But this crime also happens to many everyday citizens. Whether it&#8217;s nude pictures on social media or so-called &quot;celebrity sex tapes,&quot; the act of posting sexually explicit material online can be criminal.<\/p>\n\n    <\/div>\n\n\n\n<p>Intentional distribution of nonconsensual porn,<i>\u00a0<\/i>or &#8220;<a href=\"https:\/\/www.merriam-webster.com\/dictionary\/revenge%20porn\" target=\"_blank\" rel=\"noopener\">revenge porn<\/a>,&#8221; is a type of online harassment that occurs when an ex-partner or a hacker posts sexually explicit images of a person online without their permission.<\/p>\n<p>But what exactly is revenge porn? Does it mean that someone wants revenge on another person and posts pornographic material featuring that person? Sometimes, but it doesn&#8217;t always mean that.<\/p>\n<p>In fact, in many jurisdictions, a perpetrator doesn&#8217;t even need to be exacting\u00a0<i>revenge<\/i>\u00a0on anyone. The distributor of the material need\u00a0<i>only intend to distribute<\/i>\u00a0the sexually explicit video or photograph with the intent to annoy or harass the victim without their consent.<\/p>\n<p>This article defines revenge porn and explains its legal consequences. It also includes a chart with links to each state&#8217;s laws relating to revenge porn. After the chart, you will find information on how to <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?keyword=Criminal+Defense\" target=\"_blank\" rel=\"noopener\">get legal help<\/a> if you have been victimized by revenge porn or are facing criminal charges for perpretating this crime.\u00a0<\/p>\n<h2>What Is Revenge Porn?<\/h2>\n<p>In the legal sense, revenge porn is a form of cyber sexual harassment. In some cases, it constitutes\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/cyber-bullying.html\">cyberbullying<\/a>. It should be taken very seriously, particularly if minors are the subject of the revenge porn. Criminal penalties can include jail time or prison sentence and steep fines.<\/p>\n<p>Civil lawsuits may also arise from posting these nonconsensual pornographic materials. Civil remedies may lead to:<\/p>\n<ul>\n<li><a href=\"https:\/\/dictionary.findlaw.com\/definition\/injunction.html\" target=\"_blank\" rel=\"noopener\">Injunctions<\/a><\/li>\n<li>Infringement notices<\/li>\n<li>Formal warnings or take-down notices<\/li>\n<li>Compensatory and punitive damages<\/li>\n<\/ul>\n<h2>How Many States Have Revenge Porn Laws?<\/h2>\n<p>All states, excluding Massachusetts and South Carolina, have separate statutes specifically related to revenge porn. It&#8217;s important to note, however, that a person may still be prosecuted for revenge porn under other statutes in those two states.<\/p>\n<p>In Massachusetts, for example, someone may be prosecuted for revenge porn under <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/invasion-of-privacy-laws.html\">invasion of privacy laws.<\/a> In South Carolina, by contrast, one may be prosecuted for the same offense under obscenity laws.<\/p>\n<p>In order to be guilty of this crime in most states, the distributor must be sending out what many call nonconsensual pornography. This includes pictures or videos that are considered\u00a0<i>sexual<\/i>\u00a0in nature. Such content, for example, shows the victim&#8217;s intimate body parts. It might also show the victim engaging in sexual activity.<\/p>\n<p>Simply posting an unflattering picture of your ex in a bathing suit is not pornographic. But, if the picture features your ex&#8217;s genitalia, it could likely be considered a crime to distribute such an image.<\/p>\n<h2>Prohibited Actions<\/h2>\n<p>Each state has its own laws related to revenge porn. But, most states define the crime of revenge porn as acts committed by any person, with the intent to harass, harm, or annoy another person, that:<\/p>\n<ul>\n<li>Publish or distribute electronic or printed photographs, pictures, videos, or films;<\/li>\n<li>Show the genitalia, anus, or female breast of the other person or depict the other person engaged in sexual activity;<\/li>\n<li>Lack the depicted person&#8217;s consent; and<\/li>\n<li>Happen under circumstances where the offender knows or should have known that the depicted person had a reasonable expectation of privacy in the images<\/li>\n<\/ul>\n<p>Most state revenge porn laws provide standard exceptions. These will often include disclosures made in good faith to law enforcement, to medical service providers, under legal process, or in cases of public interest or public concern.<\/p>\n<h2>Federal Law and Revenge Porn<\/h2>\n<p>There is no specific federal law crime against revenge porn at this time. Other federal crimes may address some of the conduct taken in these cases. For example, federal criminal law addresses the distribution of sexual images that\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/child-pornography.html\">exploit children<\/a>\u00a0(under 18 years of age).<\/p>\n<p>In 2022, Congress created a\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/15\/6851#:~:text=Except%20as%20provided%20in%20paragraph%20%284%29%2C%20an%20individual,for%20relief%20as%20set%20forth%20in%20paragraph%20%283%29.\" target=\"_blank\" rel=\"noopener\">federal civil cause of action<\/a>\u00a0for victims of revenge porn. A complainant can seek compensatory and punitive damages and attorney fees in such an action. How the courts and Congress will respond to developments in this area remains an open question. Although defendants continue to raise\u00a0<a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10723\" target=\"_blank\" rel=\"noopener\">First Amendment challenges<\/a>\u00a0in this area of the law, the U.S. Supreme Court has not directly ruled on these matters.<\/p>\n<p>The Uniform Code of Military Justice provides a crime for wrongful broadcast or\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/10\/917a\" target=\"_blank\" rel=\"noopener\">dissemination of intimate images<\/a>. This permits the military to punish members of the armed forces who engage in revenge porn crimes.<\/p>\n<h2>State Revenge Porn Laws<\/h2>\n<p>Below is a list of states with revenge porn laws, including the District of Columbia.<\/p>\n<p>A person facing revenge porn charges may also face charges for other related crimes.
