This includes adoptive and natural parents. The custodial parent is typically the parent who receives the child support.<\/p>\n\n    <\/div>\n\n<p>But what factors determine child support eligibility? Read on for critical information about what you must do to be eligible for child support.<\/p>\n<h2>Why Child Support Is Important<\/h2>\n<p>Both parents have a legal duty to provide financial support for their children. Typically, the parent who doesn&#8217;t have primary custody of the child makes child support payments to the custodial parent for their share of the child&#8217;s financial needs. The court (using state child support guidelines) sets a child support amount to ensure that your child has enough money for the basic needs of food, clothes, shelter, and other necessities, including health insurance and child care.<\/p>\n<p>Depending on state law, a specific child support order remains active until the child turns 18 or 19 if the child is unmarried and still in high school full-time. Also, the child support obligation ends if a child becomes emancipated. Under certain circumstances, the court may order you to continue paying child support after the child reaches adulthood.<\/p>\n<h2>Child Support Eligibility Requirements<\/h2>\n<p>It&#8217;s essential to understand the basic legal requirements that a parent or legal guardian must meet to receive child support payments from the other parent. In a typical child support situation, the<i> <\/i>\u201cobligor,&quot; or the parent who provides the support, is generally the non-custodial parent who doesn&#8217;t live with the child most of the time. The obligor pays the custodial parent or the &quot;obligee.&quot; However, child support is not guaranteed. Specific conditions must apply. To be eligible, you must have the following:<\/p>\n<ul>\n<li>Legal relationship<\/li>\n<li>Legal obligation<\/li>\n<li>Custody<\/li>\n<\/ul>\n<h3>Legal Relationship<\/h3>\n<p>If you&#8217;re trying to get child support payments on behalf of a child, you must have a legal relationship with that child. Usually, this means the child&#8217;s biological parent. However, adoptive parents or legal guardians also meet this requirement.<\/p>\n<h3>Legal Obligation<\/h3>\n<p>The individual you&#8217;re trying to obtain money from must be legally obligated to support the child. The child support obligation comes from either a court order or by agreement.<\/p>\n<h3>Custody<\/h3>\n<p>The legal relationship connects to custody. To be eligible for support, you must have custody of your child. Generally, that means &quot;sole primary custody,&quot; but that&#8217;s not always true.<\/p>\n<h2>Establishing Paternity<\/h2>\n<p>When a child is born from a married couple, they are the presumptive parents. A husband is the presumptive or &quot;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/putative.html\" target=\"_blank\" rel=\"noopener\">putative<\/a>&quot; father, and he has paternity rights and obligations. The court also establishes paternity with a paternity test. Either parent can seek a DNA test by petitioning the court.<\/p>\n<h2>Child Support Agreements<\/h2>\n<p>A child support agreement is a legal document establishing the terms of the child support payments. It is reached by voluntary agreement with parents or through a court order as part of a family law action, such as a divorce or paternity proceeding. The contract may include the following:<\/p>\n<ul>\n<li>The parent responsible for the child support payments (the obligor)<\/li>\n<li>The amount of child support<\/li>\n<li>The timing of the child support payments<\/li>\n<li>The number of children to be supported<\/li>\n<li>The length of the agreement<\/li>\n<li>The methods of payment<\/li>\n<li>The requirements for modifying the agreement later (what to do if there&#8217;s a substantial change in one or both parents&#8217; income)<\/li>\n<li>The kinds of expenses that the parent can use the child support for (medical expenses, educational expenses, health care, after-school activities)<\/li>\n<\/ul>\n<h2>Custodial Parents<\/h2>\n<p>The court designates a &quot;custodial&quot; parent by its order (in the case of a family court proceeding, like a divorce or a child custody dispute). In a single-parent household, that parent is the custodial parent when the other parent has made no effort toward seeking custody.<\/p>\n<p>While child support can vary from state to state, the parent receiving child support is usually the custodial parent. The custodial parent has primary <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/physical-custody.html\">physical custody<\/a> of the child, where the parent lives with the child most of the time. They are chiefly responsible for the child&#8217;s daily care (arranging daycare, taking them to school and social activities, etc.). Even if the other parent has liberal time with the child and &quot;joint physical custody,&quot; the court considers the parent with more time as the custodial parent.<\/p>\n<h2>Split Custody<\/h2>\n<p>50-50 shared custody determinations are rare. Dividing the time parents spend with their children equally is difficult. In a <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/joint-custody.html\">joint custody<\/a> situation where the child spends equal time living with each parent, the court considers both parents as custodial parents. The court won&#8217;t order either parent to pay the other, especially if incomes are similar. You must address these issues first. Ask the following questions:<\/p>\n<ul>\n<li>Can the court secure payment of child support? Does the custodial parent know the <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/how-do-i-locate-a-parent-for-child-support.html\">whereabouts of the other parent<\/a>? Do they have a home address and the name of an employer? A custodial parent should find out if they&#8217;re entitled to free assistance locating the other birthparent from their state&#8217;s <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-specific-child-support-information-and-guidelines.html\">child support services agency<\/a>.<\/li>\n<\/ul>\n<ul>\n<li>Is <a href=\"https:\/\/www.findlaw.com\/family\/paternity\/legal-significance-of-paternity.html\">paternity<\/a> legally established? If the parents were unmarried, a DNA paternity test may be required.<\/li>\n<\/ul>\n<ul>\n<li>Has the custodial parent received a <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-by-court-order.html\">child support order<\/a> in family court? Until the parent has one, their state child support agency cannot help them enforce the order in most cases.<\/li>\n<\/ul>\n<h2>Child Support Services Agencies<\/h2>\n<p>Federal law sets up state child support programs. Child support agencies in your state are critical resources. Parents can complete preliminary tasks to get child support. For example, if you&#8217;re on public assistance, the child support agency will open a child support case for you.<\/p>\n<p>If you don&#8217;t receive government benefits, need to open a child support case, or have an existing order, your state child support agency can still likely help. The organization can also give you referrals for other points of assistance.<\/p>\n<p>The agencies&#8217; child support programs can provide parent location assistance, child support collections, or child support enforcement services, including help receiving current support and support that is in arrears (past due).<\/p>\n<p>Nonpayment of child support can result in <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/enforcement-of-child-support-faq-s.html\">severe sanctions<\/a>, including:<\/p>\n<ul>\n<li>Mandatory income withholding<\/li>\n<li>Medical insurance coverage assignment<\/li>\n<li>Loss of professional licenses<\/li>\n<li>Loss of driver&#8217;s license<\/li>\n<li>Property liens<\/li>\n<li>Revocation of passport<\/li>\n<li>Take money from your state or federal tax refunds (referred to as &quot;income tax intercept&quot;)<\/li>\n<\/ul>\n<h2>General Considerations for Determining Child Support Eligibility<\/h2>\n<p>The court considers other factors for determining child support eligibility, including:<\/p>\n<ul>\n<li>The needs of the child<\/li>\n<li>The physical and emotional state of the child<\/li>\n<li>The income of both parents<\/li>\n<li>The financial condition of both parents<\/li>\n<li>The standard of living the child would have received if the parents had remained together<\/li>\n<li>The number of children and the ages of the children<\/li>\n<li>The custodial parent&#8217;s financial resources\/needs<\/li>\n<\/ul>\n<h2>Can You File for Child Support Payments While Pregnant?<\/h2>\n<p>No. You can prepare the paperwork in advance, but you must wait to file until after you give birth.<\/p>\n<p>It\u2019s best to file a petition for child support as soon as your baby is born. If you are unmarried and the biological father does not sign an <a href=\"https:\/\/www.findlaw.com\/family\/paternity\/paternity-determinations-voluntary-and-formal-proceedings.html\">Acknowledgment of Paternity affidavit<\/a>, you must file a paternity petition. Establishing legal paternity is the first step in securing a child support order.<\/p>\n<p>Even if you start this process during your pregnancy with a non-invasive prenatal paternity test, a judge may order a postnatal <a href=\"https:\/\/www.findlaw.com\/family\/paternity\/paternity-tests-blood-tests-and-dna.html\">DNA test<\/a> after your child is born.<\/p>\n<p>Next, a court will assess <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/getting-child-support-checklist.html\">child support obligations<\/a> as part of a paternity order.<\/p>\n<p>While some lawmakers have <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/4512#:~:text=This%20bill%20requires%20states%20to,which%20the%20child%20was%20conceived.\" target=\"_blank\" rel=\"noopener\">proposed bills<\/a> that would allow expectant mothers to receive child support before giving birth, these bills have failed to pass. Some states have also proposed legislation allowing mothers to retroactively seek child support to cover medical expenses and health care costs relating to their pregnancy and birth. These bill have also failed to be enacted into law.<\/p>\n<p>It\u2019s smart to research child support laws prior to childbirth. You may want to talk to a <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/\" target=\"_blank\" rel=\"noopener\">family law attorney<\/a> for legal advice. They can help you open a child support case and recommend the best course of action.<\/p>\n<h2>Can You File for Child Support While Technically Still Married?<\/h2>\n<p>Yes, you can file for child support payments if you\u2019re legally married. Regardless of marital status, parents have a legal duty to support and provide for their children. This means you can <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/getting-child-support.html\">pursue a child support order<\/a> if you and the other legal parent are living apart and they are not appropriately contributing to your child\u2019s financial needs.
