The term &quot;homicide&quot; comes from French and Latin roots of <i>homo<\/i> (meaning man) and <i>cida<\/i> (meaning killing). Homicide describes the manner of death. Practically speaking, an intentional killing such as&nbsp;murder and a killing in self-defense are both homicides.&nbsp; &nbsp;<\/p>\n\n    <\/div>\n\n\n\n<p>In certain\u00a0cases, a homicide will have a legal justification, such as\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/self-defense-overview.html\">self-defense<\/a>\u00a0or some other reason. In those cases, homicide is not a crime.<\/p>\n<p>This article discusses types of homicide, criminal and non-criminal. It often involves a specific intent to end the life of a human being or to commit a felony under circumstances where another person&#8217;s death results.\u00a0<\/p>\n<p>Murder is the most serious type of criminal homicide. It carries the most severe penalties, including the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty.html\">death penalty<\/a>. Other forms of criminal homicide demonstrate a reduced level of intent. These include:<\/p>\n<ul>\n<li>Manslaughter<\/li>\n<li>Reckless homicide<\/li>\n<li>Negligent homicide<\/li>\n<li>Vehicular homicide<\/li>\n<\/ul>\n<h2>What Is Murder?<\/h2>\n<p>Murder is the most serious form of criminal homicide. State statutes typically divide murder into different degrees of wrongfulness. The typical legal definition of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/first-degree-murder-overview.html\">first-degree murder<\/a> is an unlawful killing with malice aforethought. This means the killing is both intentional and premeditated. In states that have the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty-laws-by-state.html\">death penalty<\/a>, a first-degree murder case may be pursued as\u00a0a capital murder case.<\/p>\n<p>In first-degree murder, the premeditation requirement does not require evidence of elaborate or lengthy planning. Courts have ruled that premeditation can occur after only a few seconds of reflection and consideration.<\/p>\n<h3>Intent<\/h3>\n<p>The requirement of intent can also be elastic. A jury does not need to find that the defendant intended to cause death to convict them of first-degree murder. Instead, the prosecutors can show that the defendant intended to cause serious bodily injury or kill while attempting to commit some other felony. The latter is called the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/felony-murder.html\">felony murder rule<\/a>.<\/p>\n<p>Intent also does not need to be directed at a specific person. If someone planned to kill one person, but accidentally killed someone else, the murder was still intentional and premeditated. A killer who delivers a poisoned meal to his victim, only for it to be eaten by someone else, could still face first-degree murder charges.<\/p>\n<h3>Lack of Premeditation<\/h3>\n<p>When there is a lack of premeditation, the defendant could face charges of <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/second-degree-murder-overview.html\">second-degree murder<\/a> or voluntary manslaughter, depending on the laws of the state. First-degree murder convictions likely result in a sentence of death or life imprisonment. Second-degree murder convictions may result in a term of years in prison or a life sentence with the possibility of parole. It depends on the circumstances and the state or federal law at issue.<\/p>\n<h2>What Is Manslaughter?<\/h2>\n<p>The crime of manslaughter can be voluntary or involuntary. The primary difference between manslaughter and murder is the killer&#8217;s state of mind, or <i><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\">mens rea<\/a><\/i>.<\/p>\n<p>Some states, like\u00a0New York, provide that in certain cases of voluntary manslaughter, the defendant acted &#8220;under the influence of extreme emotional disturbance&#8221; or distress. This distress is often due to provocation by the victim. Texas Penal Code <a href=\"https:\/\/codes.findlaw.com\/tx\/penal-code\/penal-sect-19-04\/\" target=\"_blank\" rel=\"noopener\">Section 19.04<\/a> defines manslaughter as &#8220;recklessly&#8221; causing the death of a person.<\/p>\n<h3>Voluntary Manslaughter<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/voluntary-manslaughter-overview.html\">Voluntary manslaughter<\/a> means the offender commits an intentional killing without a prior intent to kill. At common law, the killing happened &#8220;in the heat of passion&#8221; or &#8220;sudden quarrel&#8221; and without forethought.<\/p>\n<p>An example of this could be a road rage incident on the highway. The offender believes the other driver cut them off in traffic and then, shortly after that, forces the other driver&#8217;s car off the highway, causing their death. These cases often turn on the unique facts present in a situation.<\/p>\n<p>Each state&#8217;s laws are different. In some states, this crime could be charged as <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/second-degree-murder-overview.html\">second-degree murder<\/a>.<\/p>\n<h3>Involuntary Manslaughter<\/h3>\n<p>In some states, statutes refer to an unintentional killing as <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/involuntary-manslaughter-overview.html\">involuntary manslaughter<\/a> or negligent homicide. In these cases, the perpetrator engages in behavior that is risky or demonstrates criminal negligence, and death results. The defendant had no specific intent to kill anyone. Yet, they should have known that their actions were risky or negligent.<\/p>\n<p>Sometimes these cases arise from persons who had a special duty of care toward the victim, such as parents, who ignore the risks and cause a death.<\/p>\n<p>Examples of involuntary manslaughter or negligent homicide include deaths that result from:<\/p>\n<ul>\n<li>Operating a dangerous amusement park ride with defective safety equipment<\/li>\n<li>Failing to provide medical care to a child who is clearly sick and suffering<\/li>\n<li>Leaving a loaded gun unsecured in the home within reach of a child<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/dui-dwi.html\">Driving while intoxicated<\/a> (in some states, other states create a specific definition for these crimes)<\/li>\n<\/ul>\n<h2>Reckless or Negligent Homicide<\/h2>\n<p>Some states moved away from using the common law crime\u00a0of manslaughter. In these jurisdictions, the legislature may use the title reckless or negligent homicide to describe the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\">mental state of the defendant<\/a> better. These charges require the defendant to show either a reckless or negligent state of mind.<\/p>\n<p>The definition of recklessness is engaging in conduct you know is dangerous, disregarding the likely consequences. Some describe it as acting in a way that ignores known risks related to serious harm. Criminal negligence occurs when you fail to abide by a duty of care or special responsibility toward the victim, leading to harm. Depending on the state, reckless or negligent homicide may be a felony or misdemeanor crime.<\/p>\n<h2>Vehicular Homicide<\/h2>\n<p>When the operator of a vehicle or watercraft &#8211; a car, boat, jet ski,\u00a0snowmobile, or ATV \u2014 causes the death of another, they could face a charge of vehicular homicide or an equivalent offense. States define and subcategorize this crime\u00a0in different ways.<\/p>\n<p>In general, deaths from <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents.html\">automobile crashes<\/a> are not charged as first-degree or second-degree murder because the vehicle operator had no intent to kill anyone. Many fatal car accidents are just that &#8211; accidents. No criminal charges follow those incidents, however tragic.<\/p>\n<p>The deaths that draw <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/view-all-criminal-charges.html\">criminal charges<\/a> tend to result from the dangerously reckless or negligent operation of a vehicle. In Florida, vehicular homicide occurs when someone operates a motor vehicle in a &#8220;reckless manner likely to cause the death of, or great bodily harm to, another.&#8221; Examples of vehicular homicide include causing a death while:<\/p>\n<ul>\n<li>Committing a misdemeanor traffic violation, such as driving through\u00a0a stop sign or engaging in\u00a0<a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/reckless-driving.html\">reckless driving<\/a><\/li>\n<li>Driving at an unreasonable speed, such as street racing<\/li>\n<li>Operating a vehicle under the influence of drugs or alcohol (<a href=\"https:\/\/www.findlaw.com\/dui\/charges\/felony-dui.html\">DUI<\/a>)<\/li>\n<li>Eluding police or causing a high-speed chase<\/li>\n<li>Failing to stop and render aid after a crash (a <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/leaving-the-scene-of-an-accident-hit-and-run-state-laws.html\">&#8220;hit and run&#8221;<\/a>)<\/li>\n<\/ul>\n<h2>Justifiable Homicide<\/h2>\n<p>Some killings that may lead to criminal investigations into manslaughter or murder are not crimes. Law enforcement or courts may determine these cases amount to &#8220;justifiable homicide.&#8221; A prime example is when a person kills to protect human life, in self-defense or in defense of someone else.<\/p>\n<p>Most state laws permit a justified homicide to defend oneself or another when faced with a credible threat of serious bodily harm or death. This may occur during crimes like <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/rape.html\">rape<\/a>, armed robbery, or attempted murder.<\/p>\n<p>Justifiable homicide is not a common phenomenon. For 2019, the <a href=\"https:\/\/ucr.fbi.gov\/crime-in-the-u.s\/2019\/crime-in-the-u.s.-2019\/topic-pages\/expanded-homicide#:~:text=Law%20enforcement%20reported%20726%20justifiable%20homicides%20in%202019.,%28See%20Expanded%20Homicide%20Data%20Tables%2014%20and%2015.%29\" target=\"_blank\" rel=\"noopener\">FBI<\/a>\u00a0reported 726 cases.\u00a0Nearly half are related to officer-involved killings.\u00a0 The other half involved private citizens.\u00a0Inquiries into killings by police officers in the line of duty often result in findings of justified homicide.<\/p>\n<p>There have been a few high-profile cases of police killings leading to criminal charges (such as the conviction of\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/mn-court-of-appeals\/2196920.html\" target=\"_blank\" rel=\"noopener\">Derek Chauvin<\/a> and others in the George Floyd\u00a0case).\u00a0 Still, these prosecutions represent a tiny fraction of the cases of civilians killed by police each year.\u00a0<\/p>\n<h2>Intentional Homicide Using a Vehicle<\/h2>\n<p>Although vehicular homicides are usually unintentional and not charged as murder, some killers use their vehicles as their weapon of choice for intentional killings.<\/p>\n<p>Recent years have seen a number of high-profile cases in which drivers intentionally drove into pedestrians on the sidewalk or protestors at a demonstration. The intentional use of a vehicle to cause injury can result in <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/homicide.html\">murder charges<\/a>.\u00a0\u00a0In such cases, the motor vehicle amounts to a deadly weapon used by the defendant to cause the death.<\/p>\n<h3>Case Example: Nicholas Kraus<\/h3>\n<p>One notorious example is the case against <a href=\"https:\/\/www.hennepinattorney.org\/news\/news\/2022\/November\/kraus-11-23-2022\" target=\"_blank\" rel=\"noopener\">Nicholas Kraus<\/a>. Protests erupted in the Uptown neighborhood of Minneapolis after officers from the\u00a0U.S. Marshals Task Force attempted to arrest Winston Smith on outstanding warrants in 2021. Smith died in the confrontation.<\/p>\n<p>During further demonstrations\u00a0days later,\u00a0Kraus drove\u00a0into a crowd of protestors in Minneapolis, killing Deona Knajdek and injuring three others. Police found Kraus&#8217;\u00a0actions to be intentional but not premeditated. They charged him with <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/second-degree-murder-penalties-and-sentencing.html\">second-degree murder<\/a> because he sped up as he approached a barricade separating vehicles from the protestors.\u00a0<\/p>\n<p>Kraus, intoxicated at the time, admitted he intentionally drove into the barricade and toward the protesters. He <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-different-degrees-of-guilt.html\">pled guilty<\/a> and received a sentence of 20 years in state prison.\u00a0\u00a0<\/p>\n<h3>Case Example: James Alex Fields, Jr.<\/h3>\n<p>In an earlier incident, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/ohio-man-sentenced-life-prison-federal-hate-crimes-related-august-2017-car-attack-rally\" target=\"_blank\" rel=\"noopener\">James Alex Fields, Jr.<\/a>, a white nationalist, drove his car into a crowd of peaceful protesters during the 2017 Unite the Right rally in Charlottesville, Virginia.\u00a0The rally, organized by white supremacist groups, objected to the vote by the city council to remove a public statue of Robert E. Lee, the Confederate general during the U.S. Civil War.<\/p>\n<p>Fields\u00a0killed 32-year-old Heather Heyer and injured 30 other people.\u00a0 At a state court trial in 2018, the jury convicted him of\u00a0first-degree murder, eight counts of malicious wounding, and hit-and-run crimes. They sentenced him to life imprisonment. Federal prosecutors also charged Fields with federal <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/hate-crimes.html\">hate crimes<\/a>.<\/p>\n<p>In 2019, he\u00a0pled guilty to 29 of the\u00a030 federal\u00a0charges\u00a0to\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty-laws-by-state.html\">avoid the death penalty<\/a>. He\u00a0received a second\u00a0life sentence.\u00a0 \u00a0\u00a0<\/p>\n<h2>More Questions About Homicide?
