Understanding these rules is critical for regaining control of your voting future. Regaining your voice is too important to pursue without the proper guidance.<\/p>\n<p>Let\u2019s get started with a look at voter <span data-term-id=\"56742404\">disenfranchisement<\/span>.<\/p>\n<h2>What Is <span data-term-id=\"56742404\">Disenfranchisement<\/span>?<\/h2>\n<p>Voter <span data-term-id=\"56742404\">disenfranchisement<\/span> is when the state or federal government formally removes or restricts someone\u2019s right to vote. <span data-term-id=\"56742404\">Disenfranchisement<\/span> may affect groups of people. The now-illegal poll taxes of the <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/jim-crow-laws.html\">Jim Crow South<\/a>, for example, <span data-term-id=\"56742404\">disenfranchised<\/span> Black Americans and many poor white Americans.<\/p>\n<p>Individuals may also be <span data-term-id=\"56742404\">disenfranchised<\/span>. A court ruling, for instance, may render a specific person ineligible to vote for various reasons. This includes a <span data-term-id=\"56742401\">felony conviction<\/span>.<\/p>\n<h2>Is Restricting <span data-term-id=\"56742400\">Voting Rights<\/span> for Felons Constitutional?<\/h2>\n<p>Yes. When the <a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">Constitution<\/a> was first written, it didn\u2019t guarantee anyone the right to vote. Instead, it gave states the power to set their own voting rules for state and federal elections.<\/p>\n<p>Initially, most states granted white adult male property owners the right to vote. After the Civil War, Congress wanted to stop states from blocking Black men from voting. It passed the <a href=\"https:\/\/constitution.findlaw.com\/amendment15.html\" target=\"_blank\" rel=\"noopener\">Fifteenth Amendment<\/a>, which banned racial discrimination in voting.<\/p>\n<p>Over time, additional amendments expanded the right to vote:<\/p>\n<ul>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment19.html\" target=\"_blank\" rel=\"noopener\"><strong>The Nineteenth Amendment<\/strong><\/a> (1920): Gave the right to vote to adult women citizens<\/li>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment24.html\" target=\"_blank\" rel=\"noopener\"><strong>The Twenty-Fourth Amendment<\/strong> <\/a>(1964): Protected the right to vote for all eligible citizens by banning poll taxes in federal elections<\/li>\n<li><a href=\"https:\/\/constitution.findlaw.com\/amendment26.html\" target=\"_blank\" rel=\"noopener\"><strong>The Twenty-Sixth Amendment<\/strong><\/a> (1971): Gave the right to vote to all citizens aged 18 and older<\/li>\n<\/ul>\n<p>Even with these changes, the states retained the power to decide whether people with <span data-term-id=\"56742401\">felony convictions<\/span> could vote. The <span data-term-id=\"56742437\">Supreme Court<\/span> confirmed this in <a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/418\/24.html\" target=\"_blank\" rel=\"noopener\"><em>Richardson v. Ramirez<\/em> (1974)<\/a>. It held that the states may deny <span data-term-id=\"56742400\">voting rights<\/span> to people with <span data-term-id=\"56742401\">felony convictions<\/span>. This is because the Fourteenth Amendment allows the states to restrict voting for \u201cparticipation in rebellion or other crime,\u201d making states\u2019 voting restrictions for people with <span data-term-id=\"56742423\">criminal convictions<\/span> constitutional.<\/p>\n<h2>Restoring <span data-term-id=\"56742400\">Voting Rights<\/span> for <span data-term-id=\"56742401\">Felony Convictions<\/span><\/h2>\n<p><span data-term-id=\"56742459\">State legislatures<\/span> determine their own <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote-\/voting-rights-history-and-law.html\">voting laws<\/a>. This includes whether a <span data-term-id=\"56742401\">felony conviction<\/span> is grounds for <span data-term-id=\"56742404\">disenfranchisement<\/span>. States have a long history of prohibiting felons from voting before reinstating their rights later.<\/p>\n<p>In almost all U.S. jurisdictions, a <span data-term-id=\"56742401\">felony conviction<\/span> results in a loss of <span data-term-id=\"56742400\">voting rights<\/span> for a period of time. In these jurisdictions, people convicted of a felony never lose their <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/what-are-voter-rights.html\"><span data-term-id=\"56742400\">voting rights<\/span><\/a>. <span data-term-id=\"56742467\">Incarcerated people<\/span>\u00a0serving time for a\u00a0<span data-term-id=\"56742464\">felony offense<\/span> can still cast a legal ballot.<\/p>\n<p>Of the remaining 48 jurisdictions, the path to restoring <span data-term-id=\"56742400\">voting rights<\/span> varies. Some states automatically restore a person\u2019s <span data-term-id=\"56742400\">voting rights<\/span> as soon as they leave prison, even if they\u2019re on <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/probation-faq.html\">parole or probation<\/a>. Others require completion of the entire sentence or an individualized review before <span data-term-id=\"56742400\">voting rights<\/span> can be restored.<\/p>\n<p>Regardless of how you <span data-term-id=\"56742468\">restore your vote<\/span>, you\u2019ll need to re-register (or, in some cases, register) before you can vote. Find <a href=\"https:\/\/www.eac.gov\/voters\/register-and-vote-in-your-state\/\" target=\"_blank\" rel=\"noopener\">your state\u2019s <span data-term-id=\"56742409\">voter registration<\/span> office<\/a>\u00a0for additional information.<\/p>\n<h2><span data-term-id=\"56742460\">State-by-State<\/span> Breakdown<\/h2>\n<p>In this section, we examine the rules for restoring your right to vote in the 48 states where some or all <span data-term-id=\"56742401\">felony convictions<\/span> mean <span data-term-id=\"56742404\">disenfranchisement<\/span>. As you\u2019ll see, a few states can <span data-term-id=\"56742404\">disenfranchise<\/span> people for <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\"><span data-term-id=\"56742403\">misdemeanor convictions<\/span><\/a>.<\/p>\n<p>Every state that strips <span data-term-id=\"56742400\">voting rights<\/span> for <span data-term-id=\"56742423\">criminal convictions<\/span> offers at least one potential pathway to restoration. This is true even for states that use terms such as permanent <span data-term-id=\"56742404\">disenfranchisement<\/span> or disqualification.<\/p>\n<p>In some states, a legal <span data-term-id=\"56742469\">financial obligation<\/span> (LFO) may interfere with the restoration of your <span data-term-id=\"56742400\">voting rights<\/span>. LFOs include things like:<\/p>\n<ul>\n<li><span data-term-id=\"56742462\">Court costs<\/span><\/li>\n<li>Fines<\/li>\n<li>Court fees<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/restitution.html\">Restitution<\/a><\/li>\n<li>Supervision fees<\/li>\n<li>Costs of incarceration<\/li>\n<\/ul>\n<p>Outstanding LFOs can obstruct the <span data-term-id=\"56742416\">restoration of <\/span><span data-term-id=\"56742400\">voting rights<\/span> for various reasons. Unpaid amounts may be tied to supervision status in some states. Those convicted of other felonies don\u2019t.<\/em><\/p>\n<p><strong>Restoration process<\/strong>: Upon <span data-term-id=\"56742436\">completion of the sentence<\/span>, including probation\/parole\/supervision and full satisfaction of LFOs, a person may apply to get their <span data-term-id=\"56742402\">voting rights<\/span><span data-term-id=\"56742402\"> restored<\/span> using a\u00a0<a href=\"https:\/\/paroles.alabama.gov\/about-us\/pardons-restoration-of-voting-rights\/\" target=\"_blank\" rel=\"noopener\">Certificate of <span data-term-id=\"56742412\">Eligibility<\/span> to Register to Vote<\/a>\u00a0(CERV).<\/p>\n<p>They may also seek a pardon (required for the most serious offenses). <a href=\"https:\/\/www.alea.gov\/node\/83\" target=\"_blank\" rel=\"noopener\">The <span data-term-id=\"56742410\">Alabama<\/span> Board of Pardons and Paroles<\/a> issues CERVs and grants pardons. Pardons are granted on a discretionary basis. They then file a petition in the superior court where they were convicted and attach the certificate (or probation completion documentation).<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Arkansas<\/th>\n<td>\n<p><strong>Restoration process<\/strong>: <a href=\"https:\/\/codes.findlaw.com\/ar\/arkansas-constitution-of-1874\/ar-const-amend-51-sect-11.html\" target=\"_blank\" rel=\"noopener\">Upon completion of the entire sentence<\/a>, including probation\/parole\/supervision and full satisfaction of LFOs, obtain proof of discharge from the court or your probation\/parole officer, and submit to the county clerk.<\/p>\n<p>You may also seek a pardon to restore <span data-term-id=\"56742400\">voting rights<\/span>.
