record doesn\u2019t automatically bar you from having a voice in the country\u2019s political system.
