These laws aim to hold parents civilly liable for their children&#8217;s harmful actions.&nbsp; Parental civil liability is a form of vicarious liability.&nbsp;&nbsp;<\/p>\n\n    <\/div>\n\n<p>Parents supervise and otherwise provide control or direction to their minor children.&nbsp;<\/p>\r\n<p>Parental civil liability differs from <a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability\/parental-criminal-liability.html\">parental criminal liability<\/a>. There are times when the law identifies a parent&#8217;s misconduct or behaviors as criminal acts. Examples include state crimes such as contributing to the delinquency of a minor or endangering a child.<\/p>\r\n<p>Civil liability exposes a parent to monetary damages and other civil remedies. Most set it at 18 years of age. Some set it at another age. Basically, anyone under the age of majority in a given state is a minor child.<\/p>\r\n<p>Ohio provides a good example. In&nbsp;<a href=\"https:\/\/codes.findlaw.com\/oh\/title-xxxi-domestic-relations-children\/oh-rev-code-sect-3109-01\/\" target=\"_blank\" rel=\"noopener\">Ohio<\/a>, a person who is 18 years old and not legally disabled is an adult and has reached the age of majority. However, in Nebraska, the age of majority is 19. Mississippi is the only state that sets the age of majority at 21. There may be reasons that a child will emancipate prior to the age of majority. For example, if a child marries prior to the age of majority, they are recognized as an adult.<\/p>\r\n<h2>Can Someone Sue a Parent for Their Child&#8217;s Wrongdoing?<\/h2>\r\n<p>Yes, parents can be sued for their children&#8217;s harmful actions under the legal principle of vicarious liability. Vicarious liability means that the superior party can be held responsible for the actions of their agents or subordinates. For example, this principle is why employers may be responsible for the harmful actions of their employees.<\/p>\r\n<p>In a common scenario, the minor child causes property damage or an injury to someone. The parent did not directly commit the act in question. Yet, vicarious liability will extend to the parent based on parental supervision of the child and the child&#8217;s conduct.<\/p>\r\n<h3>Avoiding Parental Liability<\/h3>\r\n<p>Once the child is of majority age (which in most states is 18), the child is no longer a minor and the parents are no longer liable. If a court has&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability\/checklist-grounds-for-terminating-parental-rights.html\">terminated parental rights<\/a>&nbsp;over a minor, the parent also won&#8217;t be liable for any acts of the minor. Termination of parental rights ends the legal parent-child relationship.<\/p>\r\n<h2>Financial Responsibility for a Child\u2019s Actions<\/h2>\r\n<p>Parental responsibility laws in many states hold parents financially responsible for damages caused by their minor children. Damages may stem from personal injury or property damage that the child caused.<\/p>\r\n<p>Some states, however, place limits on the amount of exposure parents have under civil liability statutes. Parental civil liability laws vary from&nbsp;state to state, but many cover such acts as:<\/p>\r\n<ul>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries.html\">Torts and personal injury<\/a>, where torts are civil wrongs; assault and battery are intentional torts<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/crimes\/a-z\/vandalism.html\">Vandalism<\/a>&nbsp;to personal, government, or school property<\/li>\r\n<li>Theft<\/li>\r\n<li>Defacement or destruction of the national and state flags, cemetery headstones, public monuments, or historical markers<\/li>\r\n<li>Property destroyed in hate crimes based on race or religion, such as ransacking a synagogue<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/vicarious-liability-and-negligent-entrustment.html\">Motor vehicle accidents<\/a>&nbsp;and collisions<\/li>\r\n<\/ul>\r\n<p>State laws vary on the level of intent required to reach liability in these cases. Some states require proof that the child committed willful acts or engaged in willful misconduct. Other states may find parents liable for the acts of their children at a lesser level of intent. Motor vehicle liability may only require a showing of negligent conduct.<\/p>\r\n<p>State laws also vary regarding the types and amounts of damages available in a parental liability suit. States may provide only a remedy for compensatory or actual damages. They may limit the injured party&#8217;s recovery to a maximum amount, such as $10,000. In some states, winning the parental liability suit may entitle you to recover attorney fees and court costs as well.<\/p>\r\n<h2>Parental Civil Liability in Selected States<\/h2>\r\n<p>Lawsuits against parents partly depend on state law where the case unfolds. Below is a sample of <a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability\/parent-liability-selected-state-laws.html\">state laws on parental civil liability<\/a>.<\/p>\r\n<h3>California Liability Law<\/h3>\r\n<p>The state may find a parent liable for&nbsp;<a href=\"https:\/\/codes.findlaw.com\/ca\/civil-code\/civ-sect-1714-1\/\" target=\"_blank\" rel=\"noopener\">willful misconduct<\/a>&nbsp;of their child that results in injury or death or property damage. State law caps damages at $25,000 per act but can increase the cap every two years. The injured party can also recover attorney fees and court costs.<\/p>\r\n<h3>Hawaii Liability Law<\/h3>\r\n<p>The state may find a parent liable for&nbsp;<a href=\"https:\/\/codes.findlaw.com\/hi\/division-3-property-family\/hi-rev-st-sect-577-3\/\" target=\"_blank\" rel=\"noopener\">negligent or intentional<\/a>&nbsp;acts of their unmarried minor child. Hawaii also extends liability to those who sign the child&#8217;s application for a driver&#8217;s license for damages from motor vehicle accidents. State law does not cap damages.<\/p>\r\n<h3>Texas Liability Law<\/h3>\r\n<p>The state may find a parent liable for willful misconduct of their child that causes&nbsp;<a href=\"https:\/\/codes.findlaw.com\/tx\/family-code\/fam-sect-41-001\/\" target=\"_blank\" rel=\"noopener\">damage to property<\/a>. A parent may be liable for negligent acts of their child if the negligent acts can be attributed to the parent. State law caps damages at $25,000 per act. The injured party can also recover attorney fees and court costs.<\/p>\r\n<h3>New Jersey Liability Law<\/h3>\r\n<p>The state may find a parent liable for&nbsp;<a href=\"https:\/\/codes.findlaw.com\/nj\/title-18a-education\/nj-st-sect-18a-37-3\" target=\"_blank\" rel=\"noopener\">school property damage<\/a>&nbsp;caused by their child, including court costs. A parent may be liable for their child&#8217;s willful damage to a railroad, street railway, traction railway, or autobus public utility. The state caps damages at $5,000 per act, plus court costs.<\/p>\r\n<h3>Ohio Liability Law<\/h3>\r\n<p>The state may find a parent liable for willful misconduct of their child that causes property damage, assaults another with force likely to cause great bodily harm, or results in theft from another. State law caps damages at $10,000 per act, plus court costs.<\/p>\r\n<p>A parent may be liable for knowing the misconduct of their child who commits vandalism, desecration, or ethnic intimidation. State law caps damages at $15,000 per act, plus attorney fees and court costs.<\/p>\r\n<p>A parent may be liable for negligent or willful misconduct of their child caused by a motor vehicle accident. State law does not cap damages under state law for motor vehicle accidents.<\/p>\r\n<h3>Colorado Liability Law<\/h3>\r\n<p>The state may find a parent liable for deliberate or knowing acts of their child that cause property damage or personal injury. State law caps damages at $3,500 per act, plus attorney fees and court costs.<\/p>\r\n<p>A parent may be liable for their child&#8217;s thefts as well. State law does not cap damages. They are seen as compensatory. Parents can also face a fine of up to $250.<\/p>\r\n<h2>Negligent Supervision of a Child<\/h2>\r\n<p>A parent is liable for a child&#8217;s negligent acts if the parent knows or has reason to know that it is necessary to control the child and the parent fails to take reasonable actions to do so. This legal theory is known as negligent supervision or parental negligence. It stems from the common law tort of negligence.<\/p>\r\n<p>Liability for negligent supervision is not limited to parents. Grandparents, guardians, and others with custody and control of a child may also be liable under these circumstances. There is usually no dollar limit on this type of liability. An umbrella or&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/what-does-a-home-insurance-policy-cover.html\">homeowner&#8217;s insurance policy<\/a>&nbsp;may offer the adult some protection in a lawsuit.<\/p>\r\n<h2>The &quot;Family Car&quot; Doctrine<\/h2>\r\n<p>There is also parental liability through the&nbsp;<a href=\"https:\/\/blogs.findlaw.com\/injured\/2011\/03\/family-car-doctrine-liability-for-a-kids-wreck.html\" target=\"_blank\" rel=\"noopener\">\u201cfamily car\u201d doctrine<\/a>. This doctrine holds the owner of a vehicle legally responsible for any damage a family member causes when driving. It can apply if the owner knew about \u2014 and consented to \u2014 the family member&#8217;s use of the car. So, the parent remains liable even if they don\u2019t list the minor household member on the auto insurance policy.<\/p>\r\n<p>About half of the states apply this doctrine, known under the broader theory of&nbsp;<a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/vicarious-liability-and-negligent-entrustment.html\">negligent entrustment<\/a>. In some states, the family care doctrine comes from common law and not a statute.<\/p>\r\n<p>Most insurance policies have special provisions for members of the household under the age of eighteen. Typically, the policy must include minors who obtain a driver&#8217;s license. The car owner would not be able to invoke the uninsured motorist provision for a minor child driver residing in the insured&#8217;s household and driving the insured&#8217;s vehicle.<\/p>\r\n<h2>What Should Parents Do If Sued?<\/h2>\r\n<p>A parent might want to review the case promptly with a civil law attorney. Understanding the specific claim of harm is the first step to starting a defense.<\/p>\r\n<p>Even if you believe the <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/ten-things-to-think-about-lawsuits.html\">lawsuit has no merit<\/a>, ignoring it may result in penalties. Often, this means losing your chance to defend yourself or your child. The court may award a default judgment in the claimant\u2019s favor. There is a deadline to answer a lawsuit.<\/p>\r\n<p>Depending on state parental liability laws, possible defenses might include:<\/p>\r\n<ul>\r\n<li>The child is not liable for the injury or property damage, so the parent isn&#8217;t liable either.<\/li>\r\n<li>The <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/contributory-and-comparative-negligence.html\">claimant is partly responsible<\/a> for the harm.<\/li>\r\n<li>The parent\u2019s actions to prevent harm were reasonable and not negligent or inciteful.<\/li>\r\n<li>The parent could not have foreseen or prevented the child\u2019s actions.<\/li>\r\n<li>The defendant did not have the rights and responsibilities of legal parenthood.<\/li>\r\n<\/ul>\r\n<p><a href=\"https:\/\/www.findlaw.com\/family\/parental-rights-and-liability\/termination-of-parental-rights.html\">Terminating parental rights<\/a> won\u2019t apply retroactively. If you had parental rights and responsibilities when the child caused harm, you can still be held liable. For example, a minor hurt someone but reached the age of adulthood before the lawsuit. Their parent may still be liable if the lawsuit is within the <a href=\"https:\/\/www.findlaw.com\/state\/accident-and-injury-laws\/civil-statute-of-limitations-laws.html\">statute of limitations<\/a>.<\/p>\r\n<h3>Preparing for the Court Process<\/h3>\r\n<p>Due to the damages caps, many civil liability cases against parents go through <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/small-claims-court.html\">small claims court<\/a>. For example, New Jersey\u2019s cap of $5,000 is the same as its small claims limit. Yet, claims of serious harm or property damage could be more complex, especially in states without a parental damages cap.<\/p>\r\n<p>Many civil lawsuits end in a <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-does-it-mean-to-settle-a-case.html\">settlement <\/a>before the parties go to court. A parent can work with their lawyer to evaluate whether settling the case would be the best choice.
