An experienced attorney can evaluate your case and help build a strong defense against serious federal allegations.<\/p>\n<h2>Public Officials and Their Official Duties<\/h2>\n<p>&#8220;[A] democracy is effective only if the people have faith in those who govern, and that faith is bound to be shattered when high officials and their appointees engage in activities which arouse suspicions of malfeasance and corruption.&#8221; So wrote Supreme Court Chief Justice Earl Warren<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/364\/520.html\" target=\"_blank\" rel=\"noopener\">\u00a0in 1961<\/a>. Indeed,\u00a0<a href=\"https:\/\/www.fbi.gov\/investigate\/public-corruption\/major-cases\" target=\"_blank\" rel=\"noopener\">corrupt politicians<\/a>\u00a0have tested\u00a0democracy\u00a0in the United States throughout history.<\/p>\n<p>Public officials are people elected or nominated to a public position. They also generally include employees of any federal, state, or local governmental entity, although\u00a0<a href=\"https:\/\/lda.congress.gov\/ld\/help\/Documents\/gloss_publicofficial.htm#:~:text=A%20public%20official%20is%20an,government%20in%20the%20United%20States.\" target=\"_blank\" rel=\"noopener\">some exceptions apply<\/a>.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.oge.gov\/web\/oge.nsf\/home\" target=\"_blank\" rel=\"noopener\">U.S. Office of Government Ethics (OGE)<\/a>\u00a0is an independent federal agency that seeks to prevent conflicts of interest and maintain ethical compliance in over 130 federal government agencies. It does so by establishing policies and providing guidance. Ethical considerations were initially addressed through the executive orders of former U.S. President George H.W. Bush. These directives were later outlined in the Code of Federal Regulations (see\u00a0<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/CFR-2022-title5-vol3\/pdf\/CFR-2022-title5-vol3-sec2635-101.pdf\" target=\"_blank\" rel=\"noopener\">5 CFR \u00a7 2635.101<\/a>).<\/p>\n<p>Public servants must follow the law and specific ethical rules of public service. These rules include but aren&#8217;t limited to:<\/p>\n<ul>\n<li>Remain loyal to the\u00a0Constitution\u00a0and the law<\/li>\n<li>Do not use public office for private gain<\/li>\n<li>Do not use public funds for private gain<\/li>\n<li>Avoid\u00a0conflicts of interest<\/li>\n<li>Do not hold financial interests that conflict with the performance of their duty<\/li>\n<li>Do not solicit or accept gifts from a person or entity seeking official action from the public official&#8217;s agency<\/li>\n<li>Do not solicit or accept gifts from someone who would benefit from the public official&#8217;s action or non-action of their duties<\/li>\n<li>Act impartially and do not favor any private entity or individual (such as a nonprofit organization or immediate family member)<\/li>\n<li>Avoid any actions that may create the appearance they are violating the law, standards of ethical conduct, or any executive orders<\/li>\n<\/ul>\n<p>These ethical rules safeguard the public&#8217;s trust in public officials. As Thomas Jefferson said, \u201cWhen a man assumes a public trust, he should consider himself public property.&#8221;<\/p>\n<h2>History of Public Corruption Laws<\/h2>\n<p>There&#8217;s a long history of safeguarding against the corruption of public officials in the United States. The\u00a0<a href=\"https:\/\/supreme.findlaw.com\/documents\/fathers.html\" target=\"_blank\" rel=\"noopener\">Founding Fathers<\/a>\u00a0incorporated this into the U.S. Constitution.\u00a0<a href=\"https:\/\/constitution.findlaw.com\/article4.html\" target=\"_blank\" rel=\"noopener\">Article IV, Section IV, of the U.S. Constitution<\/a>\u00a0provides that &#8220;[t]he United States shall guarantee to every State in [the] Union a Republican Form of Government . . .&#8221;<\/p>\n<p>In guaranteeing the &#8220;Republican Form of Government,&#8221; lawmakers provided a process to\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/impeach.html\" target=\"_blank\" rel=\"noopener\">impeach<\/a>\u00a0public officials. Impeaching a public official involves charging them with misconduct. It&#8217;s the first step in removing someone from public office. Congress and the Senate may impeach the following public officials:<\/p>\n<ul>\n<li>President<\/li>\n<li>Vice President<\/li>\n<li><a href=\"https:\/\/constitution.findlaw.com\/article2.html\" target=\"_blank\" rel=\"noopener\">Other executive branch officers<\/a><\/li>\n<li>Cabinet secretaries<\/li>\n<li>Judges<\/li>\n<\/ul>\n<p>Members of Congress may be subject to expulsion by their respective bodies.<\/p>\n<p>Congress also passed laws to protect public confidence in their officials. These laws included the following:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/bribery.html\">Bribery<\/a> statutes<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/mail-fraud.html\">Mail fraud<\/a>\u00a0laws<\/li>\n<li>The\u00a0<a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/foreign-corrupt-practices-act.html\" target=\"_blank\" rel=\"noopener\">Foreign Corrupt Practices Act<\/a>\u00a0(FCPA)<\/li>\n<\/ul>\n<p>The federal government may impose criminal penalties if public officials abuse their official position. Public servants may also be subject to civil penalties if they act improperly in their official capacity. A state ethics committee may file a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/the-differences-between-a-criminal-case-and-a-civil-case.html\">civil case<\/a>\u00a0against the corrupt official. The committee may also refer the matter to the\u00a0<a href=\"https:\/\/www.usa.gov\/state-attorney-general\" target=\"_blank\" rel=\"noopener\">attorney general<\/a>.<\/p>\n<h2>Examples of Public Corruption and Disciplinary Action<\/h2>\n<p>To illustrate corruption laws, it helps to have examples. Below are several examples of the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/department-of-justice-doj-.html\" target=\"_blank\" rel=\"noopener\">Department of Justice&#8217;s<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.fbi.gov\/investigate\/public-corruption\/major-cases\" target=\"_blank\" rel=\"noopener\">Federal Bureau of Investigation&#8217;s<\/a>\u00a0(FBI) work to uncover corruption by public servants.<\/p>\n<h3>Watergate<\/h3>\n<p>The federal government arrested five men for breaking into the\u00a0<a href=\"https:\/\/www.fbi.gov\/history\/famous-cases\/watergate\" target=\"_blank\" rel=\"noopener\">Watergate Hotel in 1972<\/a>. The men wanted\u00a0<a href=\"https:\/\/supreme.findlaw.com\/supreme_court\/landmark\/landmark418-683.html\" target=\"_blank\" rel=\"noopener\">President Richard Nixon<\/a>\u00a0to win his re-election campaign. To further their plan, they tried to spy on the Democratic Party&#8217;s Headquarters located in the hotel. Law enforcement caught these men in June of 1972, the second time they broke into the hotel.<\/p>\n<p>Nixon denied any knowledge of the men or the break-in. He ultimately won his re-election campaign.<\/p>\n<p>Two reporters from the Washington Post continued to dig into the break-in. An\u00a0<a href=\"https:\/\/supreme.findlaw.com\/legal-commentary\/appendix-to-why-the-revelation-of-the-identity-of-deep-throat.html\" target=\"_blank\" rel=\"noopener\">anonymous FBI source\u00a0<\/a>contacted the reporters and told them Nixon and other White House staffers were involved in covering up the break-in. As it turned out, Nixon provided \u201chush money&#8221; to the men who broke into the hotel. He also used the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/cia.html\" target=\"_blank\" rel=\"noopener\">Central Intelligence Agency<\/a>\u00a0(CIA) to prevent the FBI from investigating the break-in.<\/p>\n<p>The\u00a0Supreme Court\u00a0eventually\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-subpoena.html\">ordered<\/a>\u00a0Nixon to produce his tape recordings from the Oval Office. The tape recordings revealed Nixon tried to cover up the break-in. Before Congress impeached him, he resigned.<\/p>\n<p>President Gerald Ford succeeded Nixon. Ford\u00a0pardoned\u00a0Nixon, so he never faced criminal charges. All told, 48 people were\u00a0convicted\u00a0for their role in the Watergate scandal.<\/p>\n<h3>ABSCAM<\/h3>\n<p>In 1978, the FBI set up a fake company, ABSCAM. They posed as a wealthy Arab sheik who wanted to buy artwork. Through its investigation, the FBI recovered over $1 million in stolen art and stopped roughly $600 million in\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/securities-fraud.html\">securities fraud<\/a>.<\/p>\n<p>The investigation ultimately led them to Washington, D.C., where corrupt politicians accepted bribes from FBI agents. For example, members of Congress accepted bribes in exchange for granting the fictional sheik\u00a0asylum\u00a0in the United States. Other politicians took bribes to grant ABSCAM a gambling license in New Jersey.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.fbi.gov\/history\/famous-cases\/abscam\" target=\"_blank\" rel=\"noopener\">ABSCAM investigation<\/a>\u00a0resulted in the arrest of a senator, six members of Congress, and other corrupt officials.<\/p>\n<h3>Tennessee Waltz<\/h3>\n<p>In 2002, the FBI began investigating widespread corruption by Tennessee public officials. The FBI started by<a href=\"https:\/\/www.fbi.gov\/history\/famous-cases\/tennessee-waltz\" target=\"_blank\" rel=\"noopener\">\u00a0investigating reports\u00a0<\/a>of fraud and corruption by a\u00a0lobbyist\u00a0in the Juvenile Court Clerk&#8217;s office. The lobbyist eventually became an\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/informant.html\" target=\"_blank\" rel=\"noopener\">FBI informant<\/a>.<\/p>\n<p>He recorded conversations between himself and a public servant close to state\u00a0legislators. The public servant informed the lobbyist that he could purchase some legislators&#8217; votes for the right sum.<\/p>\n<p>Eventually, the FBI set up a fake business. The business paid public officials over $150,000.00 in bribes for political purposes. The legislators went so far as to propose\u00a0legislation\u00a0the \u201cbusiness&#8221; drafted.<\/p>\n<p>By the time the Tennessee Waltz investigation concluded in 2008, 12 people were convicted or\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-different-degrees-of-guilt.html\">pled guilty<\/a>. This included several state senators and other public officials.<\/p>\n<h2>Soliciting or Accepting Money for Public Office Overview<\/h2>\n<p>This section discusses federal law against soliciting or accepting money for public office in greater detail.<\/p>\n<p>Solicitation refers to trying to obtain something from someone. For example, someone going door-to-door selling goods is \u201csoliciting.&#8221; If you ask someone for their point of view, you are soliciting their opinion.<\/p>\n<p>In the context of this article, solicitation refers to a public official seeking something\u2014like money or something of value\u2014in exchange for a promise to use their influence to appoint a person to public office.<\/p>\n<p>Under\u00a0<a style=\"background-color: #ffffff\" href=\"https:\/\/codes.lp.findlaw.com\/uscode\/18\/I\/11\/211\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 211<\/a>, accepting money to obtain public office can lead to federal\u00a0<a style=\"background-color: #ffffff\" href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges.html\">criminal charges<\/a>:<\/p>\n<p><i>Whoever solicits or receives, either as a political contribution, or for personal emolument, any money or thing of value, in consideration of the promise of support or use of influence in obtaining for any person any appointive office or place under the United States, shall be fined under this title or imprisoned not more than one year, or both. Whoever solicits or receives any thing of value in consideration of aiding a person to obtain employment under the United States either by referring his name to an executive department or agency of the United States or by requiring the payment of a fee because such person has secured such employment shall be fined under this title, or imprisoned not more than one year, or both . . .<\/i><\/p>\n<p>Let&#8217;s visualize this scenario further. Imagine there was a candidate for the California State Senate. They accept a campaign contribution from a wealthy donor in exchange for the promise that they&#8217;ll appoint the donor to public office. The candidate wins their political campaign and follows through on their commitment to the donor. The donor is appointed Postmaster. Here we have all the elements of solicitation:<\/p>\n<ol>\n<li>An elected official<\/li>\n<li>Accepts a political donation<\/li>\n<li>From a donor<\/li>\n<li>On the promise that the donor will be appointed to a federal position<\/li>\n<li>The elected official appoints the donor to the federal position as agreed upon<\/li>\n<\/ol>\n<p>It&#8217;s a federal\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\">misdemeanor<\/a>\u00a0to solicit or accept a bribe in this way.
