In that case, the other parent, caregiver, or&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/guardian.html\" target=\"_blank\" rel=\"noopener\">guardian<\/a>&nbsp;may need to take further action.<br>\n<\/p>\n<p>But how do you enforce a child support order? Some parents work with their local child support agency to enforce and collect payments. What can I do?<\/h2>\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support\/enforcement-and-collection-of-back-child-support.html#:~:text=The%20Child%20Support%20Enforcement%20Act%20of%201984%20gives,non-paying%20parents%20to%20pay%20their%20court-ordered%20child%20support.\">Child Support Enforcement Act of 1984<\/a>&nbsp;gives you some options. The act allows the government to help you&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-enforcement.html\">collect court-ordered child support<\/a>&nbsp;from a parent who isn&#8217;t paying.<\/p>\n<p>Typically, the government orders the delinquent parent to set up a payment arrangement. If the delinquent parent continues not to pay, the government can impose other consequences, such as:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/tax\/tax-problems-audits\/wage-garnishment-faq.html\">Wage garnishment<\/a><\/li>\n<li>Property seizure (Freezing bank accounts, placing a lien against a home, property, or other real estate)<\/li>\n<li>Suspension of an occupational license<\/li>\n<li>Suspension of a business license<\/li>\n<li>Revocation of their driver&#8217;s license<\/li>\n<li>Jail time in extreme cases<\/li>\n<\/ul>\n<p>The government can also report the delinquent parent to the IRS. Federal law allows the IRS to then make a lump sum payment from the delinquent parent&#8217;s income tax refund. The government may also be able to intercept state tax refunds. Check your state for this information.<\/p>\n<p>Furthermore, anyone who owes more than $2,500 in child support is&nbsp;<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/passports\/legal-matters\/child-support.html\" target=\"_blank\" rel=\"noopener\">ineligible for a U.S. passport<\/a>.<\/p>\n<p>As mentioned, in extreme cases, the court can hold a non-paying parent in&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/contempt-of-court.html\" target=\"_blank\" rel=\"noopener\">contempt of court<\/a>&nbsp;for failing to follow a court order. Contempt of court could result in a jail term. But judges only sometimes resort to this option. The main goal of ordering child support is to help the child. Sending a delinquent parent to jail can frustrate that goal since they can&#8217;t earn money while in prison.<\/p>\n<h2><a id=\"State\"><\/a>Can a different state enforce child support if my ex moves out of state?<\/h2>\n<p>Yes. The&nbsp;<a href=\"https:\/\/www.acf.hhs.gov\/css\/policy-guidance\/uniform-interstate-family-support-act-2008-and-hague-treaty-provisions\" target=\"_blank\" rel=\"noopener\">Uniform Interstate Family Support Act<\/a>&nbsp;(UIFSA) can help you. UIFSA has procedures for you to&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support\/paying-child-support.html\">enforce child support<\/a>&nbsp;on a parent who lives in another state. Here are some enforcement action options:<\/p>\n<ul>\n<li>Ask your state court to enforce the child support order if it still has&nbsp;<a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/personal-jurisdiction-how-to-determine-where-a-person-can-be.html\">personal jurisdiction<\/a>&nbsp;over them<\/li>\n<li>Ask your state court to forward the order to the state where the delinquent parent lives<\/li>\n<li>File a child support enforcement request with the delinquent parent&#8217;s state<\/li>\n<li>Ask the delinquent parent&#8217;s employer to garnish their pay<\/li>\n<li>Contact your state child support agency for additional information<\/li>\n<\/ul>\n<p>Two other acts also penalize deadbeat parents.&nbsp;<a href=\"https:\/\/www.acf.hhs.gov\/css\/policy-guidance\/child-support-recovery-act-1992\" target=\"_blank\" rel=\"noopener\">The Child Support Recovery Act of 1992<\/a>&nbsp;makes it a federal crime to refuse to pay child support to a parent living in another state. Also, the&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/105th-congress\/house-bill\/3811\/text\/enr\" target=\"_blank\" rel=\"noopener\">Deadbeat Parents Punishment Act of 1998<\/a>&nbsp;makes it a&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/felony.html\" target=\"_blank\" rel=\"noopener\">felony<\/a>&nbsp;not to pay child support to a parent in another state. Child support services agencies can work together across state lines.<\/p>\n<p>If you can&#8217;t find the delinquent parent, there are&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support\/how-do-i-locate-a-parent-for-child-support.html\">legal procedures that can help you locate the parent<\/a>&nbsp;and enforce the child support order.<\/p>\n<h2><a id=\"PastDue\"><\/a>Can the court order my ex to pay past-due support?<\/h2>\n<p>Yes. Courts are very strict about enforcing child support. An &quot;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/arrearage.html\" target=\"_blank\" rel=\"noopener\">arrearage<\/a>&quot; is the overdue amount when a parent falls behind on payments. The delinquent parent is &quot;in&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/arrear.html\" target=\"_blank\" rel=\"noopener\">arrears<\/a>.&quot;<\/p>\n<p>If a parent finds themselves in arrears, they can ask a judge to reduce child support payments. But a judge will only reduce future payments. So, the delinquent parent must pay the arrearage in full.<\/p>\n<p>Either parent can ask the court to increase or decrease the child support amount under certain circumstances. Most courts will require a &quot;substantial change&quot; in circumstances that justifies changing the amount of child support.<\/p>\n<h2><a id=\"JobLoss\"><\/a>If I lose my job, can a court relieve me of my child support obligations?<\/h2>\n<p>As mentioned, a court won&#8217;t excuse overdue&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support\/paying-child-support-checklist.html\">child support payments<\/a>. But, if you lose your job, you should petition the court to reduce your child support obligations.<\/p>\n<p>The state uses child support guidelines to determine the child support amount. Your income is a variable in the formula for calculating your support payment. So, the court may reduce your payment if you lose your job.<\/p>\n<p>Remember, unless the court lowers it, you&#8217;re responsible for paying the amount the court originally ordered.<\/p>\n<h2><a id=\"Discharge\"><\/a>Can I discharge my child support arrears if I file for bankruptcy?<\/h2>\n<p>No. There&#8217;s a public policy in favor of parents supporting their children. So, child support debt is one of the few debts that&nbsp;<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/the-debt-discharge-in-bankruptcy-faq.html\">bankruptcy can&#8217;t discharge<\/a>. The paying parent is subject to credit reporting. A credit reporting agency must report overdue child support information.<\/p>\n<h2><a id=\"Divorce\"><\/a>My ex and I got divorced over a year ago. If I file for child support now, can I collect for the past year?<\/h2>\n<p>Generally, no. Child support typically begins on the day you request it from the court. So, be sure to file for child support as soon as possible. Often, you can file for child support when you separate from your ex. This is also when you deal with divorce issues like alimony\/spousal support.<\/p>\n<p>Judges in some states can sometimes order child support to begin from an earlier date. This way, you could get the full amount from the past year. It often depends on the child&#8217;s age. You should seek professional advice from someone familiar with your state laws.<\/p>\n<h2><a id=\"Spouse\"><\/a>My spouse manages all our finances, but they rarely give me enough money for groceries and clothes for our children. Can I get child support?<\/h2>\n<p>Probably not, unless you don&#8217;t live with your spouse. Courts don&#8217;t like interfering with matters of family lifestyle. But the court will intervene if it&#8217;s in the&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/focusing-on-the-best-interests-of-the-child.html\">child&#8217;s best interests<\/a>. For example, to protect the child from&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-abuse.html\">abuse<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/child-neglect.html\">neglect<\/a>.<\/p>\n<p>Be aware that if your spouse is not providing basic needs, the court may take custody of your child instead of ordering child support.<\/p>\n<h2><a id=\"Arrears\"><\/a>The government claims I&#8217;m thousands of dollars in arrears. But I&#8217;ve been making payments to the other parent. What should I do?<\/h2>\n<p>There are ways to avoid this predicament. Generally, you can make a child support payment to the court clerk or send it to the other parent. But the court order often does not specify which. It only includes the amount you owe.<\/p>\n<p>It&#8217;s a good idea to ask the court to include payment instructions in the order. There are many disbursement options for payments. Many child support offices provide debit cards or electronic payment cards to the custodial parent.<\/p>\n<p>Alternatively, you can agree with the other parent on how you will make the payments. Make sure to put the agreement in writing.<\/p>\n<p>Don&#8217;t pay in cash. Remember that you bear the burden of proving payment. You must prove otherwise if the other parent claims you are in arrears. So, no matter who you&#8217;re paying, always get a receipt.<\/p>\n<p>Good evidence to show you made payment if you don&#8217;t have a receipt includes the following:<\/p>\n<ul>\n<li>Witnesses<\/li>\n<li>Bank records showing direct deposit to the custodial parent<\/li>\n<li>Other letters or documents that show the parent received the payments<\/li>\n<\/ul>\n<h2><a id=\"LifeInsurance\"><\/a>Can life insurance payments be garnished for unpaid child support?<\/h2>\n<p>Most state laws prohibit the garnishment of life insurance proceeds paid to a beneficiary. If you receive payment as a beneficiary on a <a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/life-insurance.html\">life insurance policy<\/a>, those proceeds are generally exempt from garnishment for back child support. But this depends on your state\u2019s laws.<\/p>\n<p>Keep in mind that child support enforcement can garnish your bank account, though. If you deposit funds you received as a beneficiary on a loved one\u2019s life insurance policy, those funds could then be subject to garnishment. Account garnishment is a common legal method used to enforce non-payment of child support and collect what is owed.<\/p>\n<p>You may be concerned about a beneficiary of your life insurance policy receiving proceeds in the event of your death. Even if you owe unpaid child support at the time of your death, it is unlikely your beneficiary would have to pay your child support debt from your life insurance payout. Most state laws allow death benefits to be paid directly to beneficiaries, bypassing the <a href=\"https:\/\/www.findlaw.com\/estate\/probate\/probate-process-and-timeline.html\">probate estate<\/a>.<\/p>\n<p>Some divorcing couples include a provision in their <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/settlement-agreements-and-court-approval.html\">divorce decree<\/a> for the obligor to maintain a life insurance policy that covers child support payments in the event of their death.<\/p>\n<p>Since every situation is unique and laws differ by state, consider talking to a <a href=\"https:\/\/lawyers.findlaw.com\/family-law\/\" target=\"_blank\" rel=\"noopener\">family law attorney<\/a>. An attorney can review the laws in your state and advise on your specific circumstances.<\/p>\n<h2><a id=\"Joint\"><\/a>I gained joint legal custody of my child. Will this affect my child support obligations?<\/h2>\n<p>Generally, no. Both parents can decide on the child&#8217;s behalf in joint legal custody. But it doesn&#8217;t affect financial obligations, so it does not impact child support.<\/p>\n<p>Even in&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/joint-physical-custody.html\" target=\"_blank\" rel=\"noopener\">joint physical custody<\/a>, the higher-income parent has to pay child support to the lower-income parent in most cases. Sometimes with split custody, it&#8217;s confusing as to which parent is non-custodial. How much time each parent spends with the child determines the amount. The specifics of how this sliding scale works vary by state.<\/p>\n<h2><a id=\"Visit\"><\/a>Do I still have to pay child support if my ex won&#8217;t let me visit my children?<\/h2>\n<p>Yes. Don&#8217;t confuse child support obligations with&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/more-child-custody-and-visitation-faqs.html\">custody and visitation<\/a>. While these issues are all family court issues, they are separate legal issues. So, even if the other parent doesn&#8217;t honor your visitation rights, you still must pay child support.
