Legal challenges concerning travel and telehealth suggest abortion access across states could change.<\/p>\n<p>Legal requirements aren\u2019t the only barrier to abortion access. Though abortion is legal in the United States, six states have&nbsp;<a href=\"https:\/\/data.guttmacher.org\/states\/table\" target=\"_blank\" rel=\"noopener\">only one abortion provider<\/a>. The purpose of counseling before a medical procedure is to ensure the patient can provide informed consent.<\/p>\n<p>The medical principle of <a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/understanding-informed-consent-a-primer.html\">informed consent<\/a> contains three elements:<\/p>\n<ul>\n<li><p>The patient has the capacity to make decisions about their own care<\/p>\n<\/li>\n<li><p>Their participation is voluntary<\/p>\n<\/li>\n<li><p>They have adequate and appropriate information to make an informed decision<\/p>\n<\/li>\n<\/ul>\n<h3>What Does Abortion Counseling Include?<\/h3>\n<p>The information a patient must get during a counseling session&nbsp;varies by state.<\/p>\n<p>In a review of state policies, the&nbsp;<a href=\"https:\/\/www.guttmacher.org\/\" target=\"_blank\" rel=\"noopener\">Guttmacher Institute<\/a>&nbsp;found that:<\/p>\n<ul>\n<li><p>Seven states require patients to hear that a link may exist between breast cancer and abortion. (<a href=\"https:\/\/www.komen.org\/breast-cancer\/facts-statistics\/research-studies\/topics\/abortion-and-breast-cancer-risk\/\" target=\"_blank\" rel=\"noopener\">Breast cancer researchers<\/a>&nbsp;have found no evidence to support this.)<\/p>\n<\/li>\n<li><p>Twenty-four states require that counseling will give patients a description of all abortion procedures. This means those seeking a first-term abortion will receive information on late-term abortion. However, these are very different procedures, so irrelevant information may confuse patients.<\/p>\n<\/li>\n<li><p>Eight states require that patients be told about the purported mental health effects of abortion, such as \u201cpost-abortion traumatic stress syndrome.&quot; The American Psychiatric Association and the American Psychological Association do not recognize this term as a mental disorder.<\/p>\n<\/li>\n<li><p>Thirteen states require the patient to hear about fetal pain.&nbsp;<a href=\"https:\/\/jme.bmj.com\/content\/46\/1\/3\" target=\"_blank\" rel=\"noopener\">Medical views vary<\/a>&nbsp;on this point, particularly before 24 weeks of gestation.<\/p>\n<\/li>\n<li><p>Five states require counseling that tells the patient that personhood begins at conception.<\/p>\n<\/li>\n<\/ul>\n<p>In 2015, Arkansas became the first state to legislate that providers must tell patients that they can interrupt a medication-induced abortion. Seven other states followed suit.<\/p>\n<p>But the&nbsp;<a href=\"https:\/\/www.ama-assn.org\/press-center\/press-releases\/ama-lawsuit-protect-patient-physician-relationship-north-dakota\" target=\"_blank\" rel=\"noopener\">American Medical Association<\/a>&nbsp;(AMA) balked at legislation that forced doctors to provide &quot;false, misleading, and non-medical information&quot; about medication abortions. According to the AMA, a medication abortion, once begun, is not reversible. The AMA said it &quot;undermines [the provider-patient] relationship &#8230; with messages contradicting reality and science.&quot; The laws were challenged in court.<\/p>\n<p>Legal scholars and pro-choice proponents see a connection between state requirements to provide medically unsupported information and the Supreme Court&#8217;s decision in&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/550\/124.html\" target=\"_blank\" rel=\"noopener\"><i>Gonzalez v. Carhart<\/i><\/a>. Rachel Benson Gold of the Guttmacher Institute said the ruling deferred to legislative opinion rather than medical evidence, particularly in cases where there is medical disagreement.<\/p>\n<h2><a id=\"Ultrasound\"><\/a>Ultrasound Requirements<\/h2>\n<p>Twenty-seven states have some&nbsp;<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/requirements-ultrasound\" target=\"_blank\" rel=\"noopener\">ultrasound requirements<\/a>. Sixteen states mandate that a medical provider conduct an ultrasound before an abortion. Six states require the medical provider to show and describe the image. Eight states require asking the patient if they want to see the image. An ultrasound is not a medically necessary procedure in a first-trimester abortion.<\/p>\n<h2><a id=\"Waiting\"><\/a>Waiting Periods<\/h2>\n<p>Twenty-five states require a&nbsp;<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/counseling-and-waiting-periods-abortion\" target=\"_blank\" rel=\"noopener\">waiting period<\/a>&nbsp;between counseling and an abortion procedure. The waiting period ranges from 24-72 hours. In 12 of those states, a patient must make more than one visit to the clinic. If a person has had to&nbsp;<a href=\"https:\/\/www.guttmacher.org\/news-release\/2021\/if-roe-v-wade-overturned-new-interactive-map-shows-how-far-people-seeking-abortion\" target=\"_blank\" rel=\"noopener\">travel a long distance<\/a>&nbsp;to find a legal abortion provider, this is an added burden.<\/p>\n<h2><a id=\"Hospital\"><\/a>Doctor and Hospital Requirements<\/h2>\n<p>There are a few types of abortion health care services. Providers of surgical abortion and abortion pills, such as Mifepristone and Misoprostol, must follow state laws.<\/p>\n<p>Eight states&nbsp;<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/targeted-regulation-abortion-providers\" target=\"_blank\" rel=\"noopener\">require abortion clinics<\/a>&nbsp;to be located within a specified distance from a hospital. Twenty-one states require a relationship with a hospital in case of a medical emergency. Hospitals are not required to provide such a relationship. Eighteen states have regulations that apply even to places where only medication abortion care is provided.<\/p>\n<p>The state may require that an abortion be performed in a hospital rather than a clinic, depending on the trimester. Some states require a second physician present during a late-term abortion to care for a child if there is a live birth.<\/p>\n<p>Crisis pregnancy centers (CPCs) are different from abortion clinics. These facilities advertise services for pregnancy and abortion. Yet, many of them do not staff doctors or offer abortions. They are not subject to the same <a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights.html\">patient privacy laws<\/a> and abortion provider requirements. Patients may instead contact a licensed medical provider to get accurate information and seek timely care.<\/p>\n<h2><a id=\"Gestational\"><\/a>Gestational Abortion Limits<\/h2>\n<p>Gestational limits are also an abortion restriction. The <a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/how-did-abortion-become-legal.html\">legality of an abortion<\/a> depends on how far along the pregnancy is when the person seeks to end it. States usually prohibit abortion procedures at a specific gestational period.<\/p>\n<p>The time limit when an abortion is legal typically ranges from &quot;detection of fetal heartbeat&quot; (six weeks in Texas) to fetal viability at 24 weeks. But since&nbsp;<i>Roe v. Wade<\/i>&nbsp;was overturned in 2022, 14 states have banned abortions within these time frames.<\/p>\n<p>Two <a href=\"https:\/\/www.findlaw.com\/family\/reproductive-rights\/abortion-and-the-law-background.html\">significant cases<\/a> have come before the Supreme Court on gestational limits. The first is the case that SCOTUS decided in 2022,&nbsp;<i>Dobbs v. Jackson Women&#8217;s Health Organization,&nbsp;<\/i>and&nbsp;<i>U.S. v. Texas<\/i>.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/legalblogs\/supreme-court\/why-the-dobbs-v-jackson-womens-health-organization-abortion-case-is-different\/\"><i>Dobbs v. Jackson Women&#8217;s Health Organization<\/i><\/a>&nbsp;arose from a 2018 law known as the&nbsp;Gestational Age Act. That law never went into effect because it was blocked for banning abortion before fetal viability. It would have banned almost all abortions after 15 weeks of pregnancy. The Supreme Court decided this case in 2022. As a result, whether an abortion is legal is a matter that states can decide for themselves. There is no outright ban on abortions. It is just an issue that each state may decide in its own way.<\/p>\n<h3>U.S. Supreme Court Precedent on &#8216;Fetal Heart Beat&#8217; Laws<\/h3>\n<p>In&nbsp;<a href=\"https:\/\/www.oyez.org\/cases\/2021\/21-588\" target=\"_blank\" rel=\"noopener\"><i>U.S. v. Texas<\/i><\/a>, a landmark Supreme Court case from 2021, SCOTUS weighed in on &quot;fetal heartbeat&quot; laws.<\/p>\n<p>The case concerned Texas Senate Bill 8. This legislation bans abortion after the detection of what politicians called a &quot;fetal heartbeat.&quot; The&nbsp;text of the Texas abortion law&nbsp;claims that &quot;fetal heartbeat has become a key medical predictor that an unborn child will reach live birth.&quot; They said it occurs at six weeks of gestation.<\/p>\n<p>But at this stage of development, an embryo&nbsp;<a href=\"https:\/\/www.medicalnewstoday.com\/articles\/when-does-a-fetus-have-a-heartbeat\" target=\"_blank\" rel=\"noopener\">does not have a heart<\/a>. Cardiac tissue begins forming. Yet, the heart structure generally takes 10 weeks to develop and 20 weeks to function. That\u2019s why \u201cheartbeat\u201d is a misnomer. This tissue movement is a flutter of embryonic cells, which mimics the rhythm of a heartbeat.<\/p>\n<p>Medical doctors say there is no correlation between this flutter and the viability of a pregnancy. &quot;We don&#8217;t use it to date a pregnancy or, honestly, to predict that pregnancy will continue until delivery,&quot; Dr. Samantha Kaplan, an OB-GYN at Boston Medical Center, told&nbsp;<a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2021\/09\/02\/1033727679\/fetal-heartbeat-isnt-a-medical-term-but-its-still-used-in-laws-on-abortion\" target=\"_blank\" rel=\"noopener\">National Public Radio<\/a>.<\/p>\n<p>Patients rarely discover they are pregnant at six weeks of gestation, which is a problem for those seeking an early abortion. Pregnancy is dated from the last menstrual period. This means that at six weeks, an embryo may only have implanted in the womb three weeks prior. The timing leaves a narrow window to take a pregnancy test, get an ultrasound, and schedule care.<\/p>\n<p>The new law was challenged at the U.S. Supreme Court by the U.S. Justice Department in&nbsp;<i>U.S. vs. Texas<\/i>. The Supreme Court&nbsp;<a href=\"https:\/\/www.dallasnews.com\/news\/politics\/2021\/12\/13\/texas-sb-8-abortion-law-stands-for-now-4-takeaways-from-fridays-supreme-court-ruling\/\" target=\"_blank\" rel=\"noopener\">allowed the law to remain in effect<\/a>. Furthermore, it prevented medical providers from suing government officials who enforce it. But it allowed medical providers to continue their lawsuits through the lower courts.<\/p>\n<p>U.S. Attorney General Merrick Garland responded to <i>Dobbs<\/i> by releasing a statement of support for abortion rights. He noted, \u201cThe Justice Department strongly disagrees with the Court&#8217;s decision. This decision deals a devastating blow to reproductive freedom in the United States.&quot;<\/p>\n<p>In the statement, Garland continued: \u201cIt will have an immediate and irreversible impact on the lives of people across the country. And it will be greatly disproportionate in its effect \u2013 with the greatest burdens felt by people of color and those of limited financial means.&quot;<\/p>\n<h3>Are Abortions Illegal After Six Weeks of Pregnancy?<\/h3>\n<p>It is still possible to get reproductive health services, including abortions, depending on the state. It&#8217;s important to note that there is no nationwide ban on abortions. There is no universal criminalization of abortion in effect. After <i>Dobbs<\/i>, the federal stance is that each state can make its own policies on abortion. Abortion is now regulated under state law.<\/p>\n<p>If you live in a state where abortion is illegal, you can also cross state lines to a state where abortion is legal. You may visit health centers in that state for in-person abortion care. You can then legally return to your home state after the procedure or medical abortion. In other words, <a href=\"https:\/\/www.findlaw.com\/family\/reproductive-rights\/abortion-rights-faqs.html\">abortion rights <\/a>are still observed to limited degrees. But there is now no constitutional right to an abortion.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/family\/reproductive-rights.html\">Reproductive rights<\/a> are fundamental rights. But it is more challenging to exercise these rights now. Furthermore, <a href=\"https:\/\/www.findlaw.com\/state\/family-laws\/details-on-state-abortion-laws.html\">state laws<\/a> and even federal restrictions are likely to change. Check current law before seeking abortion care.<\/p>\n<h2><a id=\"Parental\"><\/a>Parental Consent Requirements<\/h2>\n<p>Minors sometimes become pregnant and consider an abortion. Thirty-eight states require&nbsp;<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/parental-involvement-minors-abortions\" target=\"_blank\" rel=\"noopener\">parental involvement in the abortion decision<\/a>&nbsp;of a pregnant child under 18. Some states require notification only; some require consent. Kansas, Mississippi, and North Dakota require consent from both parents.<\/p>\n<p>Thirty-seven states allow a judge to decide if parental involvement is needed. Sometimes, a judge may decide if an abortion is in a person&#8217;s best interests. Sixteen states allow minors to get an abortion in cases of&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-abuse.html\">abuse<\/a>, incest, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/statutory-rape.html\">sexual assault<\/a>, or neglect.<\/p>\n<h2><a id=\"fathers\"><\/a>Do I Need the Father\u2019s Consent To Get an Abortion?<\/h2>\n<p>No, a pregnant adult does not need the other person\u2019s consent to seek an abortion. The Supreme Court <a href=\"https:\/\/www.findlaw.com\/family\/paternity\/fathers-rights-and-abortion.html\">ruled against this restriction<\/a> at the federal level. Fathers\u2019 rights do not include notice or prevention of abortion care. Their consent is not a legal requirement for abortion. They also cannot force the termination of a pregnancy. This is true regardless of marital status.<\/p>\n<h2><a id=\"Partial\"><\/a>&#8216;Partial-Birth&#8217; Abortion Ban<\/h2>\n<p>The term &quot;partial-birth abortion&quot; was coined in 1995 by the National Right to Life Committee. It refers to a specific medical procedure developed for late-term abortions. Late-term abortions are more likely to occur because of fetal impairment or abnormality.<\/p>\n<p>This abortion technique is called dilation and extraction (D&amp;X). It was developed to prevent cervical damage if the fetus was partially delivered into the birth canal. The intent was to safeguard the woman&#8217;s ability to carry a child at a later time. The federal government banned this method in most cases&nbsp;(<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/550\/124.html\" target=\"_blank\" rel=\"noopener\"><i>Gonzales v. Carhart<\/i><\/a>, 2007).<\/p>\n<h2><a id=\"Funding\"><\/a>Public Funding Restrictions<\/h2>\n<p>The 1977&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/113th-congress\/senate-bill\/142?r=100\" target=\"_blank\" rel=\"noopener\">Hyde Amendment<\/a>&nbsp;forbade using Medicaid funds for abortion, except when a woman&#8217;s life is in danger, rape, or incest. Medicaid is a joint federal-state program for those of lower income levels. States must cover abortions that meet these&nbsp;<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/state-funding-abortion-under-medicaid\" target=\"_blank\" rel=\"noopener\">federal exceptions<\/a>. One state (<a href=\"https:\/\/www.findlaw.com\/state\/south-dakota-law\/south-dakota-abortion-laws.html\">South Dakota<\/a>) has a particularly restrictive abortion law. It limits public funding for abortion to only those cases when a woman&#8217;s life is in danger. Some states use their own funds to pay for medically necessary abortions. Nine states do so only as a result of a specific court order.<\/p>\n<p>In 1979 the Department of Defense (DOD) appropriations bill prohibited using federal funds to provide abortion services for military service members and their families. In 1988, the Reagan administration&nbsp;<a href=\"https:\/\/www.guttmacher.org\/gpr\/2010\/08\/base-us-militarys-ban-privately-funded-abortions\" target=\"_blank\" rel=\"noopener\">stopped abortion services in military hospitals<\/a>&nbsp;entirely.<\/p>\n<p>In 1988, the Clinton administration reversed the DOD policy. American servicewomen and military family members could again access to abortion care at military hospitals using private funds.<\/p>\n<p>Republican leadership under the Trump administration partially reversed the DOD policy. It banned all abortions on military bases \u2014 even if paid for with private funds \u2014 except in cases of rape, incest, or life endangerment.<\/p>\n<h2><a id=\"Insurance\"><\/a>Private Insurance Coverage Restrictions<\/h2>\n<p>Only six states require&nbsp;<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/regulating-insurance-coverage-abortion\" target=\"_blank\" rel=\"noopener\">abortion to be covered by private insurance companies<\/a>, according to the Guttmacher Institute. Eleven states restrict insurance coverage of abortion in all private insurance plans. Twenty-five states restrict abortion coverage in plans offered through their state health insurance exchange. Illinois and Missouri will enable any business, hospital, or insurance company to refuse to cover birth control.<\/p>\n<h2><a id=\"Refusal\"><\/a>Refusal of Care Rule<\/h2>\n<p>Under the Trump administration, the Department of Health and Human Services (HHS) finalized&nbsp;<a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/final-conscience-rule.pdf\" target=\"_blank\" rel=\"noopener\">refusal of care rules<\/a>. The new rules would have allowed hospitals, doctors, nurses, pharmacists, paramedics, and receptionists to refuse to provide reproductive health care if it conflicted with their religious or personal beliefs.
