During that time, generally, only&nbsp;<a href=\"https:\/\/www.carnegie.org\/our-work\/article\/voting-rights-timeline\/\" target=\"_blank\" rel=\"noopener\">white landowners could vote<\/a>&nbsp;in elections.<\/p>\n<p>Various groups have challenged the right to vote throughout history:<\/p>\n<ul>\n<li>The&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/amendment15.html\" target=\"_blank\" rel=\"noopener\">Fifteenth Amendment<\/a>&nbsp;to the U.S. Constitution gave citizens voting rights regardless of race or color.<\/li>\n<li>The&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/amendment19.html\" target=\"_blank\" rel=\"noopener\">Nineteenth Amendment<\/a>&nbsp;gave women the right to vote in 1920.<\/li>\n<li>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote-\/the-voting-rights-act-of-1965-overview.html\">Voting Rights Act of 1965<\/a>&nbsp;(VRA) eliminated states&#8217; use of literacy tests and other voting prerequisites. The VRA provides for civil lawsuits regarding voter intimidation in federal elections.<\/li>\n<\/ul>\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-the-civil-rights-act-of-1964\/\">Civil Rights Act of 1964<\/a>&nbsp;prohibited states from unequally applying voter registration requirements. The rest of this article describes voter intimidation and related criminal penalties.<\/p>\n<h2>Voter Intimidation Basics<\/h2>\n<p>The right to vote free from intimidation is foundational to a&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/democracy.html\" target=\"_blank\" rel=\"noopener\">democratic society<\/a>. While states often have election laws against voter intimidation, this article focuses on the federal laws against it.<\/p>\n<p>One federal law that prohibits voter intimidation can be found at&nbsp;<a href=\"https:\/\/codes.lp.findlaw.com\/uscode\/18\/I\/29\/594\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 594<\/a>. One commits this crime by deterring or influencing voting activity through threats to deprive voters of something they already have, such as jobs, government benefits, or, in extreme cases, their safety.<\/p>\n<p>The law states:<\/p>\n<p><i>Whoever intimidates, threatens, coerces, or attempts to intimidate, threaten, or coerce, any other person for the purpose of interfering with the right of such other person to vote or to vote as he may choose, or of causing such other person to vote for, or not to vote for, any candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, at any election held solely or in part for the purpose of electing such candidate [has committed voter intimidation].<\/i><\/p>\n<p>Anyone who interferes or conspires to interfere with a person&#8217;s right to vote faces a federal&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/misdemeanor.html\" target=\"_blank\" rel=\"noopener\">misdemeanor<\/a>. They may face up to one year in prison, a hefty fine, or both if&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/conviction.html\" target=\"_blank\" rel=\"noopener\">convicted<\/a>.<\/p>\n<p>Other federal laws protect against intimidation regarding voter registration (<a href=\"https:\/\/codes.findlaw.com\/us\/title-52-voting-and-elections\/52-usc-sect-20511\/\" target=\"_blank\" rel=\"noopener\">52 U.S.C. \u00a7 20511 (1)<\/a>) and using force or threats to intimidate other registered voters, those running for office, or others involved in the election process (<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-245\/\" target=\"_blank\" rel=\"noopener\">18 U.S.C. 245(b)(1)(A)<\/a>).<\/p>\n<h2>Voter Fraud<\/h2>\n<p>Voter fraud involves using deception concerning an election. For example, the following are examples of voter fraud:<\/p>\n<ul>\n<li>Voting more than once in an election<\/li>\n<li>Voting via an&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/absentee-ballot.html\" target=\"_blank\" rel=\"noopener\">absentee ballot<\/a>, then voting in person in the same election<\/li>\n<li>Casting a&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/fraudulent.html\" target=\"_blank\" rel=\"noopener\">fraudulent<\/a>&nbsp;ballot<\/li>\n<li>Committing or attempting to commit&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/fraud.html\" target=\"_blank\" rel=\"noopener\">fraud<\/a>&nbsp;concerning an&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/election.html\" target=\"_blank\" rel=\"noopener\">election<\/a><\/li>\n<\/ul>\n<p>States have their own laws that identify specific actions amounting to voter fraud. For example,&nbsp;<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0100-0199\/0104\/Sections\/0104.041.html\" target=\"_blank\" rel=\"noopener\">in Florida<\/a>, voter fraud involves intentional&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/deception.html\" target=\"_blank\" rel=\"noopener\">deception<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/misrepresentation.html\" target=\"_blank\" rel=\"noopener\">misrepresentation<\/a>&nbsp;in an election. Law enforcement may arrest people that they suspect committed voter fraud. The penalties for voter fraud differ from state to state.<\/p>\n<p>To combat voter fraud, Florida passed a law allowing its&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/prosecutor.html\" target=\"_blank\" rel=\"noopener\">prosecutors<\/a>&nbsp;to prosecute alleged voter fraud identified by election officers.&nbsp;<a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/florida-changes-law-boost-unjust-voter-fraud-prosecutions\" target=\"_blank\" rel=\"noopener\">Critics of the law<\/a>&nbsp;say that this allows unfair&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/prosecution.html\" target=\"_blank\" rel=\"noopener\">prosecutions<\/a>&nbsp;of people who, in&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/good-faith.html\" target=\"_blank\" rel=\"noopener\">good faith<\/a>, unknowingly commit voter fraud due to confusion about their voting eligibility.<\/p>\n<h2>How Does Voter Intimidation Happen?<\/h2>\n<p>Over the years, people have attempted to intimidate voters in many ways. Common methods include lying or spreading false information about voter requirements. Others include threats or actual violence. Examples of voter intimidation include the following:<\/p>\n<ul>\n<li>Verbal threats of violence meant to intimidate voters<\/li>\n<li>Violence in or around polling locations<\/li>\n<li>Brandishing guns near polling sites<\/li>\n<li>Blocking the entrance to a polling location in a general election<\/li>\n<li>Following voters to and from the polls<\/li>\n<li>Spreading false information about voting requirements or prerequisites<\/li>\n<li>Harassing voters about whether they possess the qualifications to vote<\/li>\n<\/ul>\n<p>All of this is done to intimidate or discourage a person from voting with no basis in law or fact.<\/p>\n<h2>Examples of Voter Intimidation<\/h2>\n<p>While the 2016 presidential election saw&nbsp;<a href=\"https:\/\/www.usnews.com\/news\/politics\/articles\/2016-11-08\/voter-intimidation-complaints-surge\" target=\"_blank\" rel=\"noopener\">allegations of intimidation<\/a>&nbsp;up to Election Day, other controversial instances have occurred. This section details alleged cases of voter intimidation.<\/p>\n<h3>Armed Men in Front of a Polling Place<\/h3>\n<p>In 2008, a case of voter intimidation surfaced in a Philadelphia neighborhood. Two New Black Panther Party members stood outside a polling place dressed in black paramilitary uniforms. After looking into the incident, the&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2010\/10\/22\/AR2010102203982.html?tid=a_inl\" target=\"_blank\" rel=\"noopener\">U.S. Department of Justice<\/a>&nbsp;eventually dismissed the case.<\/p>\n<h3>Robocalls Threatening Black Voters<\/h3>\n<p>Leading up to the 2020 presidential election, two men created a recorded phone message regarding the election. The \u201crobocall&quot; threatened that the government may arrest mail-in voters depending on how they voted. The calls also threatened that the government may force them to get vaccinated. The two men made approximately&nbsp;<a href=\"https:\/\/www.cbsnews.com\/detroit\/news\/judge-orders-men-who-made-fake-robocalls-to-register-voters\/\" target=\"_blank\" rel=\"noopener\">85,000 robocalls<\/a>&nbsp;to predominantly Black neighborhoods in several states.<\/p>\n<p>A&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/grand-jury.html\" target=\"_blank\" rel=\"noopener\">grand jury<\/a>&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/indictment.html\" target=\"_blank\" rel=\"noopener\">indicted<\/a>&nbsp;the men on multiple counts of telecommunications fraud, among others. In one of several cases against the men, an Ohio judge ordered them to do 500 hours of&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/court-ordered-community-service.html\">community service<\/a>&nbsp;registering voters in Washington, D.C. They also received&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/5-things-you-should-know-about-house-arrest\/\">house arrest<\/a>&nbsp;sentences and were fined. The prosecutor in the case noted the men&#8217;s scheme \u201cattempted to disrupt the foundation of our democracy.&quot;<\/p>\n<p>The state of New York sued the men in federal court, and the&nbsp;<a href=\"https:\/\/www.fcc.gov\/\" target=\"_blank\" rel=\"noopener\">Federal Communications Commission<\/a>&nbsp;(FCC) fined them $5.1 million. In the New York case, the judge found the defendants&#8217; actions&nbsp;<a href=\"https:\/\/www.lawyerscommittee.org\/voter-suppression-robocalls-violated-civil-rights-of-black-voters-court-finds\/\" target=\"_blank\" rel=\"noopener\">violated the Voting Rights Act<\/a>&nbsp;by threatening and attempting to suppress voters.<\/p>\n<h3>First Amendment Issues<\/h3>\n<p>The&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/first-amendment.html\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a>&nbsp;to the United States Constitution protects citizens&#8217; right to&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/free-speech.html\" target=\"_blank\" rel=\"noopener\">free speech<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/amendment1\/first-amendment-freedom-of-assembly-and-petition.html\" target=\"_blank\" rel=\"noopener\">assembly<\/a>. Both the right to vote and the right to free speech are fundamental in a democracy. Lawmakers must narrowly tailor voter intimidation laws to allow people to engage voters while at the same time protecting the right to vote.<\/p>\n<p>In 1992, the U.S. Supreme Court&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/504\/191.html\" target=\"_blank\" rel=\"noopener\">upheld a Tennessee state law<\/a>&nbsp;concerning campaigning in front of polling locations. Specifically, the state law banned campaigning within 100 feet of polling sites. The Court noted that most states recognize that having \u201csome restricted zone&quot; in front of polling places is necessary in protecting the right to vote \u201cfreely and effectively.&quot; Most states have<a href=\"https:\/\/www.nass.org\/sites\/default\/files\/surveys\/2020-01\/state-laws-polling-place-electioneering-Jan2020.pdf\" target=\"_blank\" rel=\"noopener\">&nbsp;similar laws<\/a>.<\/p>\n<h3>Election Protection and Poll Watchers<\/h3>\n<p>Laws against voter intimidation punish those who interfere with voting rights. But there are other safeguards at polling locations.<\/p>\n<p><a href=\"https:\/\/www.eac.gov\/election-officials\/poll-watchers\" target=\"_blank\" rel=\"noopener\">Poll watchers<\/a>&nbsp;work at polling stations. Their job is to observe the voting process at polling locations on election day. State law determines their specific duties, obligations, and restrictions. They&#8217;re often members of a political party. Generally, they monitor the election process to ensure a fair election and that no one commits an unlawful election offense. They typically cannot violate voter privacy, and they cannot act to disrupt an election.<\/p>\n<p>If a poll watcher challenges a voter&#8217;s qualifications to vote, the challenged voter may usually still cast a provisional ballot. The voter may be allowed to cast a regular ballot depending on state law. The regular vote will count unless the challenge is sustained.<\/p>\n<p>Texas recently passed a law regarding election workers and poll watchers.&nbsp;<a href=\"https:\/\/apnews.com\/article\/elections-media-texas-voting-health-905ff2d6e6863f457694ae655d6cd49e\" target=\"_blank\" rel=\"noopener\">The law<\/a>&nbsp;allows poll watchers to move freely throughout the polling location to observe the election process. If an election official rejects a poll watcher, the official may be subject to a Class A misdemeanor. The law also bans drop boxes for voters who want to use mail-in ballots.<\/p>\n<h2>Charged With Voter Intimidation?
