Most states and cities also ban <span data-term-id=\"57414797\">noncitizen voting<\/span>, though a few <span data-term-id=\"57414821\">municipalities<\/span> in <span data-term-id=\"57414808\">California<\/span>, <span data-term-id=\"57414820\">Maryland<\/span>, <span data-term-id=\"57414817\">Vermont<\/span>, and Washington, D.C., allow certain noncitizens to vote in specific <span data-term-id=\"57414798\">local elections<\/span>. Voting illegally can result in criminal charges and immigration consequences.<\/p>\n\n    <\/div>\n\n\n\n<p>If you&#8217;re a noncitizen living in the United States, understanding your <span data-term-id=\"57414803\">voting rights<\/span> can be confusing. The rules differ across elections, and local laws vary. You can also contact a <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">civil rights attorney<\/a> who can help you understand and protect your right to vote.<\/p>\n<h2><span data-term-id=\"57414796\">Federal Elections<\/span>: Only <span data-term-id=\"57414800\">U.S. Citizens<\/span> Can Vote<\/h2>\n<p>In <span data-term-id=\"57414796\">federal elections<\/span>, including <span data-term-id=\"57414844\">general election<\/span> races for president, the U.S. Senate, and the <span data-term-id=\"57414845\">House of Representatives<\/span>, only <span data-term-id=\"57414800\">U.S. citizens<\/span> may vote. <span data-term-id=\"57414810\">Federal law<\/span> makes it unlawful for <span data-term-id=\"57414848\">non-<\/span><span data-term-id=\"57414800\">U.S. citizens<\/span> to <span data-term-id=\"57414850\">cast ballots<\/span> in these elections.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-611\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57414807\">Illegal Immigration<\/span> Reform and <span data-term-id=\"57414819\">Immigrant Responsibility Act<\/span> of 1996<\/a> criminalizes voting by noncitizens in any <span data-term-id=\"57414796\">federal election<\/span>. This applies to lawful <span data-term-id=\"57414853\">permanent residents<\/span>, U.S. visa holders, and undocumented immigrants.\u00a0<\/p>\n<p>The law also provides two limited exceptions. First, a noncitizen may vote on a non-federal matter in a mixed election, but only if state or local law authorizes them to do so, and only if the voting on that local matter is conducted completely separately from the federal ballot portion.<\/p>\n<p>The second exception is a narrow defense. The prohibition does not apply if all three of the following conditions are present:<\/p>\n<ul>\n<li>Each\u00a0natural or adoptive parent of the noncitizen is or was a <span data-term-id=\"57414800\">U.S. citizen<\/span><\/li>\n<li>They permanently resided in the United States before turning 16 years old<\/li>\n<li>They reasonably believed they were a <span data-term-id=\"57414800\">U.S. citizen<\/span> at the time of voting<\/li>\n<\/ul>\n<p>If uncertain, consider meeting with a <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">civil rights attorney<\/a> before attempting to vote.<\/p>\n<h2>Can Green Card Holders Vote?<\/h2>\n<p>No. If you are a green card holder, also known as a lawful <span data-term-id=\"57414853\">permanent resident<\/span> (LPR), you cannot vote in federal or <span data-term-id=\"57414840\">state elections<\/span>. This rule applies no matter how long you have lived in the United States.<\/p>\n<p>At the local level, a small number of <span data-term-id=\"57414821\">municipalities<\/span> allow <span data-term-id=\"57414855\">legal residents<\/span> and other noncitizens to participate in certain local races. These <span data-term-id=\"57414805\">jurisdictions<\/span> are the exception. Most cities and states do not extend any <span data-term-id=\"57414854\">noncitizen <\/span><span data-term-id=\"57414803\">voting<\/span><span data-term-id=\"57414854\"> rights<\/span>.<\/p>\n<p>It is also worth knowing that every state requires you to attest that you are a <span data-term-id=\"57414800\">U.S. citizen<\/span> when registering to vote. Eight states go further and require documentary <span data-term-id=\"57414830\">proof of <\/span><span data-term-id=\"57414826\">citizenship<\/span><span data-term-id=\"57414826\"> status<\/span> to register in at least some cases. Falsely claiming citizenship on a <span data-term-id=\"57414833\">voter registration<\/span><span data-term-id=\"57414833\"> form<\/span> is a separate federal crime.<\/p>\n<h2><span data-term-id=\"57414797\">Noncitizen Voting<\/span> in <span data-term-id=\"57414798\">Local Elections<\/span><\/h2>\n<p><span data-term-id=\"57414810\">Federal law<\/span> bars noncitizens from <span data-term-id=\"57414796\">federal elections<\/span>. However, states and <span data-term-id=\"57414821\">municipalities<\/span> can extend <span data-term-id=\"57414803\">voting rights<\/span> to <span data-term-id=\"57414848\">non-<\/span><span data-term-id=\"57414800\">U.S. citizens<\/span> in their own local races. A small but growing number of <span data-term-id=\"57414805\">jurisdictions<\/span> have chosen to do that.\u00a0<\/p>\n<p>As of 2026, the following <span data-term-id=\"57414805\">jurisdictions<\/span> allow noncitizens to vote in some <span data-term-id=\"57414798\">local elections<\/span>:<\/p>\n<h3><span data-term-id=\"57414808\">California<\/span><\/h3>\n<p><span data-term-id=\"57414818\">San Francisco<\/span> voters approved <a href=\"https:\/\/aelc.assembly.ca.gov\/sites\/aelc.assembly.ca.gov\/files\/hearings\/SF%20Measure%20N%20Nov%202016.pdf\" target=\"_blank\" rel=\"noopener\">Proposition N in November 2016<\/a>. This allows <span data-term-id=\"57414834\">noncitizen residents<\/span> to vote in <span data-term-id=\"57414828\">school board elections<\/span> if they are the parent, legal guardian, or caregiver of a child living in <span data-term-id=\"57414818\">San Francisco<\/span>. The child does not need to be enrolled in a public school. Children attending private school or those too young to attend also qualify, as long as they live in the city.<\/p>\n<h3>District of Columbia<\/h3>\n<p>Washington, D.C., enacted the <span data-term-id=\"57414797\">Noncitizen Vote<\/span> Act in October 2022. This law extended local <span data-term-id=\"57414803\">voting rights<\/span> to <span data-term-id=\"57414834\">noncitizen residents<\/span>.<\/p>\n<p>Keep in mind that the District works on a unique \u201cnon-state status.\u201d As a result, all local legislation must clear a congressional review period before it can take effect. The law passed the congressional review process in March 2023 despite facing opposition in the U.S. <span data-term-id=\"57414845\">House of Representatives<\/span>.<\/p>\n<p>A legal challenge filed shortly after was dismissed by the U.S. District Court for the District of Columbia in March 2024. The dismissal of the challenge is currently under appeal before the U.S. Court of Appeals for the D.C. Circuit, which heard oral arguments in March 2025. The law remains in effect while the appeal is pending.<\/p>\n<h3><span data-term-id=\"57414820\">Maryland<\/span><\/h3>\n<p>At least\u00a0<a href=\"https:\/\/ballotpedia.org\/Laws_permitting_noncitizens_to_vote_in_the_United_States\" target=\"_blank\" rel=\"noopener\">16 <span data-term-id=\"57414821\">municipalities<\/span> in <span data-term-id=\"57414820\">Maryland<\/span><\/a>\u00a0allow <span data-term-id=\"57414834\">noncitizen residents<\/span> to vote in <span data-term-id=\"57414843\">municipal elections<\/span>.\u00a0This includes <a href=\"https:\/\/takomaparkmd.gov\/DocumentCenter\/View\/3616\/Proclamation-Recognizing-the-30th-Anniversary-of-Noncitizen-Voting-and-10th-Anniversary-of-16--17--Year-Old-Voting-in-Takoma-Park\" target=\"_blank\" rel=\"noopener\">Takoma Park<\/a>, which is among the first <span data-term-id=\"57414821\">municipalities<\/span> to adopt <span data-term-id=\"57414854\">noncitizen <\/span><span data-term-id=\"57414803\">voting<\/span><span data-term-id=\"57414854\"> rights<\/span> for <span data-term-id=\"57414798\">local elections<\/span>.<\/p>\n<h3><span data-term-id=\"57414817\">Vermont<\/span><\/h3>\n<p>Three <span data-term-id=\"57414821\">municipalities<\/span> in <span data-term-id=\"57414817\">Vermont<\/span> have adopted similar policies:<\/p>\n<ul>\n<li>Burlington<\/li>\n<li>Montpelier<\/li>\n<li>Winooski<\/li>\n<\/ul>\n<p>Not every effort to allow\u00a0<a href=\"https:\/\/ballotpedia.org\/Laws_permitting_noncitizens_to_vote_in_the_United_States\" target=\"_blank\" rel=\"noopener\">noncitizens to vote in <span data-term-id=\"57414798\">local elections<\/span><\/a>\u00a0succeeded. For instance, <span data-term-id=\"57414811\">New York City<\/span> enacted a local law in 2021 that would have permitted noncitizens to vote in municipal contests, but a state court struck it down in June 2022. The court found that it conflicted with the New York <span data-term-id=\"57414851\">State Constitution<\/span>, which limits <span data-term-id=\"57414803\">voting rights<\/span> to <span data-term-id=\"57414800\">U.S. citizens<\/span>. The New York Court of Appeals affirmed that ruling in a 6-1 decision in March 2025.<\/p>\n<h2>States That Prohibit <span data-term-id=\"57414797\">Noncitizen Voting<\/span><\/h2>\n<p>As of early 2026, 18 states have added language to their <span data-term-id=\"57414851\">state constitutions<\/span> explicitly prohibiting <span data-term-id=\"57414797\">noncitizen voting<\/span>. States that prohibit <span data-term-id=\"57414797\">noncitizen voting<\/span> include:<\/p>\n<ul>\n<li>Alabama<\/li>\n<li>Arizona<\/li>\n<li><span data-term-id=\"57414825\">Colorado<\/span><\/li>\n<li><span data-term-id=\"57414816\">Florida<\/span><\/li>\n<li>Idaho<\/li>\n<li>Iowa<\/li>\n<li>Kentucky<\/li>\n<li><span data-term-id=\"57414831\">Louisiana<\/span><\/li>\n<li>Missouri<\/li>\n<li><span data-term-id=\"57414847\">North Carolina<\/span><\/li>\n<li><span data-term-id=\"57414842\">North Dakota<\/span><\/li>\n<li><span data-term-id=\"57414812\">Ohio<\/span><\/li>\n<li>Oklahoma<\/li>\n<li>South Carolina<\/li>\n<li><span data-term-id=\"57414815\">Texas<\/span><\/li>\n<li>Utah<\/li>\n<li>Wisconsin<\/li>\n<li>Wyoming<\/li>\n<\/ul>\n<p>Several additional states have related ballot measures pending for 2026. These constitutional amendments do not affect <span data-term-id=\"57414810\">federal law<\/span>, but close the door on <span data-term-id=\"57414821\">municipalities<\/span> in those states extending local <span data-term-id=\"57414803\">voting rights<\/span> to noncitizens.<\/p>\n<p>If you hold lawful <span data-term-id=\"57414853\">permanent resident<\/span> status or another noncitizen immigration status, contact your local board of elections to learn whether your <span data-term-id=\"57414821\">municipality<\/span> allows you to vote and the specific requirements you have to meet.<\/p>\n<h2>The Path to Full <span data-term-id=\"57414803\">Voting Rights<\/span>: <span data-term-id=\"57414809\">Naturalization<\/span><\/h2>\n<p>Once you become a naturalized <span data-term-id=\"57414846\">citizen of the United States<\/span>, you hold the same <span data-term-id=\"57414803\">voting rights<\/span> as any native-born American. These <span data-term-id=\"57414803\">voting rights<\/span> include the right to participate in all federal, state, and <span data-term-id=\"57414798\">local elections<\/span>.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/naturalization-process.html\"><span data-term-id=\"57414809\">Naturalization<\/span><\/a> is the formal legal process by which a noncitizen becomes a <span data-term-id=\"57414800\">U.S. citizen<\/span>. To be eligible, you must meet all of the following requirements:<\/p>\n<ul>\n<li>You have held <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigrants-your-rights-as-a-permanent-resident.html\">lawful <span data-term-id=\"57414853\">permanent resident<\/span> (LPR) status<\/a>, also known as a green card, for at least five years, or three years if you are married to a <span data-term-id=\"57414800\">U.S. citizen<\/span><\/li>\n<li>You have maintained continuous residence in the United States throughout that period<\/li>\n<li>You are at least 18 years old at the time of filing<\/li>\n<li>You have demonstrated good moral character<\/li>\n<li>You have passed tests in English language proficiency and the U.S. civics test<\/li>\n<\/ul>\n<p>The processing time for <span data-term-id=\"57414809\">naturalization<\/span> may vary. In general, the process from filing to <span data-term-id=\"57414809\">naturalization<\/span> can take up to two years or longer, depending on your circumstances and the current caseloads of <span data-term-id=\"57414827\">U.S. Citizenship<\/span> and Immigration Services (USCIS). Once the USCIS approves your application and you take the Oath of Allegiance, you become a <span data-term-id=\"57414800\">U.S. citizen<\/span> and may register to vote.<\/p>\n<p>If you want to gain your <span data-term-id=\"57414803\">voting rights<\/span> by becoming a naturalized <span data-term-id=\"57414837\">American citizen<\/span>, consider speaking with an <a href=\"https:\/\/lawyers.findlaw.com\/immigration\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">immigration law attorney<\/a>. Depending on the circumstances, prosecutors can charge it under <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-911\/\" target=\"_blank\" rel=\"noopener\">false claims of citizenship<\/a> or <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-1015\/\" target=\"_blank\" rel=\"noopener\">false statements in <span data-term-id=\"57414809\">naturalization<\/span> and citizenship proceedings<\/a>.<\/p>\n<p>Many noncitizens who end up on the <span data-term-id=\"57414832\">voter rolls<\/span> did not intend to register illegally. A significant number of these cases stem from administrative errors. The most common situation involves a noncitizen applying for a <span data-term-id=\"57414806\">driver&#8217;s license<\/span> or state ID at a DMV that uses automatic <span data-term-id=\"57414799\">voter registration<\/span>, which may enroll them to vote without their awareness. <span data-term-id=\"57414808\">California<\/span> Governor Jerry Brown signed\u00a0<a href=\"https:\/\/www.sos.ca.gov\/administration\/news-releases-and-advisories\/2015-news-releases-and-advisories\/governor-brown-signs-california-new-motor-voter-act\" target=\"_blank\" rel=\"noopener\">AB 1461<\/a>, which created an automatic <span data-term-id=\"57414799\">voter registration<\/span> process through the DMV and included provisions to limit criminal exposure for noncitizens who were inadvertently registered without intending to do so.<\/p>\n<p>If you learned that you may have been registered to vote without intending to, contact your <span data-term-id=\"57414798\">local election<\/span> authority to correct the record. You can also reach out to an <a href=\"https:\/\/lawyers.findlaw.com\/immigration\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a> if you are concerned about your immigration status being at risk.<\/p>\n<h2>How To Check Whether You\u2019re Eligible To Vote<\/h2>\n<p>The most direct route is to contact your local board of elections or your state&#8217;s <span data-term-id=\"57414804\">Secretary of State<\/span> office. <span data-term-id=\"57414801\">Election officials<\/span> can tell you whether your <span data-term-id=\"57414805\">jurisdiction<\/span> allows noncitizens to vote in any local races, the documentation you need to register, and how to verify or correct your current registration status. You can also visit your state&#8217;s official election website for <span data-term-id=\"57414805\">jurisdiction<\/span>-specific information or reach out to your <span data-term-id=\"57414798\">local election<\/span> authority before submitting any registration paperwork.\u00a0<\/p>\n<p>Keep in mind that receiving <span data-term-id=\"57414799\">voter registration<\/span> materials does not mean you are entitled to vote. The National <span data-term-id=\"57414799\">Voter Registration<\/span> Act of 1993, otherwise known as the &#8220;Motor Voter&#8221; law, requires DMV offices to make <span data-term-id=\"57414799\">voter registration<\/span> materials available to all applicants. Receiving those materials is separate from having the legal right to register or vote.<\/p>\n<h2>Get Legal Help With Your <span data-term-id=\"57414803\">Voting Rights<\/span><\/h2>\n<p><span data-term-id=\"57414797\">Noncitizen voting<\/span> laws are fact-specific, and the consequences of getting them wrong can be serious.
