It does not require premeditation. First-degree murder is killing someone with malice aforethought and premeditation<i>.&nbsp;<\/i><a href=\"https:\/\/dictionary.findlaw.com\/definition\/premeditation.html\" target=\"_blank\" rel=\"noopener\">Premeditation<\/a>&nbsp;means that the killer thought about what they were doing before they did it. While some states don&#8217;t use the term &#8220;second-degree murder,&#8221; most divide the crime of murder into different degrees. The intent of the killer decides what degree of murder. Criminal law recognizes there are different degrees of guilt when it comes to murder.<\/p>\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/second-degree-murder-penalties-and-sentencing.html\">sentence<\/a>&nbsp;someone convicted of second-degree murder will get varies widely among the states. It ranges from under a year in prison to life in prison.<\/p>\n<h2>What Is Second-Degree Murder?<\/h2>\n<p>Second-degree murder is the intentional killing of another person without premeditation, often showing extreme recklessness or indifference to human life. It differs from <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/first-degree-murder-overview.html\">first-degree murder<\/a>, which requires planning, and may also apply when serious harm was intended but resulted in death.<\/p>\n<h3>Intentional Killing Without Premeditation<\/h3>\n<p>Second-degree murders don&#8217;t involve any planning on the part of the killer. At the moment the murder happens, the killer either intends to kill the victim or, at least, cause them severe harm. But, up until that moment, the killer did not plan to commit murder. This lack of planning separates second-degree murder from first-degree murder.<\/p>\n<p>For example, Adam and Tom are neighbors arguing about the fence between their properties. Adam visits Tom to talk about the situation and, while there, impulsively grabs a shotgun hanging above the fireplace. Adam shoots and kills Tom. Adam didn&#8217;t have a plan to kill Tom when he went to Tom&#8217;s house that day.<\/p>\n<p>So, there was no premeditation. At the time he pulled the trigger, though, Adam fully intended to kill Tom or at least severely hurt him. In this situation, prosecutors would probably charge Adam with second-degree murder.<\/p>\n<p>But what if Tom provoked Adam? If Adam kills Tom during a sudden argument with provocation, the charge would likely be&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/voluntary-manslaughter-overview.html\">voluntary manslaughter<\/a>. The idea is that if Adam decided to kill Tom in the &#8220;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-heat-of-passion\/\">heat of passion<\/a>,&#8221; he should not get punished the same as if he intended to kill Tom.<\/p>\n<h3>Intent to Cause Only Serious Bodily Harm<\/h3>\n<p>A second situation that describes second-degree murder is where the perpetrator intends only to cause serious bodily harm but knows that death could result from the act.<\/p>\n<p>For example, instead of shooting Tom, Adam grabs a shovel and whacks Tom in the head with all his strength. While Adam didn&#8217;t&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\">specifically intend<\/a>&nbsp;to kill Tom when he hit him, he did intend to strike him with the shovel. Knowing that a blow to the head could very well result in death, the charge would likely be second-degree murder.<\/p>\n<h3>Extreme Indifference to Human Life<\/h3>\n<p>A third situation that describes second-degree murder happens when a victim dies as a result of the perpetrator&#8217;s&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-extreme-indifference-murder\/\">extreme indifference to the value of human life<\/a>. Extreme indifference generally means a complete disregard for the possibility that an act will kill someone.<\/p>\n<p>Going back to Adam and Tom, imagine that instead of hitting Tom over the head with a shovel, Adam grabs his gun and wildly fires above a crowd of neighbors who have gathered to watch the argument. Although he does not fire at the neighbors, the bullet hits someone in the distance. Adam didn&#8217;t mean to kill anyone, but he also didn&#8217;t give any thought to the harm that his actions could cause to others. This demonstrates Adam&#8217;s extreme indifference to human life.<\/p>\n<p>Another type of second-degree murder in this category occurs when someone dies as a result of <a href=\"https:\/\/www.findlaw.com\/dui\/charges\/dui-manslaughter-and-dui-murder.html\">being hit by a drunken driver<\/a>. Some states will charge a drunken driver, in this situation, with DUI (or DWI) and second-degree murder. This is because it is common knowledge that drunk driving is extremely dangerous and could kill someone.<\/p>\n<p>No matter whether it&#8217;s manslaughter or second-degree murder,&nbsp;<a href=\"https:\/\/www.findlaw.com\/dui\/charges\/dui-manslaughter-and-dui-murder.html\">death because of someone&#8217;s drunken driving is an unlawful killing<\/a>.<\/p>\n<h3>Felony Murder<\/h3>\n<p>What about a situation where an unintended death occurs during the commission of a felony? That&#8217;s where the&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-the-felony-murder-rule\/\">felony murder doctrine<\/a>&nbsp;comes in. Some states classify deaths that happen during the commission of another felony as second-degree murder, while other states characterize them as murders in the first degree.<\/p>\n<p>A court can find a person guilty of&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/felony-murder.html\">felony murder<\/a>&nbsp;even if they didn&#8217;t personally kill anyone. For example, Adam and Tom go into a convenience store, intending to rob it at gunpoint. Armed robbery is a felony. The clerk resists, and Adam shoots them. A jury could also find Tom, who didn&#8217;t shoot anyone, guilty of second-degree murder.<\/p>\n<p>How can this be? Because Tom intentionally took part in an armed robbery, he had to know there was at least a possibility someone could get shot and killed. For that reason, under the felony murder rule, a court can find Tom responsible for Adam shooting the store clerk.<\/p>\n<h2>Sentences for Second-Degree Murder<\/h2>\n<p>Depending on the state you&#8217;re in, the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/second-degree-murder-penalties-and-sentencing.html\">penalty for second-degree murder<\/a> varies widely. While second-degree murder is less serious than first-degree murder, it is still serious enough that life in prison is possible in some states. The death penalty is not an option in any state for second-degree murder.<\/p>\n<h3>Examples of Sentences:<\/h3>\n<ul>\n<li>In Illinois, second-degree murder is punishable by imprisonment of&nbsp;<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-730-corrections\/il-st-sect-730-5-5-4-5-30.html\" target=\"_blank\" rel=\"noopener\">four to 20 years<\/a>.<\/li>\n<li>Louisiana punishes second-degree murder much more severely: it imposes a mandatory sentence of&nbsp;<a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-14-sect-30-1.html\" target=\"_blank\" rel=\"noopener\">life imprisonment without the possibility of parole<\/a>&nbsp;\u2014 if the person was 18 or older when the crime happened. If they were under 18, they could be&nbsp;<a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-15-sect-574-4.html\" target=\"_blank\" rel=\"noopener\">eligible for parole consideration after serving 25 years<\/a>.<\/li>\n<li>In&nbsp;<a href=\"https:\/\/codes.findlaw.com\/va\/title-18-2-crimes-and-offenses-generally\/va-code-sect-18-2-32\/\" target=\"_blank\" rel=\"noopener\">Virginia<\/a>, second-degree murder is punishable by five to 40 years in prison.<\/li>\n<li>A person charged in the&nbsp;<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-1111.html\" target=\"_blank\" rel=\"noopener\">federal court system<\/a>&nbsp;could go to prison for years to life.<\/li>\n<\/ul>\n<h3>Aggravating and Mitigating Factors<\/h3>\n<p>In any criminal case, certain vital factors often come into play. Second-degree murder is no exception. If convicted of second-degree murder,&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/aggravated.html\" target=\"_blank\" rel=\"noopener\">aggravating<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/mitigate.html\" target=\"_blank\" rel=\"noopener\">mitigating<\/a>&nbsp;factors are essential.<\/p>\n<p>An aggravating factor may lead to a longer sentence. Information about these factors helps the judge decide on the sentence.<\/p>\n<p>Some examples of aggravating factors:<\/p>\n<ul>\n<li>There was a firearm or other&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/deadly-weapon.html\" target=\"_blank\" rel=\"noopener\">deadly weapon<\/a>&nbsp;involved<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/hate-crimes.html\">Hate crimes<\/a>: The attacker chose a victim based on a factor such as race, sexual orientation, gender, ancestry, age, or religion<\/li>\n<li>The manner of death was particularly cruel or brutal<\/li>\n<li>The person charged committed similar violent offenses in the past<\/li>\n<\/ul>\n<p>Some examples of mitigating factors:<\/p>\n<ul>\n<li>The defendant showed remorse<\/li>\n<li>Lack of \u2014 or a minimal \u2014 criminal record<\/li>\n<li>Mental or physical illness<\/li>\n<\/ul>\n<h2>Defenses to the Charge of Second-Degree Murder<\/h2>\n<p>Knowing the elements of and sentencing factors for second-degree murder cases is important. It is just as important to understand <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/defending-yourself-against-a-criminal-charge.html\">possible defenses<\/a> to a charge of second-degree murder.<\/p>\n<p>Some <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/second-degree-murder-defenses.html\">typical defenses<\/a> to second-degree murder:<\/p>\n<ul>\n<li><b>Actual innocence:<\/b>&nbsp;A person who is innocent of the crime may have an airtight&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/alibi.html\" target=\"_blank\" rel=\"noopener\">alibi<\/a>. Mistaken eyewitness identification is common.<\/li>\n<li><b>Self-defense:<\/b>&nbsp;If someone threatens your life, you may use the same amount of force to stop the person. When a person dies as a result of someone acting in self-defense, it is often called a&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/homicide-definition.html#:~:text=Justifiable%20Homicide,in%20defense%20of%20someone%20else.\">justifiable homicide.<\/a>&nbsp;But, if the person acting in self-defense did so without proper grounds, they could get convicted of second-degree murder (or the lesser offense of&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/voluntary-manslaughter-overview.html\">voluntary manslaughter<\/a>).<\/li>\n<li><b>Insanity:&nbsp;<\/b>In any crime, the defendant must have the required mental state (<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\">mens rea<\/a>) to complete the crime. If a person has a severe mental illness and can&#8217;t tell the difference between right and wrong, a court can find them&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/insanity-defense.html\">not guilty by reason of insanity<\/a>. They could also be not guilty by reason of insanity if they did not know what they were doing. Some states have another option, in these cases, besides guilty or not guilty by reason of insanity \u2014&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/guilty-but-mentally-ill.html\" target=\"_blank\" rel=\"noopener\">guilty but mentally ill<\/a>.<\/li>\n<li><b>Intoxication:<\/b>&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/wex\/intoxication\" target=\"_blank\" rel=\"noopener\">Voluntary intoxication<\/a>, in most cases, is not a defense to second-degree murder. &#8220;Involuntary intoxication,&#8221; while sometimes challenging to prove, may be a good defense.
