States have different laws for voters who do not support an official candidate.<\/p>\n\n    <\/div>\n\n\n\n<h1>Can I Vote for <span data-term-id=\"57502043\">None of the Above<\/span>? <span data-term-id=\"57502048\">Protest Votes<\/span>, Write-In Votes, and Other Options<\/h1>\n<p>Voters can be dissatisfied with the candidates on their ballot. Most states allow voters to cast their vote for a <a href=\"https:\/\/investigativepost.org\/2021\/09\/28\/dos-and-donts-of-write-in-voting\/\" target=\"_blank\" rel=\"noopener\">\u201cwrite-in\u201d candidate<\/a>. Some states, like New Jersey, allow you to write in any name you want. Other jurisdictions, like Arkansas, don\u2019t allow write-in votes at all.<\/p>\n<p>Write-in votes aren\u2019t the only type of <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/what-is-a-protest-vote.html\"><span data-term-id=\"57502048\">protest votes<\/span><\/a>. Depending on where you live, you may have several <span data-term-id=\"57502052\">voting options<\/span> in elections where you aren\u2019t happy about any of the candidates.<\/p>\n<p>This article explains whether you can vote for \u201c<span data-term-id=\"57502043\">none of the above<\/span>\u201d at the polls. They can answer any questions you have and help ensure that your voting rights are protected.<\/p>\n<h2>Options if You Don\u2019t Want To Vote for an Official Candidate<\/h2>\n<p>It can be frustrating to feel like you have to vote for a candidate printed on the official ballot if none of them appeal to you. It has to do with more than whether you register as a <a href=\"https:\/\/www.pewresearch.org\/politics\/fact-sheet\/party-affiliation-fact-sheet-npors\/\" target=\"_blank\" rel=\"noopener\">Democrat or a Republican<\/a>. It has to do with your right to cast a vote for the person you feel is most capable of performing the tasks required of the office.<\/p>\n<p>While there is one state that allows the \u201c<span data-term-id=\"57502050\">None of the Above<\/span><span data-term-id=\"57502050\">&#8221; vote<\/span>, residents of the other 49 states (plus the District of Columbia) have other ways of participating in the <a href=\"https:\/\/www.findlaw.com\/voting\/how-u-s-elections-work.html\">democratic process<\/a>.<\/p>\n<p>Some of these other <span data-term-id=\"57502052\">voting options<\/span> include:<\/p>\n<ul>\n<li>Voting for <a href=\"https:\/\/www.pbs.org\/newshour\/tag\/third-party-candidates\" target=\"_blank\" rel=\"noopener\">third-party candidates<\/a> (instead of a <span data-term-id=\"57502082\">new candidate<\/span> from the traditional <span data-term-id=\"57502047\">political parties<\/span>)<\/li>\n<li>Submitting a write-in vote<\/li>\n<li>Using tactical voting strategies<\/li>\n<li>Leaving the <span data-term-id=\"57502069\">ballot paper<\/span> blank for specific elections (a <span data-term-id=\"57502075\">blank vote<\/span>)<\/li>\n<li>Casting a <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/protest-laws-by-state.html\"><span data-term-id=\"57502048\">protest vote<\/span><\/a><\/li>\n<\/ul>\n<p>These methods allow voters to make their voices heard without abstaining from voting entirely.<\/p>\n<p>People who choose one of the above options usually realize that there is little to no chance that their <span data-term-id=\"57502060\">write-in candidate<\/span> or <a href=\"https:\/\/ballotpedia.org\/Ballot_access_for_major_and_minor_party_candidates\" target=\"_blank\" rel=\"noopener\">third-party candidate<\/a> will get the <span data-term-id=\"57502057\">most votes<\/span>. In fact, they may be able to count the <span data-term-id=\"57502056\">number of votes<\/span> these candidates receive on one hand.<\/p>\n<p>For these people, achieving the <span data-term-id=\"57502058\">plurality<\/span> of votes isn\u2019t their primary concern. They may not even be all that concerned about the <span data-term-id=\"57502062\">election results<\/span>. What matters to them is that they have the <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/voting-rights.html\">right to vote<\/a> in a way they feel is fair and just.<\/p>\n<h2><span data-term-id=\"57502048\">Protest Votes<\/span><\/h2>\n<p>A <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide.html\"><span data-term-id=\"57502048\">protest vote<\/span><\/a> is a way for the <span data-term-id=\"57502078\">constituency<\/span> to express its dissatisfaction with either the political candidates running for election or the political system itself. There are several types of <span data-term-id=\"57502048\">protest votes<\/span>, including the options described above.<\/p>\n<p>There are also other types of <span data-term-id=\"57502048\">protest votes<\/span>, such as:<\/p>\n<ul>\n<li><a href=\"https:\/\/ballotpedia.org\/Spoiled_ballot\" target=\"_blank\" rel=\"noopener\"><strong>Spoiled ballots<\/strong><\/a>: Sometimes, a person intentionally messes up a ballot so that it won\u2019t count toward any candidate. For example, they may punch out numerous \u201cchads\u201d or write on a <span data-term-id=\"57502069\">ballot paper<\/span> with a permanent marker.<\/li>\n<li><strong>Blank ballot<\/strong>: Rather than spoiling a ballot, a voter may cast a <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/can-i-leave-blanks-on-a-voting-ballot.html\">blank ballot<\/a>. The person understands that they won\u2019t have any say in the <span data-term-id=\"57502062\">election results<\/span>. However, since they don\u2019t support any of the candidates, this doesn\u2019t bother them. Their point is to demonstrate the fact that they don\u2019t support the candidates or the election in general.<\/li>\n<li><a href=\"https:\/\/stateline.org\/2022\/03\/18\/contentious-fringe-legal-theory-could-reshape-state-election-laws\/\" target=\"_blank\" rel=\"noopener\"><strong>Fringe votes<\/strong><\/a>: Some voters cast a \u201cthrow-away\u201d vote for someone they know has no chance of winning the election. They would rather do this than vote for someone they don\u2019t believe in.<\/li>\n<\/ul>\n<p>Casting a <span data-term-id=\"57502048\">protest vote<\/span> is not the same as <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/what-does-abstention-from-voting-mean.html\">abstaining from voting<\/a>. A person who is frustrated with the political system may choose not to take part in the election at all. Others can participate in the election in ways that express their dissatisfaction.<\/p>\n<p>You can cast a <span data-term-id=\"57502048\">protest vote<\/span> in almost every type of election. This is true for both statewide and <a href=\"https:\/\/codes.findlaw.com\/cfr\/title-11-federal-elections\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57502066\">federal elections<\/span><\/a>. If members of the <span data-term-id=\"57502073\">electorate<\/span> don\u2019t wish to vote for a candidate on the ballot, they can cast a <span data-term-id=\"57502048\">protest vote<\/span>.<\/p>\n<p>Some of the <a href=\"https:\/\/www.findlaw.com\/voting\/how-u-s-elections-work\/what-are-the-different-types-of-primary-elections-0.html\">elections<\/a> where you can cast a <span data-term-id=\"57502048\">protest vote<\/span> include:<\/p>\n<ul>\n<li><span data-term-id=\"57502076\">Presidential primaries<\/span><\/li>\n<li><span data-term-id=\"57502049\">Presidential elections<\/span><\/li>\n<li><span data-term-id=\"57502080\">Democratic primaries<\/span><\/li>\n<li>Republican primaries<\/li>\n<\/ul>\n<p>Whether you\u2019re a <a href=\"https:\/\/www.eac.gov\/voters\/voting-101-election-information-new-voters\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57502063\">first-time<\/span> voter<\/a> or someone who\u2019s voted in a dozen elections, you\u2019ll always have the option of casting a <span data-term-id=\"57502048\">protest vote<\/span>. The government would rather voters not do this, as it skews the impact of high\u00a0<span data-term-id=\"57502053\">voter turnout<\/span>. If you vote but cast a blank or spoiled ballot, it won\u2019t impact the <span data-term-id=\"57502062\">election results<\/span>.<\/p>\n<h2><span data-term-id=\"57502044\">Nevada<\/span>\u2019s \u201c<span data-term-id=\"57502046\">None of These Candidates<\/span>\u201d Option<\/h2>\n<p><span data-term-id=\"57502044\">Nevada<\/span> is the only state that offers a &#8220;<span data-term-id=\"57502046\">None of These Candidates<\/span>&#8221; (<span data-term-id=\"57502059\">NOTA vote<\/span>) option as an official choice at <span data-term-id=\"57502064\">polling stations<\/span>. Voters in <span data-term-id=\"57502044\">Nevada<\/span> can cast an official \u201c<a href=\"https:\/\/www.findlaw.com\/legalblogs\/ninth-circuit\/9th-cir-none-of-these-candidates-can-stay-on-nevada-ballot\/\"><span data-term-id=\"57502043\">None of the Above<\/span>\u201d vote<\/a> in federal and statewide <span data-term-id=\"57502045\">general elections<\/span>.<\/p>\n<p>Residents of <span data-term-id=\"57502044\">Nevada<\/span> also have the \u201c<span data-term-id=\"57502043\">None of the Above<\/span>\u201d option in all statewide elections, including, but not limited to, the following:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/voting\/nevada-voting-guide.html\"><span data-term-id=\"57502072\">Secretary of State<\/span> Elections<\/a><\/li>\n<li>Justice of the <span data-term-id=\"57502068\">Supreme Court<\/span> elections<\/li>\n<li>Lieutenant Governor elections<\/li>\n<\/ul>\n<p>If a <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/am-i-registered-to-vote.html\">registered voter<\/a> feels strongly that <span data-term-id=\"57502071\">none of the candidates<\/span> are qualified to hold office, they can make their feelings known by casting a vote for \u201c<span data-term-id=\"57502046\">None of These Candidates<\/span>.\u201d <span data-term-id=\"57502044\">Nevada<\/span> has allowed voters to cast a \u201c<span data-term-id=\"57502043\">None of the Above<\/span>\u201d vote since 1975. Election officials must accept these \u201c<span data-term-id=\"57502043\">None of the Above<\/span>\u201d votes the same way they would any other <span data-term-id=\"57502061\">valid vote<\/span>.<\/p>\n<h2>Write-In Votes<\/h2>\n<p>Submitting a <a href=\"https:\/\/www.findlaw.com\/voting.html\">write-in vote<\/a> can be seen as a form of <span data-term-id=\"57502048\">protest vote<\/span>. When a person is not willing to vote for any of the candidates on the ballot, they can cast a write-in vote instead. For example, imagine that a person does not support either Candidate A or Candidate B. Instead of voting for the <span data-term-id=\"57502077\">lesser of two evils<\/span>, they write in the name of the person they would support instead.<\/p>\n<p>As of 2026, 40 states plus the District of Columbia permit write-in votes. Thirty-one of these states, such as <a href=\"https:\/\/newyork.public.law\/laws\/n.y._election_law_section_8-308\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57502055\">New York<\/span><\/a>, require citizens to register the name of the person they intend to vote for prior to the election.<\/p>\n<p>Some states allow you to cast a write-in vote for anybody you choose. These states include:<\/p>\n<ul>\n<li>Alabama<\/li>\n<li>Iowa<\/li>\n<li>New Hampshire<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/nj\/title-19-elections\/nj-st-sect-19-14-2-1.html\" target=\"_blank\" rel=\"noopener\">New Jersey<\/a><\/li>\n<\/ul>\n<p>While most jurisdictions allow write-in votes, a handful of states prohibit them. These states include:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/ar\/title-7-elections\/ar-code-sect-7-5-205\/\" target=\"_blank\" rel=\"noopener\">Arkansas<\/a><\/li>\n<li>Louisiana<\/li>\n<li>South Dakota<\/li>\n<\/ul>\n<p>People who submit write-in votes understand that their candidate is not going to win the election. However, it\u2019s important enough to them that they express their lack of support for the actual candidates.<\/p>\n<h2>Voting for Third-Party Candidates<\/h2>\n<p>In many U.S. elections, voters must choose from two primary candidates. Candidates representing third parties may also be on the ballot. Some people refer to these candidates as <a href=\"https:\/\/www.jstor.org\/stable\/26528326\" target=\"_blank\" rel=\"noopener\">insurgents<\/a>. They remain on the ballot even though they can\u2019t win the election.<\/p>\n<p>Citizens can vote for a third-party candidate as a form of protest against the political establishment and their candidates. Since each citizen only gets one vote, a vote for a third-party candidate is one that a more popular candidate won\u2019t receive.<\/p>\n<h2>Tactical <span data-term-id=\"57502048\">Protest Votes<\/span><\/h2>\n<p>Sometimes, voters care more about keeping a particular candidate out of office than supporting their own candidate. This is why some voters use their vote tactically to prevent an undesirable candidate from gaining office.<\/p>\n<p><a href=\"https:\/\/electionscience.org\/research-hub\/tactical-voting-basics\" target=\"_blank\" rel=\"noopener\">Tactical <span data-term-id=\"57502048\">protest voting<\/span><\/a> usually involves someone casting their ballot for the candidate most likely to beat the undesirable candidate. They may do this even if it means not voting for the candidate they want to win.<\/p>\n<h2><span data-term-id=\"57502054\">Abstention<\/span> is Different From a <span data-term-id=\"57502048\">Protest Vote<\/span><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/what-does-abstention-from-voting-mean-.html\"><span data-term-id=\"57502054\">Abstention<\/span><\/a> occurs when a voter chooses not to participate in the electoral process. Rather than cast a <span data-term-id=\"57502048\">protest vote<\/span> or a \u201c<span data-term-id=\"57502043\">None of the Above<\/span>\u201d ballot, someone abstaining doesn\u2019t cast a vote at all.
